A clear understanding of terminology is crucial in any academic field. When it is clear that complex interdisciplinary concepts are interpreted differently depending on the academic field, geographical setting or cultural values, it is time to take action. Given this, the Glossary for Academic Integrity, newly developed by the European Network for Academic Integrity project, served as the basis for compiling a comprehensive taxonomy of terms related to academic integrity. Following a rigorous coding exercise, the taxonomy was partitioned into three (...) constituent components – Integrity, Misconduct and Neutral terms. A review of relevant literature sources is included, and the strengths and weaknesses of existing taxonomies are discussed in relation to this new offering. During the creation of these artefacts the authors identified and resolved many differences between their individual interpretative understandings of concepts/terms and the viewpoints of others. It is anticipated that the freely-available glossary and taxonomy will be explored and valued by researchers, teachers, students and the general public alike. (shrink)

Particular concern about academic ethics in higher education and research institutions in Lithuania was addressed in 2009 by the national decision to establish an Office of Ombudsman for Academic Ethics and Procedures. The decision was taken during the approval of the revised Law on Higher Education and Research by the Parliament of Lithuania. Following two failed attempts to appoint an ombudsman, the Office began to function in 2014. Since then, the ombudsman, alongside other state institutions, has been empowered to implement (...) national higher education and research policy. At the outset of the Office activity it is important to consider how public HERIs institutionalise academic integrity, i.e. how they create an ethical environment within the academic community and what means are used to support it further. Collecting data from codes of ethics, regulations of academic integrity committees and interviews, data analysis shows that academic values manifest unevenly in teaching/learning and research. Most efforts concern the behaviour of students rather than the behaviour of academic staff. Moreover, ethics infrastructure gives a misleading image, as it lacks harmony and compatibility, despite the fact that there is a myriad of means to foster ethical behaviour. Universities should make greater effort to connect academic values with operations in teaching/learning and research. (shrink)

This book explores the epistemic side of racial and sexual oppression. It elucidates how social insensitivities and imposed silences prevent members of different groups from listening to each other.

The treaty of Lisbon makes European Union (EU) accession to the European Convention on Human Rights (ECHR) an obligation of result. The issue has been intensely discussed for more than thirty years, arguing that such accession is necessary in view of the need to ensure the ECHR standard of fundamental rights protection in Europe. This question again gains prominence as the EU member states and the institutions seek to agree on the negotiation directives of EU accession to the ECHR. The (...) process brings up the difficulties involved in creating a mechanism which would both facilitate the autonomy of the EU legal order and enable individuals to bring claims against the EU to the European Court of Human Rights (ECtHR). This involves the questions how it would be possible to ensure quick access to justice, and whether the ECtHR would continue to apply the doctrine of equivalent protection in relation to EU even after the latter becomes bound by the ECHR. The article argues that EU accession to the Convention is a prominent political step ensuring coherence of human rights protection mechanism in Europe. (shrink)

The idea of the article was suggested by Lotman’s theory about two basic mechanisms of social behaviour — fear and shame. The presented paper aims at highlighting two other mechanisms of such kind — guilt and repentance. The novella Isaac (1960–61) by Antanas Škėma, the Lithuanian writer in exile, is about a Lithuanian patriot who kills a Jew called Isaac during the years of German occupation. The author’s fundamental conception implies that the real perpetrator of crime is not a separate (...) individual but the crowd representing the values of the society. Škėma’s interpretation of history demystifies the moral system in the inter-war Lithuania and proves it to be a collection of futile signs that fail to prevent society from falling into mass psychosis and following primitive impulses. The other Lithuanian novel, Leonardas Gutauskas’ Šešėliai (Shadows) written in 2000, focuses on the tense relationships between Lithuanians and Russians, suggesting that there are several moral systems determining the concepts of guilt-repentance. The Christian agricultural society embodies the ethics of individual responsibility. The domination of the Russian ethic code is associated with the separation of Churches and the strengthening of the Orthodox Church. A moral system based on harmony and aiming to reconcile the guilty and the innocent comes across as a sought ideal. Both novels discussed exemplify different modes of a liberating society. The first one is an account of the society’s effort to become free of the guilt complex and rethink its history. The second one articulates theguilt of the Russian nation against Lithuanians and fights russophobia at the same time. (shrink)

Although the Lisbon Treaty maintained the general exclusion of Common Foreign and Security Policy (CFSP) matters from ECJ jurisdiction, it introduced a number of changes into this area, including an explicit statement that the Court is competent to review the legality of the Council decisions imposing restraining measures on persons. The article analyzes the nature and origin of those changes and considers the legal implications for the level of the protection of fundamental rights in the European Union. For this purpose (...) the author firstly considers the context of the exclusion of CFSP matters from the ECJ jurisdiction, including discussions on the issue at the European Convention, and, secondly, takes a closer look at the separate heads of jurisdiction over which the Court is competent to act after the entry into force of the Lisbon Treaty. A conclusion is made that the Lisbon Treaty did not introduce significant changes to ECJ jurisdiction. Similarly to the pattern of previous amendment treaties, the Lisbon Treaty again gave recognition to the practice of the ECJ on relevant questions. Nonetheless, the amendments made by the Lisbon Treaty should be welcome for introducing more clarity into the legal regulation of the matter, thus boosting the legal certainty and protection of fundamental rights in the European Union. This paper defends a contextualist approach to epistemic injustice according to which instances of such injustice should be looked at as temporally extended phenomena (having developmental and historical trajectories) and socially extended phenomena (being rooted in patterns of social relations). Within this contextualist framework, credibility excesses appear as a form of undeserved epistemic privilege that is crucially relevant for matters of testimonial justice. While drawing on Miranda Fricker's proportional view of epistemic justice, I take issue with its lack of attention (...) to the role that credibility excesses play in testimonial injustices. I depart from Fricker's view of the relation between credibility excesses and credibility deficits, and I offer an alternative account of the contributions that undeserved epistemic privileges make to epistemic injustices. Then, through the detailed analysis of To kill a mockingbird, I elucidate the crucial role played by the social imaginary in creating and sustaining epistemic injustices, developing an analysis of the kind of social blindness produced by an oppressive social imaginary that establishes unjust patterns of credibility excesses and deficits. While in agreement with Miranda Fricker’s context-sensitive approach to hermeneutical injustice, this paper argues that this contextualist approach has to be pluralized and rendered relational in more complex ways. In the first place, I argue that the normative assessment of social silences and the epistemic harms they generate cannot be properly carried out without a pluralistic analysis of the different interpretative communities and expressive practices that coexist in the social context in question. Social silences and hermeneutical gaps are misrepresented if (...) they are uniformly predicated of an entire social context, instead of being predicated of particular ways of inhabiting that context by particular people in relation to particular others. I contend that a more nuanced—polyphonic—contextualization offers a more adequate picture of what it means to break social silences and to repair the hermeneutical injustices associated with them. In the second place, I argue that the particular obligations with respect to hermeneutical justice that differently situated subjects and groups have are interactive and need to be determined relationally. That is, whether individuals and groups live up to their hermeneutical responsibilities has to be assessed by taking into account the forms of mutual positionality, relationality, and responsivity (or lack thereof) that these subjects and groups display with respect to one another. The central argument is developed through an examination of what in race theory and in contemporary epistemologies of ignorance has been termed “white ignorance”; that is, the kind of hermeneutical inability of privileged white subjects to recognize and make sense of their racial identities, experiences, and social positionality. The paper examines the intercultural dimension of everyday aesthetics which was promoted by one of its most important Chinese proponents Liu Yuedi as a search for dialogue between various aesthetic traditions, in particular, those from the East and West. The aim of the paper is to explore some parallels between the traditional Chinese and contemporary Western aesthetic sensibilities, by looking for their common values and concepts which are gaining prominence in the discourse of everyday aesthetics. It begins with a survey (...) of the contributions of Chinese and Western scholars; the survey concerns the relevance of Chinese traditional aesthetics for everyday aesthetics, and examines particular features of the nature of perception in everyday aesthetics which is common to Chinese and Western artistic activities, aesthetic discourses and their conceptualizations. In the second section I discuss the “intercultural” concept of atmosphere as the de-personalized or “transpersonal”/intersubjective, vague and all-inclusive experience of the situational mood and environmental wholeness. I explore and compare the reflection of its characteristics in Western scholarship and Chinese aesthetics, especially in regard to the aural perception and sonic sensibility. The final section provides a comparative analysis of few examples of the integration of music into the environmental or everyday surrounding—in Daoist philosophy and Chinese everyday aesthetics, and Western avant-garde art. The analysis is concentrated on the perception of music in relation to the experience of atmosphere and everyday aesthetics, as they were defined in the previous sections. The paper challenges the “newness” of everyday aesthetics, especially if it is viewed from the intercultural perspective, and proposes the separation of its discourses into the investigation of its past and present. The concept of vital force – the immanent energy that promotes the processes of life in the body and in nature – has proved a source of endless fascination and controversy. Indeed, the question of what vitalizes the body has haunted humanity since antiquity, and became even more pressing during the Scientific Revolution and beyond. Examining the complexities and theories about vital force in Spanish modernity, Nicolás Fernández-Medina's Life Embodied offers a novel and provocative assessment of the question of (...) bodily life in Spain. Starting with Juan de Cabriada's landmark Carta filosófica, médico-chymica of 1687 and ending with Ramón Gómez de la Serna's avant-gardism of the 1910s, Fernández-Medina incorporates discussions of anatomy, philosophy, science, critical theory, history of medicine, and literary studies to argue that concepts of vital force served as powerful vehicles to interrogate the possibilities and limits of corporeality. Paying close attention to how the body's capabilities were conceived and strategically woven into critiques of modernity, Fernández-Medina engages the work of Miguel Boix y Moliner, Martín Martínez, Diego de Torres Villarroel, Sebastián Guerrero Herreros, Ignacio María Ruiz de Luzuriaga, Gaspar Melchor de Jovellanos, Pedro Mata y Fontanet, Ángela Grassi, Julián Sanz del Río, Miguel de Unamuno, and Pío Baroja, among others. Despite emerging study of business initiatives that attempt to support local peace and development, we still have significant knowledge gaps on their effectiveness and efficiency. This article builds theory on business engagements for peace through exploration of the Footprints for Peace (FOP) peacebuilding project by the Federación Nacional de Cafeteros de Colombia (FNC). FOP was a business-peace initiative that attempted to improve the lives of vulnerable populations in conflict-affected regions. Through 70 stakeholder interviews, we show how FOP operationalized local peace (...) and development in four conflict-affected departments of Colombia, and examine FNC’s motivations for and effectiveness of its peacebuilding activities. Our main finding is that FOP’s success supported several existing theories on business engagement in peace both in terms of peacebuilding by business and for local economic and societal development, providing evidence in support of development–business collaborations and local peacebuilding by business under certain targeted circumstances. We relate these findings to existing literature, highlighting where existing business-peace theory is supported, where FOP challenged assumptions, and where it illuminated new research gaps. These findings serve to take business-peace theory forward and improve our understandings of what can constitute success for business-peace initiatives in Colombia and possibly other conflict-affected regions. In the academic setting as in any organization legal norms prevail and are assumed to be congruent with ethical norms. Nevertheless, there are cases when the ratio of ethical and legal norms is inadequate and disproportional, especially those dealing with socially responsible decisions in academia. For this reason, the aim here is to analyse incongruences of ethical and legal norms related to the revocation of doctoral degrees in Lithuania, illustrated with examples of deviant behaviour by academic degree holders in terms (...) of decisions of the courts and the ombudsman for academic ethics. Lithuania, being a Member State of the European Union, is currently facing the challenge of implementing newly-adopted laws related to the revocation of doctoral degrees. Accordingly, data were collected from available online official sources to gain more comprehensive evidence, and then analysed using the inductive approach of qualitative content analysis. Research findings show that there is still a thin line between ethical and legal norms, and this line fluctuates depending on nuanced considerations. This is to say that it is still problematical to dress ethical principles in legal clothing. (shrink)

Explores the stable core of Wittgenstein's philosophy as developed from the Tractatus to the Philosophical Investigations.

Two of the most influential arguments for Bayesian updating ("Conditionalization") -- Hilary Greaves' and David Wallace's Accuracy Argument and David Lewis' Diachronic Dutch Book Argument-- turn out to impose a strong and surprising limitation on rational uncertainty: that one can never be rationally uncertain of what one's evidence is. Many philosophers ("externalists") reject that claim, and now seem to face a difficult choice: either to endorse the arguments and give up Externalism, or to reject the arguments and lose some of (...) the best justifications of Bayesianism. The author argues that the key to resolving this conflict lies in recognizing that both arguments are plan-based, in that they argue for Conditionalization by first arguing that one should planto conditionalize. With this in view, we can identify the culprit common to both arguments: for an externalist, they misconceive the requirement to carry out a plan made at an earlier time. They should therefore not persuade us to reject Externalism. Furthermore, rethinking the nature of this requirement allows us to give two new arguments for Conditionalization that do not rule out rational uncertainty about one's evidence and that can thus serve as common ground in the debate between externalists and their opponents. Using Iris Marion Young’s framework, this essay looks at racial violence as one of the many “faces” of racial oppression. In the light of this analysis I argue that the fight against racial violence requires much more than identifying the perpetrators of such violence and bringing them to justice; it requires, I argue, thick critical engagements with multiple publics and institutions and with society at large, engagements that are not only cognitive and argumentative but also affective, imaginal, and action-oriented. My (...) argument about the broad range of thick critical engagements needed in anti-racist-violence activism focuses especially on what I term epistemic activism, which refers to the critical activities of denouncing, contesting, and resisting the cognitive-affective attitudes and sensibilities that facilitate complicity with racial oppression and with racial violence. My analysis pays particular attention to the role that affectivity plays in complicity with racial violence and how affective attitudes can be used in epistemic activism to disrupt complicity and to mobilize people in the fight against racial violence. My analysis and argumentation are developed through a case study of epistemic activism: the activism against racial violence in the United States and the changes in public life and institutional recognition that activist organizations such as the National Association for the Advancement of Colored People and the Equal Justice Initiative have aimed to promote. Drawing on contemporary epistemologies of ignorance, I analyze the American ideology of color blindness as a recalcitrant form of active ignorance that operates at a meta-level. I contend that the meta-ignorance involved in color blindness operates through distorting second-order attitudes about one's cognitive and affective attitudes, resulting in cognitive and affective numbness with respect to racial matters: ignorance of one's racial ignorance and insensitivity to one's racial insensitivity. I contend that the black/white binary that has dominated the American racial imagination (...) has contributed tremendously to establish and maintain meta-blindness about racial differences. I suggest that overcoming the black/white binary demands that we expand current conceptions of racial lucidity and that we go beyond the notions of double consciousness that critical race theorists have defended since Du Bois and Fanon. According to a more expansive social pluralism, lucidity with respect to racial differences requires a kaleidoscopic consciousness that does not reinscribe the black/white binary in one's racial imagination. This article explores how racist propaganda works in visual communication and how such propaganda can be resisted. The article analyzes how photography has created new possibilities for the insidious dissemination of racist messages and discusses ways of resisting these visually transmitted propagandistic messages. The two sections of the article focus on examples of racist propaganda in visual culture: in section 1, the focus is on the propagandistic use of photography in the early twentieth century by the pro‐lynching movement; and in (...) section 2, the focus is on racist subtexts in communication that is both visual and verbal in mass media in recent decades. In both sections, the paper discusses how to neutralize and counter propaganda in visual culture by means of what the author terms “epistemic activism,” which consists in practices of interrogation and resistance that unmask, disrupt, and uproot biases and insensitivity. The article discusses different instances of epistemic activism that make explicit and effectively criticize racist subtexts in visual communication. The instances of epistemic activism discussed include the pamphlets of the anti‐lynching movement, critiques of visual artists and scholars, and the critical responses of online activists. The article argues that epistemic activism can produce critical viewership by disrupting the passive reception of visual messages and triggering more active and critical modes of viewing images. The author concludes by emphasizing the urgent need for epistemic activism that promotes critical awareness of the subtexts embedded in visual communication and a sense of critical responsibility in the production, consumption, and recirculation of images. The paper defines a measure on the set of stable matchings in the marriage problem. This measure is based on the minimization of the envy difference between the sets of men and women, while preserving stability and selects stable matchings with the least conflict of interest between both groups of agents. The solution concept proposed is called Sex-equal Matching (SEM) and the paper also provides an algorithm to compute the set of SEM.

In this essay I argue that epistemic injustices can be understood and explained as social pathologies of recognition, and that this way of conceptualizing epistemic injustices can help us develop proper diagnostic and corrective treatments for them. I distinguish between two different kinds of recognition deficiency—quantitative recognition deficits and misrecognitions—and I ague that while the rectification of the former simply requires more recognition, the rectification of the latter calls for a shift in the mode of recognition, that is, a deep (...) transformation of the recognition dynamics so that other forms of recognition can emerge. Arguing against incremental recognitional approaches that aim only at increasing social visibility/audibility, I examine communicative dysfunctions around the phenomenon of racist violence in order to show how problems of misrecognition persist and become recalcitrant even when quantitative recognition deficits disappear. In recent years, after various scandals, the role of auditors has been called into question, even casting doubt on whether their reports reliably reflect the true financial situation of the auditee, especially when this situation is not good. Normative changes in the way auditors have to rate certain questions provide a good opportunity to study this problem. These changes have acquired great relevance among the factors involved in studying audit quality. Thus, the present study analyzed the effect of the normative (...) change that took place in Spain in December 2010, related to opinions modified for going-concern uncertainties. Until that date, the auditor’s uncertainty about the company’s going-concern status led to a qualified opinion. However, under the new regulation, it became an opinion that included an explanatory paragraph stating the reasons for concern, which was considered less serious. In all, 152 small- and medium-sized enterprises that had begun bankruptcy proceedings were studied. Expert systems were used for their analysis, based on classification trees assembled through boosting and bagging. In addition, the logistic regression was used as baseline to compare previous methods. The main result obtained was that a change in the norm that catalogs the going-concern issue as less serious made auditors more likely to report this situation, thus questioning the audit quality. This article demonstrates the possibilities and problems of the formation of a new type of human‐technique‐nature relationship ‐ the organic technique ‐ in modern civilization. It is a relationship in which neither human nor nature must adapt to the needs of technology; rather, the technique is embedded in nature and becomes 'human-sized'. We can find a model for building this new type of relationship in the construction of buildings from bamboo. The uniqueness of bamboo as a building material manifests in (...) two ways. The first relates to resources: bamboo is a very fast-growing plant, so cutting it's stem does not destroy the plant itself and in three to four years there is a new 'harvest'. This means bamboo has an extremely low cost, which is critical for developing countries with rapidly growing populations. Second, bamboo has a number of architectural advantages. Due to the flexibility and elasticity of this product, bamboo buildings are earthquake resistant. Such structures do not violate the natural landscape, but instead work with it; they are characterized by low cost and ease of construction, in a variety of forms. This has led to the widespread use of bamboo by leading architects and innovators from different countries. This article shows that the application of bamboo in architecture ‐ as opposed to artificial materials such as concrete, which exploit and destroy nature and impose their forms on cultures ‐ helps this building technique to integrate into the life of ecosystems and society, and thus to become a model of harmonizing human‐technique‐nature relations. En este artículo sostengo que los tres filósofos/pedagogos cubanos del siglo XIX, Félix Varela y Morales, José de la Luz y Caballero y Enrique José Varona, fueron responsables de superar la enseñanza de la escolástica tardía en la Real y Pontificia Universidad de San Jerónimo de La Habana. Contra los filósofos y pedagogos escolásticos tardíos que preferían la lógica silogística y la autoridad de la tradición sobre la inducción, argumentaron a favor de esta última sobre la primera. Puesto que defendían (...) las ideas liberales y republicanas, también argumentaban en contra de aquellos que apelan a la autoridad de la tradición en lugar de a nuestras experiencias cotidianas. Su espíritu liberal desafió no sólo al régimen tiránico impuesto por España, sino a cualquier otro régimen cuya autoridad dependiera de la fuerza más que de la libre voluntad del pueblo a escoger sus gobernantes. Law, Economics, and Morality examines the possibility of combining economic methodology and deontological morality through explicit and direct incorporation of moral constraints into economic models. Economic analysis of law is a powerful analytical methodology. However, as a purely consequentialist approach, which determines the desirability of acts and rules solely by assessing the goodness of their outcomes, standard cost-benefit analysis is normatively objectionable. Moderate deontology prioritizes such values as autonomy, basic liberties, truth-telling, and promise-keeping over the promotion of good outcomes. It (...) holds that there are constraints on promoting the good. Such constraints may be overridden only if enough good is at stake. While moderate deontology conforms to prevailing moral intuitions and legal doctrines, it is arguably lacking in methodological rigor and precision. Eyal Zamir and Barak Medina argue that the normative flaws of economic analysis can be rectified without relinquishing its methodological advantages and that moral constraints can be formalized so as to make their analysis more rigorous. They discuss various substantive and methodological choices involved in modeling deontological constraints. Zamir and Medina propose to determine the permissibility of any act or rule infringing a deontological constraint by means of mathematical threshold functions. Law, Economics, and Morality presents the general structure of threshold functions, analyzes their elements and addresses possible objections to this proposal. It then illustrates the implementation of constrained CBA in several legal fields, including contract law, freedom of speech, antidiscrimination law, the fight against terrorism, and legal paternalism. El propósito de este artículo es realizar un análisis de las principales nociones que Wittgenstein elabora en este proceso de transición. La pregunta por resolver será, entonces, cómo Wittgenstein estructura su nueva visión del lenguaje. Para darle respuesta, en el inicio del artículo se trabajará una breve observación respecto al ansia de pureza cristalina, que, de algún modo, fue el plan que marcaba la pauta en la filosofía del Tractatus logico-philosophicus. A continuación, desde la discutida noción del significado como uso, (...) se abordarán los principales elementos que constituyen la nueva concepción del lenguaje del segundo Wittgenstein, a saber: el criterio definidor, los juegos de lenguaje, las formas de vida y los parecidos de familia. Por último, se analizará la relación que esta nueva concepción de lenguaje mantiene con las reglas y con el hecho de seguir una regla. (shrink)
