This book reassesses theories of agency and gender identity against the backdrop of changing relations between men and women in contemporary societies.

This paper shows how the mythology surrounding rape enters into a criterion of reasonableness which operates through the legal system to make women vulnerable to unscrupulous victimization. It explores the possibility for changes in legal procedures and presumptions that would better serve women's interests and leave them less vulnerable to sexual violence. This requires that we reformulate the criterion of consent in terms of what is reasonable from a woman's point of view.

This article argues that the failure of certain theories of reflexive identity transformation to consider more fully issues connected to gender identity leads to an overemphasis on the expressive possibilities thrown up by processes of detraditionalization. By ignoring certain deeply embedded aspects, some theories of reflexive change reproduce the `disembodied and disembedded' subject of masculinist thought. The issues of disembodiment and disembeddedness are explored through a study of the work of Pierre Bourdieu on `habitus' and the `field'. The idea of (...) habitus yields a more dynamic theory of embodiment central to a feminist understanding of gender identity as a durable but not immutable norm. The idea of the `field' provides a more differentiated analysis of the social context in which the reflexive transformation of gender identity unfolds. This in turn offers a way of thinking of possible transformations within gender identity as uneven and non-synchronous phenomena. (shrink)

This article considers Foucault’s analysis of ordoliberal and neoliberal governmental reason and its reorganization of social relations around a notion of enterprise. I focus on the particular idea that the generalization of the enterprise form to social relations was conceptualized in such exhaustive terms that it encompassed subjectivity itself. Self as enterprise highlights, inter alia, dynamics of control in neoliberal regimes which operate through the organized proliferation of individual difference in an economized matrix. It also throws into question conceptions of (...) individual autonomy that underpin much political thought and upon which ideas about political resistance are based. Self as enterprise also problematizes the viability of Foucault’s later work on ethics of the self as a practice of resistance. I go on to argue that Foucault’s discussion of an unresolved clash in civil society between monarchical and governmental power, between law and norm, offers an elliptical but more promising account of opposition to normalizing bio-power. There is a need to feminize the research on entrepreneurs — to include the experiences of women in what we know to be true about entrepreneurs and the entrepreneurial process. This paper highlights some of the most significant methodological problems in researching women's entrepreneurial experience, problems which in the past, have prevented researchers from gaining an understanding of this experience, and which continues to stand in the way of developing female perspectives. Instead of using the existing male-based models, new approaches (...) are called for in incorporating women's experiences into entrepreneurship theory. Much of today's writing on medical ethics is strong on philosophical theory or on legal speculation, but weak on practice. In this book, practitioners in a wide range of specialties describe the process of making ethical decisions in their everyday work. A moral philosopher analyzes their conclusions, and the theological implications are developed by a Christian theologian and Rabbinic scholar. Calling the quantity; 2ΔAΔB/|<[A, B]>|, with non-zero denominator, the uncertainty product ratio or UPR for the pair of observables, (A, B), it is shown that any non-zero correlation coefficient between two observables raises, above unity, the lower bound of the UPR for each member of an infinite collection of pairs of incompatible observables. Conversely, any UPR is subject to lower bounds above unity determined by each of an infinite collection of correlation coefficients. This result generalizes the well known Schroedinger strengthening (...) of the Robertson uncertainty relations (with the former expressed in terms of the correlation coefficient rather than the anticommutator) where the UPR and the correlation coefficient both involve the same pair of observables. A recent argument by Pitowsky (1991), leading to the relativity (as opposed to objectivity) of quantum predictions, is refuted. The refutation proceeds by taking into account the hyperplane dependence of the quantum predictions emerging from the three mutually space-like separated measurements, performed on an entangled state of three spin 1/2 particles, that Pitowsky considers. From this hyperplane dependence one finds that the logical step of conjoining the predictions from distinct measurements is ineffective since those predictions apply either, locally, to sets (...) of points with an intersection that is inaccessible to the particles, or globally, to sets of hyperplanes with an intersection that is empty. We also see how explicit reference to the hyperplane dependence of the predictions gives covariant expression to the invariant content of the predictions, which are thereby shown to be objective. The accurate delineation of various forms of business organization requires a comparative analysis of their objectives, functions, and organizational structures. In particular, this paper highlights differences in managerial work between business firms and non-profits exemplified by the charitable organization. It adopts as its template the theory of the marketing firm, a depiction of the modern corporation as it responds to the imperatives of customer-oriented management, namely consumer discretion and consumer sophistication. It describes in §2 the essentials of the theory and (...) its basis in consumer behavior analysis, and outlines its unique position as the organization responsible for marketing transactions, based on objective exchange, competitive markets and prices, and the deployment of the entire marketing mix. §3 deals in greater depth with the objective, strategic functions, and organization of the marketing firm in terms of the concepts of metacontingency and bilateral contingency. §4 discusses how the marketing firm differs from charities in terms of goal separation, market-based pricing and competition, the entrepreneurial process, the pursuit of customer-oriented management, and organizational structure. Particular attention is accorded the organizational differences between marketing firms and charities, which arise as a direct consequence of the distinct patterns of contingency they entail. §5 discusses the implications of the foregoing analysis and draws appropriate conclusions. I will discuss only one of the several entwined strands of the philosophy of space and time, the question of the relation between the nature of motion and the geometrical structure of the world.1 This topic has many of the virtues of the best philosophy of science. It is of long-standing philosophical interest and has a rich history of connections to problems of physics. This article considers two themes in Butler's work: the dialectic of subject formation - that the autonomous subject is instituted through constraint - and the relation between the psyche and the social. With regard to the former, the introduction of a notion of historicity into a conception of the symbolic yields a concept of agency. Nonetheless, this concept of agency still lacks social specificity. By reconfiguring the psyche as an effect of the interiorization of social norms, Butler introduces the destabilizing (...) force of the category of the unconscious into constructivist accounts of identity. This sociocentric reworking of the psyche-social relations provides a nuanced account of gender identity, but it results in a negative model of action as the displacement of constraining social norms. It is also important for a conception of agency to include an account of the creative dimensions of action where actors actively appropriate conflicting socio-cultural values to institute new collective forms of identity. This paper considers the advantages of incorporating Foucault's anti-essentialist theory of the body into feminist explanations of women's oppression. There are also problems in that Foucault neglects to examine the gendered character of the body and reproduces a sexism endemic in "gender neutral" social theory. The Foucauldian body is essentially passive resulting in a limited account of identity and agency. This conflicts with an aim of feminism: to rediscover and revalue the experiences of women.

The relation between leibniz's logical and his metaphysical views is the subject of much modern scholarship. Some commentators have argued that his metaphysics is based on his logic; others have taken the opposite position. However, Both sides pose the question in terms of 'priority'. On the contrary, I argue that it is likely that leibniz means the psr to play "both" a logical and a metaphysical role. The ambiguity of leibniz's psr indicates that he equates the metaphysical notion of causation (...) with the logical notion of deduction. The psr's ambiguity results less from any confusion on leibniz's part between the notions of cause and reason, Than from his desire to identify logic and metaphysics. That identity is achieved not by reducing one to the other, But by incorporating them on an equal basis into a single discipline. (shrink)

Climatologists have a unique role in providing various stakeholders and public data users with weather and climate information. In the north central region of the United States, farmers, the agricultural sector, and policy makers are important audiences for climate science. As local and global climate conditions continue to shift and affect agricultural productivity, it is useful to understand how climatologists view their role as scientists, and how this influences their communication of climate science to agricultural stakeholders. In this study, data (...) from interviews and surveys of state and extension climatologists in the NCR are analyzed to identify perceived roles and responsibilities as scientists and communicators. Pielke’s framework of the idealized roles of scientists and their communication patterns are used to develop a typology of climate science communication. Findings reveal that more than half of climatologists perceive their role to provide information as pure scientists, while some engage in an arbiter role when requested. Fewer climatologists view their role as not only producing new knowledge, but also relating it to society and providing an expanded variety of alternative applications. Climatologists who perceive their role as simply providing information and letting data users interpret its application are missing an opportunity to reduce the gap between what scientists know and farmers believe. This suggests that if climatologists would frame their climate science message in terms of agricultural impacts, hazard mitigation and risk management alternatives they could help the agricultural sector adapt to and mitigate environmental risks from a changing climate. There are many parts of science in which a certain sort of underdetermination of theory by evidence is known to be common. It is argued that reflection on this fact should serve to shift the burden of proof from scientific anti-realists to scientific realists at a crucial point in the debate between them.

We discuss the relationship between the interpretative problems of quantum gravity and those of general relativity. We argue that classical and quantum theories of gravity resuscitate venerable philosophical questions about the nature of space, time, and change; and that the resolution of some of the difficulties facing physicists working on quantum theories of gravity would appear to require philosophical as well as scientific creativity.

Recently Carolyn Brighouse and Jeremy Butterfield have argued that David Lewis's counterpart theory makes it possible both to believe in the reality of spacetime points and to consider general relativity to be a deterministic theory, thus avoiding the ‘hole argument’ of John Earman and John Norton. Butterfield's argument relies on Lewis's own counterpart-theoretic analysis of determinism. In this paper, I argue that this analysis is inadequate. This leaves a gap in the Butterfield–Brighouse defence against the hole argument.

In Parkinson’s disease, the fronto-striatal network is involved in motor and cognitive symptoms. Working memory updating training engages this network in healthy populations, as observed by improved cognitive performance and increased striatal BOLD signal. This two-part study aimed to assess the feasibility of WM updating training in PD and measure change in cognition, movement and functional brain response in one individual with PD after WM updating training. A feasibility and single-subject study were performed in which patients with PD completed computerized (...) WM updating training. The outcome measures were the pre-post changes in criterion and transfer cognitive tests; cognitive complaints; psychological health; movement kinematics; and task-related BOLD signal. Participants in the feasibility study showed improvements on the criterion tests at post-test. FL displayed the largest improvements on the criterion tests and smaller improvements on transfer tests. Furthermore, FL reported improved cognitive performance in everyday life. A shorter onset latency and smoother upper-limb goal-directed movements were measured at post-test, as well as increased activation within the striatum and decreased activation throughout the fronto-parietal WM network. This two-part study demonstrated that WM updating training is feasible to complete for PD patients and that change occurred in FL at post-test in the domains of cognition, movement and functional brain response. Two symmetry arguments are discussed, each purporting to show that there is no more room for a preferred division of spacetime into instants of time in general relativistic cosmology than in Minkowski spacetime. The first argument is due to Gödel, and concerns the symmetries of his famous rotating cosmologies. The second turns upon the symmetries of a certain space of relativistic possibilities. Both arguments are found wanting.

My essay consists of three parts. In the first section, I review the historical context of Baroque aesthetics as it is developed during the late 16th and 17th centuries in Europe and then I track its development in Latin America into the third quarter of the 18th century. The principled excess of the Baroque, to adapt Cyrano de Bergerac’s formulation cited below, was designed for theological and imperial purposes. Secondly, I address more recent literature and literary theory. Why, in the (...) early 20th century, did Latin American poets, novelists, essayists and critics begin to rediscover, recover and reconstitute Baroque modes of expression? What was it about this Catholic, monarchical, colonizing aesthetic that now seemed suited to postcolonial purposes? I refer to several theorists and writers who pioneered and/or inspired the 20th-century idea of the New World Baroque as a rebellious retort to Europe rather than a passive reflection. My third section considers how to teach the politics of Baroque aesthetics, and why Baroque aesthetics remains relevant today. (shrink)

In 1997, the poet Judy Rowe Michaels was diagnosed with ovarian cancer. Over the ensuing 20-plus years, she has published four books of poetry and experienced six recurrences of the disease. This double corpus—the body of literary work produced by a body affected by illness, diagnosis, treatment, remission, and recurrence—provides rich insight into experiences of health, disease, and medical care. But I find Michaels's poetry especially significant because it also offers a means to examine what poetry does, and doesn't do, (...) when it intersects with medicine. School teachers routinely work with minors who are vulnerable, though research on teacher professional misconduct is limited. Using a 5-year cohort of cases (N = 325) from New Zealand’s Teachers Disciplinary Tribunal (2018–2022), this study describes tribunal processes and outcomes including types, setting (private/professional) and sector (Early childhood education/primary and secondary education) of the misconduct, pleas, and penalties ordered. Physical violence constituted the most frequent (51.5%) type of misconduct, with early childhood education and female teachers being independently associated with this (...) type of misconduct. Primary/secondary and male teachers were overrepresented in boundary violation misconduct. Misconduct related to criminal convictions was significantly more likely to arise from private life contexts. While professional misconduct is rare, findings from the study point to risk factors in certain settings, and the need for more research to build understanding of risk and remediation approaches after such conduct. ABSTRACTHan Fei’s political theory is widely characterized as eschewing any connection with morality; so, can he have any conception of justice? In this paper, I accept the interpretation of Han Fei jettisoning any moral commitment, but I argue that he gives heed to an understanding of justice. This conception of justice arises naturally from the ordinary human sentiment of resentment for wrongs done and becomes a moral staple in the consciousness of ordinary people. Such a conception of justice has these (...) features: all and only the guilty receive punishment, and the punishments are in some sense proportionate to the crime. Since disregarding this popular conception of justice results in resentment and political instability, Han Fei, without any moral commitment to it, accepts the popular conception of justice on prudential and consequentialist grounds. Much contemporary work on agency offers only a partial account because it remains within an essentially negative understanding of subject formation. This essay examines the work of Judith Butler and Drucilla Cornell and argues that the negative paradigm needs to be supplemented by a more generative theoretical framework, if feminists are to develop a fuller account of agency. In the negative paradigm, the subject is understood in passive terms as an effect of discursive structures. This tends to overlook ideas of (...) self-interpretation that introduce more active dimensions into understandings of subject formation and agency. Furthermore, an unqualified notion of indeterminacy does not unpick the imbrication of relations of time and power that overdetermine agency. Ultimately, structural accounts of subject formation need to be integrated more closely with hermeneutic perspectives of the self in order to understand better the complexities of agency in a post-traditional society. An elementary notion of gauge equivalence is introduced that does not require any Lagrangian or Hamiltonian apparatus. It is shown that in the special case of theories, such as general relativity, whose symmetries can be identified with spacetime diffeomorphisms this elementary notion has many of the same features as the usual notion. In particular, it performs well in the presence of asymptotic boundary conditions.

This article examines a thread that runs through Martin Luther’s biblical and catechetical writings: his appropriation of a Messianic logic in light of a creedal interpretation of the whole of Scripture. Situating my case in relation to recent philosophical scholarship on the apostle Paul, I contend that this biblical hermeneutic may well be Luther’s signal ethical contribution for our age. Drawing on the solae and relating them to three themes central to his biblical hermeneutics—the Word of God, Scripture, and the (...) Creeds—I discuss how he develops a Messianic ethics that intrinsically links faith and love in relation to the biblical motifs of command and promise and the Christological themes of cross and incarnation. I conclude by discussing the relevance of Luther’s biblical hermeneutics for a post-secular age. (shrink)

This is distinct from mere nostalgia, in that it may generate the longing to transcend the temporal present in favor of a time of which one has had no experience, or even a timeless state of being. Implicit in malchronetic longing is the rejection of one’s experience of one’s own time, making it a revolutionary and utopian inclination. In this article we examine two dominant strategies—primitive weapons in (...) the war on time, really—that have been developed in the hopes of delivering individuals to a future beyond the reach of their natural life spans: cryonics and bionics. In today’s multi-cultural world and global economy, attention is often focused on the diversity of cultural values and practices and the need for management approaches to take these differing cultural environments into account. While there is much to be valued in this approach, the focus is often on how to navigate through distinct cultural practices in order to achieve a singular business aim, which falls within the current neoliberal paradigm of global trade. In addition, by focusing on differences in cultural (...) practices, rather than on similarities in underlying values, this approach fails to utilize an important way to achieve a greater degree of global integration in management. Despite striking cultural differences, it is possible to identify some enduring values that underlie what often appear to be quite discrete value paradigms, especially by looking at value paradigms that have endured for centuries, even millennia. This paper proposes to explore the values embedded in two such value paradigms or religious traditions, zen buddhism and Judaism, describing crucial core values in each and comparing and contrasting their ethical frameworks, in order to be able to evaluate their utility in today’s world and especially their significance for creating a more holistic, inclusive, and responsible management framework. The paper will begin by explicating the set of foundational values in each religious tradition. For example, zen buddhism, especially as expressed by Vietnamese monk Thich Nhan Hanh, utilizes the concepts of engaged mindfulness and inter-being to demonstrate the ways in which all global issues are linked together, and the collective responsibility that all humans bear for the state of our planet and the beings who live on it. This approach is inherently holistic and inclusive, and requires a management approach that takes into account the moral responsibility that we all carry. Likewise, the Jewish tradition, while using quite different terminology, also lays out a holistic and inclusive moral vision. Key concepts include the values of Tikkum Olam, to repair the world, and Tsedakah, which literally means justice or righteousness, but is commonly used to indicate charitable giving. The first value, to repair the world, emphasizes the collective moral responsibility to heal whatever damage has been done to the world in order to make the it a better place for all. It does not matter who has done the damage; what matters is each person’s obligation to improve the status quo, under the assumption that all our fates are linked together. The second value, justice and charity, is also considered to be a moral obligation, not simply a voluntary act of charity. The emphasis here is on anonymous giving, done in order to help others and without any expectation of receiving some benefit, such as positive publicity. As a moral obligation, it is not something that one should benefit from. Thus, the concept of tsekakah also emphasizes the inter-connectedness of all humanity. In addition, in the Torah, there are a series of rules about how to deal with others in business as well as the obligation, during harvest-time, to leave some grain in the fields for the less fortunate. In all, we see a focus on being mindful of others, on seeing our fates as interconnected, as in zen buddhism. The last section of the paper will explore some of the ways in which these moral imperatives can be utilized to undergird and buttress a more holistic, inclusive and responsible management approach. Some management models already include moral imperatives, such as corporal social responsibility, and this section will explore in greater detail how the above concepts have been more fully integrated into current management models.
