I. Introduction Two kinds of remedies have traditionally been employed for breach of contract: legal relief and equitable relief. Legal relief normally takes the form of money damages. Equitable relief normally consists either of specific performance or an injunction – that is, the party in breach may be ordered to perform an act or to refrain from performing an act. In this article I will use a “consent theory of contract” to assess the choice between money damages and specific performance. (...) According to such a theory, contractual obligation is dependent on more fundamental entitlements of the parties and arises as a result of the parties' consent to transfer alienable rights. My thesis will be that the normal rule favoring money damages should be replaced with one that presumptively favors specific performance unless the parties have consented to money damages instead. The principal obstacle to such an approach is the reluctance of courts to specifically enforce contracts for personal services. The philosophical distinction between alienable and inalienable rights bolsters this historical reticence, since a right to personal services may be seen as inalienable. I will then explain why, if the subject matter of a contract for personal services is properly confined to an alienable right to money damages for failure to perform, specific enforcement of such contracts is no longer problematic. Finally, I shall consider whether the subject matter of contracts for corporate services is properly confined to money damages like contracts for personal services, or whether performance of corporate services can be made the subject of a valid rights transfer and judicially compelled in the same manner as contracts for external resources. Although the condition known as synaesthesia is currently undergoing a scientific resurgence, to date the literature has largely focused on the heterogeneous nature of synaesthesia across individuals. In order to provide a better understanding of synaesthesia, however, general characteristics need to be investigated. Synaesthetic experiences are often described as occurring ‘internally’ or in the ‘mind’s eye’, which is remarkably similar to how we would describe our experience of visual mental imagery. We assessed the role of visual imagery in synaesthesia by (...) sampling a large group of synaesthetes and found that they report experiencing more vivid mental images than controls. These findings have important implications for our general understanding of synaesthesia and, in particular, emphasize the need to control for visual imagery in behavioural and neuroimaging paradigms. Suppose you are on a commercial airplane that is flying at 35,000 feet. Next to you sits a man who appears to be sleeping. In fact, this man has been drugged and put upon the plane without his knowledge or consent. He has never flown on a plane before and, indeed, has no idea what an airplane is. Your only option is to rationally persuade him to leave the window exit alone. You cry out to him and, with both hands on the handles, he turns to face you and waits to hear what you have to say. Unfortunately, many psychotherapists lack the training to effectively and ethically address these issues with their clients. At times, religious or spiritual concerns may be relevant to the reasons clients seek treatment, either as areas of conflict or distress for clients or as sources of strength and support that the psychotherapist may access to enhance the benefit of psychotherapy. This article reviews persistent ethical issues and dilemmas relevant to (...) providing psychotherapy to clients for whom issues of religion and spirituality are clinically relevant. Ethical considerations include assessment, advertising and public statements, informed consent, competence, boundary issues and multiple relationships, cooperation with other professionals, and how to effectively integrate religious and spiritual interventions into ongoing psychotherapy. A natural view of testimony holds that a source's statements provide one with evidence about what the source believes, which in turn provides one with evidence about what is true. But some theorists have gone further and developed a broadly analogous view of memory. According to this view, which this essay calls the “diary model,” one's memory ordinarily serves as a means for one's present self to gain evidence about one's past judgments, and in turn about the truth. This essay (...) rejects the diary model's analogy between memory and testimony from one's former self, arguing first that memory and a diary differ with respect to their psychological roles, and second that this psychological difference underwrites important downstream epistemic differences. The resulting view stands opposed to prominent discussions of memory and testimony, which either, like the diary model, treat memory by analogy to what we naively wish to say about testimony, or which instead attempt to extend to testimony the epistemically preservative role of memory. Six people are in trouble. We can save five of them or just the sixth. What should we do? John Taurek (1977) defends a radical view: We are not required to save the greater number. Taurek's paper has persuaded some. But even the unpersuaded agree that Taurek poses a deep and important challenge: From where does the priority of the many derive? It seems difficult, or even impossible, to convince someone who denies the importance of the numbers... to care about (...) the numbers. That’s what this paper aims to do. It will argue that the priority of the many follows, with minimal other assumptions, from something all should accept: the modest premise that if we can improve one person's chance of survival—without affecting anyone else—we should. Deflationists about truth seek to undermine debates about the nature of truth by arguing that the truth predicate is merely a device that allows us to express a certain kind of generality. I argue that a parallel approach is available in the case of logical consequence. Just as deflationism about truth offers an alternative to accounts of truth's nature in terms of correspondence or justification, deflationism about consequence promises an alternative to model-theoretic or proof-theoretic accounts of consequence's nature. I then (...) argue, against considerations put forward by Field and Beall, that Curry's paradox no more rules out deflationism about consequence than the liar paradox rules out deflationism about truth. This paper contrasts two versions of a pragmatist critique of deflationism about truth. According to the critique, understanding the practice of factual discourse requires understanding a role played in that practice by speakers’ use of the concept of truth. Huw Price takes this role to lie in the expression of attitudes of approval and disapproval toward other speakers’ assertions. Proceeding from Robert Brandom’s analysis of assertion, I defend an alternative account of truth’s role in terms of the acknowledgement and disacknowledgement (...) of communicative authority. I explain why this account fails to yield Price’s key anti-deflationary conclusion, namely that engaging in factual discourse requires holding that false assertions are ipso facto normatively incorrect. Innocence is a notion that can prove controversial. Claims of innocence typically support not imposing burdens on the innocent when their conduct is relevantly unobjectionable. This paper examines innocence in the context of violent conflict between states or groups. Many thinkers about the morality of such violence want to establish a principle that would protect innocent civilians. Yet the common view in just war theory does not affirm the moral innocence of civilians. Similarly, the common view that soldiers have an (...) equal right to kill does not affirm their equal moral culpability. (shrink)

This paper critically examines currently influential transparency accounts of our knowledge of our own beliefs that say that self-ascriptions of belief typically are arrived at by “looking outward” onto the world. For example, one version of the transparency account says that one self-ascribes beliefs via an inference from a premise to the conclusion that one believes that premise. This rule of inference reliably yields accurate self-ascriptions because you cannot infer a conclusion from a premise without believing the premise, and so (...) you cannot infer from a premise that you believe the premise unless you do believe it. I argue that this procedure cannot be a source of justification, however, because one can be justified in inferring from p that q only if p amounts to strong evidence that q is true. This is incompatible with the transparency account because p often is not very strong evidence that you believe that p. For example, unless you are a weather expert, the fact that it will rain is not very strong evidence that you believe it will rain. After showing how this intuitive problem can be made precise, I conclude with a broader lesson about the nature of inferential justification: that beliefs, when justified, must be underwritten by beliefs, when justified, must be underwritten by evidential relationships between the facts or propositions which those beliefs represent. Should we believe our controversial philosophical views? Recently, several authors have argued from broadly conciliationist premises that we should not. If they are right, we philosophers face a dilemma: If we believe our views, we are irrational. If we do not, we are not sincere in holding them. This paper offers a way out, proposing an attitude we can rationally take toward our views that can support sincerity of the appropriate sort. We should arrive at our views via a certain (...) sort of ‘insulated’ reasoning – that is, reasoning that involves setting aside certain higher-order worries, such as those provided by disagreement – when we investigate philosophical questions. According to commitment accounts of assertion, asserting is committing oneself to something’s being the case, where such commitment is understood in terms of norms governing a social practice. I elaborate and compare two version of such accounts, liability accounts (associated with C.S. Peirce) and dialectical norm accounts (associated with Robert Brandom), concluding that the latter are more defensible. I argue that both versions of commitment account possess a potential advantage over rival normative accounts of assertion in that they needn’t presuppose (...) any notion of an assertion’s correctness. Additionally, I show how dialectical norm accounts can explain relations between assertion and truth. After setting forth objections that have been raised against commitment accounts, I argue that responses are available on behalf of dialectical norm accounts. Finally, I propose that a liberalized dialectical norm account can illuminate phenomena sometimes seen as supporting truth relativism. (shrink)

The “scientific essentialist” doctrine asserts that the following are examples of a posteriori necessary identities: water is H2O; gold is the element with atomic number 79; and heat is the motion of molecules. Evidence in support of this assertion, however, is difficult to find. Both Hilary Putnam and Saul Kripke have argued convincingly for the existence of a posteriori necessities. Furthermore, Kripke has argued for the existence of a posteriori necessary identities in regard to a particular class of statements involving (...) proper names. Neither Kripke nor Putnam, however, has argued convincingly that sentences containing syntactically complex terms or descriptive phrases can express a posteriori necessary identities. I will argue by way of a hypothetical example that ‘water is H2O’ does not express a necessary identity. My argument is unique in that it attacks the relevant sufficiency claim needed to underwrite this putative necessary identity.1 That is, even if we grant that water is necessarily composed of H2O, we should not accept that H2O necessarily forms water. Building on recent work, I present sequent systems for the non-classical logics LP, K3, and FDE with two main virtues. First, derivations closely resemble those in standard Gentzen-style systems. Second, the systems can be obtained by reformulating a classical system using nonstandard sequent structure and simply removing certain structural rules (relatives of exchange and contraction). I clarify two senses in which these logics count as “substructural.”.

Brandom's "inferentialism"—his theory that contentfulness consists in being governed by inferential norms—proves dubiously compatible with his own deflationary approach to intentional objectivity. This is because a deflationist argument, adapted from the case of truth to that of correct inference, undermines the criterion of adequacy Brandom employs in motivating inferentialism. Once that constraint is abandoned, moreover, the very constitutive-explanatory availability of Brandom's inferential norms becomes suspect. Yet Brandom intertwines inferentialism with a separate explanatory project, one that in explaining the pragmatic significance (...) of meaning-attributions does yield a convincing construal of the claim that the concept of meaning is normative. According to Gupta and Belnap, the “extensional behavior” of ‘true’ matches that of a circularly defined predicate. Besides promising to explain semantic paradoxicality, their general theory of circular predicates significantly liberalizes the framework of truth-conditional semantics. The authors’ discussions of the rationale behind that liberalization invoke two distinct senses in which a circular predicate’s semantic behavior is explained by a “revision rule” carrying hypothetical information about its extension. Neither attempted explanation succeeds. Their theory may however be modified to employ a (...) relativized notion of extension. The resulting contextualist semantics for ‘true’ construes circularity as a pragmatic phenomenon. (shrink)

ABSTRACT:‘Race’ has long searched for a stable, suitable idea, with no consensus on a master meaning in sight. What I call deflationary pluralism about the existence of race recognizes that various meanings may be true as far as they go but avoids murky disputes over whether there are races in some sense. Once we have rejected the notion that racial essences yield innate cognitive differences, there is little point to arguing over the race idea. In its place, I propose the (...) idea of socioancestry, which jettisons racial thinking yet recognizes the social dynamics of color. For example, Black Americans, many of whom have traceable non-African ancestry, constitute an Africa-identified, socioancestrally black subgroup. ‘Race’ talk is not needed to sustain legitimate color-conscious approaches to social identity and social justice. Long-standing fixation on the race idea has obscured the simple truth that visible continental ancestry is the root of the social reality of color consciousness. (shrink)

Conciliationism faces a challenge that has not been satisfactorily addressed. There are clear cases of epistemically significant merely possible disagreement, but there are also clear cases where merely possible disagreement is epistemically irrelevant. Conciliationists have not yet accounted for this asymmetry. In this paper, we propose that the asymmetry can be explained by positing a selection constraint on all cases of peer disagreement—whether actual or merely possible. If a peer’s opinion was not selected in accordance with the proposed constraint, then (...) it lacks epistemic significance. This allows us to distinguish the epistemically significant cases of merely possible disagreement from the insignificant ones. (shrink)

We ask whether or not time deposit banking can also be illicit, and answer in the positive, if there is a mismatch between the time dimensions of deposits and loans. To wit, if an intermediary borrows short and lends long.

The university has lost its way. The world needs the university more than ever but for new reasons. If we are to clarify its new role in the world, we need to find a new vocabulary and a new sense of purpose. The university is faced with supercomplexity, in which our very frames of understanding, action and self-identity are all continually challenged. In such a world, the university has explicitly to take on a dual role: firstly, of compounding supercomplexity, so (...) making the world ever more challenging; and secondly, of enabling us to live effectively in this chaotic world. Internally, too, the university has to become a new kind of organization, adept at fulfilling this dual role. The university has to live by the uncertainty principle: it has to generate uncertainty, to help us live with uncertainty, and even to revel in our uncertainty. Ronald Barnett offers nothing less than a fundamental reworking of the way in which we understand the modern university. If the reliability of a source of testimony is open to question, it seems epistemically illegitimate to verify the source’s reliability by appealing to that source’s own testimony. Is this because it is illegitimate to trust a questionable source’s testimony on any matter whatsoever? Or is there a distinctive problem with appealing to the source’s testimony on the matter of that source’s own reliability? After distinguishing between two kinds of epistemically illegitimate circularity—bootstrapping and self-verification—I argue for a qualified version of (...) the claim that there is nothing especially illegitimate about using a questionable source to evaluate its own reliability. Instead, it is illegitimate to appeal to a questionable source’s testimony on any matter whatsoever, with the matter of the source’s own reliability serving only as a special case. (shrink)

This paper aims to call into question the customary division of logically revisionary responses to the truth-theoretic paradoxes into those that are “substructural” and those that are “ structural.” I proceed by examining, as a case study, Beall’s recent proposal based on the paraconsistent logic LP. Beall formulates his response to paradox in terms of a consequence relation that obeys all standard structural rules, though at the price of the language’s lacking a detaching conditional. I argue that the same response (...) to paradox can be given using a consequence relation that preserves detachment rules for a conditional, though at the price of restricting structural rules. The question “Is paradox being blocked by invoking a substructural consequence relation?” is thus ill-posed. The lesson of this example, I conclude, is that there is no useful explication of the idea of a substructural approach to paradox. (shrink)

This paper compares two ways of holding that logic is special among the sciences in that it has no restricted class of entities as its subject matter, but instead concerns all entities alike. One way is Williamson’s explanation of how inquiry into logical consequence and logical truth only superficially concerns the linguistic or conceptual entities that bear these properties. Williamson draws on ideas familiar from deflationism about truth, and his account has been called “deflationary.” I argue that the analogy is (...) misleading. While there’s a broad sense in which Williamson offers a deflationary account of logical inquiry, his view differs from deflationism about truth in being best understood as a form of instrumentalism. By contrast, I elaborate a deflationism about logical properties modeled on deflationism about truth. I defend this expressive device deflationism as an explanation of our use of logical predicates. In this first installment of a three-part series, I focus on the critique of civility. In so doing, I do not defend incivility. In fact, part of my critique of civility extends equally to incivility. My position is that we must move our normative discourse beyond both the thesis of civility and the antithesis of incivility to a synthesis that reframes the discussion in terms of nonviolence.
