As Hong Kong is the only common law jurisdiction operating in Chinese, alongside English, writing a common law judgment in Chinese is like exploring an uncharted domain in legal discourse. Apart from those judgments originally written in Chinese, Chinese judgments have also been prepared by way of translation from English. Besides, there are also English translations of Chinese judgments of jurisprudential value. Judgments in Hong Kong therefore present an interesting case for study both from a legal point of view and (...) from the perspective of discourse analysis. As Chinese judgments in Hong Kong to a large extent mirror images of their English counterparts, they provide us with insights into how judicial thinking embodied in one language is carried over to another. As the translation of court judgments can serve as a clue to the understanding of how judicial thinking is transferred and reflected in another language, this study looks into some of the fundamental problems of legal translation in general and translation of court judgments in particular, showing how the sociosemiotic approach can shed light on those problems. In this position paper, we have used Alan Cooper’s persona technique to illustrate the utility of audio- and video-based AAL technologies. Therefore, two primary examples of potential audio- and video-based AAL users, Anna and Irakli, serve as reference points for describing salient ethical, legal and social challenges related to use of AAL. These challenges are presented on three levels: individual, societal, and regulatory. For each challenge, a set of policy recommendations is suggested.

Extant studies of corporate hypocrisy have largely overlooked its implications for employees until recently. Drawing upon social information processing theory, we theorize the impact of corporate hypocrisy on employee silence—an employee behavior potentially detrimental to both organizations and society, as well as the underlying mediating and moderating mechanisms. We empirically tested our hypotheses with two studies. In Study 1, we found that corporate hypocrisy was positively related to employee silence through both employee cognitive trust and employee prosocial motivation. In Study (...) 2, we revealed that consumer pressure weakened the mediating roles of employee cognitive trust and prosocial motivation, while regulatory pressure strengthened these roles. Overall, this study sheds light on whether, how, and when employees remain silent when they perceive corporate hypocrisy. Implications for theory and practice are discussed. (shrink)

Ambient assisted living technologies are increasingly presented and sold as essential smart additions to daily life and home environments that will radically transform the healthcare and wellness markets of the future. An ethical approach and a thorough understanding of all ethics in surveillance/monitoring architectures are therefore pressing. AAL poses many ethical challenges raising questions that will affect immediate acceptance and long-term usage. Furthermore, ethical issues emerge from social inequalities and their potential exacerbation by AAL, accentuating the existing access gap between (...) high-income countries and low and middle-income countries. Legal aspects mainly refer to the adherence to existing legal frameworks and cover issues related to product safety, data protection, cybersecurity, intellectual property, and access to data by public, private, and government bodies. Successful privacy-friendly AAL applications are needed, as the pressure to bring Internet of Things devices and ones equipped with artificial intelligence quickly to market cannot overlook the fact that the environments in which AAL will operate are mostly private. The social issues focus on the impact of AAL technologies before and after their adoption. Future AAL technologies need to consider all aspects of equality such as gender, race, age and social disadvantages and avoid increasing loneliness and isolation among, e.g. older and frail people. Finally, the current power asymmetries between the target and general populations should not be underestimated nor should the discrepant needs and motivations of the target group and those developing and deploying AAL systems. Whilst AAL technologies provide promising solutions for the health and social care challenges, they are not exempt from ethical, legal and social issues. A set of ELSI guidelines is needed to integrate these factors at the research and development stage. (shrink)

ObjectiveTwo subregions of the dorsolateral prefrontal cortex have been identified as effective repetitive transcranial magnetic stimulation targets for the “anxiosomatic” and “dysphoric” symptoms, respectively. We aimed to develop a convenient approach to locate these targets on the scalp.Materials and methodsIn a discovery experiment, the two personalized targets were precisely identified on 24 subjects using a neuronavigation system. Then, a localized approach was developed based on individual scalp landmarks. This “landmark-based approach” was replicated and validated in an independent cohort. Reliability of (...) the approach was tested by calculating the correlation of both the inter-rater and intra-rater results. Validity was tested by comparing the mean distance between the personalized and landmark-based targets to the TMS spatial resolution. We further conducted a total of 24 sham rTMS sessions to estimate the misplacement between the coil center and target during a 10-min stimulation without neuronavigation.ResultsThe parameters of the “landmark-based approach” in the discovery experiment were replicated well in an independent cohort. Using discovery parameters, we successfully identified the symptom-specific targets in the independent cohort. Specifically, the mean distance between the personalized and landmark-based targets on the cortex was not significantly larger than 5 mm. However, the personalized and landmark-based targets distance exceeded 5 mm in more than 50% of subjects. During the 10-min sham rTMS session, the average coil misplacement was significantly larger than 5 mm.ConclusionThe “landmark-based approach” can conveniently and reliably locate the two symptom-specific targets at group level. However, the accuracy was highly varied at individual level and further improvement is needed. (shrink)

Differential leadership as a localized leadership style gradually developed on the basis of the Pattern of Differential Sequence. It plays a dual role in stimulating “insider subordinates” and “outsider subordinates” through the dynamic transformation of the roles. Using the process of game reasoning, the study identifies the differing principles used by insider subordinates and outsider subordinates in implementing deviant innovative behaviors. The simulation graph presents the perceived benefits of employees performing or not performing deviant innovative behaviors as clues during the (...) reasoning process, and implements deviant innovative behaviors for the high risk-taking trait of insider subordinates and the high internal control personality of outsider subordinates who implement deviant innovation. The theoretical derivation of behavior provides relevant references, and provides counter measures for effectively promoting employees’ deviant innovative behavior in the context of differential leadership. Kant’s Dreams of a Spirit Seer has puzzled most of its readers since its publication in 1766. Herder complained in general terms about the lack of unity and coherence of the book as well as Kant’s dialectical method of presenting both sides of a problem without offering his own solution. Mendelssohn was in doubt about whether Kant wanted to ridicule metaphysics or make a case for Swedenborg’s visions. Another exegetical puzzle has not been noted yet: Dreams discusses not one, but (...) three different versions of a ‘metaphysics of spirits’. All of them are mutually incompatible. In other words, the two versions of a metaphysics of spirits that Kant criticises in the first part of the book are both of them different from Swedenborg’s own claims, as they are discussed in the second part. And the two versions discussed within the first part are not homogeneous, either: the metaphysics discussed in the first chapter of the first part (the ‘tangled knot’) and those that seem to form the foundation for the second chapter of the first part (the ‘fragment of occult philosophy’) are again incompatible. And neither of them fits with what Kant analyses as Swedenborg’s metaphysical position in the second part: The position of the ‘tangled knot’ can tentatively be labelled as ‘crypto-materialist’. Swedenborg’s own position is characterised in the text as ‘idealist’. The ‘fragment of occult philosophy’ in contrast is probably best described as ‘dualist’. If this diagnosis is correct, it reinforces Herder’s complaints about the lack of coherence of Dreams as well as Mendelssohn’s worry about its targets. And it adds the additional challenge to explain how there can be a ‘crypto-materialist’ metaphysics of spirit-seeing. I propose to weaken the impact of these problems by identifying a second target of Kant’s scorn in Dreams – a metaphysical position Kant could be sympathetic with as far as its fundamental intentions are concerned, but that draws his ire because of an equally comprehensive failure in the realisation of these intentions. Methods: An electronic search of PubMed, Embase, and the Cochrane library database was performed to identify the papers between January 1980 and June (...) 2013 that reported on laparoscopic/robotic kidney transplantation. The terms "laparoscopic kidney/renal transplant" and "robotic kidney/renal transplant " were used. Cross-referencing was also used to find the further publications. Only English language reports were selected and accepted for descriptive analysis. Results: A total of 17 papers and abstracts were retrieved. There were two case-control studies of small volume. High-level evidence comparing the safety and efficacy of laparoscopic/robotic kidney transplant with conventional open kidney transplant was not available at the time of this review. Conclusion: The limited published data have suggested that laparoscopic/robotic kidney transplant may offer the advantages of less pain, better cosmesis, possible shorter hospital stay, and fewer wound complications, without compromising graft function. Accordingly, some immunosuppressive agents, such as sirolimus, might be able to be commenced earlier, after laparoscopic/robotic kidney transplant. The techniques are various at this early stage. A uniformed operative technique may be established in the near future. With refinement of laparoscopic devices, this technique may be widely employed. Further studies will be needed to demonstrate the advantages of laparoscopic/robotic kidney transplant over the conventional open kidney transplant. Keywords: laparoscopic surgery, robotic surgery. Les grandes interrogations sur la politique, la Cité, la République, se posent le plus souvent au cours de périodes où les réalités auxquelles ces notions sont communément référées sont en voie de délitement. Il en était ainsi dans l'Antiquité, comme en attestent, parmi d'autres, les préoccupations qui se font jour dans les écrits de Démosthène, Aristote, Cicéron. C'est aussi, en substance, ce qu'énonçait il y a plus de quinze siècles, Augustin, lorsque, dans une formule ramassée, se fondant sur la définition (...) cicéronienne de la respublica, il confrontait celle-ci à sa réalité : La république n'est plus puisqu'elle a cessé d'être la chose du peuple. Nous n'avons plus que le nom de république dont la réalité est dès longtemps perdue. Dans des circonstances où paraissent, une nouvelle fois, se défaire des institutions humainement construites, politique, république ou nation, il importe de savoir si l'usage de ces mots recouvre des réalités vivaces ou en voie de déconstitution. Il convient pour cela de "savoir à quoi on a affaire", de quels objets on parle, c'est là l'ambition de cet essai. Il ne s'agit pas pour autant de forger de toutes pièces des concepts inédits et vides, mais plutôt de travailler à penser la politique et ses lieux de réalisation, non en tant qu'idées, mais en tant que "choses", réalités concrètes, faisant retour aux réflexions de ceux qui se sont attachés à les concevoir dans leurs processus de constitution. Humility and modesty are both emphasized in Eastern and Western societies. However, people usually conflate them in everyday usage. To reduce the confusion of the two constructs, it is very vital to carefully differentiate the two constructs and examine whether they lead to similar or different effects on job performance. In this study, we scrutinized the effects of the two constructs on four dimensions of job performance simultaneously, including task performance, citizenship behavior, unethical pro-organizational behavior, and innovative behavior. Using a (...) dataset of 239 employees and 77 supervisors, we showed that modesty is not related to task performance and voicing, but that it is positively related to unethical pro-organizational behavior and negatively related to helping and innovative behavior. In contrast, we showed that humility is negatively related to unethical pro-organizational behavior and positively related to task performance, helping, voicing, and innovative behavior. Our findings reveal that modesty and humility can lead to very divergent work outcomes. The results strongly support the idea that modesty and humility are distinct constructs embedded in separate nomological networks and strongly suggest that organizations should encourage employees’ humility rather than modesty. The theoretical and practical implications of this work are discussed. (shrink)
