Few thinkers of the latter half of the twentieth century have so profoundly and radically transformed our understanding of writing and literature as Jacques Derrida. The revised Common Rule includes a new option for the conduct of secondary research with identifiable data and biospecimens: regulatory broad consent. Motivated by concerns regarding autonomy and trust in the research enterprise, regulators had initially proposed broad consent in a manner that would have rendered it the exclusive approach to secondary research with all biospecimens, regardless of identifiability. Based on public comments from both researchers and patients concerned that this approach would hinder important medical advances, however, regulators decided to (...) largely preserve the status quo approach to secondary research with biospecimens and data. The Final Rule therefore allows such research to proceed without specific informed consent in a number of circumstances, but it also offers regulatory broad consent as a new, optional pathway for secondary research with identifiable data and biospecimens. In this article, we describe the parameters of regulatory broad consent under the new rule, explain why researchers and research institutions are unlikely to utilize it, outline recommendations for regulatory broad consent issued by the Secretary's Advisory Committee on Human Research Protections, and sketch an empirical research agenda for the sorts of questions about regulatory broad consent that remain to be answered as the research community embarks on Final Rule implementation. At the age of eighty-four, Thomas Hobbes wrote an autobiography in Latin elegaics. Unsurprisingly, it was not as widely read as his two great philosophical works, Leviathan and Behemoth, in which he laid out a set of sociopolitical theories that enraged many of the philosophers and moralists of Europe. In this comprehensive biography, first published in 1904, Sir Leslie Stephen charts the character and changes of Hobbes' thinking, from the scholasticism of his early Oxford education, to his later devotion (...) to geometry and deductive science. With an emphasis on personal influences, Stephen sets Hobbes and his work in the historical context of Hobbes' often difficult patrons, the Civil War, and the Restoration, providing an insight into the life of the eminent philosopher and into the tenets of early twentieth-century biographical writing. This article defends legal instrumentalism, i.e. the thesis that law is distinguished among social institutions more by the means by which it serves its ends, than by the ends it serves. In Kelsen's terms, '[L]aw is a means, a specific social means, not an end.' The defence is indirect. First, it is argued that the instrumentalist thesis is an interpretation of a broader view about law that is common ground among theorists as different as Aquinas and Bentham. Second, the following (...) familiar fallacies that seem to stand in the way of accepting the thesis are refuted: (1) If law is an instrument, then law can have no non-instrumental value. (2) If law is an instrument, then law always has instrumental value. (3) For law to be an instrument, there must be generic end that law serves. (4) If law is an instrument, law must be a neutral instrument. These claims are all wrong. In passing, the instrumentalist thesis is distinguished from other, unrelated, views sometimes associated with instrumentalism, including Brian Tamanaha's diagnosis of the vices of American law, and the views of those who think that jurisprudence is an instrument in the service of social ends. Multinational corporations (MNCs) have brought attention to the challenges of business ethics in intercultural settings. A lack of understanding regarding cultural pluralism in business ethics education has motivated some scholars to consider a broader lens, one that recognizes the influence of religion (Spalding and Franks 2012). Management awareness of the similarities and differences that stem from deeply held beliefs is essential, as unstated thoughts and feelings caninfluence starting assumptions, even before ethical decision-making processes begin. If deeply entrenched cultural traditions and (...) religious values remain implicit and/or misunderstood, collaborative efforts may be derailed due to an inadvertent lack of respect and understanding. Because many Westerners remain unfamiliar with Muslim-based beliefs, the authors advance business ethics education by offering an overview of business practices in the Middle East. A modeland exercise are presented as tools to promote awareness of cultural perspectives. The distinction between norms and facts is long-standing in providing a challenge for psychology. Norms exist as directives, commands, rules, customs and ideals, playing a constitutive role in human action and thought. Norms lay down 'what has to be' and 'what has to be done' and so go beyond the 'is' of causality. During two millennia, norms made an essential contribution to accounts of the mind, yet the twentieth century witnessed an abrupt change in the science of psychology where norms (...) were typically either excluded altogether or reduced to causes. The central argument in this book is twofold. Firstly, the approach in twentieth-century psychology is flawed. Secondly, norms operating interdependently with causes can be investigated empirically and theoretically in cognition, culture and morality. Human development is a norm-laden process. (shrink)

Drawing on philosophical thought from the eighteenth century as well as conceptual frameworks developed in the twenty-first century, the essays in Beyond Sense and Sensibility examine moral formation as represented in or implicitly produced by literary works of late eighteenth-century British authors.

Mr. Mathien asks for evidence that there is Canadian philosophy in a special sense. He is not concerned with questions about whether people who were Canadians, or lived out much or most of their working lives in Canada, wrote philosophy which deserves to be taken seriously. Rather, he asks whether what has gone on in Canada by way of philosophy can be assembled in such a way as to make a coherent discipline.

I shall argue that Bradley needs a way of expressing logical tensions between apparently conflicting judgements, a way which will render them intelligible and non-contradictory. I shall also argue that the method he demands must, to meet his own standards, remain faithful to his belief that all philosophy — even logic — has to be anchored in experience. But it must also preserve certain basic logical notions about contradiction. The method cannot be either what is usually called the Hegelian dialectic (...) or the dialectic of relations of which Ralf Church speaks. It is, however, in important respects remarkably close to the procedure that Duns Scotus develops in his account of the disjunctive transcendentals. (shrink)

Bernard Bosanquet insisted that the truth of “moral socialism” — the doctrine that we all form part of a mutually dependent community and that we all have an obligation to put the common good ahead of our personal self-interest — follows necessarily from what we know about the nature of reality and from the logic of ethics. “Economic socialism”, the doctrine, in his view, that there ought to be a central bureaucracy on which all should depend for our continued well-being, (...) indeed, perhaps, for our very existence, is, he urged, the antithesis of moral socialism and is, in fact, a peculiar form of individualism. Religious discourse is in some way about the world, but its relation to other kinds of discourse – scientific historical, and moral – is a matter of dispute. Suggestions to avoid conflict with other kinds of discourse – the suggestion that religion invokes a distinct ‘language game’ and the suggestion that it should be taken as ‘basic’ for instance – have not, I argue, been successful. Essentially religion is involved in orienting us to the world and our goals, and orientation (...) has its own concerns. I ask what would be needed for successful orientation and suggest that talk about God my include elements which are essential for orientation. The argument suggests that the object of our orientation transcends the usual distinctions between the subjective and the objective. Perhaps this is the idea of the beatific vision. (shrink)

Green believed that, underlying the structure of human experience, there is an immanent God, gradually realised in the world through the processes of history. He believed in progress, and he sometimes spoke of it as “moral progress.” Talk of the history of moral progress came easily to him. No less than Rané Rapin, the seventeenth century Jesuit who told us that we should read history in a way which showed us its capacity for moral enlightenment, Green believed in hope.
