Massimiliano Tomba's Insurgent Universality is a stunning book. Conceptually, historically, and rhetorically innovative, it shows how popular challenges to conservative and liberal forms of state-centered politics outlive attempts to contain and repress them. Tomba's reading of revolutionary declarations and manifestos in France, Saint-Domingue, Russia, Mexico, and elsewhere recalls experimental democratic practices that can animate contemporary political thinking. After surveying some of Insurgent Universality's key contributions, I ask how Tomba's argument could be extended in relation to recent debates about the politics (...) of memory and consider what possibilities its anti-statism forecloses. Finally, I explore what gets lost in formulations of modernity that do not come to terms with racialized forms of bondage and dispossession and invite Tomba to speculate about how radical theories of politics might navigate between romantic figurations of democratic excess, on one hand, and a tragic preoccupation with aftermaths, on the other. His advance directive demonstrated that he valued his dispositional or long-term autonomy over his unquestioned right to make decisions. He also indicated to his oarsmen that he understood the nature of temptation and his inability to resist it. Ideas of autonomy and sexual choice are central to this discussion of new AIDS treatments, especially (...) the trials of preventative vaccines. Questions arise over the rights of individuals and the extent that these should be limited by concerns of the gay community. Should the gay community intervene in the risky decisions of individuals if no explicit advance directive exists? If so, how do they justify their paternalism? Could their aims not be better served through strengthening the individual dispositional autonomy of trial participants rather than making specific claims about the common good? (shrink)

Australia has one of the harshest regimes for the processing of asylum seekers, people who have applied for refugee status but are still awaiting an answer. It has received sharp rebuke for its policies from international human rights bodies but continues to exercise its resolve to protect its borders from those seeking protection. One means of doing so is the detention of asylum seekers who arrive in Australia by boat. Health care providers who care for asylum seekers in these conditions (...) experience a conflict of “dual loyalty,” whereby their role in preserving and maintaining the health of patients can run counter to their employment in detention facilities. I argued that a value-free account of our concept of disease cannot be given. Part of this argument consisted in showing that diseases as a class do not constitute a natural kind. To understand this, we need only see that we define and classify conditions into diseases and non-diseases not in terms of their causes but in terms of their effects. While no philosophical position is watertight, the arguments overwhelmingly favour the conclusion that diseases do not constitute a natural kind. (...) This study explores how religious women become legitimate actors in the public sphere and analyzes their agency—its meanings, capacities, and transformative aims. It presents a novel case study of Israeli Modern-Orthodox Agunah activists who engage in highly politicized collective feminist resistance as religious actors working for religious ends. Embedded in and activated by Orthodoxy, they advocate women’s rights to divorce, voicing a moral critique of tradition and its agents precisely because they are devoutly devoted to them. Such political agency is (...) innovatively conceptualized as “devoted resistance”: critique within relationship, enabled by cultural schema, and comprising both interpretive skills and “relational-autonomy” capacities. This study contends that understanding agency within religious grammars reveals its underlying logics, highlighting how structures shape the meanings and realization of women’s varied “agentive capacities.” It challenges current dichotomies like feminism/religion, resistance/submission, and autonomy/dependence. Overall, the author argues for a nuanced, culturally specific, capacity-based, relational approach to analyzing religious women’s agency. (shrink)

The purpose of this paper is to refute an argument against the doctrine of creation presented by sartre in "being and nothingness". The central contention of this paper is that sartre is wrong in asserting that the otherness of the creature from God implies a distinctness of existence of the creature from God which renders creation impossible. The main body of the paper is divided into three parts. In the first part, An attempt is made to show that the biblical (...) treatment of creation does not carry with it the broken-Backed notion which sartre attributes to creation. In the second part, The biblical singers and chroniclers are shown to hold the view that god's otherness is not that of a distinct existence from the creature because they see god's being as that of "presence". Finally, By reflection on a creation passage in "amos", We are enabled to see that the presence/being concept of God helps make intelligible at least one example of the usage of creation language in the old testament. This paper criticizes the understanding of philosophy as entirely made up of argument. It gives some characterization of argument as a rhetorical form and conversation as a motivating attitude. It explicates the understanding of this distinction in Book 1 of Plato’s Republic, and emphasizes the contemporary relevance of the distinction by appeal to the work of Richard Rorty. While respectful of Rorty’s insights, it sides more with the Platonic understanding of philosophical conersation, which does not abandon the pursuit of truth.

Vagueness is an extremely common feature of natural language, but does it actually play a positive, efficiency enhancing, role in communication? Adopting a probabilistic interpretation of vague terms, we propose that vagueness might act as a source of randomness when deciding what to assert. In this context we investigate the efficacy of multiple sender channels in which senders choose assertions stochastically according to vague definitions of the relevant words, and a receiver then aggregates the different signals. These vague channels are (...) then compared with Boolean channels in which assertions are selected deterministically based on classical definitions. We show that given a sufficient number of senders, a linear stochastic channel outperforms Boolean channels when performance is measured by the expected squared error between the actual value described by the senders and the receiver’s estimate of it based on the signals they receive. The number of senders required for vague channels to be at least as accurate as Boolean channels is shown to be a decreasing function of the size of the language i.e. the number of description labels available to the senders. Vague channels are then shown to be robust to transmission error provided the error rate is not too large. In addition, we investigate the behaviour of both Boolean and vague channels for a parametrised family of distributions on the input values. Finally, we consider optimal vague channels assuming a fixed number of senders and show that, provided there are more than two senders, a vague channel can be found that outperforms the optimal Boolean channel. In this context, we show that for channels with relatively low numbers of senders S-curve production functions are optimal. (shrink)

In a recent edition of the Medical Journal of Australia, Greg Dore and David Cooper called on persons in developed nations like Australia to bridge the divide between resource-rich countries to nations in the developing world, where therapies to ease or halt the ravages of the virus are nonexistent or in short supply.

We argue that in the decision making process required for selecting assertible vague descriptions of an object, it is practical that communicating agents adopt an epistemic stance. This corresponds to the assumption that there exists a set of conventions governing the appropriate use of labels, and about which an agent has only partial knowledge and hence significant uncertainty. It is then proposed that this uncertainty is quantified by a measure corresponding to an agent’s subjective belief that a vague concept label (...) can be appropriately used to describe a particular object. We then apply Bayesian networks to investigate, in the case when knowledge of labelling conventions is represented by an ordering or ranking of the labels according to their appropriateness, how measure values allocated to basic labels can be used to directly infer the appropriateness measure of compound expressions. The end of the twentieth century witnessed a resurgence of demands for reparations for slavery and segregation in the United States. At the same time, a chorus of prominent political theorists warned against the threat "identity politics" poses for democratic politics. This essay considers whether it is possible to construct an argument for reparations that responds to these concerns, particularly as they are articulated by Wendy Brown. To do so, I explore how Brown's analysis of the dangers of political organizing (...) around "wounded identities" and of appealing to the state for redress might inform and be informed by arguments for black reparations. Du Bois’s Darkwater (1920) as a window onto Du Bois’s political theory at an underexamined stage of his career and onto a challenge at the heart of black political thought: how to formulate a conception of collective life that regards the humanity of black women and men as a central concern. Exploring Du Bois’s attempt to articulate what can be seen through the lens of an avowedly “black” perspective and his creative juxtaposition of different (...) modes of writing, the author suggests why Darkwater remains a valuable resource for democratic theory in an age misleadingly described as “post-racial.”. Toni Morrison: Imagining Freedom explores Morrison’s reflections on the idea of freedom in her novels and nonfiction from the 1970s to 2019. While Morrison’s literary achievements are widely celebrated, her political thought has yet to receive its due. Morrison’s writing illuminates the meanings of freedom and unfreedom in a democratic society that was founded on both the defense of liberty and the right to enslave and dispossess. Toni Morrison: Imagining Freedom argues that Morrison’s fiction and her meditations on the power (...) of language contest the wishful thinking of color-blindness and repudiate complaints that it is time to get beyond race. Morrison’s attentiveness to the experiences of people “no one inquired of,” especially her interest in the lives of black women and girls, reorients democratic inquiry in the shadow of racial slavery, settler colonialism, and the ongoing processes of theft and domination they set in motion. Morrison’s writings, Balfour contends, kindle new practices of freedom-seeking that do not rely on the subjugation of others. (shrink)

Research Ethics, Volume 18, Issue 1, Page 51-63, January 2022. Aboriginal and Torres Strait Islander peoples in Australia, have historically experienced research as another means of colonialization and oppression. Although there are existing frameworks, guidelines and policies in place that respond to this history, the risk of exploitation and oppression arising from research still raises challenging ethical questions. Since the 1990s the National Health and Medical Research Council in Australia has developed specific sets of guidelines that govern research with these (...) populations in an attempt to redress injustices of the past. The current guidelines: Ethical Conduct in Research with Aboriginal and Torres Strait Islander Peoples and Communities: Guidelines for Researchers and Stakeholders, 2018, emphasis six core values which are bound together by “spirit and integrity.” The values are reflected through respect for cultural inheritance, and genuine negotiation of partnerships between researchers, other stakeholders, and communities. We examine whether these guidelines can lead to research and research practices that redress some of the ongoing traumas of colonialization and racism. We draw upon Margaret Urban Walker’s formulation of restorative justice, based upon her “pragmatics of repair” which relies upon “voice, validation and vindication” and at its core, the restoration of relationships. Australia's policy of mandatory indefinite detention of those seeking asylum and arriving without valid documents has led to terrible human rights abuses and cumulative deterioration in health for those incarcerated. We argue that there is an imperative to research and document the plight of those who have suffered at the hands of the Australian government and its agents. However, the normal tools available to those engaged in health research may further erode the rights and well being of this population, requiring (...) a rethink of existing research ethics paradigms to approaches that foster advocacy research and drawing on the voices of those directly affected, including those bestowed with duty of care for this population. The aim of this section is not to constitute a new and newly virtuous canon, but rather to goad readers to reflect anew on knowledge production and the institutional and circulatory practices that (...) compose it, reaching from journal readers, to classrooms and conferences, and on to late night conversations and confabulations. In this essay, I contend that feminist theories of citizenship in the U.S. context must go beyond simply acknowledging the importance of race and grapple explicitly with the legacies of slavery. To sketch this case, I draw upon W.E.B. Du Bois's “The Damnation of Women,” which explores the significance for all Americans of African American women's sexual, economic, and political lives under slavery and in its aftermath.

What does it look like when an organization tentatively steps away from an exclusively rules-based regime and begins to attend to both rules and principles? What insights and guidance can ethicists and ethical theory offer? This paper is a case study of an organization that has initiated such a transition. The American Institute of Certified Public Accountants has begun a turn toward the promotion of ethical principles and best practices by adding a “conceptual framework” to its existing Code of Professional (...) Conduct. This conceptual framework calls upon its members to intentionally increase their awareness of significant threats to their compliance with its rules of conduct and to establish safeguards to offset or eliminate those threats. To this end, each member is required to regard every questionable situation, circumstance, transaction or relationship by attempting to view it through the eyes of an imagined reasonable third party. This paper examines this protocol theoretically and practically. First, we frame this analysis within the principles and ethical concepts that inform the professional ethics of accountants. Second, we critique the AICPA’s long-standing rules-based approach to its Code. Third, we examine the new conceptual framework with a view toward its potential for the promotion of a more principles-based approach to the professional ethics of the accounting profession. Fourth, we give attention to the notion of the “reasonable and informed third party,” which has been embedded in the new conceptual framework, and consider how two schools of thought—Adam Smith’s modernist “impartial spectator” concept and Emmanuel Lévinas’ postmodern phenomenology in regard to “the Other”—may offer theoretical support and clarity for this epistemic exercise. Finally, we point out several ways in which the AICPA’s commitment to its new conceptual framework could be strengthened and enhanced. (shrink)
