Is Joseph Margolis a member of the often neglected school of “Columbia naturalism”? Columbia naturalism promoted a distinctive non-reductive nationalism in mid-twentieth-century America. Inspired by pragmatism, and Dewey in particular, its members included Ernest Nagel, John Herman Randall, Joseph Blau, Herbert Schneider, and Justus Buchler. Margolis received his degree from Columbia in 1953. Neither his early work in aesthetics nor his mature attempt to justify pragmatic themes in an uncompromising dialogue with analytic and continental philosophy seems particularly “Columbian.” Neither (...) does his radical endorsement of a kind of relativism. However, Margolis is after all some kind of naturalist. Furthermore, the Columbians shared a forgotten doctrine, called “objective relativism.” If the combination of naturalism and relativism is a Columbian fruit, Margolis may have has fallen closer to the tree than first appears. Among race scholars, there is a general consensus that (1) groups thought to be races in the 19th/20th century do not possess the characteristics attributed to them in classic racial ideology, (2) such groups are nevertheless intergenerational collectivities with distinctive social and historical experiences, and (3) those experiences were and are deeply shaped by the false beliefs of classic racial ideology. The groups of whom this consensus is true are felicitously called “racialized groups,” terminology preferable to “social construction,” “classic racial (...) groups,” “ethnic groups,” and “ancestral/descent groups,” though each of these has something to be said for it. The socio-historical consensus is not, however, adequately reflected in recent work on race, for example, by Appiah (who confuses race and racialization), Mallon (who does not capture the “group-ness” of racialized groups), and Glasgow (who does not capture the way the false ideology of race has shaped the experience of racialized groups). The theory of events presented is one that construes events to be concrete particulars; and it embodies an attempt to take seriously the idea that events are the changes that objects undergo when they change. The theory is about what an event really is, about when events are identical, about what properties events have essentially, and about what relations events bear to entities of other kinds. It is well-acknowledged that teachers play a significant role in enhancing student learning and that investigating teachers’ cognitions about teaching is a first and important step to understanding the phenomenon. Although much research into teachers’ cognitions about grammar teaching has been conducted in various socio-cultural contexts, little has been reported on cognitions of Chinese teachers of English as a foreign language so far. Such understanding is of primary importance to student success in language learning given the sociocultural context where grammar (...) takes a lion’s share in high-stakes examinations. In order to address this research gap, we developed and validated the Chinese EFL Teachers’ Cognitions about Grammar Teaching Questionnaire. Two subsamples were randomly invited to respond to the TCAGTQ and the data were then subjected to exploratory factor analysis and confirmatory factor analysis to test the validity and reliability of the instrument. The EFA excluded eight items from the TCAGTQ and generated six factors with 27 items. The CFA result from the other subsample supported a six-factor model with a good model fit. Moderate correlations between the six factors also supported the predictive validity of the questionnaire, showing that the TCAGTQ is a valid and reliable inventory for measuring Chinese university EFL teachers’ cognitions about grammar teaching. Our findings suggest that the TCAGTQ can be used as a useful tool for teachers to self-assess their professional practice for improving teaching. (shrink)

Deep brain stimulation is an experimental procedure for treatment-resistant depression. Some results show promise, but blinded trials had limited success. Ethical questions center on vulnerability: especially on whether depressed patients can weigh the risks and benefits effectively, whether depression causes “desperation,” and whether media portrayals create unrealistic hopes. We interviewed 24 psychiatric inpatients with treatment-resistant depression, qualitatively analyzing their comments. Most had minimal interest in deep brain stimulators. Some might consider them if their depression worsened, if alternatives were exhausted, or (...) if the evidence were stronger. Fears focused on the surgery, adverse effects, and the novelty of the device. Patients felt the depression interfered with their ability to weigh the risks and benefits. Patients seemed highly attuned to the risks, and were skeptical that the treatment would be effective. We conclude that ethical concerns about vulnerability remain, yet patients with treatment-resistant depression were thoughtful and cautious about trying a novel therapy. (shrink)

In this essay I defend a theory of psychological explanation that is based on the joint commitment to direct reference and computationalism. I offer a new solution to the problem of Frege Cases. Frege Cases involve agents who are unaware that certain expressions corefer (e.g. that 'Cicero' and 'Tully' corefer), where such knowledge is relevant to the success of their behavior, leading to cases in which the agents fail to behave as the intentional laws predict. It is generally agreed that (...) Frege Cases are a major problem, if not the major problem, that this sort of theory faces. What is the core of the distinctiveness of Homo sapiens? Some of the most famous hypotheses include tool use and tool making, language, free will and moral agency, self-consciousness, mind itself, and reason or rational problem-solving. All these answers are partly true. But recent work in comparative psychology, primatology, and cognitive science have converged on a conception of human distinctiveness that underlies these. Remarkably, it was explored a century ago by George Herbert Mead. The American pragmatists played a special role (...) in the development of non-reductive naturalism. But among them, Mead uniquely endorsed the notion of “emergence” developed by the British Emergentists. This led him to an analysis of the emergence of the human self and mind out of social processes, most famously employing his concept of “significant gesture.” In recent decades both notions have been buttressed by philosophical and scientific work. Emergence has returned in the sciences of nonlinear dynamics and complexity, and has been re-conceptualized by philosophers like Wiliiam Wimsatt. Mead’s social conception of the human mind and self have been repurposed by a host of scientists, as in Michael Tomasello’s conception of “joint intentionality” and Antonio Damasio’s analysis of self-consciousness. These developments show that Mead was remarkably prescient in his core insights. (shrink)

In this chapter, I embrace Jeff Goldsworthy’s conclusion that Ronald Dworkin was an originalist regarding the meaning of canonical legal texts. I briefly examine the evidence for that claim, and I ask how its truth affects Dworkin’s fit-acceptability account of the nature of law. In a brief digression, I present a broad-brush view of the jurisprudential debate between legal positivists and natural lawyers. I then explain why the natural law view must fail and why legal positivists must make an unpalatable (...) choice between a gunman model and a model based on deception. Finally, I situate and explain Dworkin’s third-way jurisprudence and its fatal flaws. I conclude by explaining how devastating Dworkin’s originalism is for his third-way jurisprudential view that law consists of those principles that best justify the community’s past and present coercive political decisions. Various authors insist that some body of natural phenomena are legitimately describable or explainable only on one level of description, and would disqualify any description not confined to that level. None offers an acceptable definition explicitly. I extract such a definition I find implicit in the work of two such authors, J.J. Gibson and Hubert Dreyfus, and modify the result to render it more defensible philosophically. I also criticize the definition Shaw and Turvey offer, demonstrate some applications of my definition, (...) and try to forestall certain misunderstandings of those presuppositions and that definition. The present essay is primarily concerned with. By analyzing the usefulness of the idea of efficient causation I shall expose its primarily classificatory function and the intrinsic limits which this function of the idea prescribes for it. The plan of these remarks is as follows: to exhibit the classificatory function of the causal analysis, to show how this function operates in the relation between categorical and hypothetical assertions, to show briefly how it operates in counterfactual and dispositional assertions, and to (...) show the role of this function in the identification of events. Then I shall relate the limits of causal classification to those of predicative classification and show briefly the significance of this functional view of causal determinism for Freudian psychology. Each of the topics must be treated only in so far as it bears on the rest, and important questions in each area will therefore be by-passed. In one sense the applications to Freudian psychology constitute the primary target of the study, since it is in that field that classical determinism has enjoyed a notorious renaissance. What role does and should religion play in the legal sphere of a modern liberal democracy? Does religion threaten to create divisions that would undermine the stability of the constitutional order? Or is religious disagreement itself a force that works to create consensus on some of the core commitments of constitutionalism--liberty of conscience, toleration, limited government, and the rule of law? This essay explores these questions from the perspectives of contemporary political philosophy and constitutional theory. The thesis of the essay (...) is that pluralism--the diversity of religious and secular conceptions of the good--can and should work as a force for constitutional consensus and that such a consensus is best realized through commitment to an ideal of public legal reason instantiated by the practice of legal formalism. The case for these claims is made in six parts. After the introduction, Part II, The Fact of Pluralism in the Context of Contemporary Religious Division, explores the idea of religious division in light of an important notion in political philosophy--the idea that John Rawls calls the fact of reasonable pluralism. Part III, Public Legal Reason, argues that the fact of pluralism has important normative consequences for the foundations of normative legal theory and argues for an ideal of public legal reason. Part IV, Legal Formalism, contends that this idea is best realized in constitutional practice through a formalist approach to constitutional interpretation--one that deliberately eschews direct reliance on religious and secular comprehensive conceptions of the good. Part V, Feasibility and Positive Theory, discusses the question whether this ideal of public legal reason and corresponding conception of constitutional formalism are realistic, given the constraints imposed by democratic politics under contemporary conditions.
