The purpose of this study is to identify and explain a religious paradigm in Targum Qohelet (TgQoh). Targum Qohelet is dated to a period between 500 CE and 1101 CE. This study concludes that the most probable setting for this Targum was the beit midrash (the house of study). A paradigmatic research approach is used to identify the range of translation components to explain the translation method employed in TgQoh and the rationale behind it. This research approach reveals how the (...) translator(s) used their interpretative ability to create a completely different thought-world when compared with the original Hebrew Text. Various subparadigms emerge as a network of connected religious beliefs to form a cogent systematic rabbinic theology of a perfect world order to replace the pessimism of the Hebrew base text. The Aramaic version reflects a complete solution to the existential problems raised by Biblical Qohelet. It seeks to provide humankind with guidelines for creating a ‘perfect world’ both on earth and in the afterlife. The use of a paradigmatic analysis based on the concept of a ‘perfect world’ provides an ideal model for analysing the translation strategy of TgQoh and understanding its method of rendering. Contribution: The application of paradigmatic methodology bridges the gap between the relatively secular nature of the Hebrew version of Qohelet (Ecclesiastes) and the overwhelmingly and inescapable theological forms of the Aramaic targum. The paradigms in the Aramaic translation identify how the targum applied rabbinic ideology to explain the meanings that lies behind the original Hebrew text of Qohelet. The paradigms, when taken together reveal how the cynical nature of Hebrew Qohelet was changed into a rabbinical guide for righteous living, here described as ‘perfect world’. (shrink)

Gregory Clark sets parallel aims: to apply Kenneth Burke's critical vocabulary (...) to cultural history, and to read American tourist sites and literature in the frame of Burke's notion of "identity" (147). Clark sees the American public landscape as "constituting in individual citizens a shared sense of common identity as members of a national public" (148). He claims that such shared experiences are as rhetorical as are more typical instances of public discourse. Thus American tourism has contributed to developing us into a national community.Clark supports his theme of rhetorical influence with six case studies: New York City, Shaker villages, Yellowstone National Park, the Grand Canyon, the Lincoln Highway, and the 1915 San Francisco Panama Exposition. While Burke's vocabulary offers a handy point of departure, the real news is in [End Page 172] Clark's discussion of the meaning and prominence of each of his six exemplars as cultural icons.This may be most evident (and endearing) as Clark recalls his own boyhood visits to Yellowstone, where he stood in the parking lot and was as captivated by the variety of license plates from across the country as by the hot springs and mudpots (69). This too was a celebration of nationhood. Equally fascinating is his consideration of the efforts of Stephan Mather, Mary Colter, and the Fred Harvey Company both to preserve national parklands and to develop a befitting "National Park Service Rustic" architectural style to enhance the natural landscape (this long before Disney's theme parks). Such typical excerpts almost cry out for Ken Burns or the History Channel to recreate the optimistic climate of a Romantic Post-Bellum civic culture depicted by Clark.The book becomes more tedious when its repeated invocation of Burkian terms tilts toward veneration. In his lifetime, Burke was unnerved by uncritical academic worship. He sought understanding, not deification. As he remarked, "They are an evangelical brood, bejeez. So... I [became] an observer at my own funeral."1 His wariness of academic enthusiasm is well taken. It does no disservice to Burke, for example, to recognize that his "identification" is a reworking of Vico's "ingenium" outfitted in creaky 1920s literary machinery.2 Shorn of some of the cumbersome Burkian baggage, the book's exemplars emerge as epideictic celebrations of the American tourist phenomenon and its part in shaping a national Romantic consciousness:And as rhetoric they traffic not in actions but in attitudes. People can encounter them without ever thinking of themselves as anything but spectators. Even in that role they are being educated... in matters of individual and collective identity.(148)Seen thus as reminders of our forebears' vision in pioneering the development of a national landscape trust, Clark's work edifies and opens us to the quiet excitement of meditative discovery. The question addressed by this book is what, if anything, stoic ethics would be like today if stoicism had had a continuous history to the present day as a plausible and coherent set of philosophical commitments and methods. Ever since Greek antiquity "disembodied knowledge" has often been taken as synonymous with "objective truth." Yet we also have very specific mental images of the kinds of bodies that house great minds--the ascetic philosopher versus the hearty surgeon, for example. Does truth have anything to do with the belly? What difference does it make to the pursuit of knowledge whether Einstein rode a bicycle, Russell was randy, or Darwin flatulent? Bringing body and knowledge into such intimate contact is occasionally seen (...) as funny, sometimes as enraging, and more often just as pointless. The article explores the influence of unproven specificity of pathogenesis manifested in clinical psychiatry and research. A selected literature review of studies attempting to identify a biological marker is presented. To date, the search for a biological marker to establish a psychiatric diagnosis has been unsuccessful. Clinical settings and programs are described which seem to be driven by psychological issues, one such example being the search for villains. Thus, specific assumptions about etiology affect therapy technique and treatment planning and may (...) be disadvantageous to patient care. Biological and psychological development in all of its phases is subject to a diverse range of perturbations, intrinsic as well as extrinsic. A flexible, balanced view is called for before specificity is extended to general theories, which, in turn, affect therapy and treatment settings. (shrink)

Yet, in the actual body of both texts, we find numerous occasions where Kant deviates from the rules he initially articulates. ABSTRACTThis article investigates a virtue-centered approach to normative legal theory in the context of legislation. The core idea of such a theory is that the fundamental aim of law should be the promotion of human flourishing, where a flourishing human life is understood as a life of rational and social activities that express the human excellences. Law can promote flourishing in several ways. Because peace and prosperity are conducive to human flourishing, legislation should aim at the establishment and maintenance of (...) these conditions. The human excellences are developed in childhood and young adulthood by stable and nurturing families and by educational institutions: therefore, the law should support and foster families and schools. Corpus linguistics is becoming a respected method of statutory and constitutional interpretation in the United States over the past decade, yet it has also generated a backlash from a group of scholars that engage in empirical work. This essay attempts to demonstrate both the contributions and the risks of using linguistic corpora as a primary tool in legal interpretation. Its legitimacy stems from the fact that courts routinely state that statutory terms, when not defined as a matter of law, are (...) to be given their ordinary meaning. Judges have responded to this challenge, with the assistance of the linguistics community, by using corpora to determine which meanings are ordinary. However, legal analysts have not determined exactly what makes one meaning ordinary and another not ordinary. This gap has led to a level of disagreement in the field. Moreover, while linguists who engage in corpus linguistic analysis typically emphasize the importance of context, the legal application is peculiarly context-free, in keeping with legal philosophies that eschew reliance on reference to a law’s purpose and the intent of the legislature that enacted it. This move adds a political dimension to corpus analysis as a means of legal interpretation. Yet, the article concludes that by relying on a blend of general and specialized corpora, the legal system can substantially reduce the problem of contextualization, as some linguists and practitioners have already recognized.
