Jnanasrimitra (975-1025) was regarded by both Buddhists and non-Buddhists as the most important Indian philosopher of his generation. His theory of exclusion combined a philosophy of language with a theory of conceptual content to explore the nature of words and thought. Jnanasrimitra's theory informed much of the work accomplished at Vikramasila, a monastic and educational complex instrumental to the growth of Buddhism. His ideas were also passionately debated among successive Hindu and Jain philosophers. Apart from his voluminous, immensely learned, and spectacularly successful contributions to the fields of Hermeneutics, non-dualist Metaphysics, and poetics, the sixteenth century South Indian polymath Appayyadīkṣita is famed for reviving from obscurity the moribund Śaivite Vedānta tradition represented by the Brahmasūtrabhāṣya of Śrīkaṇṭha. Appayya’s voluminous commentary on this work, his Śivārkamaṇidīpikā, not only reconstitutes Śrīkaṇṭha’s system, but radically transforms it, making it into a springboard for Appayya’s own highly original critiques of standard views of Mīmāṃsā and Vedānta. Appayya addresses long (...) sections of his commentary to matters dealt with glancingly or not at all in the root text, drawing conclusions which Śrīkaṇṭha nowhere endorses. Furthermore, the distinctive positions Appayya develops in the Śivārkamaṇidīpikā feed into Appayya’s other works in ways that have so far been largely ignored by modern scholars. For example, most or all the discussions Appayya’s Pūrvottaramīmāṃsāvādanakṣatramālā, twenty-seven essays on scattered topics in Mīmāṃsā and Vedānta, build on arguments first advanced in the Śivārkamaṇidīpikā—most notably Appayya’s totally original theory of the signification of adjectives, first developed in the Śivārkamaṇidīpikā, the full elaboration and defense of which takes up fully sixteen of the twenty-seven essays that make up the Pūrvottaramīmāṃsāvādanakṣatramālā. Wikipedia has challenged traditional notions about the roles of experts in the Internet Age. Section 1 sets up a paradox. Wikipedia is a striking popular success, and yet its success can be attributed to the fact that it is wide open and bottom-up. How can such a successful knowledge project disdain expertise? Section 2 discusses the thesis that if Wikipedia could be shown by an excellent survey of experts to be fantastically reliable, then experts would not need to be granted (...) positions of special authority. But, among other problems, this thesis is self-stultifying. Section 3 explores a couple ways in which egalitarian online communities might challenge the occupational roles or the epistemic leadership roles of experts. There is little support for the notion that the distinctive occupations that require expertise are being undermined. It is also implausible that Wikipedia and its like might take over the epistemic leadership roles of experts. Section 4 argues that a main reason that Wikipedia’s articles are as good as they are is that they are edited by knowledgeable people to whom deference is paid, although voluntarily. But some Wikipedia articles suffer because so many aggressive people drive off people more knowledgeable than they are; so there is no reason to think that Wikipedia’s articles will continually improve. Moreover, Wikipedia’s commitment to anonymity further drives off good contributors. Generally, some decisionmaking role for experts is not just consistent with online knowledge communities being open and bottom-up, it is recommended as well. (shrink)

It will be argued that the Critique of Pure Reason reflects an important but not final stage in Kant's understanding of belief. Its structure is further refined and its scope narrowed in later works, including the Critique of Practical Reason and Critique of Judgment . Naturalists tell us to rely on what science tells about the world and to eschew aprioristic philosophy. But foundational physics relies internally on modes of thinking that can only be called philosophical, and philosophical arguments rely upon what can only be called scientific inference. So what, then, could the naturalistic thesis really amount to?

Should the nation provide expensive care and scarce organs to convicted felons? We distinguish between two fields of justice: Medical Justice and Societal Justice. Although there is general acceptance within the medical profession that physicians may distribute limited treatments based solely on potential medical benefits without regard to nonmedical factors, that does not mean that society cannot impose limits based on societal factors. If a society considers the convicted felon to be a full member, then that person would be entitled (...) to at least a decent minimum level of care — which might include access to scarce life-saving organs. However, if criminals forfeit their entitlement to the same level of medical care afforded to all members of society, they still would be entitled to a kind of rudimentary decent minimum granted to all persons on simple humanitarian grounds. Almost certainly this entitlement would not include access to organ transplants. (shrink)

Justice is a natural virtue. Well-functioning humans are just, as are well-ordered human societies. Roughly, this means that in a well-ordered society, just humans internalize the laws and social norms (the nomoi)--they internalize lawfulness as a disposition that guides the way they relate to other humans. In societies that are mostly well-ordered, with isolated zones of substantial dysfunction, the nomoi are limited to those norms that are not clearly inconsistent with the function of law--to create the conditions for human flourishing. (...) In a radically dysfunctional society, humans are thrown back on their own resources--doing the best they can in circumstances that may require great practical wisdom to avoid evil and achieve good. Justice is naturally good for humans--it is part and partial of human flourishing. All of these are natural ethical facts. "Natural Justice" develops these claims in four stages. Part I contextualizes the claim that justice is a natural virtue in relationship to David Hume's famous argument about deriving ought from is, G. E. Moore's open-question argument, and the so-called fact-value distinction. The upshot of the discussion in part I is the claim that there are no clearly decisive objections to existence of natural ethical facts. Part II traces the movement from neo-Aristotelian virtue ethics to virtue jurisprudence by articulating a theory of the judicial virtues. Among these are the virtues of practical wisdom and of justice. Practical wisdom or phronesis is best understood on the model of moral vision, which in the context of law is legal vision or situation sense. The virtue of justice is best understood as lawfulness. Just humans are law-abiding or nomimos--in that they internalize the widely shared and deeply held social norms of their social groups. This part concludes with the claim that a legally correct decision is the decision that characteristically would be rendered by a fully virtuous judge under the circumstances of the case. Part III argues that natural justice can be understood on the model of natural goodness as articulated in the work of Philippa Foot and Michael Thompson. The intuitive idea is that justice as lawfulness is naturally good for reason--using social creatures in human circumstances. This part also articulates and responds to a variety of objections. Part IV concludes by articulating the sense in which an aretaic theory of law that incorporates a natural virtue of justice as lawfulness can be viewed as an expression of the natural law tradition. The natural law idea that an unjust enactment is not a true law corresponds to two senses in which positive laws can fail to be nomoi (in the technical sense specified by virtue jurisprudence). First, a given enactment may contravene deeply held and widely shared social norms. Second, such enactments may be fundamentally inconsistent with the purpose of law--the promotion of human flourishing. (shrink)

Vedānta Deśika produced his monumental poetic biography of Kṛṣṇa in a time when Kṛṣṇa-centered devotionalism was expanding to become perhaps the dominant mode of bhakti across South Asia. Central to this phenomenon is the growing popularity of the Bhāgavatapurāṇa, and especially of its exploration of Kṛṣṇa’s erotic play with the gopīs in his youth. Troubled by the unrestrained and seemingly adharmic sexuality of Kṛṣṇa, Deśika used the literary techniques and narrative paradigms of the mahākāvya to assimilate but also domesticate this (...) increasingly important Bhāgavata episode: Kṛṣṇa’s eroticism remains central but confined within more conventional marital norms and is thus made dharmically and theologically acceptable. Once he has resolved these dharmic problems, however, Deśika is happy to explore the soteriological, devotional, and paradoxical dimensions of erotic love with Kṛṣṇa. (shrink)

Howard Brody expresses concern that citing the “two cases that put futility on the map,” namely Helga Wanglie and Baby K, may be providing ammunition to the opponents of the concept of medical futility. He in fact joins well-known opponents of the concept of medical futility in arguing that it is one thing for the physician to say whether a particular intervention will promote an identified goal, quite another to say whether a goal is worth pursuing. In the latter instance, (...) physicians are laying themselves open “to the criticism of taking on basic value judgments that are more appropriately left to patients and their surrogates.” Brody states that in both the Wanglie and Baby K cases, the “basic value judgments” had to do with the worthiness of maintaining unconscious life via medical technology. He classifies this as “a question of professional integrity—but not a question of futility,” adding that “more than semantics hinges on this distinction.” The “more than semantics” factor is a pragmatic, even political one. Failure to make this distinction renders physicians “that much more suspect and less trustworthy in the public debate.”. (shrink)

Max Weber’s contribution to cultural sociology has received insufficient attention, due to the unfinished character of his work and its reception. This paper investigates aspects of his contribution in relation to the field of art, broadly conceived, and in terms of the uses of his ideas by historians of art and design, such as T. J. Clark. Weber’s social theory considers art from two perspectives: the relative autonomy of cultural and artistic forms and modes of expression, and the social construction (...) of works of art and culture. From the latter point of view technics and the technical become important factors in a double sense: The technologies of modern civilization external to art shape the “spirit” of art and its contents, and development in art proceeds as an effort to solve technical problems internal to the art form itself. Examples from painting, architecture and music illustrate the relationships. It is these perspectives that characterize the Weberian approach to art and invite further investigation as contributions to cultural sociology and social theory. (shrink)

I argue that physicians can save women from life-threatening pregnancies by performing a craniotomy, placentectomy, or salpingotomy without intending death or harm. To support this conclusion, I defend the relevance thesis about intentions (a person intends X only if X explains the action). I then criticize the identity thesis (if a person intends X and knows that X is identical to Y then the person intends Y) and three mistakenly strict moral principles: (1) one may not intend something that is (...) a serious harm for an innocent person, (2) one may not intend to terminate pregnancy before viability, and (3) one may not act on a person’s body in a harmful way in order to benefit another person. (1) would prohibit procuring organs from living donors, (2) would prohibit treating hepatic pregnancies and other ectopic pregnancies, and (3) would prohibit procuring organs from living donors and performing many prenatal surgeries. André Naud was a French‐Canadian Catholic theologian who served as a peritus or advisor to Cardinal Leger, the Archbishop of Montreal at the Second Vatican Council between 1962 and 1965. Naud’s entire theological career was informed by the teachings of the Council. This was the reason why during the Papacy of John Paul II after 1978 he became alarmed at the expansion and the distortion of the authority of the magisterium. Over the last fifteen years of his life, he wrote (...) three remarkable books on this theme. In the last book (2002) entitled Les Dogmes et le Respect de l’Intelligence: Plaidoyer Inspiré par Simone Weil (The Dogmas and the Respect for Intelligence: An Argument Inspired by Simone Weil), he undertook an in‐depth analysis of Simone Weil, who had argued in the 1940s that Catholicism was in need of a philosophical cleaning up. This paper elaborates and explains the particular ways that Weil’s writings helped Naud to reformulate in the spirit of the Second Vatican Council the role of the magisterium with regard to dogmatic formulations, the manner of the reception of that teaching, the inspiration of scripture, the interpretation of miracles and the understanding of the Church itself. Retributivists argue that punishment must be justified by the ill-desert of the one punished. And there are several philosophical positions on the justification of punishment in between these two: for example, weak or teleological retributivism, which justifies particular instances of punishment by both their consequences and the desert of the offenders, and positions which distinguish between the institution (...) of punishment and specific instances of punishment. The Affordable Care Act did not start the consolidation rapidly occurring with hospitals/health systems and medical groups, but it most definitely accelerated the movement to combine. In the last five years, the number and size of consolidations have been at an all-time high. This comment reviews the degree to which consolidation has occurred and explores the key reasons behind these consolidations. It then posits that consolidations should be evaluated in light of the Triple Aim goals of enhancing access to care, (...) reducing cost, and strengthening quality, and looks at the evidence to date in light of these goals.
