Our think tank tasked by the Dutch Health Council, consisting of Radboud University Nijmegen Honours Academy students with various backgrounds, investigated the implications of Deep Brain Stimulation for psychiatric patients. During this investigation, a number of methodological, ethical and societal difficulties were identified. We consider these difficulties to be a reflection of a still fragmented field of research that can be overcome with improved organization and communication. To this effect, we suggest that it would be useful to found a centralized (...) DBS organization. Such an organization makes it possible to 1) set up and maintain a repository, 2) facilitate DBS studies with a larger sample size, 3) improve communication amongst researchers, clinicians and ethical committees, and 4) improve communication between DBS experts and the public at large. Nichelle Cherry (bio), and Martina Darragh* (bio)In 1995, the Joint Commission on Accreditation of Healthcare Organizations (JCAHO) expanded its patient rights standards to include requirements for assuring that hospital business practices would be ethical. Renamed “Patient Rights and Organization Ethics,” these standards are based on the realization that a hospital’s obligation to (...) its patients is derived from two relationships: the patient-provider relationship governed by “clinical ethics,” and the customer-supplier relationship governed by “business ethics.” “[This] boundary between ‘clinical’ ethics and ‘business’ ethics is not clear and in many cases is nonexistent. While marketing and admission practices are seen as issues related to ‘business’ ethics, they can lead to unneeded admissions or demand for unneeded services, both of which can unnecessarily expose the patient to the risk of side effects or complications. Likewise, underutilization of needed services is likely to lead to less than optimal health outcomes” (I. Schyve 1996, p. 17). “These new standards arose out of well-publicized concerns about abuses in which patients were admitted to hospitals unnecessarily and were discharged or transferred only after their insurance expired” (I. Schyve 1996, pp. 15–16).These abuses also sparked eloquent protests against threats to patient well-being and to the nature of the patient-provider relationship in the bioethics literature. The fiduciary responsibility of the provider to inform and to protect the patient was fragmented by insurer business practices such as gag clauses and economic credentialing of providers (VII. Scope Note 31, 1996). The background role that the institution plays, though poorly articulated historically, has been brought sharply into focus by the explosive growth of the managed practice of medicine. The context of medical ethics is no longer limited to the resolution of individual cases, but instead encompasses the adoption of institutional structures to protect and promote patient welfare (IV. Emanuel 1995, p. 335). In this new configuration, the institution and the providers are co-fiduciaries for populations [End Page 189] of patients, and the medicine that is practiced is “appropriately economically disciplined.” The expression “My patient always comes first” is no longer “... intellectually serious or morally responsible.” But, “... to be sure, both conceptually and in practice, being an economically disciplined fiduciary professional or institution is ethically unstable.... The task is to identify the boundaries outside of which institutional policy and behavior will not count as an ethically defensible form of being... [a] fiduciary.” (IV. McCullough 1997, pp. 143–44). This process of delimiting and enforcing boundaries requires the development of “... a language for talking about the ethical values of the organization. If such a language does not exist, discussions about ethics become cumbersome and unlikely to occur” (IV. Cleveland Clinic Foundation 1998, p. 2).As with bioethics generally, the literature addressing organizational ethics is multidisciplinary. JCAHO’s compliance guide for its revised standards, Ethical Issues and Patient Rights, draws on a wealth of ideas from both clinical ethics and business ethics. This is often an awkward alliance. “Because the study of organizational ethics is in its infancy compared to other areas of healthcare ethics, discussions about it often seem like hot air with no palpable payoff” (I. Boyle 1998, p. 2). The fact that “... there is an ancient history that reflects widespread doubt about the moral probity of business” (II. Frederick 1995, p. 209) does not help. To begin, “Aristotle had rude things to say about business” (II. Jackson 1998, p. 401). A brief review of introductions to several of the business ethics textbooks cited in this bibliography reveals that a rebuttal of “business ethics as an oxymoron” is the standard opening paragraph. This stigma is unfounded, and “increased stability” has characterized the state of business ethics literature during the 1990s (II. Beauchamp and Bowie 1997, p. ix). Significant attention has been given to elaborating two often overlapping theories—stakeholder and social contractarian.Originating in the 1960s as a pun on “stockholder,” proponents of stakeholder theory claim that a corporation’s fiduciary responsibility extends beyond increasing its profitability to protecting the rights of individuals or groups affected by its actions. Plato’s often-quoted statement in the Phaedrus that we should “cut up each kind according to its species along its natural joints” (265e) has become an influential metaphor in discussions of natural kinds and natural properties. In this essay, I investigate the source domain of the metaphor, the joints of the animal body, to determine if these joints are indeed “natural”—meaning that there exists a single, non-disjunctive account of joint-hood applicable to the osteological world. By examining animal joints from the perspective (...) of both the butcher and the biologist, I argue that there is no single natural division of the body into component skeletal parts. I conclude by considering what impact this result should have on our understanding of natural kinds and on the metaphors we use to describe them. (shrink)

The creation of cultural information by humans is an ability that requires to compound together different factors. Although information needs to be transmitted faithfully enough so to prevent errors, space must be left to create innovations at the same time. -/- Individual trial and error is the principal source of innovations among all primate species, especially in emulative contexts, but it does not explain the quantity, quality or rapidity of human cultural production. On the other hand, imitation and (over)imitation explain (...) quite well faithful transmission and error control but do not explain the creation of cultural novelties nor the ratchet effect of human culture. To explain these latter components, we need a combination of trial and error in emulative contexts and (over)imitation. Here we suggest that this combination of the ability in creating innovations and transmitting them faithfully occurred for the first time during the Palaeolithic. In that time frame, we can detect the establishment of imitation as the main social learning strategy in the genus Homo. Adopting a niche construction (henceforth NC) paradigm, we propose that this combination became a social characteristic of Homo sapiens which ontogenetically happens when children reach the school age in modern humans. If engaging in end of life conversations and advance care planning not only is desired by many Americans but also might significantly improve patient care at the end of life, then why was a provision that provided reimbursement for physicians to engage in end of life planning through Medicare removed from legislation? If, as some researchers have suggested, reimbursements under Medicare “would have been a start” for encouraging these conversations, then why was the Advance Care Planning Consultation provision in the (...) 2008 health reform effort so vehemently opposed by politicians and citizens alike? The heated and misleading rhetoric employed against the ACPC undoubtedly contributed to intractable polarization surrounding this portion of the health reform bill and assured its failure. But the ACPC's emphasis on “checklists” and regulation may also have served as fodder for these fiery critiques. If that's right, legislation that focuses squarely on the broader and more fundamental goals of end of life consultations and deemphasizes administrative and documentary concerns may have a greater chance for success in years to come, as health reform is implemented and the battle over the ACPC fades from memory. Ekstrom argues that incompatibilism concerning free will and causal determinism is true and thus the right account of the nature of free action must be indeterminist in nature. She examines a variety of libertarian approaches, ultimately defending an account relying on indeterministic causation among events and appealing to agent causation only in (...) a reducible sense. Written in an engaging style and incorporating recent scholarship, this study is critical reading for scholars and students interested in the topics of motivation, causation, responsibility, and freedom. This essay tells a story. It is a story of the author's experience with community supported agriculture (CSA). It is also a story that depicts the difficulties of academic activism and grass-roots engagement. As an academic and an activist, the author argues that it is important to admit and share experiences that are “less than perfect,” since they are the basis for a more complete knowledge and a more organic existence, individually, collectively, sensually, and intellectually.

This paper sketches a right-maker account of normative practical reasons along functionalist lines. The approach is contrasted with other similar accounts, in particular John Broome's analysis of reasons as explanations of oughts.

Its argument begins with a moral (...) intuition that the authors take to be near universal: "people matter." If Christian theological and ethical thought can be shown to explain and shore up the notion that [End Page 190] "people matter" better than other ethical outlooks—and the authors believe it can—then the work will have (1) established a proper moral foundation for holding and acting on the conviction that people matter and (2) provided a reasoned argument for why Christianity as a fundamental belief system is better and truer than the other ethical systems examined.The text of Why People Matter is accessible and well written. The essays weave together coherently around two central ideas: each human person has inherent, inalienable dignity, and Christianity is the truest way of understanding and acting on that conviction. To demonstrate what Christianity has to offer, the book begins (after a summative introduction by Kilner) with a set of essays describing five ethical outlooks: utilitarianism, collectivism, individualism, naturalism, and transhumanism. In each, a different author lays out an ethical foundation and concept of the outlook, shows how the concept illuminates why "people matter," explains why it may seem compelling, and argues that it fails to grasp something crucial about why people matter and how to live as if they matter. As Kilner puts it, "each [outlook] recognizes and champions something important that is missing in other ways of thinking. However, each is dangerously reductionistic by making that missing element the all-encompassing focus of its approach" (190).Next, Kilner examines the Christian conviction that every human being is made in the image of God. He argues that this conviction, rightly understood, provides the only adequate foundation for the idea that "people matter." Respect for the image of God leads to proper respect for the human rights of others. Following this, David Gushee analyzes biblical passages and themes to argue that encounters with human beings are always also encounters with God; thus, we must treat people accordingly.Why People Matter accomplishes its purpose as an apologetic, and it seems especially likely to help committed Christians understand how their moral convictions can hold up in debates with common Western philosophical ethical outlooks. A wise friend once described C. S. Lewis (referenced several times in the work) as "a master of convincing Christians that what they already believe is true." That sort of persuasion is one of the appropriate goals of apologetic, and Why People Matter seems likely to achieve it.I have two comments on areas where readers may come away unsatisfied. First, the contributors' descriptions of the ethical outlooks they discuss are necessarily brief; those who hold these outlooks would likely wish to quibble with or nuance their arguments. Second, the work addresses only Western philosophical outlooks; the authors do not engage non-Christian religious traditions. In the spirit of interreligious cooperation, this is an excellent decision: frankly, I would not want to read a work that spent several chapters explaining why Christian ethical thought is superior to the ethical thought of, say, Hinduism or Judaism. But the work does leave unanswered, and unasked, the question [End Page 191] of whether a reader who does come to reject individualism, transhumanism, and so on might not just as well embrace Islam or Buddhism as Christianity.That said, this is an engaging work on the title question. The conjunction of Schrodinger dynamics and the usual way of thinking about the conditions under which quantum systems exhibit determinate values implies that measurements don't have outcomes. The orthodox fix to this quantum measurement problem is von Neumann's postulate of measurement collapse, which suspends Schrodinger dynamics in measurement contexts. Contending that the fundamental dynamical law of quantum theory breaks down every time we test the theory empirically, the collapse postulate is unsatisfactory. Recently philosophers and physicists have proposed a less violent (...) solution to the measurement problem. Their modal interpretations of quantum mechanics advocate unusual ways of thinking about the situations under which quantum systems exhibit determinate observable values, semantics which reconcile determinate measurement outcomes with universal Schrodinger dynamics. Thus modal interpretations hold out hope that quantum theory is complete and exceptionless. ;This dissertation tempers that hope. I consider the modal approach to the neglected problem of state preparation. A promising modal account exploits standard quantum transition probabilities. But, I claim, modal interpretations must subject these transition probabilities to a consistency constraint which they can be shown to violate. Non-standard transition probabilities might avoid this inconsistency, but they would also introduce novel dynamics, and so undo the modal triumph of taking Schrodinger dynamics to be complete and universal. Next I consider Albert and Loewer's assault on modal accounts of "error-prone" measurements. I argue that the Albert-Loewer problem is more general than Albert, Loewer, or their critics appreciate, and that the Araki-Yanase theorem implies the existence of a class of observables whose error-free measurements succumb to the Albert-Loewer problem. I review modal responses to Albert and Loewer which appeal to the palliative effects of a decohering environment and find them incomplete. Finally, based on the physicist Anthony Leggett's work with SQUIDs, I present a system concerning which the empirical commitments of modal interpretations contradict those of the quantum statistical algorithm, minimally interpreted. I conclude that these modal difficulties can be resolved only by taking the quantum formalism to be incomplete. (shrink)

Characterizing the biopolitical chiefly as a move from the juridical toward the normalizing, Bazzicalupo both critiques recent neomaterialist theorizations of biopower as vitalist and singles out some currents of feminist thought for their modern, anticommunitarian bias. A discussion of Arendt's analysis of depoliticization is then taken up from the perspective of immunity, one indebted to the thought of Roberto Esposito. She (...) concludes with a spirited defense of aesthesis, which she defines as the creative assimilation of the other and an active reactivity, and an argument in favor of a non-normative ethics capable of resolving some of the most glaring ambivalences of biopolitics.
