The processing of sensitive information in the health field is subject to rigorous standards that guarantee the protection of information confidentiality. Recently, the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) stated their formal opinion on a standard procedure in dental offices involving the submission of a questionnaire that includes the patient's health status. HIV infection status is included on the form. The Authority has stated that all health data collection must be in accordance with the current (...) Italian normative framework for personal data protection and respect the patient's freedom. This freedom allows the patient to decide, in a conscious and responsible way, whether to share health information with health personnel without experiencing any prejudice in the provision of healthcare requested. Moreover, data collection must be relevant and cannot exceed the principles of treatment goals with reference to the specific care of the concerned person. However, the need for recording information regarding HIV infection at the first appointment, regardless of the clinical intervention or therapeutic plan that needs to be conducted, should not alter the standard protection measures of the healthcare staff. In Italy, consent for health treatment, aside from being an ethical and deontological obligation, constitutes an essential requirement for any medical treatment according to articles 13 and 32 of the National Constitution and also in accordance with the Council of Europe's ‘Convention on Human Rights and Biomedicine’. An essential requirement for the validity of consent is that clear, exhaustive and adequate information be provided to the patient himself: the practice of informed consent is a communicative relationship in which the patient (...) can express doubts, perplexities and clarification requests to the dentist. Furthermore, dental treatment has specific peculiarities: the relationship between dentistry and aesthetics, the concomitant presence of pathologies requiring different treatments, the elongated care process and the establishment of a trustworthy relationship and familiarity with the patient represent important aspects in the configuration of the dentist-patient relationship and in the process of acquiring informed consent. The dentist must offer correct information on diagnosis, prognosis, the therapeutic perspective and the likely consequences of therapy, alternative therapy and refusal of therapy, as well as eventual commitments for the period after treatment. Particular consideration must be given to minors and patients of unsound mind: the dentist's approach to these patients needs to be clear and appropriate to the person's age and understanding ability, even if the decisional power for sanitary treatment may be in the hands of a third person. : Today’s debate on empathy is characterized by an interplay between neuroscience, philosophy of mind and phenomenology that has led to several distinct definitions of empathy. Much of the difficulty in defining empathy is due to the emphasis on its prosocial value, a feature that has made it a “keyword” of our time. Does the role empathy has been assigned in social interactions imply its involvement in matters of identity, similarity and affective resonance? What happens when the flow of sensations (...) and emotions between humans produces more complex interactions and gives rise to feelings of estrangement, facing the unknown, or a fear of others? We need a paradigm shift in which we consider empathy in practice, rather than theory. We need to consider how various empathies arise in different contexts and manifest in diverse ways. In this way, we can shed light on the limits and failures of mutual comprehension, and arrive at a more radical and realistic vision of the great challenge involved in relating to others. In this paper, we identify and examine an overlooked strategy to counter bigoted speech on the spot. Such a strategy we call ‘bending’. To ‘bend’, in our sense, is to deliberately give a distorted response to a speaker’s harmful move – precisely, an ameliorative response, which may turn that move into a different, less harmful, contribution. To substantiate our proposal, we distinguish two ideas of uptake – interpretation and response – and argue for the general claim that a distorted response (...) on the hearer’s part may end up transforming a speaker’s contribution. Patterns of distortion have been analyzed in the literature as unjustly undermining speakers’ agency and exacerbating oppression. Our analysis shows that, under certain circumstances, distortion can be employed to derail bigoted speech and thus serve the purposes of social justice. We close by discussing the virtues and limits of bending vis-à-vis a different, much-discussed, counterspeech strategy, i.e. ‘blocking’ (Langton 2018). (shrink)

The central aim is to show the extent and power of arguments from evil. The book provides a close investigation of an under-defended claim at the heart of the major free-will-based responses to such arguments, namely that free will is sufficiently valuable to serve as the good, or prominently among the goods, that provides a (...) God-justifying reason for permitting evil in our world. Offering a fresh examination of traditional theodicies, it also develops an alternative line the author calls a divine intimacy theodicy. It makes an extended case for rejection of the position of skeptical theism. The book expands upon an argument from evil concerning a traditional doctrine of hell, which reveals a number of interesting issues concerning fault, agency, and blameworthiness. In response to recent work contending that the problem of evil is defanged since God's baseline attitude toward human beings is indifference, the book defends the essential perfect moral goodness of God. We are at a turning point in the debate on the ethics of Artificial Intelligence (AI) because we are witnessing the rise of general-purpose AI text agents such as GPT-3 that can generate large-scale highly refined content that appears to have been written by a human. Yet, a discussion on the ethical issues related to the blurring of the roles between humans and machines in the production of content in the business arena is lacking. In this conceptual paper, drawing on (...) agenda setting theory and stakeholder theory, we challenge the current debate on the ethics of AI and aim to stimulate studies that develop research around three new challenges of AI text agents: automated mass manipulation and disinformation (i.e., fake agenda problem), massive low-quality content production (i.e., lowest denominator problem) and the creation of a growing buffer in the communication between stakeholders (i.e., the mediation problem). In this paper, I analyse a specific kind of loneliness that can be experienced in the networked life, namely “extended loneliness”. I claim that loneliness—conceived of as stemming from a lack of satisfying relationships to others—can arise from an abundance of connections in the online sphere. Extended loneliness, in these cases, does not result from a lack of connections to other people. On the contrary, it consists in the complex affective experience of both lacking and longing for meaningful relationships while (...) being connected to many people online. The recursive interaction with a digital assistant in a smart flat is my key example for defining the contours of this specific kind of loneliness that emerges when hyperconnectivity becomes pervasive in the user’s daily-life. Drawing on Sherry Turkle’s work and employing the conceptual framework of the extended mind, I analyse the specific characteristics of extended loneliness and explore its phenomenology. (shrink)

The definitions and conceptualizations of health, and the management of healthcare have been challenged by the current global scenarios (e.g., new diseases, new geographical distribution of diseases, effects of climate change on health, etc.) and by the ongoing scholarship in humanities and science. In this paper we question the mainstream definition of health adopted by the WHO—‘a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity’ (WHO in Preamble to the constitution of (...) the World Health Organization as adopted by the international health conference, The World Health Organization, 1948)—and its role in providing tools to understand what health is in the contemporary context. More specifically, we argue that this context requires to take into account the role of the environment both in medical theory and in the healthcare practice. To do so, we analyse WHO documents dated 1984 and 1986 which define health as ‘coping with the environment’. We develop the idea of ‘coping with the environment’, by focusing on two cardinal concepts: adaptation in public health and adaptivity in philosophy of biology. We argue that the notions of adaptation and adaptivity can be of major benefit for the characterization of health, and have practical implications. We explore some of these implications by discussing two recent case studies of adaptivity in public health, which can be valuable to further develop adaptive strategies in the current pandemic scenario: community-centred care and microbiologically healthier buildings. Through a discussion of the socially extended mind, this paper advances the “not possible without principle” as an alternative to the social parity principle. By charging the social parity principle with reductionism about the social dimension of socially extended processes, the paper offers a new argumentative strategy for the socially extended mind that stresses its existential significance. The “not possible without principle” shows that not only is something _more_ achieved through socially located processes of knowledge building, but also that, and (...) more importantly, what is achieved is something that _would not have been possible without_ social interaction_._ The social parity principle states that the result of an activity achieved via social interaction should be assumed functionally equivalent to a solitary investigation and is characterized by multiple realisability. Contrary to the social parity principle, the “not possible without principle” holds that the result would not have been achieved without the social interaction between (at least) two agents with specific existential needs. The socially extended mind never happens in a void. This means that the "not possible without" principle should be located in real-life, affectively charged, embodied experiences of skilful interactions between agents. This fundamental conceptual change via reference to the “existential necessity” that regulates socially extended processes is necessary in order to effectively lead the socially extended mind to a truly embedded and embodied account. In recent years, political philosophers have been fiercely arguing over the virtues and vices of utopian vs realistic theorizing. Partly due to the lack of a common and consistently used vocabulary, these debates have become rather confusing. In this chapter, I attempt to bring some clarity to them and, in doing so, I offer a conciliatory perspective on the “utopian vs realistic theorizing” controversy. I argue that, once the notion of a normative or evaluative theory is clearly defined and distinguished (...) from the desiderata that any good theory should satisfy, many of the disagreements between supporters and opponents of “utopian” or “ideal” theorizing can be easily dissolved. I conclude that, in general, political philosophers should be cautious when theorizing at the extreme ends of the “utopian-realistic” spectrum, but that, setting extremes aside, the correct level of realism or idealism depends on the particular question a theory aims to address. The view that emotions can provide defeasible justification for evaluative beliefs is widespread in the emotion literature. Despite this, the question of whether epistemic emotions can provide defeasible justification for theoretical beliefs has been almost entirely ignored. There seems to be an implicit consensus that while emotions may have justificatory roles to play in the former case, they have no such roles to play in the latter case. Here, I argue against this consensus by sketching a proposal for securing epistemic (...) emotions justificatory roles. (shrink)

Constructivism as a distinct metaethical position has garnered significant interest in recent years due in part to Sharon Street’s theory, Humean metaethical constructivism. According to Street’s account, practical reasons are constructed by individual valuing entities. On this view, then, whether a particular reason applies to an individual is completely contingent upon what that individual actually values. In this article I argue for the recognition of multiple sources of practical reasons and values, including both individuals and communities. The resulting view, which (...) I call layered constructivism, strengthens the constructivist project and begins to resolve some of the common critiques leveled against Street’s Humean constructivism. To begin, layered constructivism retains many of the benefits of Street’s approach, such as providing a naturalistic picture of normativity and maintaining a close tie between practical reasons and individual motivation. Moreover, the inclusion of collective sources of normativity and the importance of the resulting values for individuals is supported by recent empirical research on norms. Layered constructivism can also respond to the common concerns that Humean constructivism fails to adequately account for the immense influence our social lives have on our normative reasons and values, and that it entails an objectionable level of contingency. Finally, acknowledging the existence of differently constructed reasons helps us make sense of the pervasive human experience of navigating a variety of seemingly incommensurable normative reasons. In recent years, discussion around memory modification interventions has gained attention. However, discussion around the use of memory interventions in the criminal justice system has been mostly absent. In this paper we start by highlighting the importance memory has for human well-being and personal identity, as well as its role within the criminal forensic setting; in particular, for claiming and accepting legal responsibility, for moral learning, and for retribution. We provide examples of memory interventions that are currently available for medical (...) purposes, but that in the future could be used in the forensic setting to modify criminal offenders’ memories. In this section we contrast the cases of dampening and enhancing memories of criminal offenders. We then present from a pragmatic approach some pressing ethical issues associated with these types of memory interventions. The paper ends up highlighting how these pragmatic considerations can help establish ethically justified criteria regarding the possibility of interventions aimed at modifying criminal offenders’ memories. Although recent work has been done on the Barnes Foundation and its philosophical and pedagogical background, almost all the research effort has been focused on the friendship and intellectual link between John Dewey and Albert C. Barnes. Unfortunately, to the best of our knowledge, the impact of George Santayana’s philosophy on the Foundation has not been systematically examined. The hypothesis that we present and develop in this article is that Santayana’s thought is essential for the aesthetic theories elaborated within the (...) framework of the Barnes Foundation: Barnes’ theory of art criticism; Dewey’s aesthetic theory, and even Lawerence Buermeyer’s aesthetic theory. This article is a first approximation with the purpose of clarifying these philosophical, theoretical and historical relationship so as to start to fill the existing gap in contemporary literature on the topic. Today political theorists and the public generally often associate descriptive representation with democracy. However, in Victorian Britain supporters of descriptive representation tended to be arrayed against democracy. The impression that democracy was incompatible with descriptive representation and a set of related values, primary among which was deliberation, formed one of the great obstacles which democratic theory faced in this period. These values belonged to a traditional theory of representation which held that Parliament ought to be a mirror of the nation (...) in its diversity and which judged democracy, in contrast, to be an illiberal mode of regulating the franchise because it risked handing the representation wholly to one part or class within society. In response to this school of thought, democratic theory developed two conflicting responses: first, that democracy could accommodate social and ideological diversity; second, that democracy was irreconcilable with the goal of mirroring diversity, but that nevertheless democracy had to be preferred on grounds of fairness and non-arbitrariness. The psychological factors influencing a return to sport has gained increased research attention. In the current investigation, we explored professional basketball players’ perceptions of the psychological factors facilitating a return to performance equal to or exceeding previous performance standards. We also sought to describe athletes’ experiences – both positive and negative – of returning to sport following injury recovery. Ten Italian professional male basketball players (age range 22-36 years), were retrospectively interviewed in relation to three time-periods: (1) from the commencement (...) of rehabilitation to their first official competition, (2) the first official competition, and (3) the six-months following the initial competition. Hierarchical content analysis of the data revealed numerous themes across the three time periods. In regards to Period 1, participants indicated that social support, investment in rehabilitation and training programs, coping skills and motivation were fundamental in reaching pre-injury performance levels. During their first official game (i.e. Period 2), athletes reported that realistic performance expectations, focusing on the performance, positive emotions, motivation, arousal and social support facilitated their return to sport. Athletes however, also described a predominance of factors that hindered their return to pre- injury levels (i.e., low confidence in personal abilities, decrements in skill execution and dysfunctional physical sensations). Moreover, participants typically described a substandard level of performance during their first competition back following injury. In recounting experiences during the six months following their first official game, basketballers reported improvements in skill execution and highlighted the importance of coping skills, motivation and social support. The process of restoring self-confidence in one’s ability to successfully perform was perceived as crucial in enabling participants to move beyond a mere return to sport to a return to high performance ─ that is, to reach a level of proficiency equal to or exceeding previous performance standards. Findings support the relevance of cognitive, emotional and behavioral responses highlighted in the Integrated Model and suggest the importance of addressing psychological factors throughout the return-to-sport process. Finally, results from the present study hold a number of practical implications for athletes’ aiming to achieve a return to pre-injury levels. (shrink)

In this text, Jacques Rancière critically discusses the work of Georges Didi-Huberman on images. He disagrees with various claims seemingly made by Didi-Huberman about images, such as that they can “take position” or that they are “active.” Rancière argues that Didi-Huberman adds another form of dialectics to the simpler form of dialectics adopted by Bertolt Brecht and Harun Farocki in their works, namely one that also involves a layering of different temporalities. However, both in Brecht’s War Primer and in Didi-Huberman’s (...) analysis of it, all the potencies credited to images as such are actually potencies of the words that accompany the images. Rancière comes to the conclusion that to “put images in motion,” as Didi-Huberman wants to do, or to regard them as being “active,” he has to put words, his own poetic and extensive writings, in motion. In this chapter, I focus on the faculties by which we gain knowledge, namely, sensibility and the understanding, as well as on the methodological framework within which Sor Juana Inés de la Cruz examines them. I stress the importance that the author gives to sensibility and the physiological apparatus that grounds and explains sensation.With respect to her conception of understanding, I will show that it is both the sign of man’s filiation with God and a faculty that displays deficiencies and (...) limitations with respect to the difficult task of attaining knowledge.Finally, I examine Sor Juana’s criticism both of the Neoplatonic method, which looks for a vision of the universe as a whole, as well as of the deductive method of the Aristotelian- Scholastic tradition, which attempts to reduce the unmanageable diversity of beings to some specific characteristics and laws.My conclusion is that Sor Juana shares with modern philosophers the critical attitude against tradition; she holds that traditional methods do not enable us to reach knowledge about either the remotest causes or the closest effects. On my view, Sor Juana takes an epistemological approach to philosophy, as do Bacon and Descartes, but she does not propose a new method; this is not because of some radical skepticism on her part, but because of the enormity of the task of the human mind achieving complete knowledge. PURPOSE: The purpose of this paper is to consider some of the philosophical and bioethical issues raised by the creation of the draft social values framework developed to facilitate data collection and country-specific presentations at the inaugural workshop on "Social values and health priority setting" held in February 2011. -/- DESIGN/METHODOLOGY/APPROACH: Conceptual analysis is used to analyse the term "social values", as employed in the framework, and its relationship to related ideas such as moral values. The structure of the framework (...) (process and content values) is considered in light of current debate in philosophy and bioethics about the political and moral aims served by these kinds of values, and the extent to which they are either suited to, or sufficient for, the policy context. -/- FINDINGS: There is much to be gained by engaging with the arguments presented in the philosophical literature in order to further refine the framework. The framework should remain neutral in respect of the importance of procedural values in different contexts and should be as inclusive as possible in respect of the principles it includes. Further development would be best served by taking a multidisciplinary approach. The framework could provide a valuable space in which future debates about procedural/substantive values can be considered. -/- ORIGINALITY/VALUE: The paper brings philosophical and bioethics perspectives to bear on a new framework proposed for the analysis of social values in health priority setting. It identifies how such a practical, policy-focused framework might be informed by engagement with deeper, and often unresolved, questions or principle around resource allocation in health. (shrink)

Research ethics consultation is increasingly recognized as a potentially valuable mechanism for addressing the depth and breadth of ethical issues that arise in research related to human health and well-being. However, fundamental questions remain, including: What is “research ethics consultation”? And what is its justification beyond the purposes already served by existing entities? We examine how a research ethics consultation service may differ from or complement the role of an institutional review board by offering a definition of research ethics consultation (...) and by exploring the potential scope of a consultation service in terms of types of clients served, questions addressed, and advice provided at various stages of the research process. We then consider the relationship between research ethics consultation services and IRBs, as well as the issues that may arise between them, including possible conflicts of interest. (shrink)

The woman at the heart of Pearl Jam’s “Better Man” (Vitalogy, 1994) is trapped. She has committed herself to a relationship that makes her miserable, but she sees no viable alternative to staying in it. She mourns a past self who might have been able to leave and dreams of a dierent way things might be, but remains unable to move on. It is tempting to view her with a mixture of pity and frustration (reecting some of the personal circumstances (...) -- Eddie Vedder’s mother’s second marriage -- informing its composition). As a moral being, she appears to be hopelessly compromised by her situation, even as she is also doing her best to survive under conditions designed to undermine her autonomy and keep her trapped (as abusive relationships do). The song is not so much critical of her choice to stay as it is confused by and resigned to it. -/- What keeps a person where she so clearly does not want to be? -/- The song itself was, at least early in its recorded life for Pearl Jam, similarly compromised. Vedder appears to have thought of it as too “accessible”, too much of a pop hit for the kind of musical vision he had in mind either for Vs. (for which it had originally been intended) or for Vitalogy; by this point in the band’s career, he was ever more actively resisting success, accessibility, and everything that went with the version of rock star life imposed collectively on the band and on him as an individual. The form that resistance took was an exercise of artistic and other forms of control, sometimes exercised in ways that were destructive or damaging (to the band and its internal relationships, its fame or success, its image, its artistic identity, etc.). -/- What keeps an artist or a band where they so clearly do not want to be? In this chapter, I oer a loose exploration of some possible philosophical approaches to answering the question of what keeps us where we are, like it or not, worked out in parallel through the lyrics of “Better Man” and the circumstances of the song’s eventual arrival Vitalogy. My main interest is in examining the ethical dimensions of the question itself -- what, if anything, are we morally required or expected to do under compromised or compromising conditions? My main suggestion is that answering the question might require of us a messier, more ambivalent, and perhaps more compassionate notion of moral agency, inspired by Simone Weil’s work on affliction. We surveyed IRB chairs' perspectives on offering individual genetic research results to participants and families, including family members of deceased participants, and the IRB's role in addressing these issues. Given a particular hypothetical scenario, respondents favored offering results to participants but not family members, giving choices at the time of initial consent, and honoring elicited choices. They felt IRBs should have authority regarding the process issues, but a more limited role in medical and scientific issues.

The essay examines contemporary Arab films that express the body's forces. One strategy, common with other world cinemas, is that films carry out different operations at the molar and molecular levels, which correspond to different levels of embodiment and body politics. Another, more unique to Arab cinema, is to cultivate strategies of protecting and enfolding bodies, similar to what Foucault termed ars erotica. Third, they enlist the audience in a struggle to attain what Spinoza called ‘adequate ideas’, ideas that arise (...) immanently from the body's capacities. (shrink)

Significant amounts of wealth have been exchanged as part of marriage settlements throughout history. Although various models have been proposed for interpreting these practices, their development over time has not been investigated systematically. In this paper we use a Bayesian MCMC phylogenetic comparative approach to reconstruct the evolution of two forms of wealth transfers at marriage, dowry and bridewealth, for 51 Indo-European cultural groups. Results indicate that dowry is more likely to have been the ancestral practice, and that a minimum (...) of four changes to bridewealth is necessary to explain the observed distribution of the two states across the cultural groups. The idea that guides this paper is that visual images of law have contributed in a very important way to the creation of a mental image of law that supports the belief in an obligation to obey the law. My purpose is: first, to identify and to analyse the visual representation of law and the messages they convey. Second, attempt to find out how they shape the mental image we have of law by following the construction of judicial space and, (...) then, through the iconography of law in order to understand how they build the belief that there is an obligation to obey the law; hence the idea that law has authority.Resumen:La idea central de este ensayo es que las imágenes visuales del derecho han contribuido en un modo importante a la creación de una imagen mental del derecho que apoya la creencia de que hay una obligación de obedecer el derecho. Así, el propósito de la autora es: primero, identificar y analizar la representación visual del derecho y los mensajes que ellas transmiten. Segundo, tratar de averiguar cómo estas representaciones conforman la imagen mental que tenemos del derecho: siguiendo la distribución del espacio judicial y, entonces, a través de la iconografía del derecho para comprender cómo construyen la creencia de que hay una obligación de obedecer el derecho; y por lo tanto la idea de que el derecho tiene una autoridad. Relevance Theory makes one of the strongest defenses of the thesis of local linguistic underdetermination. According to this thesis, the intuitive concept expressed by a lexical item in the utterance of a sentence is an ad hoc concept. Ad hoc concepts result from a linguistically free pragmatic process. The postulation of ad hoc concepts is due to the fact that the sort of cognitive organization they introduce is held as necessary to satisfy the demands that, for this Theory, imposes the (...) understanding of intuitive concepts. Here I propose that our cognitive system can satisfy these demands without tolerating propositions basically determined by ad hoc concepts. I also suggest that the information provided by ad hoc concepts is dispensable for the understanding of intuitive concepts. Finally, I propose a local lexical position according to which, the intuitive concept expressed by a lexical item is the concept lexically associated with that item. (shrink)

During the pandemic, civil society organisations adjusted their purpose to provide support to the most vulnerable. In the midst of the first wave, Superbergamo, an initiative that grew out of local activist associations, provided groceries and medicine to the elderly, the infirm and at-risk groups during the lockdown in Bergamo, Italy. This research analyses a newspaper article from Corriere della Sera published almost two years after the event, which tells the story of Stefano ‘Kino’, one of the volunteers of Superbergamo. (...) Using Critical Discourse Analysis, we show how the mainstream media normalised the story of Superbergamo to transform a critical, radical, leftist mutual aid practice, into an example of charitable volunteering. By omitting and recontextualising central elements, the article inscribed the mutual aid practice in a catholic narrative, stripping it of any critical afflatus of the status quo. Reframed within the catholic vocabulary by the Corriere della Sera’s weekly insert ‘good news’, the story of Superbergamo becomes one that reinforces the common sensical model of catholic charitable volunteering.
