As far as we know, the 5th-century B.C. Greek philosopher Socrates himself wrote nothing. We discover his thoughts and deeds entirely through the writings of his followers, disciples who accompanied him on his walks through the Athenian Agora and engaged in dialogue with him in the Stoa Basileios. Rather than examining his ideas in abstract, this stimulating little book aims to place Socrates in his physical setting, using textual references to follow his progress through the material remains that have been (...) uncovered by the American School of Classical Studies at Athens since 1931. The author not only sheds new light on the great philosopher's life, but also provides a vivid reconstruction, through following the career of one of its most famous citizens, of daily life at the center of classical Athens. Decisions about continuing or terminating a pregnancy touch on profound, individualized questions about bodily integrity, reproductive autonomy, deeply held values regarding one's capacity for parenthood, and, in the case of a high-risk pregnancy, the risks one is willing to take to have a baby. So far as possible, reproductive decisions are made between a patient, in some cases her partner, and her medical provider. However, this standard framework cannot be applied if the patient lacks decision-making capacity. In this essay, we (...) discuss one such case that came before our clinical ethics team. We describe the challenges of respecting a patient's reproductive preferences when the patient cannot share what those preferences are, and we argue that decisions regarding reproductive health care should not be treated with exceptionalism. Rather, they should proceed under the normal processes of surrogate decision-making, including the application of substituted judgment. This approach enables us to take the patient's values into account when considering the questions implicated in reproductive health care, just as we do for other kinds of health care decisions in which a patient's deeply held values are salient. Thucydides' account of the Athenian general Phrynichus' secret correspondence with the Spartan admiral Astyochus is both troubling and obscure. It may be summarized as follows: Phrynichus, having eloquently opposed Alcibiades' efforts to be recalled from exile and fearing that a repatriated Alcibiades would take vengeance on him, wrote to Astyochus revealing Alcibiades' pro-Athenian activities. Astyochus handed the letter to Alcibiades, who then wrote to the ranking Athenians on Samos concerning Phrynichus' ‘treason’ and demanded his execution. Phrynichus then wrote again to (...) Astyochus, now proposing to make it possible for the Spartans to destroy the whole Athenian force at Samos. (shrink)

There are in the Iliad nine examples of individuals, either human or divine, who recount their ancestry in some detail. The overlap of situation, assertion and vocabulary among these nine examples seems to be sufficient to constitute a theme of lineage-boasting.

Published in 1913 as _La Philosophie Bergsonienne_, this incisive critique of the thought of Henri Bergson was Jacques Maritain's first book. In it he shows himself already to have an authoritative grasp of the thought of St. Thomas Aquinas and an uncanny ability to demonstrate its relevance to alternative philosophical systems such as that of Henri Bergson. Volume 1 in the series _The Collected Works of Jacques Maritain_, this edition faithfully reproduces the 1955 translation published by the Philosophical Library. It (...) would be difficult to overestimate Bergson’s role in extricating French philosophy from the deadening materialism that dominated the Sorbonne. It was that cultural milieu that brought Maritain and his wife Raïssa to the brink of suicide. They drew back for two major reasons. First were the lectures of Henri Bergson at the Collège de France, in which the Maritains found a defense of metaphysics, of the transcendent beyond the material, within which they could find meaning in life. The second reason was their conversion to Catholicism, a move they and many of their contemporaries made after being introduced to Bergson’s work. Soon after his conversion, Jacques Maritain immersed himself in the thought of Thomas Aquinas and was struck by the comparative weaknesses of Bergson. This book is Maritain’s relentless criticism of the philosophy of the man whose lectures had meant so much to him. Its ferocity marks it as a young man’s book, written in part to exorcize the defects of Bergson’s philosophy as they were understood by one now schooled in Thomism. Twenty-five years later, Maritain, while not retracting his criticisms, regretted their intemperance and, as a result, moderated his assessment of Bergson in a long preface to the second edition. The coronavirus disease (COVID-19) crisis provoked an organizational ethics dilemma: how to develop ethical pandemic policy while upholding our organizational mission to deliver relationship- and patient-centered care. Tasked with producing a recommendation about whether healthcare workers and essential personnel should receive priority access to limited medical resources during the pandemic, the bioethics department and survey and interview methodologists at our institution implemented a deliberative approach that included the perspectives of healthcare professionals and patient stakeholders in the policy development process. Involving (...) the community more, not less, during a crisis required balancing the need to act quickly to garner stakeholder perspectives, uncertainty about the extent and duration of the pandemic, and disagreement among ethicists about the most ethically supportable way to allocate scarce resources. This article explains the process undertaken to garner stakeholder input as it relates to organizational ethics, recounts the stakeholder perspectives shared and how they informed the triage policy developed, and offers suggestions for how other organizations may integrate stakeholder involvement in ethical decision-making as well as directions for future research and public health work. Cet article traite d’un mythe cosmogonique où un dragon mapuche, le Kai Kai Filu, appartenant à la Patagonie argentine et chilienne, est signalé comme le responsable du déluge, de la montée des eaux et de la formation des golfes, îles et autres accidents géographiques. Un suivi du mythe montre qu’avec les frontières dressées entre ces deux pays, les populations originaires se sont fragmentées ainsi que leurs récits millénaires. Le résultat est que l’Argentine présente un mythe segmenté, plus proche des mythes (...) occidentaux et le sud du Chili nous raconte une version plus ancienne, faisant basculer le sens de la figure du dragon et sa forme dans un glissement symbolique significatif. Ce mythe vit de manière permanente et apparaît dans de nombreuses narrations locales, narrations qui vont témoigner de la vitalité du mythe : il change et se renouvelle selon les mouvements de la terre et les tsunamis qui se succèdent dans cette région du Sud. Les versions s’enrichissent quand les changements des structures économiques bouleversent la vie des habitants et que de nouveaux éléments apparaissent dans les contes populaires, revigorisant le mythe originel. Conceptions of autonomy in western philosophy and ethics have often centred on self-governance and self-determination. However, a growing bulk of literature also questions such conceptions, including the understanding of the autonomous self as a self-governing independent individual that chooses, acts, and lives in accordance with her or his own values, norms, or sense of self. This article contributes to the critical interrogation of selfhood, autonomy, and autonomous decision making by combining a feminist focus on relational dimensions of selfhood and autonomy (...) with phenomenological philosophy of the embodied self as being-in-the-world. It offers a philosophical investigation of different dimensions of bodily relational autonomy by turning to phenomenological accounts of the lived body as self-reflexive. When so doing, we hope to contribute to bridging the gap that sometimes exists between discussions of autonomy in analytic moral philosophy and of freedom and facticity in phenomenological philosophy. We see this gap as unfortunate, and hold that a nuanced understanding of autonomy and autonomous decision making can be reached if these strands of philosophy are brought into dialogue. (shrink)

The risks taken into account in legal decision-mak- ing are, often, matters of life and death, but the way we think about risk is flawed. This is a problem. The dominant account of how emotions are involved in risky decision-making follows the standard probabilistic account of risk. If we entertain a modal ac- count of risk, however, this changes the way in which a host of legal actors—members of the jury, judges, defendants, lawyers, legislators, regulators, and police—ought to think about (...) how emotions impact risk evaluation. In what follows, I examine what taking a modal account of risk would mean for the way we under- stand emotions in the evaluation of legal risk: specifically, the risk of wrongful conviction. The present chapter draws on contemporary research in the epistemology of risk to examine how emotions can influence the evaluation of legal risk. I first review a distinction between two understandings of risk—the probabilistic account and the modal account—and demonstrate how the probabilistic account is in- complete. Next, I highlight how emotion can be seen to mediate decision-making in a series of empirical studies on the assessment of gruesome photographic evidence. I then analyse the standard accounts of how emotions play a role in risk assessment, which build upon a probabilistic account of risk. A modal account of risk and emotion is then offered, demonstrating the ways in which emotions can contribute to the evaluation of risk understood modally. Finally, I consider what legal practices and structures need to be refined or abandoned in order to facilitate the condi- tions most conducive to harnessing the evaluative power of emo- tions in legal decision-making. Montesquieu's Persian Letters has long been thought to conceal a secret chain uniting the various letters which comprise the work. An examination of the historical context of the Persian Letters, the characters' remarks on justice and self- interest, and the important literary techniques that Montesquieu employs, helps to bring the secret chain to light. The work's letters are written and sequenced to show how self-interest can overawe justice, emphasizing the need for fair and reasonable third party involvement in order to (...) achieve justice in human affairs. Montesquieu calls upon readers to serve as the final link in this chain, prompting the reader ultimately to consolidate the Persian Letters' treatment of politics, philosophy and morality. (shrink)
