Kentucky Association of Health Plans, Inc. v. Miller.Valerie Gutmann - 2003 - Journal of Law, Medicine and Ethics 31 (4):729-731.
In Kentucky Association of Health Plans, Inc. v. Miller,, the Supreme Court unanimously held that states’ “any willing provider” laws are not preempted by the Employee Retirement Income Security Act of 1974. The Court ruled that states can regulate their health maintenance organizations, and thus upheld a Kentucky law that requires insurers to reimburse services of any health care provider who is willing and able to meet established criteria. The Supreme Court has heard several cases related to ERISA (...)

Opioid-Related Legislation in Kentucky and West Virginia: Assessing Policy Impact.Julia F. Costich & Dana Quesinberry - 2019 - Journal of Law, Medicine and Ethics 47 (S2):36-38.
Kentucky and West Virginia are among the states most severely affected by opioid poisonings and deaths. The legislatures of both states have enacted a broad range of bills intended to address related issues. We present an overview of legislation enacted in 2017 and 2018, along with an approach to analysis of practitioner response to one type of legislation.

Sitting Downtown at Kentucky Fried Chicken.Kevin S. Decker - 2013 - In Robert Arp & Kevin S. Decker (eds.), The Ultimate South Park and Philosophy. Wiley. pp. 194–207.
Like many episodes of South Park, “Medicinal Fried Chicken” drags real political scenarios into the cold, hard light of the Rocky Mountains. In this chapter, the author aims at challenging the received interpretation of the moral message behind “Medicinal Fried Chicken” and many other South Park episodes, the message that legislating lifestyles is immoral at worst and ridiculous at best. This message is encapsulated by the moral perspective known of libertarianism, which takes individual rights in political and social scenarios to (...)

An Analysis of Social Capital Generation among Coalfield Residents in Harlan County, Kentucky.Feng Hao - 2015 - International Journal of Social Quality 5 (1):67-83.
The coal industry exercises a pervasive influence upon mining communities in Appalachia even though it makes minimal contributions to employment. Miners rarely participate in movements that fight against coal companies for better working conditions. One explanation for this paradox is the depletion of social capital. In this article, I first use the existing body of literature to build a theoretical framework for discussing bonding social capital. Second, I analyze how the United Mine Workers of America in Harlan County, Kentucky (...)

An Evaluation of the Impact of End-Of-Course Exams and Act-Qualitycore on U.S. History Instruction in a Kentucky High School.Rebecca G. W. Mueller & Lauren M. Colley - 2015 - Journal of Social Studies Research 39 (2):95-106.
The growth of high-stakes testing in state accountability systems necessitates further examination of their impact on stakeholders. Prompted by broader state-level reform in Kentucky, this evaluation aims to provide insight into a new accountability system's effect on social studies teachers. Using a goal-free evaluation model and case study design, the researchers examined the content and instructional decisions made by a group of U.S. history teachers in response to a new end-of-course exam designed by ACT-QualityCore. The evaluation incorporated a content (...)

Doing masculinity: gendered challenges to replacing burley tobacco in central Kentucky.Ann K. Ferrell - 2012 - Agriculture and Human Values 29 (2):137-149.
This paper offers a case study based on qualitative research in the burley tobacco region of central Kentucky, where farmers are urged to diversify away from tobacco production. “Replacing” tobacco is difficult for economic and material reasons, but also because raising tobacco is commensurate with a locally valued way of doing masculinity. The focus is on these two questions: How can the doing of work associated with tobacco production and marketing be understood as also doing a particular masculinity? What (...)
