In Kentucky Association of Health Plans, Inc. v. Miller,, the Supreme Court unanimously held that states’ “any willing provider” laws are not preempted by the Employee Retirement Income Security Act of 1974. The Court ruled that states can regulate their health maintenance organizations, and thus upheld a Kentucky law that requires insurers to reimburse services of any health care provider who is willing and able to meet established criteria. The Supreme Court has heard several cases related to ERISA (...) in the last few years, and other such cases are working their way through the court system. Coupled with this most recent decision in Miller, the Supreme Court may significantly alter the shape of the insurance industry. (shrink)

Kentucky and West Virginia are among the states most severely affected by opioid poisonings and deaths. The legislatures of both states have enacted a broad range of bills intended to address related issues. We present an overview of legislation enacted in 2017 and 2018, along with an approach to analysis of practitioner response to one type of legislation.

Like many episodes of South Park, “Medicinal Fried Chicken” drags real political scenarios into the cold, hard light of the Rocky Mountains. In this chapter, the author aims at challenging the received interpretation of the moral message behind “Medicinal Fried Chicken” and many other South Park episodes, the message that legislating lifestyles is immoral at worst and ridiculous at best. This message is encapsulated by the moral perspective known of libertarianism, which takes individual rights in political and social scenarios to (...) be not only basic, but also to trump many other moral considerations. For tensions between an individual's good and the common good in the drug legalization debate, the chapter further discusses a 1989 exchange between Milton Friedman and William J. Bennett. (shrink)

The coal industry exercises a pervasive influence upon mining communities in Appalachia even though it makes minimal contributions to employment. Miners rarely participate in movements that fight against coal companies for better working conditions. One explanation for this paradox is the depletion of social capital. In this article, I first use the existing body of literature to build a theoretical framework for discussing bonding social capital. Second, I analyze how the United Mine Workers of America in Harlan County, Kentucky (...) at the beginning of the twentieth century worked to generate social capital. The results show that these coalfield residents demonstrated a high degree of social capital in terms of a strong shared sense of reliability and a dedication to collective activities and intimate networks. The union during that period engaged in strategies that were instrumental in creating this high level of social capital: holding regular meetings, organizing collective actions, promoting collective identity, and electing charismatic leaders. The growth of high-stakes testing in state accountability systems necessitates further examination of their impact on stakeholders. Prompted by broader state-level reform in Kentucky, this evaluation aims to provide insight into a new accountability system's effect on social studies teachers. Using a goal-free evaluation model and case study design, the researchers examined the content and instructional decisions made by a group of U.S. history teachers in response to a new end-of-course exam designed by ACT-QualityCore. The evaluation incorporated a content (...) analysis of teacher materials, observation of a professional learning community meeting, and teacher interviews. The results of this evaluation indicate that teachers generally support the changes in the new assessment system but find specific elements frustrating and hesitate to completely revamp their instructional practices. Considering these assessment system changes occurred to advance Kentucky's goal of college and career readiness for all, this evaluation provides insight into what is actually happening in classrooms and should assist teachers and administrators as they assess the impact of these reforms on classroom practice. This paper offers a case study based on qualitative research in the burley tobacco region of central Kentucky, where farmers are urged to diversify away from tobacco production. “Replacing” tobacco is difficult for economic and material reasons, but also because raising tobacco is commensurate with a locally valued way of doing masculinity. The focus is on these two questions: How can the doing of work associated with tobacco production and marketing be understood as also doing a particular masculinity? What (...) does an understanding of farm work as a simultaneous doing of gender illuminate about the challenges of diversification away from tobacco? Asking tobacco farmers to “grow something else” is also asking them to do gender differently, suggesting that the transition away from tobacco must be understood as a gendered transition. This research, focused primarily on male farmers who continue to raise tobacco, suggests the need for gendered research with women and men who have moved away from tobacco to other crops. (shrink)

This article highlights local government responses to the opioid crisis in Northern Kentucky through a series of interviews with county-level officials. The author's discussions with civic leaders reflect the challenges faced by local communities and the new approaches implemented to stem the epidemic.

Beberapa puluh tahun yang lalu Steven McKenzie menjadi editor sebuah kumpulan karangan yang berjudul To Each Its Own Meaning: An Introduction to Biblical Criticism and their Application (1993). Dalam bunga rampai itu dibahas metode-metode penelitian lama yang berfokus pada latar belakang sejarah teks (penelitian sumber, sejarah tradisi, jenis sastra, peredaksian), cara-cara penelitian literer yang lebih baru (seperti penelitian strukturalis, pasca-strukturalis, naratif, atau reader’s respons) dan beberapa yang lain (penelitian ilmu sosial, kanonik, atau retorika). Dalam dua puluh tahun sejak terbitan itu (...) banyak pendekatan baru berkembang, misalnya, dalam symposia pertemuan para pakar Alkitab nasional dan internasional, dan dalam banyak monograf, bunga rampaidan artikel Jurnal. Untuk membantu pembaca mengikuti perkembangan cepat itu, kini McKenzie & Kaltner menerbitkan New Meanings for Ancient Texts. Mereka memilih sembilan pendekatan yang makin berpengaruh dan meminta kepada pionir-pionir utama setiap pendekatan untuk memberi deskripsi pendekatannya yang jelas bagi non spesialis dan mengilustrasikannya dengan meneliti satu atau beberapa teks contoh. Judul bab dari beberapa di antara kesembilan pendekatan itu barangkali segera ditanggap pembaca, karena sudah lebih lama dikenal. Misalnya, “Psychological Biblical Criticism” (D. Andrew Kille, pp. 137-154) dan “Ecological Criticism” (Norman Habel, pp. 39-58). Pendekatan-pendekatan ini agaknya dimuat di sini karena mengalami pergeseran paradigma dalam beberapa dasa warsa terakhir. Dekat tetapi berbeda dengan itu “Cultural-Historical Criticism of the Bible” (Timothy Beal, pp.1-20) meneliti bagaimana kata, kiasan, objek dan ide dalam Alkitab menerima bentuk dan artinya dalam konteks kebudayaan tertentu yang memproduksikannya atau mereproduksikannya. “The Bible and Popular Culture” (Linda Schearing and Valerie Ziegler, pp. 77-96) kurang berfokus pada Alkitab sendiri tetapi menganalisa bagaimana teks-teks tertentu berfungsi dalam ungkapan-ungkapan budaya rakyat, lelucon, iklan, komik, seni, film, dll., juga mengingat pergeseran yang kini terjadi dari budaya teks tertulis ke apropriasi visual. “Disability Studies and the Bible” (Nasya Junior and Jeremy Schipper, pp. 21-38) dan apa yang disebut “Queer Criticism” (Ken Stone, pp. 155-176) meneliti Alkitab dari situasi kelompok-kelompok tertentu, entah mereka orang-orangcacat yang banyak muncul dalam teks-teks Alkitab yang dapat dimengerti lebih baik dari dalam pengalaman invaliditas; atau mereka yang dari sudut seks dan jender berada dalam posisi yang tidak menguntungkan atau bahkan ditolak. Di sini a.l. tempatnya penelitian Alkitab komunitas gay and lesbian, dan lebih awal feminisme......................... Apakah bunga rampai tentang pelbagai pendekatan baru ini penting untuk seorang yang sudah cukup puas dengan metodenya selama ini atau yang menerima Alkitab sebagai buku yang mempunyai otoritas terhadap dirinya dan jemaatnya? Keberatan (kita) yang sudah lama diajukan terhadap pendekatan tersebut, pada akhir setiap karangan dengan jujur dikemukakan dan diberi tanggapan singkat. Membaca contoh-contoh penafsiran dalam bunga rampai ini, saya sering merasa diajak ke dalam suatu perjalanan yang berbelit-belit. Tetapi setelah beberapa tikungan muncul juga pemandangan menarik dan berharga yang belum pernah saya perhatikan selama ini. Selain itu, setiap artikel mulai dengan pengantar umum tentang, misalnya, fenomen postmodernisme, ilmu ekologi, atauqueer criticism yang sudah lebih lama dikembangkan di akademi umum, dan baru sekarang mulai dipakai juga untuk analisa teks-teks biblis. Pengantar-pengantar itu saja memberi gambaran menarik tentang masalah-masalah yang dewasa ini digumuli dalam komunitas global. Setuju atau tidak, mengetahuinya penting untuk keduanya. William Louis Poteat , a North Carolina intellectual of the Progressive Era, gained a reputation as a leading liberal in southern higher education. This book, which was recognized by a prestigious National Endowment for the Humanities publication grant, is useful for historians of science because it illustrates how scientific ideas, particularly Darwinism, were diffused into a rural and isolated society.From his student years to the end of his life, Poteat was intimately connected with a Southern Baptist college, Wake Forest. He (...) matriculated at Wake Forest and became a tutor there in 1878. Although almost entirely self‐taught in the sciences, he became a popular and respected professor of biology. As his knowledge of science came from reading contemporary papers and monographs rather than from traditional study, he developed a perspective more modern than that of most of his peers. He rose through the ranks, ultimately becoming president of Wake Forest in 1905.Relatively early in his career, Poteat began the work that earned him a place in southern history by writing articles and giving lectures on the ways in which science and religion were related. By the end of his first decade as a faculty member, he had become convinced of the importance of Darwin's theory of evolution and had decided that it posed no threat to traditional Christianity. In supporting this view, Poteat followed the lead of mainstream European and Northern American churches, which had no problem reconciling evolution with the Book of Genesis and its description of creation occurring in seven days. After all, who knew what a day meant in the mind of God? Many Southern Protestants, however, rejected this position.Randal Hall sees Poteat as an advocate of a liberal social philosophy fully in accord with the social gospel of the Progressive age. As a leading proponent for change in his state, Poteat “personified North Carolina Progressivism” , and his defense of Darwin was of a piece with his philosophy. But it is unclear whether Poteat's admiration for Darwin stemmed from an understanding of science or an obsession with eugenics, an obsession that in time came to dominate his thinking.Poteat vigorously used his position as president of the Southern Baptist Education Association to promote theories of eugenics. Although Darwin did not actively promote racism, followers of his thought such as Poteat could easily educe racist ideas from it. They could argue, for example, that individuals should speed up the process of producing superior humans by helping nature along through the process of selective breeding. Concerned with the large number of Americans who were institutionalized, and the even greater number who were barely educated, Poteat maintained that the government should control the right to reproduce and sterilize the unfit, including the “self‐centered, the coarse‐fibered, and the discourteous” . He thought that civilization would crumble unless such procedures were put in place, because there would be an “overproduction of under‐men” . Indeed, following this same line of thought, he opposed war because it foolishly wasted “our best blood” . He called for federal legislation to govern marriage and divorce, requiring applicants to meet his moral requirements and to pass a rigorous medical examination. Even in conservative North Carolina, these ideas provoked astonishment. A leading Raleigh newspaper accused Poteat of wanting to be the “boss of a human stock farm” .Although Randal Hall's book is primarily a biography of William Louis Poteat—and secondarily a history of Wake Forest as it evolved from a tiny Baptist school into a major college—it is also a study of the split personalities of Southern Progressives. On the one hand, they rejected rule by educated leaders; on the other, they wanted government to control the most intimate aspects of life, such as reproduction. Poteat thought that all these things should be overseen by a “genteel Christian community led by a liberal elite” . The complexity and cognitive dissonance of Southern Progressives are well illustrated in this book. (shrink)
