Natural Justice is a bold attempt to lay the foundations for a genuine science of morals using the theory of games. Since human morality is no less a product of evolution than any other human characteristic, the book takes the view that we need to explore its origins in the food-sharing social contracts of our prehuman ancestors. It is argued that the deep structure of our current fairness norms continues to reflect the logic of these primeval social contracts, but the (...) particular fairness norm a society operates is largely a product of cultural evolution. In pursuing this point, the book proposes a naturalistic reinterpretation of John Rawls' original position that reconciles his egalitarian theory of justice with John Harsanyi's utilitarian theory by identifying the environment appropriate to each. : Any precise version of H-D needs to handle various problems, most notably, the problem of selective confirmation: Precise formulations of H-D should not have the consequence that where S confirms T, for any T', S confirms T&T'. It is the perceived failure of H-D to solve such problems that has lead John Earman to recently conclude that H-D is "very nearly a dead horse". This suggests the following state of play: H-D is an intuitively plausible idea that breaks down (...) in the attempt to give it a precise formulation. Indeed I think that fairly captures the view among specialists in the field of confirmation theory. Here I argue that the truth about H-D is largely the reverse: H-D can be given a precise formulation that avoids the longstanding technical problems, however, it relies on a fundamentally unsound philosophical intuition. The bulk of this paper involves reviewing the problems affecting previous attempts at giving precise formulations of H-D and displaying some recent versions that can handle these problems. It then briefly explains why the basic intuition behind H-D is itself unsound, namely, because H-D involves a tacit assumption of inductive scepticism. Finally, the historical relation between H-D and the positivists' quest for a criterion of empirical significance will be reconsidered with the surprising result that having glossed H-D as fundamentally unsound it is concluded that a sound version of the criterion of empirical significance is now available. The demarcation criterion, the positivists' philosopher's stone that serves to separate claims with empirical significance from claims lacking empirical significance having finally been found, it is argued that we should regard empirical significance as just one among a variety of virtues and not follow the positivists in taking it to be a sin qua non for all meaningful statements. This paper was presented at the American Philosophical Association's 2007 Berger Prize session. It is a reply to Ken Himma's comment on my paper, "How Facts Make Law," which was awarded the 2007 Berger Prize for the outstanding paper in philosophy of law published during 2004 and 2005. In his thoughtful and thought-provoking paper, Himma claims that the argument of "How Facts Make Law" must go wrong somewhere because, if successful, the argument shows too much with too little. (...) In particular, he claims that my argument, with very limited resources, reaches a conclusion that entails that subjectivist and non-cognitivist theories of morality are false. Himma insists that I should not be able to resolve such controversial debates in meta-ethics with no meta-ethical or even normative resources. My basic response has two parts. First, it is not correct that my conclusion entails that subjectivist and non-cognitivist theories of morality are false. My conclusion itself is neutral as to the metaphysics of morality. Second, it's not even true that my argument, if successful, shows that there must be moral facts. The reason is that I rely on the plausibility of the existence of moral facts (whatever their metaphysics) in arguing for my conclusion. In sum, my argument's conclusion doesn't get us nearly as far as Himma thinks. Nor are my argument's resources as meager as he claims. (shrink)

Using a case of intended but failed doping, the author seeks to answer the question of if an agent cheated when they intended to but failed in the case of doping due to inert, counterfeit drugs. The examination looks at the case using the concept of cheating and concludes by dividing the results of cheating into primary and secondary effects.

This article is extracted from a forthcoming book, ‘Natural Justice’. It is a nontechnical introduction to the part of game theory immediately relevant to social contract theory. The latter part of the article reviews how concepts such as trust, responsibility, and authority can be seen as emergent phenomena in models that take formal account only of equilibria in indefinitely repeated games. Der Arbeitsbegriff Hegels ist mehrdeutig: Er umfasst den Bereich der ökonomischen Arbeit ebenso wie die Arbeit, die den Geist der Menschheit in der Geschichte, der Kunst und der Gesellschaft hervorbringt und entwickelt. Die Gemeinsamkeit dieser unterschiedlichen Arbeitsbegriffe liegt nach Hegel darin, dass sie von der menschlichen Existenz nicht wegzudenken sind. Beide bestimmen den vernünftigen Zugriff der Menschen auf ihre Umwelt in der gleichen Weise: Die Menschen formulieren Zwecke, die sie an ihre Umwelt herantragen und durch geeignete Mittel zu verwirklichen suchen, (...) gleich, ob diese Zwecke ökonomisch, kulturell oder moralisch bestimmt sind. Darüber, dass die zweckmäßige Bestimmung als Form der Bestimmung und Gestaltung der Welt im Geist der Menschheit insgesamt verstanden wird, wird die ökonomische mit der moralischen Arbeit vermittelt und Arbeit bei Hegel so insgesamt zum Ausdruck von Selbstbestimmung. Hegel vertritt damit einen Arbeitsbegriff, der für die Moderne prototypisch ist. Dass Arbeit frei mache, ist nicht nur die in grausamer Weise ideologisch umgesetzte Devise der Nationalsozialisten, sondern ein Gedanke, der eine Grundannahme der normativen Ideale der Moderne im gesamten politischen Spektrum darstellt. Diese Problematik aufnehmend, nimmt die Autorin die Hegelsche Intention einer vernünftigen Begründung des Verhältnisses der Menschen zu sich selbst, zu einander und zu ihrer Umwelt ernst und befragt seinen Arbeitsbegriff nach den Grenzen vernünftiger Begründbarkeit. Sie unterstellt dabei, dass die kritische Aufarbeitung nicht nur der Auslegung eines ‚Klassikers‘ dient, sondern einen Begriff zu klären vermag, an dem auch unsere Gegenwart sich messen lassen muss. In European industrialized countries, a large number of companies in the healthcare, hotel, and catering sectors, as well as in the technology sector, are affected by demographic, political, and technological developments resulting in a greater need of skilled workers with a simultaneous shortage of skilled workers (CEDEFOP, 2015, 2016). Consequently, employers have to address workers who have not been taken into account such as low-skilled workers, workers returning from a career break, people with a migrant background, older people, and jobseekers (...) and train them, in order to guarantee the professionalization of this workforce (Festing and Harsch, 2018). Continuing vocational education and training (CVET) is seen as an indispensable tool; because CVET has advantages for both employers and employees, it helps to increase the productivity of companies (Barrett and O’Connell, 2001), to prevent the widening of socioeconomic disparities (Dieckhoff, 2007), and to open up career opportunities for the workforce (Rubenson and Desjardins, 2009). However, participation rate on CVET seems to differ, depending on institutional factors (such as sector and size of the company) and individual characteristics (such as qualification level, migration background, age and time of absence from work) (e.g., Rubenson and Desjardins, 2009; Wiseman and Parry, 2017). In contrast to previous research, our study aims to provide a holistic view of reasons for and against CVET, combining the different perspectives of employers and (potential) employees. The analysis of reasons and barriers was carried out based on semi-structured interviews. Fifty-seven employers, 73 employees, and 42 jobseekers (potential employees) from the sectors retail, healthcare and social services, hotels and catering, and technology were interviewed. Results point to considerable differences in the reasons and barriers mentioned by the disadvantaged groups. These differences are particularly significant between employees on the one side and employers, as well as jobseekers, on the other side, while the reasons to attend CVET of jobseekers are more similar to those of employers. The results can be used to tailor CVET more closely to the needs of (potential) employees and thus strengthen both the qualification and career opportunities of (potential) employees and the competitiveness and productivity of companies. Michael Fried’s unexpected contribution to defining the ontological status of video art includes an intriguing claim that projective art is particularly suited to the ‘staging’ of empathic projection. Fried applies Stanley Cavell’s notion of empathic projection, developed in relation to skepticism of ‘other minds’, to moving image installations that not only exploit the beholder’s capacity for empathically projecting, but do so in such a way as to reveal the mechanism at play. In developing this claim, I compare Fried’s key example (...) of Douglas Gordon’s Play Dead; Real Time with Bill Viola and Kira Perov’s Martyrs, a work that likewise elicits an emotional response but without a compensatory foregrounding of the underlying structuring mechanism. However, the comparison suggests that the staging of empathic projection should not be interpreted as an anti-theatrical strategy, but rather as an exemplary manifestation of what I am calling the configurational encounter – a revealing of the artwork’s conditions of existence. I reference Paul Sharits’s Epileptic Seizure Comparison, an important precursor to Gordon’s staging of empathic projection. Finally, I consider Chris Welsby’s landscape films in the light of the capacity of technology to reveal psychological mechanisms of projection, tracing such processes of projection to early childhood experiences of differentiating the human from the non-human. Time travel narratives provide fascinating plots, which exercise our imaginations in ever so many ways. But is (...) the idea of travelling forward and backward in time pure fantasy—or can it be done? To be sure, not all time travel scenarios are coherent. An estimated 700,000 people in the United States have "long COVID," that is, symptoms of COVID-19 persisting beyond three weeks. COVID-19 and its long-term sequelae are strongly influenced by social determinants such as poverty and by structural inequalities such as racism and discrimination. Primary care providers are in a unique position to provide and coordinate care for vulnerable patients with long COVID. Policy measures should include strengthening primary care, optimizing data quality, and addressing the multiple nested domains of inequity.

The euthanasia literature typically discusses the difference between “active” and “passive” means of ending a patient’s life. Physician-assisted suicide differs from both active and passive forms of euthanasia insofar as the physician does not administer the means of suicide to the patient. Instead, she merely prescribes and dispenses them to the patient and lets the patient “do the rest” – if and when the patient chooses. One supposed advantage of this process is that it maximizes the patient’s autonomy with respect (...) to both her decision to die and the dying process itself. Still, despite this supposed advantage, Oregon is the only state to have legalized physician-assisted suicide. After summarizing the most important Supreme Court opinions on euthanasia (namely, Cruzan v. Director, Missouri Dep’t of Health; Vacco v. Quill; Washington v. Glucksberg; and Gonzales v. Oregon), this paper argues that while there are no strong ethical reasons against legalizing physician-assisted suicide, there are some very strong policy reasons for keeping it criminal in the other forty-nine states. These notes, which are conservative more often than they are revolutionary, have originated from some reviews which I have recently written of books on Apuleius. I have found that the only way to preserve any consistency in the format is to open each note by citing the text I should prefer and then following that with a Latin apparatus criticus. The aim of the notes is generally only to shed light on the individual passages, to offer conversion or conviction, but (...) some notes serve the rather larger purpose of bolstering a general view of the editors of Apuleius against some modern misconceptions. What merit should we find in Heliodoros' novel? Towards its end Hydaspes, agonizing over whether to save Charikleia from human sacrifice, sees before him an internal audience stirred by πθη equal to his and ‘weeping through pleasure and pity at Fortune's stage-management’ . This is a popular audience, a demos, evincing a popular reaction, but one which Heliodoros anticipated and doubtless welcomed. Their reaction is characterized by simple, direct emotions and some limited awareness of the larger processes that have been (...) going on in this novel. For them this is a world of τχη and amazement. Does the novel invite any deeper critical reaction than this? (shrink)

These lines, which I cite according to Hill's forthcoming edition, have caused scholars some difficulty of interpretation. Trabibus has generally been taken to refer to battering-rams and thus, for instance, we find in the Delphin edition as an interpretation of trabibusque … loco the words ‘et strepenti ariete loco extrudunt lapides firme constrictos’’. Certainly, if they drive stones from their place with a ram, it is the ram that is the best candidate for the epithet sonorus – a candidature every (...) ω manuscript rejects, except two alleged by Barth. P, however, has et ariete, replacing the rather uninformative adjective artata and providing an explicit noun for sonoro to agree with; and P was followed by the early editors Lindenbrogius and Cruceus. ‘Infeliciter’’, says Barth. Infelicitously indeed: et is deleted by P in the first hand and would not scan; without et the sentence does not construct and the line still does not scan – for the word is ariěte. (shrink)
