Despite claims of ‘evidence based policy’, the place of empirical evidence in family law reform is ambiguous. There is ongoing socio-legal analysis of the differential value and uses of quantitative data and anecdote in detailing women’s experiences and advocating for change. In this paper, we engage with these issues through a focus on how data were constructed in a key government report, Every Picture Tells a Story, which was used to officially define the problem and outline recommendations in the controversial (...) 2006-08 reform of the Australian Child Support Scheme. Our discussion focuses on two questions: what legitimacy is accorded to different kinds of evidence in family law reform processes?; and, how is this legitimacy gendered? We applied feminist critical discourse analysis to the type, source and claims of the data included in the child support chapter of the report. Our findings indicate that both quantitative data and anecdote were used to privilege fathers’ financial interests and autonomy; in contrast, women’s voices and interests were marginalised. Thus, we argue the legitimacy of data is ascribed through its relationship to the gendered definition of the ‘problems’ of child support, rather than the type of data per se. (shrink)

It is widely thought that the acceptability of an abstraction principle is a feature of the cardinalities at which it is satisfiable. This view is called into question by a recent observation by Richard Heck. We show that a fix proposed by Heck fails but we analyze the interesting idea on which it is based, namely that an acceptable abstraction has to “generate” the objects that it requires. We also correct and complete the classification of proposed criteria for acceptable abstraction.

Although military personnel are required to follow all legal orders, morally the traditional contract between soldier and state rests on shared assumptions about the purposes for which national militaries will and will not be used.

Hua-yen is regarded as the highest form of Buddhism by most modern Japanese and Chinese scholars. This book is a description and analysis of the Chinese form of Buddhism called Hua-yen, Flower Ornament, based largely on one of the more systematic treatises of its third patriarch. Hua-yen Buddhism strongly resembles Whitehead's process philosophy, and has strong implications for modern philosophy and religion. Hua-yen Buddhism explores the philosophical system of Hua-yen in greater detail than does Garma C.C. Chang's _The Buddhist Teaching (...) of Totality _. An additional value is the development of the questions of ethics and history. Thus, Professor Cook presents a valuable sequel to Professor Chang's pioneering work. The Flower Ornament School was developed in China in the late 7th and early 8th centuries as an innovative interpretation of Indian Buddhist doctrines in the light of indigenous Chinese presuppositions, chiefly Taoist. Hua-yen is a cosmic ecology, which views all existence as an organic unity, so it has an obvious appeal to the modern individual, both students and layman. (shrink)

A number of authors have argued that Peano Arithmetic supplemented with a logical validity predicate is inconsistent in much the same manner as is PA supplemented with an unrestricted truth predicate. In this paper I show that, on the contrary, there is no genuine paradox of logical validity—a completely general logical validity predicate can be coherently added to PA, and the resulting system is consistent. In addition, this observation lead to a number of novel, and important, insights into the nature (...) of logical validity itself. (shrink)

In “Properties and the Interpretation of Second-Order Logic” Bob Hale develops and defends a deflationary conception of properties where a property with particular satisfaction conditions actually exists if and only if it is possible that a predicate with those same satisfaction conditions exists. He argues further that, since our languages are finitary, there are at most countably infinitely many properties and, as a result, the account fails to underwrite the standard semantics for second-order logic. Here a more lenient version of (...) the view is explored, which allows for the possibility of countably infinite predicates understood as the product of linguistic supertasks. This enriched deflationist account of properties—the Infinitary Deflationary Conception of Existence—supports the standard semantics for models with countable first-order domains, and allows one to prove the categoricity of the second-order Peano axioms. Biobanks are proliferating rapidly worldwide because they are powerful tools and organisational structures for undertaking medical research. By linking samples to data on the health of individuals, it is anticipated that biobanks will be used to explore the relationship between genes, environment and lifestyle for many diseases, as well as the potential of individually-tailored drug treatments based on genetic predisposition. However, they also raise considerable challenges for existing legal frameworks and research governance structures. This book critically examines the current governance (...) structures in place for biobanks in England and Wales. It shows that the technologies, techniques and practices involved in biobanking do not always conform neatly to existing legal principles and frameworks that apply to other areas of medical research. Using a socio-legal approach, including interview data gathered from the scientific community, this book provides unique insights and makes recommendations about appropriate governance mechanisms for biobanking in the future. It also explores the issues around the secondary use of information, such as consent and how to protect privacy, when biobanks are accessed by a number of different third parties. A notion of feasible function of finite type based on the typed lambda calculus is introduced which generalizes the familiar type 1 polynomial-time functions. An intuitionistic theory IPVω is presented for reasoning about these functions. Interpretations for IPVω are developed both in the style of Kreisel's modified realizability and Gödel's Dialectica interpretation. Applications include alternative proofs for Buss's results concerning the classical first-order system S12 and its intuitionistic counterpart IS12 as well as proofs of some of Buss's conjectures concerning IS12, (...) and a proof that IS12 cannot prove that extended Frege systems are not polynomially bounded. The use of genome-wide association studies in medical research and the increased ability to share data give a new twist to some of the perennial ethical issues associated with genomic research. GWAS create particular challenges because they produce fine, detailed, genotype information at high resolution, and the results of more focused studies can potentially be used to determine genetic variation for a wide range of conditions and traits. The information from a GWA scan is derived from DNA that is a (...) powerful personal identifier, and can provide information not just on the individual, but also on the individual's relatives, related groups, and populations. Furthermore, it creates large amounts of individual-specific digital information that is easy to share across international borders. This paper provides an overview of some of the key ethical issues around GWAS: consent, feedback of results, privacy, and the governance of research. Many of the questions that lie ahead of us in terms of the next generation sequencing methods will have been foreshadowed by GWAS and the debates around ethical and policy issues that these have created. A minimum voting age is defended as the most effective and least disrespectful means of ensuring all members of an electorate are sufficiently competent to vote. Whilst it may be reasonable to require competency from voters, a minimum voting age should be rejected because its view of competence is unreasonably controversial, it is incapable of defining a clear threshold of sufficiency and an alternative test is available which treats children more respectfully. This alternative is a procedural test for minimum electoral (...) competence. A procedural test for minimum electoral competence also succeeds in fulfilling adults’ duties to promote children’s rational and moral engagement with democracy. A minimum voting age should therefore be rejected, all things considered. A procedural test for minimum literacy and independent voting is the most justified means to ensure competency from voters and to promote the democratic agency of children. (shrink)

During the Winter of 2011 I visited SADAF and gave a series of talks based on the central chapters of my manuscript on the Yablo paradox. The following year, I visited again, and was pleased and honored to find out that Eduardo Barrio and six of his students had written ‘responses’ that addressed the claims and arguments found in the manuscript, as well as explored new directions in which to take the ideas and themes found there. These comments reflect my (...) thoughts on these responses (also collected in this issue), as well as my thoughts on further issues that arose during the symposium that was based on the papers and during the many hours I spent talking and working with Eduardo and his students. Truth values are, properly understood, merely proxies for the various relations that can hold between language and the world. Once truth values are understood in this way, consideration of the Liar paradox and the revenge problem shows that our language is indefinitely extensible, as is the class of truth values that statements of our language can take – in short, there is a proper class of such truth values. As a result, important and unexpected connections emerge between the semantic paradoxes (...) and the set-theoretic paradoxes. (shrink)

Counterfactualism is a useful process for historians as a thought-experiment because it offers grounds to challenge an unfortunate contemporary historical mindset of assumed, deterministic certainty. This article suggests that the methodological value of counterfactualism may be understood in terms of the three categories of common ahistorical errors that it may help to prevent: the assumptions of indispensability, causality, and inevitability. To support this claim, I survey a series of key counterfactual works and reflections on counterfactualism, arguing that the practice of (...) counterfactualism evolved as both cause and product of an evolving popular assumption of the plasticity of history and the importance of human agency within it. For these reasons, counterfactualism is of particular importance both historically and politically. I conclude that it is time for a methodological re-assessment of the uses of such thought-experiments in history, particularly in light of counterfactualism's developmental relatedness to cultural, technological, and analytical modernity. Adorno and Foucault are among the 20th century’s most renowned social critics but little work has been done to compare their ideas about the activity of critique. ‘Adorno, Foucault and Critique’ attempts to fill this lacuna. It takes as its starting point the Kantian legacy that informs Adorno’s and Foucault’s notions of critique, or their ‘ontologies of the present’, as Foucault calls them. Exploring the ontological foundations of critique, the article then addresses the principal objects of critique: domination and fascism. (...) Williams, Elster and Pears hold that an effort to induce in oneself a belief in the truth of some proposition that one believes to be false can succeed only if one manages, somewhere along the way, to forget that one is engaged in such an effort. Although this view has strong intuitive appeal, it is false, and in this paper it is shown to be false by example.

This book is a comprehensive exposition of the Transcendental Deduction of the Categories in both editions of Kant’s Critique of Pure Reason.

Which famous twentieth-century philosopher instigated a revolution in philosophy, arguing that the philosopher’s business is not to advance general theories about reality, but rather to help release our thinking from the intellectual cramps produced by a misunderstanding of the forms of language? Wittgenstein? Wrong! according to John W. Cook. This revolution in philosophy actually had no author. Apparently, it arose through a misinterpretation of Wittgenstein’s later writings. In fact, Cook implies, Wittgenstein himself was not genuinely engaged in a (...) struggle with philosophical puzzles, but rather had an ontological theory up his sleeve: he was a conventional empiricist in the tradition of Berkeley, Ernst Mach, and Russell, though he happened to express himself so obscurely that some philosophers, believing themselves inspired by his writings, dreamed up the whole revolution by mistake, as it were. However, Cook is not arguing that the revolution should be canceled; rather he looks at Wittgenstein’s work from the standpoint of that accidental revolution, berating Wittgenstein, as it were, for not having thought to be a Wittgensteinian himself. The Canadian Truth and Reconciliation Commission has been mandated to collect testimonies from survivors of the Indian Residential Schools system. The TRC demands survivors of the residential school system to share their personal narratives under the assumption that the sharing of narratives will inform the Canadian public of the residential school legacy and will motivate a transformation of settler identity. I contend, however, that the TRC provides a concrete example of how a politics of recognition fails to transform relationships between (...) Native and settler Canadians not only because it enacts an internalization of colonial recognition, but because it fails to account for what I call “settler ignorance.” Work in epistemologies of ignorance and epistemic oppression gives language to explain sustained denial and provide tools to further understand how settler denial is sustained, and how it can be made visible, and so challenged. For this task, Mills’s articulation of white ignorance should be expanded to a consideration of white settler ignorance. Over and above an account of white ignorance, such an account will have to consider the underlying logics of settler colonialism. This characterization of settler ignorance will show that the denial of past and ongoing violence against Indigenous peoples, through the reconstruction of the past to assert the primacy of settlers, is not explainable in terms of a lack of recognition but is rather structural ignorance. Numerous recent discoveries in China of ancient tombs have greatly increased our knowledge of ritual and religious practices. These discoveries include excavated oracle bones, bronze, jade, stone and pottery objects, and bamboo manuscripts dating from the twelfth to fourth century BCE. Inscribed upon these artifacts are a large number of records of numerical sequences, for which no explanation has been found of how they were produced. Structural links to the Book of Changes, a divination manual that entered the Confucian canon, (...) are evident; yet, the algorithm described therein dates to the slightly later second to first century BCE. By combining archeological and statistical evidence, we propose a new methodology that enables us to reconstruct and test cleromantic techniques which can explain how these numerical sequences were generated. Dice and divination stalk use, either in combination or separately, appear in fact to have been underlying the rather stable numerical patterns in ancient China all the way back to the late Shang dynasty (1300–1046 BCE). Bringing to light such a long-standing technique, which awaits further confirmation from the ever-growing database of newly discovered numerical and textual records, can change drastically our understanding of early Chinese history and of the historical development of sophisticated arithmetical practices and the rationalization of chance. Biomedical research is increasingly carried out in low- and middle-income countries. International consensus has largely been achieved around the importance of valid consent and protecting research participants from harm. But what are the responsibilities of researchers and funders to share the benefits of their research with research participants and their communities? After setting out the legal, ethical and conceptual frameworks for benefit sharing, this collection analyses seven historical cases to identify the ethical and policy challenges that arise in relation to (...) benefit sharing. A series of recommendations address possible ways forward to achieve justice for research participants in low- and middle-income countries. (shrink)

SummaryThe medical career of Sir John Colbatch illuminates some of the ways in which experimental philosophy, social change, and medical entrepreneurialism together helped bring about the end of the old medical regime in England. Colbatch's career in Augustan England depended very much on a growing public culture in which the well-to-do decided matters of intellectual importance for themselves, becoming increasingly free not only from the clerics but from the physicians. In this new world, debates about the fundamental principles of the (...) new science took place increasingly in public, and in the English language, without the learned men of the university being able to enforce their authority. It gave people like Colbatch a new opportunity to make their way into the medical establishment. (shrink)

Fine and Antonelli introduce two generalizations of permutation invariance — internal invariance and simple/double invariance respectively. After sketching reasons why a solution to the Bad Company problem might require that abstraction principles be invariant in one or both senses, I identify the most fine-grained abstraction principle that is invariant in each sense. Hume’s Principle is the most fine-grained abstraction principle invariant in both senses. I conclude by suggesting that this partially explains the success of Hume’s Principle, and the comparative lack (...) of success in reconstructing areas of mathematics other than arithmetic based on non-invariant abstraction principles. He also offered ideas about what positive change might look like on the basis of his determinate negation of damaged life. This paper begins by exploring Adorno’s ideas about possibility and determinate negation. It also discusses his views about the sort of changes that might be made. This study explored the challenges of informed consent and understanding of the research process among Black and Latino men under community supervision. Between February and October 2012, we conducted cognitive face-to-face interviews using open-ended questions on the significant areas of research participation among 259 men aged 35 to 67 under community supervision in Bronx, New York. Content analysis of the open-ended questions revealed limited knowledge concerning the understanding of research participation. The study participants appeared to generally understand concepts such as (...) compensation after research participation and confidentiality. Participants demonstrated a lack of understanding of certain aspects of the research process—informed consent, human subject, Institutional Review Board, and clinical trials. These findings are informative to researchers conducting studies with criminal justice populations and Institutional Review Boards reviewing research studies. (shrink)
