The experimental philosophy of law is a recent movement that aims to inform traditional debates in jurisprudence by conducting empirical research. This paper introduces and provides a systematic overview of the main lines of research in this field. It also covers the most important debates in the literature regarding the implications of these findings for the philosophy and theory of law. It argues that three challenges arise when addressing (old) legal-philosophical questions in (new) experimental ways by drawing normative implications from (...) empirical data: such implications are value-driven, depend on explanations of empirical findings and vary across legal systems. : The transplantation of adult human neural stem cells into prenatal non-humans offers an avenue for studying human neural cell development without direct use of human embryos. However, such experiments raise significant ethical concerns about mixing human and nonhuman materials in ways that could result in the development of human-nonhuman chimeras. This paper examines four arguments against such research, the moral taboo, species integrity, "unnaturalness," and human dignity arguments, and finds the last plausible. It argues that the transfer of human (...) brain or retinal stem cells to nonhuman embryos would not result in the development of human-nonhuman chimeras that denigrate human dignity, provided such stem cells are dissociated. The article provides guidelines that set ethical boundaries for conducting such research that are consonant with the requirements of human dignity. (shrink)

Tractatus Politico-Philosophicus (Political-Philosophical Treatise) of W. Julian Korab-Karpowicz proposes a new idea-system. Ideas concerning different topics related to politics are introduced. The work aims to establish the principles of good governance and of a happy society, and to open up new directions for the future development of humankind. It is also in part a critique of the epistemology of early Wittgenstein as presented in his Tractatus Logico-Philosophicus. It argues that one can speak about politics and ethics with sense, and (...) that political philosophy is still a viable enterprise for us. This explanation is provided in response to the review of Tractatus Politico-Philosophicus by Katarzyna Heremska and a critical note of Pawel Kloczowski that were both published in Argument 6(1), 2016. In this article I present the concept of human evolution by Hoene- Wroński. I believe that his ideas are still an unexplored resource which can lead us to the better understanding of the evolution of humanity and of our destiny. I follow closely his discussion of human evolution and describe its seven stages. Further, I argue that the case of human evolution is strongly supported by new scientific theories, especially by quantum theory and the novel perspectives that it opens for (...) humankind. I end my article with the conclusion that the insights on human evolution derived from the Hoene-Wroński’s writings and from new scientific theories can guide us to the new politics based on the awareness of human identity that can overcome old divisions among humankind and conflicts derived from them. Along with the rapid growth that the field of assisted reproduction has experienced over the last few years, numerous ethical issues have arisen and need to be discussed thoroughly. One of them is the limitation of access to assisted reproduction techniques. Because no one should be discriminated against, it is essential to substantiate every single refusal of access carefully. The criterion of welfare of the child is used most frequently. In this paper, we propose a thought experiment aiming at contributing (...) to the discussion by demonstrating that this criterion, even in its strictest form, can easily allow access to assisted reproduction for legal persons as well. The paper examines a relatively neglected element of Spinoza's theory of mind-body relations: the intentional relation between human minds and bodies, which for Spinoza constitutes their “union”. Prima facie textual evidence suggests, and many readers agree, that because for Spinoza human minds are essentially ideas of bodies, Spinoza is also committed to an ontological and explanatory dependence of certain properties of human minds on properties of bodies, and thus to a version of materialism. The paper argues that such dependence would (...) contradict Spinoza's key epistemological commitments, including the explanatory closure of mental and physical realms, and Spinoza’s claim that all knowledge is knowledge of a thing's causes. The paper argues that Spinoza's dual-reality theory of representation allows us to interpret the intentional relation between human minds and bodies in a way that does not commit Spinoza to a problematic dependence of minds on bodies. This is possible if we take Spinoza's references to properties of bodies in his account of the human mind as references to objectively real bodies, that is as references to the immanent representational content of human minds. The article proposes a new solution to the long-standing problem of the universality of essences in Spinoza's ontology. It argues that, according to Spinoza, particular things in nature possess unique essences, but that these essences coexist with more general, mind-dependent species-essences, constructed by finite minds on the basis of similarities that obtain among the properties of formally-real particulars. This account provides the best fit both with the textual evidence and with Spinoza's other metaphysical and epistemological commitments. Technological structure arises as a consequence of innovation processes, encompassing R&D activities, implementations, as well as diffusion. Innovation processes influence technological competitiveness by linking changes in market shares at home and abroad with their technological potential. Increased productivity resulting from higher innovativeness combined with increased technological investments result in changes in relative unit operating costs and higher demand for more technologically advanced products, thus determining the dynamics of economic development. The aim of this study is to analyse the course of (...) determinants of innovation processes and the level of international competitiveness of regions after the COVID-19 crisis, including especially Podlaskie Voivodeship. Regions are classified into three types of exposure (low, medium, high) and crossed with three degrees of risk sensitivity for the regional economy. Podlaskie Voivodeship has medium exposure and lower sensitivity to pandemic crises. Regions with relatively high sensitivity and exposure to COVID-19 lockdowns were motivated to make greater changes in business processes. Podlaskie Voivodeship relies highly on foreign trade, which is why the COVID-19 crisis, the war in Ukraine and limited contacts with Poland’s eastern border have negatively affected the region’s innovation. The analysis shows that the establishment of competitive advantages based on the effects of COVID-19 crises should be expanded by regions with medium or high sensitivity to lockdowns. (shrink)

According to the Principle of Conditional Non-Contradiction (CNC), conditionals of the form “If p, q” and “If p, not q” cannot both be true, unless p is inconsistent. This principle is widely regarded as an adequacy constraint on any semantics that attributes truth conditions to conditionals. Gibbard has presented an example of a pair of conditionals that, in the context he describes, appear to violate CNC. He concluded from this that conditionals lack truth conditions. We argue that this conclusion is (...) rash by proposing a new diagnosis of what is going on in Gibbard’s argument. We also provide empirical evidence in support of our proposal. (shrink)

The article presents hypotheses about the origins of the tradition of Konik Zwierzyniecki’s march, also known as the Lajkonik, formulated over the course of about 200 years, as well as possible cultural connections of the Krakow custom with traditions and rituals developed by other communities. Due to the so far unexplained origin of the Lajkonik character and numerous scientifically acceptable historical and cultural interpretations of the horse costume used in the procession, the article also attempts to perform a comparative analysis (...) of similar folklore phenomena on the basis of examining symbolic connotations. The introduction presents the multifaceted symbolism of the horse in European culture and the use of its character in various folk rituals, mostly of a religious or apotropaic character. The main part of the text presents the history of the evolution of scientific views on Lajkonik and distinguishes the most important, possible interpretations of the Konik Zwierzyniecki puzzle. The aim of the article is to systematize and collect the hypotheses outlined so far, but dispersed in numerous publications, regarding the origin, cultural and historical significance of the Lajkonik march. The direct subject of the analysis are the monographic studies, diaries, memoirs, protocols and scientific articles presented in the footnotes and bibliography, analyzed by using the comparative and analytical-synthetic method. Although the article does not provide an explanation of the Lajkonik phenomenon, it is a scientifically significant collection of historical, cultural, linguistic and ethnological information on the Krakow custom and similar European traditions. Due to the multifaceted approach to the subject and the presentation of seemingly unrelated scientific findings from separate fields, this text may also be used for further research aimed at unraveling and determining the genesis of the Krakow tradition of Konik Zwierzyniecki. Our way of seeing things depends upon the state of our minds. We can look at the world through the lenses of love, hate or indifference. What remains largely unquestioned about science is its essence. Scientific objectivity is not free from subjectivity. I argue that objective, scientific knowledge is a partial knowledge based on indifference, the state of mind that constitutes the scientific attitude. Hate does not produce knowledge at all, but reinforces our prejudices. However, love gives the possibility of (...) knowing someone or something fully, and not only as an object. Once we accept that our experiences, thoughts, and feelings are not incommunicable, we can arrive at inter-subjective and non-objective moral knowledge which results from our recognition of others as persons and our affective engagement with the world. The notion of objectivity in science has come under critique of feminist writers. The scientific ideal of a detached, neutral observer, who has no race, no gender, no cultural identity, no class, and views the world “from nowhere,” has been challenged, and patterns of domination explored. Feminists argue that objectivity is a tacit generalization from the subjectivity of a small, privileged social group “of educated, usually prosperous, white men.” Hence, it is a result of the denial of the subjectivity of (...) women and other marginalized people. The task which I set before myself is to inquire into the problem of objectivity in science and to explore the relationship between objectivity and subjectivity. I argue that, although the feminists’ critique of objectivity contributes to a greater awareness of the problem of objectivity in science and indeed subjectivity matters, their critique is ill founded. It is an example of one of many stereotypes and simplifications that we can find in today’s feminist thought. The affective engagement with the world, the approach that I propose, leads us to knowledge beyond objectivity. It is a prerequisite of knowing persons as persons and things as they are. (shrink)

Many scholars have argued that unity of humankind can be established on the basis of some basic or core human values. Instead of engaging in a comparative empirical research, compiling lists of core values derived from different cultures, discuss their relevance for human fellowship, I examine the simple values of life that during the 1980s united people in Poland and made them to form the powerful civic movement, which was Solidarity.Poland’s Solidarity of the 1980s has not yet entered a canon (...) of routinely studied great social movements. However, it has initiated a profound world transformation. We are no longer divided by a global confrontation between communism and liberal democracy. The main today’s issue is globalization. Although altered in many respects, the world has still been affected by many serious problems. They necessitate another positive world transformation and a new Global Solidarity that can undertake it.A Global Solidarity movement can learn from Poland’s Solidarity. My contention is that it should not be grounded in any ideological thinking, but in inclusive values—values that do not divide but can potentially unite all human beings—and these values can be derived from basic human needs. In short, Global Solidarity should be based on what I call the “righteousness of life”. It can be achieved if there is a growing recognition of what is right for life and a growing interest in protecting and enhancing life.Building a Global Solidarity is not an attempt to replace governments, but rather to exert pressure on them, so that they support international organizations and consider the welfare of all humanity. While wielding power that at present none of the NGOs represent, Global Solidarity can be a life promoting and enhancing instrument of global society through which a more humane world will be achieved. This article presents Grotius’s argument against raison d’état and his defense of the rule of law in international relations. Grotius remains an important voice in the debate about the character of international politics. He challenges the views of the adherents of the doctrine of raison d’état who, following Machiavelli, give rulers the license to disobey legal and ethical norms whenever the vital interests of the state are at stake, and to use any means to achieve their goals, including warfare. On (...) the other hand, he also takes a position against pacifists who on moral or religious grounds are adverse to any war. The paper explores situational and dispositional underpinnings of cooperative behavior. According to psychological research, cooperation is strongly related to affective states and personality dimensions. In an experimental study we examined the conditions under which people cooperate with each other. The dispositional traits of co-workers, the contribution to a collaborative effort, and a situational factor – ambient odor condition were taken into consideration. A one-way ANOVA revealed that compared to a malodorous condition, both the pleasant odor condition and the natural odor (...) condition showed higher rates of cooperation. Further analysis indicated that only malodors influenced affective states which in turn determined social decisions. Although we found effects for the participants’ agreeableness and the coworker’s contribution to a joint work, they appeared to play a less critical role than affective states induced by the experimental odor conditions tested here. In the discipline of international relations there are contending general theories or theoretical perspectives. Realism, also known as political realism, is a view of international politics that stresses its competitive and conflictual side. It is usually contrasted with idealism or liberalism, which tends to emphasize cooperation. Realists consider the principal actors in the international arena to be states, which are concerned with their own security, act in pursuit of their own national interests, and struggle for power. The negative side of (...) the realists’ emphasis on power and selfinterest is often their skepticism regarding the relevance of ethical norms to relations among states. National politics is the realm of authority and law, whereas international politics, they sometimes claim, is a sphere without justice, characterized by active or potential conflict among states. A pertinent concern in the human enhancement debate is that human enhancement technologies (HET) are intrinsically bad and, hence, morally impermissible. This article evaluates the related claims about the intrinsic badness of HET by looking into philosophical theories of intrinsic value. It investigates how well-established conceptions of intrinsic value map onto typical bioconservative arguments about HET's intrinsic badness. Three predominant variants of these arguments are explored and found wanting: (i) HET are intrinsically bad owing to their unnaturalness; (ii) the pursuit (...) of HET reveals intrinsically bad character (“the desire for mastery”); and (iii) HET will necessarily undermine intrinsically valuable things (e.g., human dignity). My analysis shows that the debate on intrinsic value places serious constraints on claims about the intrinsic badness of HET. More specifically, the analysis shows that bioconservative arguments are, for the most part, inconsistent, misconceived, and overly speculative. Enhancement interventions cannot be bearers of intrinsic value on any of its plausible understandings, and, even if we could grant such a possibility, there are no compelling reasons to presume that the intrinsic value of HET would be necessarily negative. As a result, claims regarding their moral impermissibility are unwarranted. (shrink)

This paper aims to analyze technical and internal aspects of one particular type of human moral enhancement, i.e. enhancement of moral motivation via direct emotion modulation. More precisely, it challenges the assumption that modifying certain emotions will have the results desired by the advocates of this theory. It is argued that neuropsychological understanding of the role and function of emotions, as well as of underlying cognitive mechanisms, might be relevant for the discussion about biomedical enhancement of moral capacities. Moreover, typical (...) claims about direct emotion modulation seem to be contradicted, or at least seriously challenged, by available neuroscientific data. Particular attention is paid to the theory that emotions are evolved and functionally specialized programs whose task is to coordinate other adaptive mechanisms of human psychology in order to promote one’s fitness. If this view of emotions is plausible, it can be argued that several difficulties for moral bioenhancement theory ensue. Neuroscientific and evolutionary-psychological perspective seem to indicate that emotions don’t fulfill necessary requirements to serve as the vehicles of moral enhancement and it should, therefore, take into account role and function of entire cognitive modules associated with moral decision-making. The article explores the idea that according to Spinoza finite thought and substantial thought represent reality in different ways. It challenges “acosmic” readings of Spinoza's metaphysics, put forth by readers like Hegel, according to which only an infinite, undifferentiated substance genuinely exists, and all representations of finite things are illusory. Such representations essentially involve negation with respect to a more general kind. The article shows that several common responses to the charge of acosmism fail. It then argues that we must (...) distinguish the well-founded ideality of representations of finite things from mere illusoriness, insofar as for Spinoza we can have true knowledge of what is known only abstractly. Finite things can be seen as well-founded beings of reason. The article also proposes that within Spinoza's framework it is possible to represent a finite thing without drawing on representations of mind-dependent entities. (shrink)

According to the Principle of Conditional Non-Contradiction (CNC), unless p is impossible, conditionals “If p, then q” and “If p, then not q” are jointly inconsistent. Although intuitively appealing, CNC gives rise to serious problems that semantic theories of conditionals validating it have to face. Most notably, an example of violation of CNC, as presented by Allan Gibbard, may lead to the conclusion that conditionals do not express propositions at all. In the preset paper we propose a new analysis of (...) Gibbard's argument showing that the violation of CNC is only apparent. Subsequently, we suggest a new way of defining truth conditions for conditional sentences. (shrink)

The discussion of the possibility of world government has been revived since the end of the Cold War and particularly after the turn of the millennium. It has engaged many authors. In this article, I provide a survey of the continuing debate on world government. I explore the leading question of the debate, whether the conditions of insecurity in which states are placed and other global problems that face contemporary humanity require the creation of a global authority, and consequently, the (...) establishment of a world state. After a careful analysis I suggest that a world state is neither necessary nor inevitable nor desirable. I argue that the plurality of nation-states that form an international society has a great advantage over a world state. It supports the diversity of character and culture, and sustains the continuous progress of humankind. (shrink)

Reasoning with conditionals is central to everyday life, yet there is long-standing disagreement about the meaning of the conditional. One example is the puzzle of so-called missing-link conditionals such as "if raccoons have no wings, they cannot breathe under water." Their oddity may be taken to show that conditionals require a connection between antecedent ("raccoons have no wings") and consequent ("they cannot breathe under water"), yet most accounts of conditionals attribute the oddity to natural language pragmatics. We present an experimental (...) study disentangling the pragmatic requirement of discourse coherence from a stronger notion of connection: probabilistic relevance. Results indicate that mere discourse coherence is not enough to make conditionals assertable. (shrink)

In _Suppose and Tell_, Williamson makes a new case for the material conditional account. He tries to explain away apparently countervailing data by arguing that these have been misinterpreted because researchers have overlooked the role of heuristics in the processing of conditionals. Cases involving the receipt of apparently conflicting conditionals play an important dialectical role in Williamson’s book: they are supposed to provide evidence for the material conditional account as well as for the defeasibility of a key procedure underlying our (...) everyday assessments of conditionals. We argue that they can serve neither of these purposes and that Williamson overestimates the reach of heuristics. We specifically challenge Williamson’s assumption that, in the kind of cases centrally at issue in his book, the recipient of conflicting conditionals will typically accept those at face value, even granting Williamson that conditionals can be freely passed among speakers under normal conditions of testimony. The paper offers a new account of Spinoza's conception of “substance”, the fundamental building block of reality. It shows that it can be demonstrated apriori within Spinoza's metaphysical framework that (i) contrary to Idealist readings, for Spinoza there can be no substance that is not determined or modified by some other entity produced by substance; and that (ii) there can be no substance (and hence no being) that is not a thinking substance.

We live in an era when increasing numbers of babies are conceived through assisted reproduction technologies (ART). Using a comprehensive approach, the present research seeks to contribute to the understanding of gender differences in experiencing and coping with infertility, and in dealing with ART treatment. Our sample consisted of 10 heterosexual couples aged 24 to 43 and the data were collected through semi-structured interviews. In the studied sample, gender differences existed not only in experiences of infertility, but also in understanding (...) it, and in dealing with ART treatment. Responses to stress caused by infertility were stronger in women and they also perceived this stress more intensely than men. For women the central aspect of infertility was the desire for a child, while for men it was perceived more as a socially imposed obligation to fulfill the male role. (shrink)

The History of the Peloponnesian War of Thucydides is usually seen as an archetypal statement of power politics. Thucydides is regarded as a political realist who asserts that the pursuit of moral principles does not enter the world of international affairs. The article shows that, on the contrary, we find in Thucydides' work a complex theory. He supports neither extreme realism, in which morality is denied, nor utopian idealism which overlooks the aspect of power in international relations. He is profoundly (...) interested in ethical issues in domestic and international politics. One can see in the History the first example of realist-idealist debate and its conclusions are still valid for us. (shrink)

The article is an introduction to the issue of Polish literature written in Germany after 1989. The first part of the work focuses around the current literary discussions on defining and developing the terminology and methods enabling research into this new literature – written abroad after the fall of the Iron Curtain. Post­-emigration literature, migration literature, minority literature, multi­-, inter­-, trans­-cultural and diasporic literature – these are only a few of the suggested terms. The second part of the article refers (...) to the works of selected representatives of Polish literature written after 1989 and the issues they discuss in their works. The purpose of the article is to briefly present the complexity of an important problem in the views of Polish, German and Slavic philologists. At the same time, it aims to show that study of the phenomenon in question is still insufficient. (shrink)
