In a discussion of the spread of Latin in ancient Palestine it has been argued that, apart from Westerners like Jerome who settled in the province and a number of translators from Greek into Latin and from Latin into Greek, three Latin authors whose works are extant may have been, with various degrees of probability, natives of the country. These are Commodian of Gaza, arguably the earliest extant Christian Latin poet; Eutropius, the author of abreviariumof Roman history, who apparently hailed (...) from Caesarea; and the anonymous author of theDescriptio totius mundi et gentium, who certainly was a native of the Syro-Palestinian region, and conceivably of one of the Palestinian cities. Here I wish to discuss another case, which seems to me characteristic of the reluctance of scholars to admit that Latin, and Latin authors, were more prevalent in the East than is usually acknowledged. In fact, it may be not misleading to assert that the invariably adduced exceptions of Ammianus Marcellinus and Claudian as Latin writers from the East are exceptions by virtue of the quality of their work rather than by its very existence. This book makes a significant contribution to the contemporary debate about multiculturalism and democratic theory. It reflects upon the ways in which claims about culture and identity are advanced by immigrants, national minorities, aboriginals, and other groups. It argues that liberal democrats should provide recognition and support for minority cultures and identities, and examines case studies from a number of different societies to show how theorists can learn about justice.

The thesis of the present volume is critical and dual. (1) Present day philosophy of man and sciences of man suffer from the Greek mis taken polarization of everything human into nature and convention which is (allegedly) good and evil, which is (allegedly) truth and fal sity, which is (allegedly) rationality and irrationality, to wit, the polar ization of all fields of inquiry, the natural and social sciences, as well as ethics and all technology, whether natural or social, into the (...) totally positive and the totally negative. (2) Almost all philosophy and sci ences of man share the erroneous work ethic which is the myth of man's evil nature - the myth of the beast in man, the doctrine of original sin. To mediate or to compromise between the first view of human nature as good with the second view of it as evil, sociologists have devised a modified utilitarianism with deferred gratification so called, and the theory of the evil of artificial competition (capitalist and socialist alike) and of keeping up with the Joneses. Now, the mediation is not necessary. For, the polarization makes for abstract errors which are simplistic views of rationality, such as reductionism and positivism of all sorts, as well as for concrete errors, such as the disposition to condemn repeatedly those human weaknesses which are inevitable, namely man's inability to be perfectly rational, avoid all error, etc. , thus setting man against himself as all too wicked. In California Dental Association v. FTC, 119 S. Ct. 1604, the U.S. Supreme Court reviewed a decision by the U.S. Court of Appeals for the Ninth Circuit that a nonprofit affiliation of dentists violated section 5 of the Federal Trade Commission Act, 15 U.S.C.A. § 45, which prohibits unfair competition. The Court examined two issues: the Federal Trade Commission's jurisdiction over the California Dental Association ; and the proper scope of antitrust analysis. The Court unanimously held that CDA was subject (...) to FTC's jurisdiction, but split 5-4 in its finding that the district court's use of abbreviated rule-of-reason analysis was inappropriate.CDA is a voluntary, nonprofit association of local dental societies. It boasts approximately 19,000 members, who constitute roughly threequarters of the dentists practicing in California. Although a nonprofit, CDA includes for-profit subsidiaries that financially benefit CDA members. CDA gives its members access to insurance and business financing, and lobbies and litigates on their behalf. Members also benefit from CDA marketing and public relations campaigns. (shrink)

Multifunctionality poses significant challenges for human brain mapping. Cathy Price and Karl Friston argue that brain regions perform many functions in one sense and a single function in another. Thus, neuroscientists must revise their “cognitive ontologies” to obtain systematic mappings. Colin Klein draws a different lesson from these findings: neuroscientists should abandon systematic mappings for context-sensitive ones. I claim that neither account succeeds as a general treatment of multifunctionality. I argue that brain areas, like genes or organs, are multifunctional in (...) different ways. I call this the “functional heterogeneity hypothesis.” I contend that different multifunctional parts require different mapping strategies. (shrink)

AS IS WELL KNOWN, Thomas Aquinas stands out from his contemporaries in his apparent willingness to defend the possibility of an eternal but created universe, although, like all orthodox Christian believers, he affirmed that the world had a temporal beginning in the light of Scriptural teaching. That Thomas Aquinas (...) defended the possibility of an eternal creation was amply demonstrated over a decade ago by Fr. NOONE world could be both eternal and created, while another pair of studies by Aersten and van Veldhuijsen have begun to explore from a more historical perspective the importance of Aquinas's formulation of the doctrine of creation for understanding his thought and its distinctiveness.3 The present paper is intended not so much to challenge the conclusions of any of these admirable studies as to put their findings into a wider historical framework through which we may hope to discover what is unique in Aquinas's doctrine of creation. In reading the Scriptum super Sententias of Thomas Aquinas, one is immediately struck by the novelty of Aquinas's claim that the philosophers and thus reason itself may reach the conclusion that the world is created. Such a claim seems quite different from the account of the philosophical knowledge of creation given by several of St. Thomas's immediate predecessors and contemporaries. What, then, emboldens Aquinas to make such a claim? Is Aquinas's reading of the philosophers so original and so superior to that of his contemporaries that he is capable of seeing in the philosophers a doctrine of creation that they missed? Or does Aquinas's originality on the philosophical demonstrability of creation have more to do with a reformulation of the doctrine of creation? Or does Aquinas both have an original interpretation of the philosophers and a different understanding of the doctrine of creation? In an attempt to answer these questions, the present paper will survey early and mid-thirteenth century views on the philosophers and the doctrine of creation and compare those views to Aquinas's position in the Scriptum super Sententias. As a result of numerous, highly publicized, ethical breaches, firms and their agents are under ongoing scrutiny. In an attempt to improve both their image and their ethical performance, some firms have adopted ethical codes of conduct. Past research investigating the effects of ethical codes of conduct on behavior and ethical attitudes has yielded mixed results. In this study, we again take up the question of the effect of ethical codes on ethical attitudes and find strong evidence to suggest that (...) business professionals employed at firms with ethical codes of conduct are significantly less accepting of ethically questionable behavior toward most stakeholders. One notable exception relates to ethical actions toward customers. (shrink)

We describe the results of an experiment testing for the presence of strong altruism among Christians in New Zealand. The study examined anonymous participant generosity to cohort. We found that in modified dictator games, anonymous Christians in New Zealand gave significantly more to Canadian Christians than anonymous New Zealand citizens gave to their fellow citizens. The gifting opportunities occurred after anonymous benefactors observed recipients willingly undertake costly acts of group commitment. We found that mean gifting after witnessing a fellow group (...) member metaphorically "fall on a hand grenade" to punish a member of an out-group was almost four times greater in the Christian group than it was in the New Zealand control. Our data support the hypothesis that religious altruism exists and is especially strong among Christians in New Zealand. The data also weakly support a multi-level selection hypothesis for the evolution of religious altruism. (shrink)

In “Reliabilism Leveled” Jonathan Vogel (2000) provides a strong case against epistemic theories that stress the importance of tracking/sensitivity conditions. A tracking/sensitivity condition is to be understood as some version of the following counterfactual: (T) ~p oÆ ~Bp (T) says that s would not believe p, if p were false. Among other things, tracking is supposed to express the external relation that explains why some justified true beliefs are not knowledge. Champions of the condition include Robert Nozick (1981) and, more (...) recently, Keith DeRose (1995). To my knowledge, the earliest formulation of the counterfactual condition is found in Fred Dretske’s conclusive reasons condition (1971), which says, s would not have had the reason that she does for believing p, if p were false. Vogel contends that any such counterfactual condition on knowledge will render the theory of knowledge too strong. He believes that there is at least some possible reflective knowledge that cannot satisfy the counterfactual--viz., the possible knowledge that one does not believe falsely that p. The alleged impossibility of such reflective knowledge is taken by Vogel to be a decisive objection to the tracking theories advocated by Dretske, Nozick, DeRose1 and others. The criticism finds its roots in Vogel’s earlier work (1987), and recurs in papers by Ernest Sosa (2002, 1996). Sosa suggests that the externalist idea behind tracking is on target, but that Nozick’s counterfactual is a misbegotten regimentation of the idea. In its place Sosa offers his own counterfactual “safety” condition, which he feels properly captures the externalist idea. Sosa’s counterfactual is not the topic of this paper. I mention it only to point out that the criticism that constitutes the subject of my investigation is meant to do a lot of work. In Sosa’s 1 case the criticism is meant to motivate his own counterfactual analysis, and in Vogel’s case the criticism promises to be a silver bullet against a theory that has recently found renewed life in the work of Keith DeRose.. In this paper and its sequel, I consider the significance of Jarrett’s and Shimony’s analyses of the so-called factorisability condition for clarifying the nature of quantum non-locality. In this paper, I focus on four types of non-locality: superluminal signalling, action-at-a-distance, non-separability and holism. In the second paper, I consider a fifth type of non-locality: superluminal causation according to ‘logically weak’ concepts of causation, where causal dependence requires neither action nor signalling. In this connection, I pay special attention to the difficulties (...) that superluminal causation raises in relativistic space–time. I conclude by evaluating the relevance of Jarrett’s and Shimony’s analyses for clarifying the question of the compatibility of quantum non-locality with relativity theory. My main conclusions are, first: these analyses are significant for clarifying the questions of superluminal signalling in quantum phenomena and for the compatibility of these phenomena with relativity. But, second, by contrast: these analyses are not very significant for the study of action-at-a distance, superluminal causation, non-separability and holism in quantum phenomena. (shrink)

This article explores normative questions about what legal rights settled immigrants should have in liberal democratic states. It argues that liberal democratic justice, properly understood, greatly constrains the distinctions that can be made between citizens and residents. The longer people stay in a society, the stronger their moral claims become, and after a while they pass a threshold that entitles them to virtually the same legal status as citizens and eventually easy access to citizenship itself.

This study measures social desirability bias (SD bias) by comparing the level of discipline sales managers believe they would administer when supervising unethical selling behavior with the level of discipline they perceive other sales managers would select. Results indicate the presence of SD bias; the sales manager respondents consistently claimed that they would be stricter while their peers would be more lenient. Using an analytical technique that takes social desirability bias into account, it appears that sales managers use of (...) discipline is affected by the sales performance of the salesperson being disciplined resulting in more lenient discipline for top sales performers. In addition, the more lenient treatment for top sales performers persists even when there is a pattern of a prior ethical infraction and the existence of an explicit organizational policy proscribing the act in question. Sales managers believe that, like themselves, others would be stricter when an unethical act is committed for the second time but not as strict as they personally would be. A within-subjects interaction effect indicates more SD bias under the condition of the unethical act being committed for the second time. (shrink)

This study addresses the impacts of new genetic discoveries and technologies on different segments of today's society. The book begins with a chapter on genetic complexity, and subsequent chapters discuss moral and ethical questions arising from today's genetics from the perspectives of health care professionals, the media, the general public, special interest groups and commercial interests.

In our papers on the rationality of magic, we distinghuished, for purposes of analysis, three levels of rationality. First and lowest (rationalitYl) the goal directed action of an agent with given aims and circumstances, where among his circumstances we included his knowledge and opinions. On this level the magician's treatment of illness by incantation is as rational as any traditional doctor's blood-letting or any modern one's use of anti-biotics. At the second level (rationalitY2) we add the element of rational thinking (...) or thinking which obeys some set of explicit rules, a level which is not found in magic in general, though it is sometimes given to specific details of magical thinking within the magical thought-system. It was the late Sir Edward E. Evans-Pritchard who observed that when considering magic in detail the magician may be as consistent or critical as anyone else; but when considering magic in general, or any system of thought in general, the magician could not be critical or even comprehend the criticism. Evans-Pritchard went even further: he was sceptical as to whether it could be done in a truly consistent manner: one cannot be critical of one's own system, he thought. On this level (rationalitY2) of discussion we have explained (earlier) why we prefer to wed Evans Pritchard's view of the magician's capacity for piece-meal rationality to Sir James Frazer's view that magic in general is pseudo-rational because it lacks standards of rational thinking. A defining characteristic of Alzheimer’s disease is difficulty in retrieving semantic memories, or memories encoding facts and knowledge. While it has been suggested that this impairment is caused by a degradation of the semantic store, the precise ways in which the semantic store is degraded are not well understood. Using a longitudinal corpus of semantic fluency data, we derive semantic network representations of patients with Alzheimer’s disease and of healthy controls. We contrast our network-based approach with analyzing fluency data with (...) the standard method of counting the total number of items and perseverations in fluency data. We find that the networks of Alzheimer’s patients are more connected and that those connections are more randomly distributed than the connections in networks of healthy individuals. These results suggest that the semantic memory impairment of Alzheimer’s patients can be modeled through the inclusion of spurious associations between unrelated concepts in the semantic store. We also find that information from our network analysis of fluency data improves prediction of patient diagnosis compared to traditional measures of the semantic fluency task. (shrink)

Actions for which we are responsible constitute our engagement with the world as rational agents. What is the relationship between such actions and our capacities for rational agency? I take this to be a question about responsibility in a particular use of that term, which I shall call ‘responsibility2’. We are not responsible2 for all our intentional actions (actions under hypnosis, for example), but we can nevertheless be responsible2 for actions we do not adequately control, for negligent actions, and for (...) non-intentional omissions. Appreciating this helps show that familiar principles of responsibility are false: those which delimit responsibility to intentional actions or to actions and outcomes under our control. In the attempt to fashion an alternative principle, cases of negligence prove pivotal. We hold ourselves and others responsible2 for conduct within our respective ‘domains of secure competence’, (i.e. that within which we are confident of doing what we set ourselves to do, barring events which defeat our competence), even when actions within that domain fail. The significance of this practice of holding ourselves and others responsible2 lies in the way it maintains our sense of who we are and of how we are related to the world in which we act.1. (shrink)

In Wittgenstein on Meaning, Colin McGinn argues that the skeptical argument that Kripke distills from Wittgenstein's rule-following considerations generates at most what might be called meaning skepticism (the non-factuality view of meaning), and not concept skepticism (the non-factuality view of concepts). If correct, this would mean the skeptical reasoning is far less significant than Kripke thinks. Others have seemed to agree with McGinn. I argue that McGinn is wrong here--that, in fact, Kripke's skeptical reasoning has a straightforward extension to concepts. (...) Thorstein Veblen is perhaps best thought of as America’s answer to Karl Marx. This is sometimes obscured by the rather unfortunate title of his most important work, The Theory of the Leisure Class (1899), which misleading, insofar as it suggests that the book is just a theory of the “leisure class.” What the book provides is in fact a perfectly general theory of class, not to mention property, economic development, and social evolution. It is, in other words, a system of (...) theory that rivals Marx’s historical materialism with respect to scope, generality and explanatory power. Furthermore, it is a system of theory whose central predictions, with respect to the development of capitalism and the possibilities for emancipatory social change, have proven to be essentially correct. When stacked up against Marx’s prognostications, this success clearly provides the basis for what might best be described as an invidious comparison. (shrink)

Study of the foreign magistri and protomagistri of the medieval cathedral of Ragusa (Dubrovnik) (ca 1130-1350, rebuilt after 1693) reveals the social dynamics of artists’ travel in Mediterranean ports. Building on previous research of the builders’ artistic contexts and references, this analysis combines close reading and comparison of contract documents, discussion of Ragusa’s foreign citizenship law, and questions informed by the sociology of mobility. The study concludes that the governor patrons of Ragusa Cathedral exploited the increased physical and occupational mobility (...) of Adriatic builders, then arrested that mobility by offering the builders social advantages in the form of professional security and a path to citizenship. This balance of mobility at multiple levels manifested in the cathedral’s cosmopolitan and open-ended design. (shrink)

In 1981 S. W. Hawking and J. Hartle presented a quantum mechanical description of the early stages of possible cosmological evolution. Their proposal was interpreted by many authors as a pattern of cosmic creation from nothing in which no divine Creator is needed. In this approach, physically defined “nothing” was identified both with the empty set of set theory and with metaphysical nothingness. After defining philosophical presuppositions implicitly assumed in Hawking's paper, one discovers that this alleged nothingness has all properties (...) of the philosophically conceived Logos accepted by Hellenic philosophers of the Neoplatonic tradition. Consequently, Hawking's theory of creation remains consistent with Christian theism, and its only theological opponents can be found among defenders of Samuel Clark's God of scientific gaps. There are three distinct forces that conspire to produce a great deal of economic misery. We can refer to them, for convenience, as misfortune, unfairness, and improvidence. Political philosophers have often shown an interest in one or another of these, but seldom all three. Furthermore, those who do acknowledge all three have often felt driven to collapse them into one root cause of inequality. My goal in this essay will be to argue that the three are independent of one another, (...) but more importantly, that they each require distinct remedies. This is important for egalitarians because it defeats any attempt to develop a “one-size-fits-all” policy aimed at creating a more equal society. This analysis helps us to understand several of the tensions that arise in our attempts to combat inequality that are often obscured by an overemphasis on the power of redistributive taxation as well as generalized inattention to the way that successful welfare states achieve meaningful progress in promoting greater equality. Philosophical discussions of mechanisms and mechanistic explanation have often been framed by contrast to laws and deductive-nomological explanation. A more adequate conception of lawfulness and nomological necessity, emphasizing the role of modal considerations in scientific reasoning, circumvents such contrasts and enhances understanding of mechanisms and their scientific significance. The first part of the paper sketches this conception of lawfulness, drawing upon Haugeland, Lange, and Rouse. This conception emphasizes the role of lawful stability under relevant counterfactual suppositions in scientific reasoning across (...) the sciences, in place of traditional conceptions of law that are primarily confined to the physical sciences. It also extends lawful stability beyond verbally or mathematically expressed law-statements, to encompass other ways of conjoining patterns in the world with scientific pattern recognition. The remainder of this paper shows how and why mechanisms constructively exemplify this conception of lawfulness in scientific practice: • Mechanisms are robust, counterfactually stable and inductively projectible patterns, even though they are not exceptionless “laws of nature”. • Mechanistic explanations often take non-verbal forms, which consequently resist philosophical inclinations to semantic ascent, but understanding lawfulness in terms of counterfactually stable pattern recognition accounts for these ways in which scientific understanding outruns the expressive capacities of natural languages; • Mechanisms are sometimes characterized as real patterns in the world, and sometimes as epistemic representations; understanding mechanisms as modal patterns shows why both conceptions are needed, as mutually supportive. • Mechanisms are typically open-ended, and only partially specified, in ways open to and directive toward further articulation and revision. Understanding mechanisms as modal patterns incorporates this aspect of mechanistic understanding within a broader conception of scientific understanding as embedded in research practice, rather than in bodies of knowledge extracted from it. • Mechanistic explanation has often been placed on the causal side of an opposition between causal and nomological explanation, but understanding mechanisms as modal patterns helps overcome that opposition, and contributes to a pluralist conception of causal relations and their characteristic forms of counterfactual invariance. • The recognition of mechanisms as modal patterns allows for a new way to think about the relations among distinct levels of a mechanistic hierarchy, and the broader scientific significance of mechanistic understanding.
