Over the last few decades, multiple studies have examined the understanding of participants in clinical research. They show variable and often poor understanding of key elements of disclosure, such as expected risks and the experimental nature of treatments. Did the participants in these studies give valid consent? According to the standard view of informed consent they did not. The standard view holds that the recipient of consent has a duty to disclose certain information to the profferer of consent because valid (...) consent requires that information to be understood. The contents of the understanding and disclosure requirements are therefore conceptually linked. In this paper, we argue that the standard view is mistaken. The disclosure and understanding requirements have distinct grounds tied to two different ways in which a token of consent can be rendered invalid. Analysis of these grounds allows us to derive the contents of the two requirements. It also implies that it is sometimes permissible to enroll willing participants who have not understood everything that they ought to be told about their clinical trials. (shrink)

Both male ornamentation and male combat result in increased male mortality. Because population sizes are limited by a carrying capacity, increased age-specific adult male mortality will result in decreased age-specific adult female mortality, as well as decreased juvenile mortality. As intersexual competition is one form of intraspecific competition, through choosing to mate with ornamented and/or combative males, females in polygamous systems reduce intraspecific competition. Because average male fitness must exactly equal average female fitness, male fitness will paradoxically rise with increasing (...) male mortality. This theory also offers new perspectives on peripheral problems to sexual theory, such as mate location, resource guarding, leks, harems, and others. (shrink)

We argue that there is a conflict among classical theism's commitments to divine simplicity, divine creative freedom, and omniscience. We start by defining key terms for the debate related to classical theism. Then we articulate a new argument, the Aloneness Argument, aiming to establish a conflict among these attributes. In broad outline, the argument proceeds as follows. Under classical theism, it's possible that God exists without anything apart from Him. Any knowledge God has in such a world would be wholly (...) intrinsic. But there are contingent truths in every world, including the world in which God exists alone. So, it's possible that God contingently has wholly intrinsic knowledge. But whatever is contingent and wholly intrinsic is an accident. So, God possibly has an accident. This is incompatible with classical theism. Finally, we consider and rebut several objections. (shrink)

Interpreting John Paul II's message to the Pontifical Academy of Sciences in the context of the new scientific discoveries concerning the mitochondrial DNA, one can argue that the human species emerged in Africa some 200,000 years ago. The very problem of the emergence of the human soul in the process of biological evolution represents a subject outside the cognitive competence of science. Attempts can be undertaken to explain this issue in the epistemological perspective of philosophy and theology. In traditional versions (...) of evolutionary theism, God* s interaction in nature was interpreted in causal categories when deterministic dependences were stressed in the process of evolutionary growth. In new proposals, God's presence in an evolving nature has been explained in categories of potentialities and propensities built by God into an evolving Nature. Consequently, in this approach God could be conceived not as a Paleyan designer but rather as a composer unfolding the possibilities hidden in His creation. The future of the evolutionary process depends not only on cosmic physical determinants; it depends to a large extent on the quality of cooperation of human actions with the influence of the Divine Creator. Accordingly, the shape of human culture, as well as the state of moral consciousness of Homo sapiens, should be taken into consideration to discuss the future evolution of the human species. /// Interpretando a mensagem do Papa João Paulo II à Academia Pontifícia das Ciências no contexto das novas descobertas científicas referentes ao DNA mitocondrial, o autor do artigo considera ser possível defender que a espécie humana surgiu em África há cerca de 200 000 anos. Contudo é possível realizar tentativas no sentido de explicar esta questão na perspectiva epistemológica da filosofia e da teologia. Nas versões tradicionais do teísmo evolutivo, a interacção de Deus com a natureza era interpretada segundo categorias causais quando as dependências deterministicas eram sublinhadas no processo do desenvolvimento evolutivo. No contexto de novas propostas interpretativas, a presença de Deus na ordem evolutiva tem sido explicada em termos das potencialidades e das propensidades induzidas por Deus na Natureza em evolução. Consequentemente, segundo esta abordagem Deus poderia ser concebido não como sábio projectista de que fala William Paley, mas antes como um compositor fazendo vir ao de cima as possibilidades escondidas na sua própria criação. O futuro do processo evolutivo depende não apenas das determinantes físicas do cosmos; ele depende em larga medida da qualidade da cooperação das acções humanas com a influência do Criador. Neste sentido, o artigo defende que a forma da cultura humana, bem como o estado da consciência moral do homo sapiens deve ser tido em consideração em ordem a se poder discutir a evolução futura da espécie humana. ABSTRACT I begin by developing a challenge for the Higher-Order Thought variant of Higher-Order representational theories of consciousness. The challenge is to account for the distinctive phenomenal character of visual experience—its presentational character. After setting out the challenge, I articulate a novel form of Higher-Order theory that can account for presentational character—the Map Theory of consciousness. The theory’s distinctive claim is that the relevant higher-order representations have a cartographic format.

Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. However, rejecting these generalizations for a more (...) nuanced view still has dramatic implications for the status quo in both health policy and clinical ethics. (shrink)

Moral responsibility requires that we are in control of what we do. Many contemporary accounts of responsibility cash out this control in terms of abilities and hold that the relevant abilities are strong abilities, like general abilities. This paper raises a problem for strong abilities views: an agent can plausibly be morally responsible for an action or omission, despite lacking any strong abilities to do the relevant thing. It then offers a way forward for ability‐based views, arguing that very weak (...) abilities can form the basis of moral responsibility for both actions and omissions. (shrink)

Does the Second Amendment protect those who threaten others by negligently or recklessly wielding firearms? What line separates constitutionally legitimate gun displays from threatening activities that can be legally proscribed? This article finds guidance in the First Amendment doctrine of true threats, which permits punishment of “statements where the speaker means to communicate a serious expression of an intent to commit an act of unlawful violence to a particular individual or group of individual.” The Second Amendment, like the First, should (...) not be read to protect those who threaten unlawful violence. And to the degree that the constitution requires a culpable mental state in such circumstances, the appropriate standard should be recklessness. (shrink)

Lakatos claimed that Popper wrote of beliefs; thus ascribing subjectivism to him Popper flatly denied this, treating it a willful distortion.1 Ironically, it is the theory of Lakatos that is subjectivist.

The aim of this paper is to show that a corollary of resolute readings of Wittgenstein’s conception of nonsense cannot be sustained. First, I describe the corollary. Next, I point out the relevance to it of Wittgenstein’s discussion of family resemblance concepts. Then, I survey some typical uses of nonsense to see what they bring to an ordinary language treatment of the word “nonsense” and its relatives. I will subsequently consider the objection, on behalf of a resolute reading, that “nonsense” (...) is a term of philosophical criticism. Finally, I conclude that resolute readings have not sufficiently accounted for how nonsense behaves in our language; they have failed to heed Wittgenstein’s warning: “don’t think, but look!”. The concept of evidence-based medicine (EBM) has been invented by physicians mostly from English Canada, mostly from McMaster University, Ontario, Canada. The term EBM first appeared in the biomedical literature in 1991 in an article written by a prominent member of this group—Gordon Guyatt from McMaster University. The inventors of EBM have also created the Grading of Recommendations, Assessment, Development and Evaluations (GRADE) working group, which is a prominent international organisation whose main purpose is to develop evidence-based clinical practice guidelines (...) (CPGs). CPGs that are based on the GRADE approach are becoming increasingly adopted worldwide, in particular by many professional or governmental organisations. This group of thinkers being thus identified, we have retrieved and read many of their publications in order to try and understand how they intend to incorporate bioethical values into their concept. The author of this little essay did also spend a few years on the internet as an active member of the GRADE group discussion list. The observations thus gathered suggest that although some of the inventors of EBM, at least Gordon Guyatt, wish to incorporate core principles of biomedical ethics into their concept (ie, non-malevolence, beneficence and maybe to a lesser extent respect for autonomy, and justice), some clarifications are still necessary in order to better understand how they intend to more explicitly incorporate bioethical values into their concept and, perhaps more importantly, into evidence-based CPGs. Le procès de la conscience dénonce d'un côté la conscience de l'autre, reconnaît que les religions et les philosophies ne sont que des issues qui permettent de combler le vide d'être que la conscience a creusé en nous.

Recent epistemology and value theory have become more open to the role played by affectivity in the constitution of human knowledge of value. In this paper, two figures important to the phenomenological and personalistic traditions are retrieved as precedents for this contemporary development: Edith Stein and Dietrich von Hildebrand. In the first part of the paper, Stein’s phenomenology of affective acts is adapted as an account of the structure of “value-grasping acts.” The second part of the paper identifies two difficulties (...) that arise on the basis of Stein’s account: how do we know that an emotion constitutes a response to intrinsic value, and how do we know an emotional response to value is most attuned to its object? The remainder of the paper responds to these difficulties, thereby legitimating the account as a viable moral epistemology. These responses draw inspiration from von Hildebrand’s phenomenological accounts of value-response and freedom. (shrink)

Il décrit la révolution de ses modes de représentations provoquée par l’éclatement de la guerre civile libanaise, et cela, au contact du milieu intellectuel et politique français. Cela donna corps à son engagement dans un domaine particulier des mathématiques, la « théorie des jeux ». Il introduit brièvement le cadre conceptuel de cette théorie en vue de (...) l’analyse du conflit, et la façon dont il fut étendu pour y inclure les configurations politiques instables. Au Centre Pompidou-Metz, faisant écho à l'exposition inaugurale, un colloque international a étudié de manière pluridisciplinaire et transversale la question du chef-d'œuvre. Loin de se focaliser sur le débat esthétique, les diverses approches ont assigné le droit, l'histoire, la sociologie, l'économie et les sciences exactes, pour mieux soumettre cet "objet" à un véritable examen clinique. Cette question ne serait-elle plus d'actualité? Loin s'en faut! Entre cœur et raison, la sacralisation des œuvres d'art produit toujours autant de savoirs, de savoir-faire et (...) de savoirs sur le faire. Mettant en avant le patrimoine, restaurant les objets de l'art, les reconstituant, favorisant le tourisme culturel, exhumant le vrai, condamnant le faux : à sa mesure, le "chef-œuvre" dynamise encore et toujours les divers moments de l'art. Participation in competition festivals—where students and ensembles compete against each other for high scores and accolades—is a widespread practice in North American formal music education. In this article, I use Marx's theories of labor, value, and phantasmagoria to suggest a capitalist logic that structures these competitions. Marx's theories might suggest that one of musical performance's educational use-values is its function as a representation of the labor of musical learning. Competitions reward the hiding of this use-value by privileging performances that conceal (...) the labor of musical learning. In hiding this use-value, the performance's exchange-value, or "price," is increased by gaining a higher score. In this way, competitions are phantasmagoric: they conceal learning within the performance in thrall of the exchange-value of a high score. Despite these flaws in competitions, educators and students might exploit competition festivals' value of coming together and comparing learning with others. Rather than retreating from competition festivals, educators might transform them by imagining renewed practices where students and educators come together to share their learning through performance, listening, and dialogue. Herbert Morris argues in his influential retributivist paper, "Persons and Punishment," that criminals deserve punishment because their actions represent an unfair distribution of benefits and burdens in society. The proper distribution of benefits and burdens is important, in part, to restore law abiding citizens’ confidence that others will follow the law. In this paper I show that Morris's argument for why criminals deserve punishment morally requires us to set up an institution of rehabilitation in addition to the institution of punishment. (...) Such an institution is morally required because neither pure punishment systems nor punishment systems that incorporate quasi-rehabilitative aspects have ever worked to uphold the necessary confidence that Morris tells us law abiding citizens must have in order to protect the social order. Moreover, we cannot abandon Morris's appeal to the duty to maintain social order without also abandoning a plausibly Morrisian framework. (shrink)

We once took death to be a permanent part of human experience. This is no longer the case. As death, and its allies pain and suffering, have increasingly become subject to medical treatment and social control, we think of them in new ways. However, as important as this fundamental transformation is, I have chosen to discuss something entirely different in this essay: I contend here that death has a particular sting for us of the contemporary world since we lack stories (...) and metaphors to talk about it. The removal of controversial names and monuments from the public sphere in the United States has gained traction in the context of efforts to achieve social justice for historically mistreated and marginalized communities. Such debates are increasingly raising issues in the healthcare setting as hospitals and medical schools grapple with the legacies of figures whose scientific contributions are clouded with ethical transgressions. Present efforts to address these challenges have largely occurred at the institutional level. The results have been guidelines that (...) are complex, highly inconsistent across institutions, and largely downplay the symbolic importance of such historical redress. This paper proposes a simpler three-part test for name and monument removal in the medical and hospital settings that places greater weight on the symbolic importance of the renaming process itself instead of only considering the outcomes. There is growing interest in developing co-operation between adult literacy researchers and practitioners to further research skills and approaches. Canada’s National Literacy Secretariat has recently initiated a series of policy debates that suggested several possibilities: targeted research grants, research internships for practitioners, practical sabbaticals for researchers, support for networking between literacy researchers and practitioners, and joint seminars and workshops between researchers and practitioners. A common theme throughout these discussions is the need to develop critical thinking about both collaborative research and (...) adult literacy. In this paper we discuss two collaborative initiatives between university-based researchers and adult literacy groups in the provinces of British Columbia and Ontario. Each project was based on the notion of “research circles” and specifically designed to enhance research capacity and critical thinking about literacy research. (shrink)
