This book demonstrates the originality and coherence of Jonathan Edwards' philosophical theology using his dynamic reconception of reality as the interpretive key. The author argues that what underlies Edwards' writings is a radical shift from the traditional Western metaphysics of substance and form to a new conception of the world as a network of dispositions: active and abiding principles that possess reality apart from their manifestations in actions and events. Edwards' dispositional ontology enables him to restate the Augustinian-Calvinist tradition in (...) theology in a strikingly modern philosophical framework. A prime example of Edwards' innovative reconstruction in philosophical theology is his conception of God as both eternal actuality and a disposition to repeat that actuality within God and also through creation. This view is a compelling alternative to the traditional Western doctrine of God as changeless actuality, on the one hand, and the recent process theologians' excessive stress on God's involvement in change, on the other. Edwards' achievement was that he saw dynamic movement as essential to God's own life without compromising the traditional Christian tenets of God's prior actuality and transcendence. The author of this volume also explicates the way in which Edwards' dynamic reconception of reality informs his theories of imagination, aesthetic perception, the knowledge of God, and the meaning of history. In this paper I will discuss three areas in which advances in human reproductive technology could occur, their uses and abuses, and their effects on society. First is the potential to drastically increase the success rate and availability of in vitro fertilization and embryo freezing. Second is the ability to perform biopsies on embryos prior to the onset of pregnancy. Finally, I will consider the adding or altering of genes in embryos, commonly referred to as genetic engineering.As new reproductive technologies (...) pass from experimental models into the potential for medical utilization, I believe that it will be important for lawmakers everywhere to avoid the impulse to outlaw procedures that a society believes to be unnatural at a first glance. Rather, I would hope that they can respond thoughtfully with legislation that serves two purposes — to protect the rights of couples to overcome infertility or to reduce the risk of genetic disease in their children-to-be, and more importantly, to protect children-to-be from the abuses that could result from some of the practices that I will discuss. The problem of epistemic circularity involved in justifying fundamental epistemic principles is one of the fundamental problems of epistemology. One important way out of this problem is a Sellarsian social practice theory of justification, according to which we are justified in accepting an epistemic principle if we can answer all objections raised against it in our social practice of demanding justification and responding to such demands. This paper explains the nature and origin of what I am calling Transgressive Realism, a middle path between realism and anti-realism which tries to combine their strengths while avoiding their weaknesses. Kierkegaard created the position by merging Hegel’s insistence that we must have some kind of contact with anything we can call real (thus rejecting noumena), with Kant’s belief that reality fundamentally exceeds our understanding; human reason should not be the criterion of the real. The result is the idea that (...) our most vivid encounters with reality come in experiences that shatter our categories, the way God’s commandment to kill Isaac irreconcilably clashes with the best understanding of ethics we are capable of. I explain the genesis of this idea, and then show it at work in Heidegger and Levinas’ thought. Understanding this position illuminates important aspects of the history of continental philosophy and offers a new perspective on realism. (shrink)

Contemporary biomedical ethics and environmental ethics share a common ancestry in Aldo Leopold's and Van Rensselaer Potter's initial broad visions of a connected biosphere. Over the past five decades, the two fields have become strangers. Public health ethics, a new subfield of bioethics, emerged from the belly of contemporary biomedical ethics and has evolved over the past 25 years. It has moved from its traditional concern with the tension between individual autonomy and community health to a wider focus on social (...) justice and solidarity. Public health has a broad focus that includes individual, community, and environmental health. Public health ethics attends to these broad commitments reflected in the increasing concern with the connectedness of health of individuals to the health of populations, to the health of animals, to the health of the environment; it is well situated to reconnect all three “fields” of ethics to promote a healthier planet. This paper argues that there is an inconsistency between Jaegwon Kim's earlier work on supervenience and his more recent work on explanatory exclusion. In his work on supervenience Kim advocates an explanatory agnosticism that, by the time of his later work, is replaced by an endorsement of reductive explanation. My argument is that this tension between Kim's early and later work is unfortunate since explanatory exclusion is highly questionable in its own right and is not reconcilable with his earlier work (...) on supervenience anyway. /// El presente artículo sostiene que existe una inconsistencia entre los primeros textos sobre superveniencia de Jaegwon Kim y sus trabajos más recientes sobre exclusión explicativa. Frederic Lee sets out the foundations of a post-Keynesian price theory through developing an empirically grounded production schema. The administered, normal cost and mark-up price doctrines are explained in parts I-III of the book, as many of their theoretical arguments are important for developing the foundations. This involves discussing the work of Gardiner Means, Philip Andrews, and Michal Kalecki as well as the developers of the doctrines, such as Edwin Nourse, Paolo Sylos Labini, Harry Edwards, Josef Steindl and Alfred Eisner. In 2009, health authorities from Taiwan formally attended the 62nd World Health Assembly of the World Health Organization as observers, marking the country’s participation for the first time since 1972. The long process of negotiating this breakthrough has been cited as an example of successful global health diplomacy. This paper analyses this negotiation process, drawing on government documents, formal representations from both sides of the Taiwan Strait, and key informant interviews. The actors and their motivations, along with the forums, practices (...) and outcomes of the negotiation process, are detailed. While it is argued that non-traditional diplomatic action was important in establishing the case for Taiwan’s inclusion at the WHA, traditional concerns regarding Taiwanese sovereignty and diplomatic representation ultimately played a decisive role. The persistent influence of these traditional diplomatic questions illustrates the limits of global health diplomacy. (shrink)

Credal reductivism is the view that outright belief is reducible to degrees of confidence or ‘credence’. The most popular versions of credal reductivism all have the consequence that if you are near-maximally confident that p in a low-stakes situation, then you outright believe p. This paper addresses a recent objection to this consequence—the Correctness Objection— introduced by Jeremy Fantl and Matthew McGrath and further developed by Jacob Ross and Mark Schroeder. The objection is that near-maximal confidence cannot entail outright belief (...) because when you believe a false proposition, you are wrong or incorrect, whereas you can be highly confident of a false proposition in a low-stakes situation without being incorrect. Both Fantl and McGrath’s and Ross and Schoeder’s versions of the Correctness Objection admit of multiple interpretations. But it is argued that even on the most charitable interpretations the objection fails. (shrink)

An episiotomy is ‘an intrapartum procedure that involves an incision to enlarge the vaginal orifice,’1 and is primarily justified as a way to prevent higher degrees of perineal trauma or to facilitate a faster birth in cases of suspected fetal distress. Yet the effectiveness of episiotomies is controversial, and many professional bodies recommend against the routine use of episiotomies. In any case, unconsented episiotomies are alarmingly common, and some care providers in obstetric settings often fail to see consent as necessary (...) in context. In their article, ‘The ethics of consent during labour and birth: episiotomies,’ van der Pijl et al reiterate that consent is necessary for episiotomies. They specify, further, that the antenatal period is crucial for exchanging information, establishing trust between the birthing subject and provider, and exploring the birthing subject’s—rather than the care provider’s—values and preferences regarding episiotomies. They recommend an individualised approach, which would enable birthing subjects to choose how and when they want to give consent. I applaud van der Pijl et al on their practicable recommendations regarding consent for episiotomies. This is certainly a step in the right direction where respect for birthing subjects’ bodily autonomy and integrity is concerned. Still, we must be reminded that consent alone is not coextensive with autonomy. The conditions for securing informed consent in healthcare does not guarantee that one’s decision is truly reflective of their values. Background Nurses providing care to patients with end-of-life or terminal illnesses often encounter ethically challenging situations leading to moral distress. However, existing quantitative studies have examined moral distress using instruments that address general clinical situations rather than those specific to end-of-life care. Furthermore, qualitative studies have often been limited to participants from a single unit or those experiencing moral distress-induced circumstances. A comprehensive and integrated understanding of the overarching process of moral distress is vital to discern the unique circumstances surrounding (...) end-of-life care and its consequential impacts. Research objectives To explore the moral distress experiences of nurses who are frequently involved in caring for patients with end-of-life or terminal illnesses and apply it to two existing theories: the model of moral distress and the ecological model. Research design A qualitative descriptive approach was employed. Participants and research context Seven focus group interviews involving 30 nurses were performed. The subsequent transcriptions underwent rigorous content analysis. Ethical considerations We obtained Institutional Review Board approval from a university. Focus group interviews were conducted with nurses who agreed to participate and signed the consent form. Findings The moral distress-inducing factors and nurses’ perceived impact of moral distress were identified and categorized based on moral distress theories and ecological models. A total of 15 categories and 30 subcategories across the following 4 domains were derived: (1) intrapersonal, (2) interpersonal, (3) organizational, and (4) structural factors. Conclusions End-of-life-specific circumstances induced moral distress among nurses, with both negative and positive impacts identified. Effective organizational and policy support is essential to manage conflicts, form a healthy organizational culture, provide training, and prevent unnecessary expenses due to the negative consequences of moral distress. This article focuses on Homers idea of reflexive rhetoric. The majority of Homeric deliberation scenes contain no deliberative calculi. One approach to this problem would be to generalize from the scenes where Odysseus uses deliberative calculi to those where he does not. One might argue, though, that data have to be transmitted to and outputted from a computer via interfaces, one where data are transformed into electrical impulses, and one where the output is printed as information. The deliberative calculus cannot (...) be the essential link between deliberation and persuasion, though it undoubtedly figures into the process of self-persuasion to the extent that it either explicitly or implicitly brings about a particular decision. In this perspective, the fact that Homer is frequently silent about deliberative calculi is irrelevant to the question of whether Odysseus persuades himself. The idea of Homeric rhetoric is alleged to pose the problem of anachronism. Moving toward an account of reflexive rhetoric allows to see in even greater detail the centrality of rhetoric to human condition. The growing demand for uterus transplantation (UTx) invites continued philosophical evaluation of the function of UTx (and what constitutes its ‘success’), as well as the recipient eligibility for UTx. Currently, UTx caters to partnered, cisgender women of childbearing age looking to get pregnant and give birth to a biogenetically related child. The medical justification for this—the treatment of uterine infertility—explains the primacy of this practice. However, this dominant conceptualization of UTx does not necessarily capture the diverse needs for which both (...) cis- and transgender women might take interest in UTx that are not strictly procreative, such as bodily integrity and gender identity reasons. In this paper, I argue that non-procreative motivations for uterus acquisition ought to be taken seriously as a matter of non-discrimination and consistency. (shrink)

ABSTRACT: Proponents of the ‘Threshold View’ have held that to believe a proposition is to be sufficiently confident of the proposition’s truth, but that there is no sharp cutoff between degrees of confidence that constitute belief and degrees of confidence that do not. Brian Weatherson has objected that no plausible account of vagueness can support this view. In this paper, I reply to Weatherson’s objection. Along the way, I identify a way in which one might hope to maintain the Threshold (...) This essay explores the controversy over peer-to-peer (p2p) software, examining the legal and ethical dimensions of allowing software companies to develop p2p technologies. It argues that, under the Supreme Court’s ruling in the Sony betamax case, technology developers must be accorded the freedom to innovate and develop technologies that are capable of substantial noninfringing uses. This doctrine, known as the Sony doctrine, provides an important safe harbor for technological development, including p2p. The safe harbor, however, does not immunize conduct beyond (...) the design, sale, or supply of the product. For other conduct that falls outside the Sony safe harbor, the traditional standards of secondary liability apply. (shrink)

In recent decades in Korea, many significant changes in political, social and cultural dimensions have been held by the citizen’s initiative, where the revitalization of citizenship and strong civic unity have played a role. Yet, in regard to the characteristic of Korean citizenship, it seems that the aspect of individual subject has not been fully matured or issued; that is, there is a dissymmetry between the strong civic unity and a weak individual subject. This paper attempts to explore a possible (...) historical account of why this has been the case by examining the historical development of the concept of enlightenment in modern Korea and Japan. ‘Enlightenment’, as a modern concept in Korea, was imported via Japan in the period from the late nineteenth century to the early twentieth century as in many other new concepts such as ‘democracy’ or ‘nation’. However, by comparison to the Western idea of the Enlightenment, its modern concept, Korean or Japanese, developed a different meaning in each own context, while lacking its original meaning essential to the creation of the ‘modern individual subject’ as a ‘citizen’. Hence, in modern Korea and Japan, the word ‘enlightenment’ is regarded as a historical concept with no contemporary relevance. (shrink)

The primary aim of this paper is to provide a plausible fictional creationist explanation of when and how a fictional object comes into existence without a successful creative intention, focusing on the problem posed by Stuart Brock’s nominalist author scenario. I first present some intuitions about parallel scenarios for fictional objects and concrete artifacts as data to be explained. Then I provide a sufficient condition for the existence of artifacts that can explain both cases. An important upshot of this is (...) that there is an overlooked way to bring artifacts into existence that should merit serious consideration, and this leads to a version of the mind-dependence, but not the intention-dependence, view of artifacts. Much has been written about the ethics of humanitarian intervention in the past fifteen years. In this paper I discuss a variety of justifications that have been proposed (in fact, seven theories of justification), finding difficulties with each of them, and then I offer a theory of justification of my own. My approach to justification will differ from most of the earlier accounts in two ways. First, I begin the discussion of justification at a different point. Second, I seek to (...) expand the traditional discussion of humanitarian intervention to cover an area not usually addressed, namely, the question of the scope of justified humanitarian intervention. If humanitarian intervention is sometimes justified, precisely when is it justified? This is no merely academic question, given the belated appeal to humanitarian intervention on the part of those scrambling to provide a public justification of the war in Iraq. (shrink)

This essay analyzes two types of patient‐experience data to broaden and deepen understanding of trust in health care. Analysis of patients’ open‐ended comments shows a close connection between patients’ feelings of trust and their intent to recommend providers and provider organizations—a global measure to evaluate patients’ perceptions of care experiences. Patients’ comments also reveal the bidirectional building of trust between the patient and the caregiver. Trust gets built when patients perceive their caregivers to trust their knowledge of their bodies as (...) well as when caregivers demonstrate caring behaviors that earn the patients’ trust. Patients’ ratings of a closed‐ended survey item on “confidence in provider” create the greatest differentiation for the global measure of patient experience—whether patients did or did not recommend a practice or provider. The essay also discusses related findings on pre‐visit friction and the use of humor by the caregiver to expand understanding of trust. (shrink)

To better understand risk management and mutual aid among American ranchers, we interviewed and mailed a survey to ranchers in Hidalgo County, New Mexico, and Cochise County, Arizona, focusing on two questions: When do ranchers expect repayment for the help they provide others? What determines ranchers’ degrees of involvement in networks of mutual aid, which they refer to as “neighboring”? When needs arise due to unpredictable events, such as injuries, most ranchers reported not expecting to be paid back for the (...) help they provide. When help is provided for something that follows a known schedule or that can be scheduled, such as branding, most ranchers did expect something in return for the help they provide. This pattern makes sense in light of computational modeling that shows that transfers to those in need without expectations of repayment pool risk more effectively than transfers that create debt. Ranchers reported helping other ranchers more often when they belonged to more religious and civic organizations, when they owned larger ranches, when they relied less on ranch vs. other income, and when they had more relatives in the area. Operators of midsize ranches reported helping other ranchers more frequently than did those on smaller and larger ranches. None of our independent variables predicted how many times ranchers reported receiving help from other ranchers. Although ranch culture in the American West is often characterized by an ethic of individualism and independence, our study suggests that this ethic stands alongside an ethic of mutual aid during times of need.
