By introducing a name ‘one meter’ and stipulating that it refers to the length of stick S, the stipulator appears to be in a position to gain immediate (and arguably a priori) knowledge of a mind‐ and language‐independent fact—the fact that the length of stick S is one meter. It appears that other users of the name can gain this knowledge only through empirical enquiry. I argue that this presents a paradox. After clarifying the nature of the paradox, I offer (...) a solution by arguing that, contrary to appearances, other users of ‘one meter’ implicitly knew that the length of stick S is one meter before learning the name, as did the stipulator prior to introducing the name. En aras de reflexionar sobre la noción de sujeto, se determina importante revisar el discurso del neoliberalismo y su inscripción en el enigma de la subjetividad. Resignificar el factor de la experiencia humana implica sortear los desafíos de la visión biológica-reduccionista, para privilegiar la máxima del saber inconsciente. El recorrido hermenéutico de este documento (...) retoma un andamiaje interdisciplinario, cuya base es representada por disciplinas como la filosofía, las neurociencias y el psicoanálisis. En tal sentido, se considera necesario efectuar un cambio de paradigma que pondere la historia y constitución subjetiva, en contraposición de prácticas que degradan la singularidad del ser humano. Priorizar la influencia del entorno social en la vida de los educandos, aunado a salvaguardar su desarrollo mental, físico y psicológico, se perfila como un requisito clave para sostener un funcionamiento idóneo del sistema nervioso y construcción del psiquismo. Es imperativo extender el avance de las ciencias a los auspicios de las políticas públicas, vincular el conocimiento neurocientífico y condición subjetiva a los espacios de formación docente, supone un ejercicio de profilaxis educativa. Restituir lafunción de la escuela implica desterrar prácticas homogéneas, de discriminación y violencia, tendientes acolapsar la palabra y justicia social. El recorrido (...) epistemológico de este documento se construye a partir de unencuentro interdisciplinario con disciplinas como la filosofía, psicología y sociología, cuya insignia es revalorar al sujeto aprendiz. El movimiento de transformación hacia prácticas incluyentes supone un reto para los espacios de formación docente y despliegue de políticas educativas con igualdad sustantiva. En tal sentido, la instauración de proyectos libertarios se aleja de las formas de totalización institucional que en tanto sistemas de control y clasificación social, tienden a ratificar procesos de desubjetivación. La aprehensión del saber y producciónde verdades no puede legitimarse como una entelequia, es ineludible reconstruir la historia de la educacióndesde ángulos no enunciados y desde saberes oficialmente obstruidos. Rips para esclarecer el intrincado campo de investigación relacionado con los fundamentos de la inferencia y, en general, del razonamiento humano. The principle of exchange seems to be limited in its application, and it cannot serve as a link between utilitarianism and the idea of a market for interpersonal relations. Our preferences concern the inner states of other people as well as their overt behavior. The neglect of this aspect of our preferences is a result of the coupling of utilitarianism with behaviorism. The problem is thus behaviorism, not consequentialism. It might be argued that commensurability is wrong because it sanctions impure (...) practices - aside from any principle of exchange. In reply, it may be argued that the principle of purity is an intuitive one, which must be justified at a higher level. At the intuitive level, the purity principle competes with the view that practices are in some cases too pure already, and that blind purity cannot be maintained without educational deception. The apparent difficulty of making tradeoffs among different kinds of consequences is a problem in practice, not a problem in principle. The difficulty may indeed justify certain prescriptive rules, but a blanket prohibition against impure practices would seem to require considerable defense. (shrink)

We have been oversold on the base rate fallacy in probabilistic judgment from an empirical, normative, and methodological standpoint. At the empirical level, a thorough examination of the base rate literature (including the famous lawyer–engineer problem) does not support the conventional wisdom that people routinely ignore base rates. Quite the contrary, the literature shows that base rates are almost always used and that their degree of use depends on task structure and representation. Specifically, base rates play a relatively larger role (...) in tasks where base rates are implicitly learned or can be represented in frequentist terms. Base rates are also used more when they are reliable and relatively more diagnostic than available individuating information. At the normative level, the base rate fallacy should be rejected because few tasks map unambiguously into the narrow framework that is held up as the standard of good decision making. Mechanical applications of Bayes's theorem to identify performance errors are inappropriate when (1) key assumptions of the model are either unchecked or grossly violated, and (2) no attempt is made to identify the decision maker's goals, values, and task assumptions. Methodologically, the current approach is criticized for its failure to consider how the ambiguous, unreliable, and unstable base rates of the real world are and should be used. Where decision makers' assumptions and goals vary, and where performance criteria are complex, the traditional Bayesian standard is insufficient. Even where predictive accuracy is the goal in commonly defined problems, there may be situations (e.g., informationally redundant environments) in which base rates can be ignored with impunity. A more ecologically valid research program is called for. This program should emphasize the development of prescriptive theory in rich, realistic decision environments. (shrink)

Motivated by examples from general relativity and Newtonian gravitation, this essay attempts to distinguish between the dynamical structure associated with a theory in physics, and its kinematical structure. This enables a distinction to be made between a structural realist interpretation of a theory based on its dynamical structure, and a structural realist interpretation of spacetime, as described by a theory, based on its kinematical structure. I offer category-theoretic formulations of dynamical and kinematical structure and indicate the extent to which such (...) formulations deflect recent criticism of the radical ontic structural realist's conception of structure as "relations devoid of relata". The difficulty of explaining the outputs of artificial intelligence (AI) models and what has led to them is a notorious ethical problem wherever these technologies are applied, including in the medical domain, and one that has no obvious solution. This paper examines the proposal, made by Luciano Floridi and colleagues, to include a new ‘principle of explicability’ alongside the traditional four principles of bioethics that make up the theory of ‘principlism’. It specifically responds to a recent set of criticisms that (...) challenge the supposed need for such a principle to perform an enabling role in relation to the traditional four principles and therefore suggest that these four are sufficient without the addition of explicability. The paper challenges the critics’ premise that explicability cannot be an ethical principle like the classic four because it is explicitly subordinate to them. It argues instead that principlism in its original formulation locates the justification for ethical principles in a midlevel position such that they mediate between the most general moral norms and the contextual requirements of medicine. This conception of an ethical principle then provides a mold for an approach to explicability on which it functions as an enabling principle that unifies technical/epistemic demands on AI and the requirements of high-level ethical theories. The paper finishes by anticipating an objection that decision-making by clinicians and AI fall equally, but implausibly, under the principle of explicability’s scope, which it rejects on the grounds that human decisions, unlike AI’s, can be explained by their social environments. An account of the role and the nature of logic in imperial stoic philosophy which challenges the prevailing orthodoxy and presents a novel interpretation of this crucial period of ancient philosophy.

The Snowden leaks, first published in June 2013, provided unprecedented insights into the operations of state-corporate surveillance, highlighting the extent to which everyday communication is integrated into an extensive regime of control that relies on the ‘datafication’ of social life. Whilst such data-driven forms of governance have significant implications for citizenship and society, resistance to surveillance in the wake of the Snowden leaks has predominantly centred on techno-legal responses relating to the development and use of encryption and policy advocacy around (...) privacy and data protection. Based on in-depth interviews with a range of social justice activists, we argue that there is a significant level of ambiguity around this kind of anti-surveillance resistance in relation to broader activist practices, and critical responses to the Snowden leaks have been confined within particular expert communities. Introducing the notion of ‘data justice’, we therefore go on to make the case that resistance to surveillance needs to be conceptualized on terms that can address the implications of this data-driven form of governance in relation to broader social justice agendas. Such an approach is needed, we suggest, in light of a shift to surveillance capitalism in which the collection, use and analysis of our data increasingly comes to shape the opportunities and possibilities available to us and the kind of society we live in. The flight from foundationalism in the earlier part of this century left several options in its wake. Distress over the possibility of foundationalist replies to the regress problem, coupled with consternation over the thought of circular reasoning mysteriously becoming acceptable as the circle gets large led to the attraction of holistic theories of a coherentist variety. Yet, such coherentisms seemed to leave the belief system cut off from the world, and perhaps a better idea was to abandon the approach to (...) epistemology that centered on the concepts of evidence and justificatory relations and focus instead on connections between our thoughts and the world which they are about, an idea leading to causal and reliability theories. One of the key criticisms of understanding health in terms of adaptation to one’s environment is that medical judgments should be able to apply across environments. If we say that a condition is pathological ‘for person X in environment E’, then we quickly run into problems of desirability and social values. However, many key concepts in biology entail an inability to separate the organism from its environment. In other words, it is precisely by referring to ‘organism X in environment E’ (...) that we can determine what is ‘normal and natural’. In this chapter, I will argue that the role of this inseparability of organism and environment for understanding medical norms has been misunderstood and the implications of it for naturalistic theories of health and disease have gone largely unappreciated. To better understand this contextualist approach, I will discuss the ideas of John Ryle and Georges Canguilhem, focusing primarily on the latter. In Canguilhem’s work we find some key arguments for why organismic norms need to be understood relative to environments and how this can help to clarify the concepts of health and disease. I will explore his peculiar form of naturalism that was based on the dynamism and variability of organisms, show how it can be clarified through more recent biological research, and mention some of its limitations. This article argues that Cicero laid down his imperium in Brundisium in September 47 after Caesar had, in a meeting between the two men, granted Cicero permission to retain his imperium and title of imperator for as long as Cicero wished to do so. Instead of accepting Caesar’s offer, Cicero instead immediately repudiated it, laid down his imperium in the city of Brundisium, and went immediately to Tusculum to begin a second period of political retirement. Caesar’s offer and his return (...) to Italy in the autumn of 47 gave Cicero an excuse to consider expired the SCU of 7 January 49 and, by immediately renouncing his imperium, perform, under the cover of his now-fulfilled obligation to the Pompeians, a calculated personal statement of political independence. It is shown how the discussion of the semantics of sentences attributing belief, central to the philosophy of language since Frege, may benefit from consideration of pragmatic features of the context of utterance. ;The dissertation begins with a historical introduction to the problem of substitutivity in belief contexts. Traditional solutions advanced by Frege, Russell, and Carnap are reviewed, along with traditional objections to such solutions. It is then suggested that the traditional Quinian approach of declaring belief ascriptions semantically ambiguous might (...) be avoided by appeal to pragmatic considerations. ;Radically divergent appeals to pragmatics are discussed. It is suggested, on one hand, how theories of reference associated with philosophers such as Kripke and Kaplan can benefit from pragmatic analysis, as it is demonstrated that substitution failure in belief ascriptions may be due to pragmatic rather than semantical factors. This is argued for in three ways: it is shown how the result of unacceptable substitution may be pragmatically ambiguous, insufficiently informative, or simply misleading. ;It is also suggested, on the other hand, how some followers of Frege may similarly argue that substitution success may be due to pragmatic rather than semantical factors. That is, it is shown how those who maintain that substitution in belief contexts is not truth-preserving and, roughly, that a sentence attributing a belief to someone is true only if the person would assent to it, can argue that our occasional inclination to accept a belief report to which the believer would not assent may be due to features of the sentence's utterance, rather than its truth conditions. ;After brief speculation on the ramifications of these pragmatic analyses for the semantics of belief, there is a discussion of the principle methodological issues raised by pragmatic analyses, with special attention to the distinction between pragmatic import and semantical meaning. Further discussion of pragmatics comes in the appendix, containing a critical review of various conceptions of pragmatics and of Grice's theory of conversation. (shrink)

The last two decades have witnessed a crescendo of allegations that clinical translation is rife with waste and inefficiency. Patient advocates argue that excessively demanding regulations delay access to life‐saving drugs, research funders claim that too much basic science languishes in academic laboratories, journal editors allege that biased reporting squanders public investment in biomedical research, and drug companies (and their critics) argue that far too much is expended in pharmaceutical development.But how should stakeholders evaluate the efficiency of translation and proposed (...) reforms to drug development? Effective reforms require an accurate model of the systems they aspire to improve—their components, their proper functions, and their pathologies. However, there is currently no explicit and well‐developed model of translation for evaluating such criticisms.In what follows, we offer an explicit model of clinical translation. Many discussions of clinical translation and its pathologies presume that its main output is tangible: new drugs, vaccines, devices, and diagnostics. We disagree. We argue that the principal output of clinical translation is information—in particular, information about the coordinated set of materials, practices, and constraints needed to safely unlock the therapeutic or preventive activities of drugs, biologics, and diagnostics. To develop this information calls for a process far different from a simple linear progression of clinical trials; it requires exploratory sampling of many different elements in this set. Our model points to some limitations and liabilities of influential proposals for reforming research. It also reveals some underrecognized opportunities for improving the efficiency of clinical translation. (shrink)

This book provides the first systematic, book-length defence of natural law ideas in ethics, politics and jurisprudence since John Finnis's influential Natural Law and Natural Rights. Incorporating insights from recent work in ethical, legal and social theory, it presents a robust and original account of the natural law tradition, challenging common perceptions of natural law as a set of timeless standards imposed on humans from above. In four experiments, we asked subjects for judgements about scenarios that pit utilitarian outcomes against deontological moral rules, for example, saving more lives vs. a rule against active killing. We measured trait emotions of anger, disgust, sympathy and empathy, asked about the same emotions after each scenario. We found that utilitarian responding to the scenarios, and higher scores on a utilitarianism scale, were correlated negatively with disgust, positively with anger, positively with specific sympathy and state sympathy, and less so with (...) general sympathy or empathy. In a fifth experiment, we asked about anger and sympathy for specific outcomes, and we found that these are consistently predictive of utilitarian responding. (shrink)

The question examined in this study is not merely how a Nietzschean critique of law would look had Nietzsche ever applied his genealogical method to the question of law, but also what positive function Nietzschean philosophy may ascribe to law, and how law must then be transformed. The methodological parable imagines a “post-genealogy” or “pot-ressentiment” phase of the human condition, akin to the Marxist “post-revolutionary” phase: how would law look for the person of power - overman or otherwise - who (...) needs to live among others? How is normativity possible - what are its forms and functions - in a social world that has undergone a reevaluation of all values? The study traces three possible models for conceptualizing law in Nietzschean terms, each requiring a radical shift from traditional (in different contexts: liberal, Christian, bourgeois) conceptions. The first one is play: law as affirming and embracing the essence of the Dionysian, which is perpetual becoming. Play requires us to let go of law's role as the curtailer of arbitrariness. An integral part of the Nietzschean program, it requires a radical reevaluation: not just law's content is overcome, nor merely its bourgeois forms (in Pashukanis' critical terms), but its “internal” or “inherent” values of certitude and stability are overcome as well. The model I offer for play is not Zarathustra's dicethrow but Borges' The Lottery in Babylon. The second model is that of resistance, framed by Nietzsche's analysis of power and Deleuze's distinction between active and reactive forces. The insight here is that power requires resistance, and it is law's primary function to empower the other in order to invest value in meeting and confronting her; thus the monism of the will to power not only does not do away with normativity in the public sphere but actually requires it - but for goals opposite to those of liberalism. Resistance is linked to the third model, fashioned after Nietzsche's model of education: here, law performs not as a socializing agent but rather as a “liberator” of authenticity. Its function is analogous to that of a mentor whose role is to ultimately encourage the pupil into coming into her own will, shedding ressentiment and bad conscience in an active, i.e. non-conscious way; in its relation to consciousness it is the opposite of psychoanalysis. A fourth consideration is then offered, the role of normativity in self-overcoming, or self-legislating; namely, how does normativity figure in the will to power's most significant challenge. While all these models work from an interpretation of the will to power as becoming, the last two are especially dependent on the active-reactive distinction. The cornerstone is not to mix up power with representations of power; to realize that the case is not the will that desires power (as an object of desire, this would necessarily involve a representation of power) but power that wills becoming. In dealing with this metaphysical question I expound on a similar crucial interpretation, originally offered by Deleuze; however, I break off from Deleuze's claim that the will to power has nothing to do with any notion of struggle. If this discussion of the will to power is missed , or if it is wrong, the main argument of this article can not hold. Finally, I use this interpretation of the will to power to solve Kafka's riddle in The Trial: a necessary move once one realizes that, in the ethical history of western culture, Kafka's parable of the seeker of the law before its closed gates continues a sequence that began with Plato's fable of the cave and continued with Zarathustra's cave parable. I add three points that may be termed methodological or contextual. The first is positioning Nietzsche's limited discussion of law and politics as a derivative of his metaphysics of the will and treatment of moral psychology, not as an independent topic to be searched and indexed in some textual corpus. The second is to understand the question of normativity in its particularly Nietzschean sense, i.e. “what is X to me/to the overman?”, and not in the Kantian sense of uncovering the conditions that entail any synthetic, a-priori sentence (such as normative ones). The last comment places the Nietzschean project in a larger pattern that defined radical thought in the late nineteenth and early twentieth centuries, and whose other cases are Marx and Freud: a new metaphysics (will to power/materialism/id) that uncovers a state of bondage, psychological and material, in which law plays a pivotal role in its function of reinforcer and supplier of a legitimizing language (respectively, of ressentiment, of the relations of production, of Oedipus and the bourgeois family); and finally radical, yet partial ways of overcoming bondage that are not mutually translatable - genealogy, revolution, psychoanalysis.
