This article has two main goals: to examine and classify the ways data can be used to advance normative theorizing in political theory, and to demonstrate such usages in the contested disciplinary field of religion–state relations and specifically regarding the hotly debated model of the separation of religion and state. Regarding the former, it is suggested here that the general observation that evaluation of political institutions must rely on proper understanding of such institutions and hence be data-sensitive, can be further (...) detailed or classified, via the following categories: conversion, institutional clarity, theoretical clarity and finally, theory improvement. With regard to the latter we examine how data regarding religion–state relations enables a better understanding (via the noted novel classifications or categories) of two important debates: ‘delineation’ (i.e. the argument that pure separation of religion and state does not exist) and ‘separation-establishment’ (i.e. arguing that models other than separation are permissible in religion–state relations). This study uses the Religion and State round 2 dataset to examine the presence of religious freedom in 177 countries. There are many different conceptions of the meaning of religious freedom but they can be divided into two categories, those which focus on the free exercise of religion—that is the right to practice religion and maintain religious institutions—and those which focus on treating all religions equally, also known as the level playing field model. The results show that neither form of (...) religious freedom is common even among democracies and states which have constitutional clauses protecting religious freedom. This finding has serious implications for our understanding of the nature of liberal democracy. (shrink)

As Professor Dov Fox points out in his essay, reference to “potential life” in American abortion jurisprudence is both indeterminate and underspecified. This commentary highlights that use of the phrase “potential life” by courts also obscures the fact that a position has been taken that biological life is not the equivalent of legal personhood. Worse, the position has been imposed on those who do not share it without offering reasons to justify its imposition in terms that those who oppose it (...) can reasonably be expected to endorse. FoxThe voices that speak from the pages of these testimonial narratives are those of physicians who are engaged in medical humanitarian work. The preponderance of them are based in U.S. academic medical centers where they have clinical, teaching, and research responsibilities from which they regularly "commute" to care for patients in what the euphemistic language of "global (...) health" terms "resource-limited," rather than "poor" countries." This "hybrid life," as one of the physicians (Robert Riviello) refers to it, has transported them periodically to numerous African societies (to Algeria, Ethiopia, Gabon, Morocco, Rwanda, Sudan, Tanzania, and Uganda), to Haiti, to India and Nepal, and to Guatemala and Mexico. Three of the "stories" are written by physicians at work in the countries where they were born (Prasanta Tripathy in Eastern India, Sridevi Seetharam and colleagues in Southern India, and Paul Pierre, in Haiti).Only one group of physician-coauthors (Maricruz Merino, Jonathan Iralu, and Sonya Shin) write about their experiences in practicing medicine among poor and socially disadvantaged patients on the American mainland—in the setting of the Navajo Indian reservation in Gallup, New Mexico.All these physicians describe their involvement in humanitarian medicine as emanating from their commitment to "social justice," to "saving lives," and to "caring for the poor"; to their universalistic convictions about "human solidarity," and the non- otherness of others; to their indignation about the inequities and injustices of the world, particularly with regard to access to health care (in the words of Jeffrey Deal, "[They] deserve better. They all do"); and to their "passionate" desire, not just their "sense of duty," to help rectify these wrongs (Richard Keiden). I was struck by the fact that none of them uses the word "suffering" to describe the plight of the persons whom they feel they have been called to medically assist.Three of the physicians express the wellsprings of their motivation in religious terms. Richard Keiden refers to a "guiding principle of Judaism" on which his medical humanitarian work has been founded—"tzedakah"—which "translates as charity but actually means righteousness," is based on a "concept of social justice," and is "an obligation, not a choice." Robert Riveillo says that at the time of his graduation from high school he envisioned his "life's work as a long-term missionary surgeon"; he invokes "loving mercy," as well as justice, "in this work of solidarity" that he has undertaken; and he poignantly admits that "most days I still long to pack my things, my family, and our efforts and move to Africa for a life of direct service." What Jeffrey Deal writes is the most explicitly and ardently religious of all. He identifies his work as a physician in Sudan with Jesus's "desire for us to care [End Page 115] for the poor and downtrodden in His stead." He is haunted by his "failure" to deliver alive a "partially born" baby girl who for him incarnated "the least of the least" of whom Jesus "spoke passionately." And in touching "ever so briefly... [that] one, tiny being [he] encountered... [on ] that hot morning in Sudan," he attests, he "touched Jesus."Jeffrey Deal is not the only one who was so stricken by the death of a baby or a child. For a number of these physicians (Sadath Sayeed, Maneesh Batra, and for Sridevi Seetharam, Lisa Adams and their colleagues), it was a tragedy that they found hard to bear with "detached enlightenment" (Sayeed), or to accept. The most demonstrably heartbroken and morally outraged among them is Sadath Sayeed, who "wept uncontrollably" over the death of a baby boy, born "at home" in Haiti, "probably in one of the hundreds of make-shift tent cities." The baby was not breathing continuously, and was "handed" to him to care for. At the close of the "story " about this experience that he recounts, Sayeed lashes out with fury and angst at those who were likely to ask him, "How was it in Haiti?" This volume’s two target articles explore novel approaches to word order alternations, especially Scandinavian Object Shift. They share the common perspective that aspects of linear order long considered the exclusive purview of syntax may be better understood if the burden of explanation is split between phonological and syntactic modules. The two articles differ substantially, however, in how this general hunch plays out, in particular in the amount of the explanation that is attributed to extra-syntactic factors. Fox and Pesetsky’s “Cyclic Linearization” (...) model (hereafter F&P, CycLin) is compatible with familiar syntactic models, and can be seen as a filter running (cyclically) on the output of syntactic derivations. F&P suggest that their proposal can explain various heretofore stipulated conditions on syntactic operations as consequences of the architecture of their system and a single axiom about linearization. Erteschik-Shir’s proposal in “Sound Patterns of Syntax” (hereafter E-S) is more radical, in the sense that far less of the familiar syntax is retained; where for CycLin movement is still a syntactic process, on E- S’s view a good deal of traditionally syntactic movement must be rethought in linear, rather than hierarchical terms. Both articles are largely exploratory and leave many of the details still to be spelled-out. To engage the ideas on specifics, then, will involve to some degree making some educated guesses about what ancillary assumptions the relevant authors might condone. I will therefore restrict myself to a few comments at a general level, though it will be impossible to do justice to these authors’ ideas in the allotted space. (shrink)

The neural basis of human memory is incredibly complex. We argue that the diversity of neural systems underlying various forms of memory suggests that any discussion of enhancing ‘memory’ per se is too broad, thus obfuscating the biopolitical debate about human enhancement. Memory can be differentiated into at least four major systems with largely dissociable neural substrates. We outline each system, and discuss both the practical and the ethical implications of these diverse neural substrates. In practice, distinct neural bases imply (...) the possibility, and likely the necessity, of specific approaches for the safe and effective enhancement of various memory systems. In the debate over the ethical and social implications of enhancement technologies, this fine-grained perspective clarifies—and may partially mitigate—certain common concerns in enhancement debates, including issues related to safety, fairness, coercion, and authenticity. While many researchers certainly appreciate the neurobiological complexity of memory, the political debate tends to revolve around a monolithic one-size-fits-all conception. The overall project—exploring how human enhancement technologies affect society – stands to benefit from a deeper appreciation of memory’s neurobiological diversity. (shrink)

This paper explores Emmanuel Levinas' Jewish writings, and in particular, his Talmudic commentaries and essays on Judaism. The aim is to elicit some salient features of his methodological approach to the Jewish sacred texts. In general, Levinas' specific reflections on method (in terms of reading the Jewish Scriptures) are confined to sporadic, fragmentary comments interspersed throughout his writings. In extracting these reflections, a specifically Levinasian approach emerges. In particular, his approach shows how one may ethically encounter the Other(s) in these (...) sacred texts. (shrink)

It stands to reason that full understanding of what is involved in the ‘hard problem’ will emerge only on the basis of systematic scientific investigation of the subjective phenomena of consciousness, as well as the objective phenomena of matter. Yet the idea of such a systematic scientific investigation of the subjective phenomena of consciousness has largely been absent from discussions of the ‘hard problem’. This is due, apparently, both to philosophical objections to the possibility of such a science of consciousness, (...) and to the absence of appropriate subjective investigative methodologies. The present paper argues that cognitive-developmental research on the development of the mental/physical distinction in young children undercuts standard philosophical objections to the possibility of an appropriate scientific study of the phenomena of consciousness, that methodologies for exploring the contents and dynamics of onsciousness akin to those developed in Eastern cultures could play a significant role in the development of such a science of consciousness, and that the experience of ‘pure consciousness’ often reported in association with these methodologies suggests reformulation of our ordinary ideas about the relationships between consciousness, qualia, and the objective world that may prove particularly useful for resolution of the ‘hard problem’. This article examines the home rapid HIV test as a new practice of US biocitizenship. Via an analysis of discourse surrounding self-diagnostics, I conclude that while home HIV tests appear to expand consumer rights, they are in fact the vanguard of a new form of self-testing that carries a moral urgency to protect one’s own body and to manage societal risk. In addition, these tests extend biomedical authority into the private domain, while appearing to do the exact opposite. Furthermore, access (...) to these tests may be stratified, contradicting the intent expressed by the manufacturer to reach populations in need of it most and reinforcing stigma against them. Lastly, diagnostics such as the rapid home HIV test represent new obligations for surveillance of one’s own health and that of others. The new public health effort to test the population at large has given rise to a new ‘risky’ population: the untested bodies. (shrink)

Ken Binmore argues that justice consists in a proportional bargaining equilibrium of a ‘game of morals’, which corresponds to a Nash bargaining equilibrium of a ‘game of life’. His argument seems unassailable if rational agents are predominantly self-interested, an assumption that he is apparently willing to make on the grounds that human behaviour is ultimately constrained in accord with the selfish gene paradigm. But there is no compelling scientific evidence for that paradigm. Rather, human nature appears to be highly plastic. (...) If so, rational agents might eventually be moulded by cultural forces into social and moral actors who effectively believe that they are the same person-no different from anyone else−when it comes to certain vital personal interests which ought to be treated as rights. In this context, a utilitarian outcome is an efficient and fair equilibrium of the game of life. Compliance with the rules is enforced by the actor’s own conscience, a powerful internal ‘judicious spectator’ which threatens to inflict harsh punishment in the form of intense feelings of guilt for cheating. Sartre's concept of ‘non-thetic awareness’ must be understood as equivalent to the concept of ‘nonconceptual content’ currently discussed in anglophone epistemology and philosophy of mind, since it could not otherwise play the role in the structure of ‘bad faith’, or self-deception, that Sartre ascribes to it. This understanding of the term makes sense of some otherwise puzzling features of Sartre's early philosophy, and has implications for understanding certain areas of his thought.

Book 8 of Lucan's Bellum Civile opens with Pompey in desperate flight from Caesar after the disaster of Pharsalus, and in equally desperate search for a reliable ally. Before the fateful decision is taken that Pompey should make for Egypt, where he will be murdered upon arrival by minions of the treacherous Ptolemy XIII, Pompey dispatches his Galatian client-tetrarch Deiotarus to sound out the distant Parthians and summon their armed hordes to wage war on his behalf ; the king promptly (...) embarks on his arduous errand, never to reappear in Lucan's text. Although Pompey is said by several historical sources to have expressed an interest in exploring the prospect of an alliance with Parthia, the mission of Deiotarus is almost certainly a complete fiction, as Duff has convincingly demonstrated. What could Lucan's motive have been for inventing this episode out of whole cloth? (shrink)

Purpose As data-driven tools increasingly shape our life and tech ethics crises become strikingly frequent, data ethics coursework is urgently needed. The purpose of this study is to map the field of data ethics curricula, tracking relations between courses, instructors, texts and writers, and present a proof-of-concept interactive website for exploring these relations. This method is designed to be used in curricular research and development and provides multiple vantage points on this multidisciplinary field. Design/methodology/approach The authors use data science methods (...) to foster insights about the field of data ethics education and literature. The authors present a semantic, linked open data graph in the Resource Description Framework, along with proof-of-concept analyses and an exploratory website. Its framework is open-source and language-agnostic, providing the seed for future contributions of code, syllabi and resources from the global data ethics community. Findings This method provides a convenient means of exploring an overview of the field of data ethics’ social and textual relations. For educators designing or refining a course, the authors provide a method for curricular introspection and discovery of transdisciplinary curricula. Research limitations/implications The syllabi the authors have collected are self-selected and represent only a subset of the field. Furthermore, this method exclusively represents a course’s assigned literature rather than a holistic view of what courses teach. The authors present a prototype rather than a finished product. Originality/value This curricular survey provides a new way of modeling a field of study, using existing ontologies to organize graph data into a comprehensible overview. This framework may be repurposed to map the institutional knowledge structures of other disciplines, as well. (shrink)
