Fluorescence correlation spectroscopy (FCS) is a powerful technique to measure concentrations, mobilities, and interactions of fluorescent biomolecules. It can be applied to various biological systems such as simple homogeneous solutions, cells, artificial, or cellular membranes and whole organisms. Here, we introduce the basic principle of FCS, discuss its application to biological questions as well as its limitations and challenges, present an overview of novel technical developments to overcome those challenges, and conclude with speculations about the future applications of fluorescence fluctuation (...) spectroscopy. Michael Smith has recently argued that non-cognitivists are unable to accommodate crucial structural features of moral belief, and in particular that non-cognitivists have trouble accounting for subjects' certitude with respect to their moral beliefs. James Lenman and Michael Ridge have independently constructed 'ecumenical' versions of non-cognitivism, intended to block this objection. We argue that these responses do not work. If ecumenical non-cognitivism, a hybrid view which incorporates both non-cognitivist and cognitivist elements, fails to meet Smith's challenge, it is unlikely that (...) According to neo-republicans, democracy is morally justified because it is among the prerequisites for freedom as non-domination. The claim that democracy secures freedom as non-domination needs to explain why democratic procedures contribute to non-domination and for whom democracy secures non-domination. This requires an account of why domination is countered by democratic procedures and an account of to whom domination is countered by access to democratic procedures. Neo-republican theory of democracy is based on a detailed discussion of the former but a (...) scant discussion of the latter. We address this lacuna by interpreting the two most influential principles of inclusion, the all-subjected principle and the all-affected principle, in light of neo-republican commitments. The preliminary conclusion is that both principles are able to capture relations of domination between the democratic state and the people controlled by it in the relevant sense. Yet, the state has virtually unlimited powers to control residents, but only limited powers to interfere in the lives of non-residents. Republican aspirations are therefore more in tune with the all-subjected principle according to which only residents in the territory of the state should be granted rights to political participation. Just as we can be more or less certain about empirical matters, we can be more or less certain about normative matters. Recently, it has been argued that this is a challenge for noncognitivism about normativity. Michael Smith presented the challenge in a 2002 paper and James Lenman and Michael Ridge responded independently. Andrew Sepielli has now joined the rescue operation. His basic idea is that noncognitivists should employ the notion of being for to account for normative certitude. We shall (...) argue that the being for account of normative certitude is vulnerable to many problems shared by other noncognitivist theories. Furthermore, we shall argue that Sepielli’s account has its own problems: His favored normalization procedure for degrees of being for has highly problematic implications. (shrink)

Problems of logical theory choice are current being widely dis- cussed in the context of anti-exceptionalist views on logic. According to those views, logic is not a special science among others, so, in particular, the methodology for theory choice should be the same in logic as for other scientific disciplines. Richard Routley advanced one such methodology which meshes well with anti-exceptionalism, and argued that it leads one to choosing one single logic, which is a kind of ultralogic. We argue that (...) the choice for only one correct system of logic may be rejected on the basis of the methodology proposed by Routley and, furthermore, that taking anti-exceptionalism about logic seriously recommends that a pluralist view of logic should be accepted. We call this view “full-blooded anti-exceptionalism”, and the resulting view on logic, lacking a proper name, “local pluralism”. (shrink)

Accommodating degrees of moral certitude is a serious problem for non-cognitivism about ethics. In particular, non-cognitivism has trouble accommodating fundamental moral certitude. John Eriksson and Ragnar Francén Olinder [2016] have recently proposed a solution. In fact, Eriksson and Francén Olinder offer two different proposals—one ‘classification’ account and one ‘projectivist’ account. We argue that the classification account faces the same problem as previous accounts do, while the projectivist account has unacceptable implications. Non-cognitivists will have to look elsewhere for a plausible solution (...) to the problem of accommodating fundamental moral certitude. (shrink)

Machine learning algorithms are increasingly used to support decision-making in the exercise of public authority. Here, we argue that an important consideration has been overlooked in previous discussions: whether the use of ML undermines the democratic legitimacy of public institutions. From the perspective of democratic legitimacy, it is not enough that ML contributes to efficiency and accuracy in the exercise of public authority, which has so far been the focus in the scholarly literature engaging with these developments. According to one (...) influential theory, exercises of administrative and judicial authority are democratically legitimate if and only if administrative and judicial decisions serve the ends of the democratic law maker, are based on reasons that align with these ends and are accessible to the public. These requirements are not satisfied by decisions determined through ML since such decisions are determined by statistical operations that are opaque in several respects. However, not all ML-based decision support systems pose the same risk, and we argue that a considered judgment on the democratic legitimacy of ML in exercises of public authority need take the complexity of the issue into account. This paper outlines considerations that help guide the assessment of whether a ML undermines democratic legitimacy when used to support public decisions. We argue that two main considerations are pertinent to such normative assessment. The first is the extent to which ML is practiced as intended and the extent to which it replaces decisions that were previously accessible and based on reasons. The second is that uses of ML in exercises of public authority should be embedded in an institutional infrastructure that secures reason giving and accessibility. (shrink)

The literature on democracy and disagreement has argued that the principle of respect for judgement requires that disagreement within democracy is resolved by a democratic decision. This paper raises the question what the principle of respect for judgement requires when there is disagreement on democratic inclusion. The paper argues that not all, but some, disagreements on democratic inclusion must be resolved by a democratic decision. Three reasons for when it need not are distinguished, issue-related reasons, people-related reasons, and judgement-related reasons. (...) When parties disagree on democratic inclusion because they disagree on basic principles, the disagreement need not be resolved by a democratic decision, for issue-related or for people-related reasons. When, instead, parties disagree on democratic inclusion despite agreeing on basic principles, the disagreement must be resolved by a democratic decision if the judgements of the disagreeing parties are reasonable. This book addresses the logical aspects of the foundations of scientific theories. Even though the relevance of formal methods in the study of scientific theories is now widely recognized and regaining prominence, the issues covered here are still not generally discussed in philosophy of science. The authors focus mainly on the role played by the underlying formal apparatuses employed in the construction of the models of scientific theories, relating the discussion with the so-called semantic approach to scientific theories. The book (...) describes the role played by this metamathematical framework in three main aspects: considerations of formal languages employed to axiomatize scientific theories, the role of the axiomatic method itself, and the way set-theoretical structures, which play the role of the models of theories, are developed. The authors also discuss the differences and philosophical relevance of the two basic ways of aximoatizing a scientific theory, namely Patrick Suppes’ set theoretical predicates and the "da Costa and Chuaqui" approach. This book engages with important discussions of the nature of scientific theories and will be a useful resource for researchers and upper-level students working in philosophy of science. (shrink)

In this paper, we generalize the ordered-pair semantics advanced by Matthew Clemens for the Logic of Paradox to n-tuple semantics, for each fixed n. Moreover, we show that the resulting semantics can accommodate not only LP, but also classical logic as well as strong Kleene logic depending on the set of designated values that one chooses. Building on the technical observations, we offer intuitively plausible readings for the semantics, and we also discuss some weaknesses of the original intuitive reading advanced (...) by Clemens. Intelligence on mass media audiences was founded on representative statistical samples, analysed by statisticians at the market departments of media corporations. The techniques for aggregating user data in the age of pervasive and ubiquitous personal media build on large aggregates of information analysed by algorithms that transform data into commodities. While the former technologies were built on socio-economic variables such as age, gender, ethnicity, education, media preferences, Big Data technologies register consumer choice, geographical position, web movement, and behavioural information in (...) technologically complex ways that for most lay people are too abstract to appreciate the full consequences of. The data mined for pattern recognition privileges relational rather than demographic qualities. We argue that the agency of interpretation at the bottom of market decisions within media companies nevertheless introduces a ‘heuristics of the algorithm’, where the data inevitably becomes translated into social categories. In the paper we argue that although the promise of algorithmically generated data is often implemented in automated systems where human agency gets increasingly distanced from the data collected, one can observe a felt need among media users and among industry actors to ‘translate back’ the algorithmically produced relational statistics into ‘traditional’ social parameters. The tenacious social structures within the advertising industries work against the techno-economically driven tendencies within the Big Data economy. (shrink)

In the first two volumes of On What Matters,1 Derek Parfit pursued a conciliatory project in normative ethics, which sought to dissolve the disagreement between the most plausible versions of Kantianism, contractualism and rule consequentialism. Parfit was less conciliatory in his meta-ethics, however. Does Parfit’s conciliatory project in metaethics succeed? We shall begin to address this question in the next section by, first, trying to get a grip on Parfit’s position, which now goes by the name ‘non-realist cognitivism’, and, second, (...) by examining his account of properties, and of normative properties in particular. We shall then examine whether Parfit’s triviality objection is effective against Jackson’s brand of naturalism. Finally, we will ask whether Parfit is right to think that his favoured metaethical view converges with what he thinks are the most plausible forms of naturalism and quasirealism,illustrated by Railton’s view and Gibbard’s view, respectively. Logical anti‐exceptionalism is the view that logic is not special, it is continuous with science. This continuity is typically understood in terms of the use of the abductive method in logical theory choice, with logical knowledge resulting from our choice of the theory best accounting for the data. In this paper, we argue for two related claims: (i) that this understanding of the continuity between logic and science faces considerable challenges; and (ii) that such challenges may be avoided by elaborating (...) the continuity of logic with science in terms of the “logic‐as‐models” approach. More specifically, we defend that logical theories should be seen in the lights of the “models‐as‐epistemic‐tools” approach, an approach to the nature of models in empirical science more closely connected with current scientific practice. The result is a version of logical anti‐exceptionalism opening new perspectives for the philosophical understanding of logic. (shrink)

Research is crucial to advancing knowledge about dementia, yet the burden of the disease currently outpaces research activity. Research often excludes people with dementia and other cognitive impairments because researchers and ethics committees are concerned about issues related to capacity, consent, and substitute decision-making. In Australia, participation in research by people with cognitive impairment is governed by a national ethics statement and a patchwork of state and territorial laws that have widely varying rules. We contend that this legislative variation precludes (...) a consistent approach to research governance and participation and hinders research that seeks to include people with impaired capacity. In this paper, we present key ethical principles, provide a comprehensive review of applicable legal rules in Australian states and territories, and highlight significant differences and ambiguities. Our analysis includes recommendations for reform to improve clarity and consistency in the law and reduce barriers that may exclude persons with dementia from participating in ethically approved research. Our recommendations seek to advance the national decision-making principles recommended by the Australian Law Reform Commission, which emphasize the rights of all adults to make their own decisions and for those with impaired capacity to have access to appropriate supports to help them make decisions that affect their lives. The notion of an individual and the related issues on individuation are topics that appear in the philosophical discussion ever since the antiquity. The idea of an individual thing is intuitively clear: an individual is something of a specific kind that is a unity, having its own identity, and being so that it is possible at least in principle to discern it from any other individual, even of similar species. But when we try to leave the intuitive realm and push (...) this idea to a logical analysis, we find a cluster of problems that are difficult to overcome within standard logico-mathematical contexts. In this work, we shall be concerned with some aspects of this intuitive concept of an individual and on some related facts about individuation taken from recent discussions that arose ever since the inception of quantum theory, pushing the discussion to a “logical” view, which in our opinion is still lacking in the usual debates on such issues. In the final part of the paper, we propose a metaphysics where the notion of identity is substituted, for some objects, by a weaker notion of indiscernibility, and we try to justify such a move. In most of the uses of the expression “quantum theory”, we shall not make explicit the distinction between the non-relativistic and the relativistic approaches, although they of course are quite different, for we think that the problems as we shall present them appear in both versions. But, as the text goes, the context will distinguish between them and these questions will become clear to the reader. (shrink)

Contextualism concerning vagueness (hereafter ‘CV’) is a popular response to the puzzle of vagueness.[1] The goal in this paper is to uncover in what ways vagueness may be a particular species of context-sensitivity. The most promising form of CV turns out to be a version of socalled ‘Non-Indexical Contextualism’.[2] In §2, we sketch a generic form of CV (hereafter ‘GCV’). In §3, we distinguish between Truth CV and Content CV. A non-indexical form of CV is a form of Truth CV, (...) while an indexical form of CV is a form of Content CV. In §4, we argue that the theory of vagueness given in Fara (2000) is crucially incomplete but is best seen as a non-indexical form of CV. In §5, we set forth four kinds of error-theory to which CV might be committed. It turns out that Non-Indexical CV is committed to a weaker, and more plausible, error-theory than Indexical CV. In §6, we address a challenge posed by Keefe (2007) to the effect that CV entails that any speech report of what has been said by a particular vague utterance, where the context of utterance and the reporting context are relevantly different, will almost always be inaccurate. While this challenge is prima facie effective against Indexical CV it proves to be less effective against Non-Indexical CV. In §7, we look at two tests for context-sensitivity and assess whether they can be employed against CV. These tests, if cogent, reveal that the only workable form of CV is Non-Indexical CV. (shrink)

In this paper we discuss two approaches to the axiomatization of scientific theories in the context of the so called semantic approach, according to which (roughly) a theory can be seen as a class of models. The two approaches are associated respectively to Suppes’ and to da Costa and Chuaqui’s works. We argue that theories can be developed both in a way more akin to the usual mathematical practice (Suppes), in an informal set theoretical environment, writing the set theoretical predicate (...) in the language of set theory itself or, more rigorously (da Costa and Chuaqui), by employing formal languages that help us in writing the postulates to define a class of structures. Both approaches are called internal , for we work within a mathematical framework, here taken to be first-order ZFC. We contrast these approaches with an external one, here discussed briefly. We argue that each one has its strong and weak points, whose discussion is relevant for the philosophical foundations of science. (shrink)

In this contribution we explore revisionists and anti-revisionists conceptions of the historical imagination. The focus will be on how these conceptions of the historical imagination determine how one ought to answer the question of whether or not it is in principle possible to know the past in its own terms rather than from the perspective of the present. The contrast that we are seeking to draw is that between a conception of the historical imagination which is revisionist in the sense (...) that it is committed to the claim that knowledge of the past is in principle impossible, and one which is anti-revisionist in the sense that it regards knowledge of the past in its own terms to be in principle possible. Revisionism, as we understand it here, is not the contingent claim that in some cases (where, for example, new evidence which was previously unavailable comes to light) the historical understanding of the past may be revised; rather, it represents an a priori claim about the impossibility of knowing the past in its own terms in all cases, and not just in some. Likewise, anti-revisionism, as we understand it here, is the view that historical knowledge is in principle possible; it is not the claim that it is always achieved as a matter of fact. The debate between revisionist and anti-revisionist conceptions of the historical imagination is therefore a second-order debate about the nature of historical knowing, about whether it is possible, and if so, about what its conditions of possibility are. It is not a first order debate about whether or not such knowledge has been achieved in any given case. (shrink)

In this paper we consider the phenomenon of superpositions in quantum mechanics and suggest a way to deal with the idea in a logical setting from a syntactical point of view, that is, as subsumed in the language of the formalism, and not semantically. We restrict the discussion to the propositional level only. Then, after presenting the motivations and a possible world semantics, the formalism is outlined and we also consider within this schema the claim that superpositions may involve contradictions, (...) as in the case of the Schrödinger's cat, which is both alive and dead. We argue that this claim is a misreading of the quantum case. Finally, we sketch a new form of quantum logic that involves three kinds of negations and present the relationships among them. The paper is a first approach to the subject, introducing some main guidelines to be developed by a `syntactical' logical approach to quantum superpositions. (shrink)

Na análise do desenvolvimento da história e filosofia das ciências, deparamo-nos com uma questão: haveria um contexto favorável à possível emergência de uma intuição ou a mesma seria completamente desprovida de qualquer espaço que pudesse fomentá-la? Deixando de lado antigas teorias que defendiam a intuição ser proveniente dos deuses, ou outras que não exploravam espaços pelos quais ela pudesse ser favorecida, defendemos, com Kuhn, uma possível vinculação a ela favorecedora. Trata-se de uma conjuntura de fatores apresentados como elementos centrais da (...) passagem da ciência normal para a ciência revolucionária. A problematização, a criticidade, o experimento mental e o pensar filosófico são alguns fatores que não garantem um caminho rigorosamente lógico ao alcance da intuição. Embora não hajam passos pré-determinados para o alcance duma intuição, não podemos ignorar aquelas vias indiretas que possam fomentá-la a partir de um possível contexto filosófico de descoberta. Academic careers between the completion of a PhD and the acquisition of tenure are characterized by short term contracts, high levels of competition, and future uncertainty. Existing research indicates that uncertainty is a primary cause for postdocs in all disciplines to constantly question the continuation of their career. Despite this commonality between disciplines, we argue that future imaginations, coping strategies and ultimately the decision-making practices to exit or remain in academia differ in each discipline. Drawing from 60 qualitative interviews with (...) physicists and historians, we compared imaginations of the labor market inside and outside of academia, as well as narratives on how they perceive their agency to exit or remain. Our data shows that imaginations of the labor market outside of academia, have considerable consequences for their sense of precarity and planning of career paths. We propose that the uniform concept of future uncertainty must be separated into ‘existential uncertainty’ and ‘secured uncertainty’, which more accurately reflect the problems postdocs are confronted with and the resulting coping strategies. While those who consider their uncertainty as existential either evoke narratives of survival to continue in adverse conditions or begin parallel careers as added security. Those who perceive their future as uncertain but generally secured rely either on their ability to decide when necessary or postpone the question indefinitely. These differences that correlate with our chosen disciplines have important implications for research quality as well as mental-health hazards and further our understanding of self-exploitation and precarity in academia. Team reasoning is the idea that we can think as a ‘we’ and this can solve some coordination dilemmas, such as Hi-Lo. However, team reasoning can only solve the dilemmas it is intended to solve if the conditions for team reasoning warrant the belief that others will also perform team reasoning and these conditions cannot render team reasoning otiose. In this paper, I will supplement the theory of team reasoning by explaining how agency transformation also involves a change in the (...) normative attitude. To do this, I will use the theory of affordances, which is the idea that the environment provides ways to interact with it. I will argue that when a person perceives as a group member, she associates herself and the other members with the group’s mosaic of affordances. This triggers a feeling of joint ownership of the agency. It is the feeling that it is up to us to deal with the situation, so we feel entitled to demand each other to cooperate. It warrants the belief that others are team-reasoners without rendering team reasoning otiose. This means that the agency transformation (from I to we) involves a change in the normative attitude. Recent commentaries on the relation between Deleuze and Foucault often operate with an implicit idea of compatibility or consistency that postulates systematic harmony as the decisive criterion for the affinity between them. Accordingly, the predominant question is whether Deleuze and Foucault are “true” friends philosophically and politically. Although the assessments differ, they share a likewise implicit notion of the friend as familiar that excludes any form of ambivalence in amicable relations and consequently cannot fully account for the dynamics and variability (...) of the relation between Deleuze and Foucault. This article tries to address this problem by suspending the notion of the friend-as-familiar, effectively posing the question of what concept of friendship we would have if the ambivalent relation between Deleuze and Foucault would be the model. For this, the reconstruction begins with the early encounters and follows their relationship until the supposed split in the context of the desire-pleasure-debate. What becomes apparent is the dialogical structure of the philosophical friendship between Deleuze and Foucault that entails convergences as well as divergences, which will eventually be related to their own and fundamentally different concepts of friendship. Deleuze and Foucault, as will be argued, are neither “vrais amis” nor “faux amis” but simply amis that practised a form of philosophical friendship, lasting for more than 15 years. (shrink)

"Speculative Realism in Environmental Education and the Philosophy of Education" was a joint research symposium for the networks on Environmental and Sustainability Education (NW 30) and Philosophy of Education (NW 13), held at the European Conference of Education Research (ECER), 25 August, 2023, in Glasgow, Scotland. The symposium aimed to open up discussion on renewed interest in realisms in the field of philosophy, and what that might mean for education research and the field of environmental education research in particular. As (...) backdrop, environmental education harbours strong democratic traditions as well as recognitions of relationships to a world that is composed by more than human positions and desires. The symposium then forms part of an ongoing discussion of how these positions are understood and intermingle in a rapidly changing world. The expectation of the event was to broaden discussion about the voices present in environmental education, human and otherwise, and sharpen engagement with established traditions within the field. In brief, three paper presentations and discussion by Graham Harman probed questions of: (a) the lightness and darkness of the objects of education, (b) who visibly desires which object in/as education, and (c) the risks of literalisms and correlationalisms in, for example, what is alluring to, and pursued by, educators. In other words, what we care about in and as environmental and sustainability education, what is perceived/treated as peculiar, and what is treated as normal and perverse to the realities of education in the Anthropocene, all matter to the work of speculative realism. This paper introduces the Special Issue of Theoria entitled "Quantum Mechanics and Reality". We first comment on its origins related to the VIII International Workshop on Quantum Mechanics and Quantum Information, promoted by the International Network on Foundations of Quantum Mechanics and Quantum Information. We then briefly introduce each contribution individually, bringing the papers together under the Special Issue's topic.

In the present article, the authors argue that the study of Salafism as a contemporary Islamic new religious movement could benefit from an analytical perspective separating fundamentalism into the modes of inferentialism and deferentialism. The basics of these concepts are outlined and discussed in relation to different aspects of contemporary Salafism as well as in relation to previous tendencies in Islamic history. As a case study, the authors employ the concept in an analysis of a contemporary Swedish Salafi discourse on (...) the ‘wiping of the socks’ in the context of ritual purity. The authors argue that the concept of ‘deferential fundamentalism’ has a potential in the study of Salafism in that it allows for comparative analysis, both cross-religiously and diachronically, in contextualising Salafism historically. It also allows for an analysis of Salafi thought and practice in relation to theories of how human beings in general process social information. (shrink)

In this paper we consider the notions of structure and models within the semantic approach to theories. To highlight the role of the mathematics used to build the structures which will be taken as the models of theories, we review the notion of mathematical structure and of the models of scientific theories. Then, we analyse a case-study and argue that if a certain metaphysical view of quantum objects is adopted, namely, that which sees them as non-individuals, then there would be (...) strong reasons to ask for a different mathematical framework for describing the structures that would be the models of the corresponding theory. In departing from the standard frameworks, we hope to bring to the scene, within the scope of the semantic approach, the importance of paying attention to some fundamental concepts usually only superficially touched by philosophers of science. Should artificial intelligences ever be included as co-authors of democratic decisions? According to the conventional view in democratic theory, the answer depends on the relationship between the political unit and the entity that is either affected or subjected to its decisions. The relational conditions for inclusion as stipulated by the all-affected and all-subjected principles determine the spatial extension of democratic inclusion. Thus, AI qualifies for democratic inclusion if and only if AI is either affected or subjected to decisions by the (...) political unit in relevant ways. This paper argues that the conventional view is too simple; that it neglects democratic reasons to recognize only agents and/or moral patients as participants in decision-making. The claim defended is that AAP and ASP implicitly affirm requirements for agency and patiency. In ASP, the entity included must be an agent understood either in terms of legal status, capacity to comply with the law or ability to recognize legitimate authority. In AAP, the entity included must be a patient, understood either in terms of capacity for sentience or consciousness. Thus, the idea here is to explore the potential democratic inclusion of artificial intelligences by an updated account of the relevant conditions of agency and patiency that are implicit in democratic theory. Although conceivable that AI is or will be either affected or subjected in relevant ways to decisions made by political units, it is far less clear that AI will ever be agents or patients in the sense required for democratic inclusion. The historiographical concept "Enlightenment" has for a long time wavered between the idea of a single unified Enlightenment and the notion of multiple competing enlightenments. This volume revisits this seeming contradiction by asserting that the Enlightenment should be understood as a shared process of communication, seeking ways to accommodate and mediate rival ideologies and orient enlightenment projects towards the betterment of humankind. Taking the work of the eminent Enlightenment scholar Hans Erich Bödeker as their point of departure, the different chapters (...) seek to explore this perspective through specific case studies of political communication. Readers are offered a selection of Bödeker's texts never previously translated into English, along with a series of contributions from his former colleagues, students, and collaborators. In doing so the book displays the broad scope of Bödeker's own work, as well as the multiplicity of themes captured within the framework of the Enlightenment. Genres, modes, and strategies of communication are contrasted with the institutions and cultural practices underpinning them. In exploring the depth and scope of Bödeker's work, the volume pays tribute to a German tradition rooted in historical semantics, while at the same time querying its present state and its future. This article seeks to address the manner in which we should conceptualise the duties of directors in making decisions where fundamental rights are at stake. We first attempt to show that, in making decisions that implicate fundamental rights, directors are required to consider all individuals affected as having an intrinsic dignity. The interests of non-shareholders must thus be addressed in a non-instrumental manner which, we argue, is only compatible with the adoption of a ‘stakeholder’ conception of directors’ duties. Adopting such (...) an approach, however, raises the difficulty of how directors are to balance multiple intrinsically valuable interests. We argue that the doctrine of proportionality—which has been developed in fundamental rights law as a structured enquiry concerning the circumstances in which it is justifiable to limit rights—can be adapted to the domain of corporate decision-making. The proportionality enquiry provides a transparent, structured process of reasoning that can aid corporate decision-making and open up the possibility for reviewing decisions of directors that affect the fundamental rights of individuals.
