It is clear enough that utilitarianism contributed to the softening of many penal systems in the world by arguing that very cruel punishments should be excluded every time a less cruel one would be just as effective. But does utilitarianism as such oppose the death penalty ? It is well known that Beccaria and Bentham criticized capital punishment on utilitarian grounds. But the fact that John Stuart Mill held a speech in favour of the death penalty at the House (...) of Commons in 1868 suggests that there is no necessity for a utilitarian thinker to oppose it. Otherwise, it would be possible to claim that John Stuart Mill betrayed, so to speak, the principle of utility by defending such a punishment. But nothing, it seems, allows us to say so. On the contrary, we would like to suggest that Mill’s disagreement with Bentham and Beccaria originates from his own empirical judgement on the following question : is death penalty the most cruel punishment for murder ? In other words, whether we like it or not, there is no way we can hold that Mill was less faithful than Beccaria and Bentham to the principle of utility when supporting the death penalty. (shrink)

What role does non-genetic inheritance play in evolution? In recent work we have independently and collectively argued that the existence and scope of non-genetic inheritance systems, including epigenetic inheritance, niche construction/ecological inheritance, and cultural inheritance—alongside certain other theory revisions—necessitates an extension to the neo-Darwinian Modern Synthesis (MS) in the form of an Extended Evolutionary Synthesis (EES). However, this argument has been challenged on the grounds that non-genetic inheritance systems are exclusively proximate mechanisms that serve the ultimate function of calibrating organisms (...) to stochastic environments. In this paper we defend our claims, pointing out that critics of the EES (1) conflate non-genetic inheritance with early 20th-century notions of soft inheritance; (2) misunderstand the nature of the EES in relation to the MS; (3) confuse individual phenotypic plasticity with trans-generational non-genetic inheritance; (4) fail to address the extensive theoretical and empirical literature which shows that non-genetic inheritance can generate novel targets for selection, create new genetic equilibria that would not exist in the absence of non-genetic inheritance, and generate phenotypic variation that is independent of genetic variation; (5) artificially limit ultimate explanations for traits to gene-based selection, which is unsatisfactory for phenotypic traits that originate and spread via non-genetic inheritance systems; and (6) fail to provide an explanation for biological organization. We conclude by noting ways in which we feel that an overly gene-centric theory of evolution is hindering progress in biology and other sciences. (shrink)

S’il compare d’abord la condition des femmes à celle des esclaves, c’est pour ensuite l’en distinguer, car la persistance de l’inégalité des sexes est en contradiction avec les principes juridiques des sociétés modernes. Il est donc attentif à la situation singulière du problème de l’assujettissement des femmes (...) : il ne s’agit pas de chercher à faire une « révolution sociale au nom d’un droit abstrait », mais de déraciner les préjugés qui expliquent la permanence archaïque de l’inégalité des sexes. In 1991, Benoît Patar published a set of anonymous commentaries on Aristotle’s De anima. He argued that both works should be ascribed to John Buridan and, taken together, constitute the first of Buridan’s three series of lectures on De anima. Even though Patar’s proof of the authenticity of the commentaries has not been unanimously accepted, his attribution of the works to Buridan turned out to be persistent. This article examines the question of the authenticity of the two anonymous commentaries. (...) It argues that there is no conclusive reason to attribute the works to Buridan. The texts are closely related to works by Buridan, but they bear the same relation to commentaries written by Nicole Oresme. As a consequence, the works should be considered to be exactly what they are: anonymous commentaries on Aristotle’s De anima, written in the same context and around the same time in which the commentaries by John Buridan and Nicole Oresme were also written. After a brief sketch of the state of Buridan studies, this review article examines the recent study, by Benoît Patar, of a commentary on Aristotle’s Physics that is generally attributed to Albert of Saxony, but which Patar believes to have been authored by John Buridan (the text is preserved in the manuscript Bruges, Stadsbibliotheek 477, fols. 60va–163vb, and was edited by Patar himself in 1999). Patar is utterly convinced that the Bruges Quaestiones represent Buridan’s prima lectura, that is, his (...) first course of lectures on the Physics, which preceded the two other redactions that are traditionally attributed to him. However, there is no textual evidence in support of this assumption, but only speculative circumstantial evidence. The article therefore rejects Patar’s thesis as highly problematic. (shrink)

This biography of Jacques Derrida tells the story of a Jewish boy from Algiers, excluded from school at the age of twelve, who went on to become the most widely translated French philosopher in the world – a vulnerable, tormented man who, throughout his life, continued to see himself as unwelcome in the French university system. We are plunged into the different worlds in which Derrida lived and worked: pre-independence Algeria, the microcosm of the École Normale Supérieure, the cluster of (...) structuralist thinkers, and the turbulent events of 1968 and after. We meet the remarkable series of leading writers and philosophers with whom Derrida struck up a friendship: Louis Althusser, Emmanuel Levinas, Jean Genet, and Hélène Cixous, among others. We also witness an equally long series of often brutal polemics fought over crucial issues with thinkers such as Michel Foucault, Jacques Lacan, John R. Searle, and Jürgen Habermas, as well as several controversies that went far beyond academia, the best known of which concerned Heidegger and Paul de Man. We follow a series of courageous political commitments in support of Nelson Mandela, illegal immigrants, and gay marriage. And we watch as a concept – deconstruction – takes wing and exerts an extraordinary influence way beyond the philosophical world, on literary studies, architecture, law, theology, feminism, queer theory, and postcolonial studies. In writing this compelling and authoritative biography, Benoît Peeters talked to over a hundred individuals who knew and worked with Derrida. He is also the first person to make use of the huge personal archive built up by Derrida throughout his life and of his extensive correspondence. Peeters’ book gives us a new and deeper understanding of the man who will perhaps be seen as the major philosopher of the second half of the twentieth century. (shrink)

This paper considers three horary quadrants of strikingly similar design and underlying mode of conception. Two are dated, 1398 and 1399, while the third, undated instrument can now be dated for the first time with some certainty to 1400. The parameters used in their construction are analysed, and the latitude for which they were made is elucidated. This shows that all three were made for use in London or southern England. One of the three, dated 1399, has previously been attributed (...) to the patronage of Richard II, King of England, by virtue of the badge decorating the quadrant. The badge on the second quadrant, dated 1398, for a long time also associated with Richard II, has now been established to have been used by Richard's half brother, John Holland, Duke of Exeter. The third quadrant undoubtedlybelongs to the group, but cannot be assigned to the patronage of any individual. (shrink)

The chronicle of John of Worcester is one of the most important sources of earlier English history. The chronicle, which was written at Worcester by 1140, is of considerable interest to historians of both the Anglo-Saxon period and of the late eleventh and twelfth centuries. Its backbone is a translation of an Anglo-Saxon chronicle with varied connections, and this edition makes possible the detailed examination of these allegiances. Its annals for the second half of the ninth century provide one (...) of the earliest surviving witnesses to the text of Asser's Life of Alfred. The author had access to otherwise unrecorded sources of events in the eleventh century, and the chronicle's value as a contemporary source for the reign of Stephen has long been acknowledged. Dr McGurk has completed the edition of the work left unfinished by R. R. Darlington on his death in 1977. The chronicle will be published in three volumes. Volume II covers the annals for 450 to 1066, and volume III the annals from 1067 to 1140. Volume I will be published last, and will contain a general introduction and supplementary material. Double effect reasoning is central to Catholic moral theology. It is the principle which enables it to maintain absolute moral standards while effectively handling morally difficult choices which entail bringing about some evil as well as the good. DER has been focused on the way in which it applies to human agents and their relation to bringing about evil as well as the good. According to DER, only the good can be brought about intentionally; evil can only be brought about (...) as the side effect of the good. It will be argued that DER also applies to God’s choices. It is our best resource for understanding God’s relation to evil in the world He creates. (shrink)

John Yolton seeks to allow readers of Locke to have accessible in one volume sections from a wide range of Locke's books, structured so that some of the interconnections of his thought can be seen and traced. Although Locke did not write from a system of philosophy, he did have in mind an overall division of human knowledge. The readings begin with Locke's essay on Hermeneutics and the portions of his Essay Concerning Human Understanding on how to read a (...) text. The reset of the selections are organized around Locke's division of human knowledge into natural science, ethics, and the theory of signs. Yolton's introduction and commentary explicate Locke's doctrines and provide the reader with the general background knowledge of other seventeenth-century writers and their works necessary to an understanding of Locke and his time. In recent articles in this journal Benoit Gaultier and John Biro have argued that the original Gettier cases and the ones closely modelled on them fail, and the reason for the failure is that the subject in these cases does not actually have the belief that would serve as a counterexample to the justified-true-belief analysis of knowledge. They claim that if our evidence pertains to a particular individual (as in the first case) or to the truth of one (...) of the disjuncts (as in the second case), we do not genuinely believe the existential generalization or the disjunction which logically follows. I will challenge their arguments and suggest that our unwillingness to assert the existential generalization or the disjunction under these conditions does not stem from lack of belief but from pragmatic principles. I sin udmærkede kommentar til vores artikel «En etisk diskussion af screening for kræftsygdomme» beskriver Geir Hoff den udtalte mangel på evidens vedrørende nytteværdien af screeningsprogrammer for kræftsygdomme baseret på randomiserede studier. Ydermere fremhæver Geir Hoff misforholdet mellem den manglende evidens ved screening og de strenge krav, der er til evidensen i den farmaceutiske industri. Dette er en velkommen kritik, pga. en udtalt ukritisk og uvidenskabelig tilgang til anvendelse af screening for denne eller hin sygdom eller risikofaktor.
