BackgroundFrance has long been a country of immigration and in some respects may be seen to have a generous policy with respect to asylum seekers and access to health care for migrants. The French state notably provides healthcare access for undocumented migrants, through state medical aid and since 1998 has had a humanitarian policy for granting temporary residence permits for medical reason (TRPMR) to migrants. Within a context of political debate, reform and tightening immigration control we will examine this latter (...) policy focusing especially on the dilemmas that arise for physicians of migrant patients when they are requested to write medical certificates as part of a TRPMR application. In a 2017 reform the key role of making recommendations on the granting or not of permits was handed over to Ministry of the Interior health inspectors. Recommendations are made after perusal of medical certificates established by the migrant’s physician and complementary evidence.Main bodyThe writing of medical certificates by a physician would seem straightforward. This is far from the case since it raises a number of ethical dilemmas. These occur within a physician-patient relationship embedded within a social contract between the State, the physician and the migrant patient. To clarify the ethical issues arising 3 vignettes based on practice within an infectious disease unit at a large Paris hospital have been developed. The vignettes highlight ethical dilemmas in the care for migrants with tuberculosis (dilemma in defining health and disease), chronic hepatitis (dilemma between beneficence and do not harm), and HIV / AIDS (issue of deservingness). We will go on to reflect on issues of social justice and responsibility for the health of migrants within a globalized world.ConclusionsCriteria for residence permit delivery appear less than clear-cut and are interpreted in a restrictive way. Neither are the consequences of refusing a residence permit taken into account. We call for an empirical transnational ethics study involving countries implementing similar TRPMR policies. We also call for inclusion of lobbying competences into the medical undergraduate curricula, in order to breed future generations of physicians skilled in defending social justice. (shrink)

Unter den Versuchen Fichtes, sein Denken allgemeinverständlich darzustellen, zählt diese 1800 erschienene Schrift zu den inhaltlich abgerundetsten und aufschlußreichsten; bei den Zeitgenossen stieß sie jedoch auf vehemente Kritik, Hegel sah in ihr gar einen besonders illustrativen Text für den Aufweis der Haltlosigkeit der von Fichte in der Wissenschaftslehre vertretenen Position einer auf das Ich als Tathandlung gegründeten Philosophie. Darum vermag allein schon die Lektüre von Fichtes Bestimmung des Menschen und ihrer kritischen Rezeption in Hegels Glauben und Wissen einen Einblick in (...) die Gründe zu vermitteln, warum bis ins 20. Jahrhundert die Philosophie Fichtes weitgehend als ein merkwürdiger Mosaikstein auf dem Wege "Von Kant bis Hegel" oder, im Hinblick auf den "Endpunkt" dieses Wegs wohl genauer, in der "Entwicklung des Spinozismus" betrachtet wurde. Deutlich wird einer neuen Lektüre aber auch, wieviel noch zu tun bleibt, um die wichtigen Erkenntnisse, die im Deutschen Idealismus auf so getrennten Bahnen gewonnen wurden, im Blick auf die gemeinsamen Grundprobleme einer "Ersten Philosophie" ohne Rückfall in die traditionellen Feindbilder wahrzunehmen und kritisch in die pluralistische Diskussion heutigen Philosophierens einzubringen. What moral reasons, if any, do we have to ensure the long-term survival of humanity? This article contrastively explores two answers to this question: according to the first, we should ensure the survival of humanity because we have reason to maximize the number of happy lives that are ever lived, all else equal. According to the second, seeking to sustain humanity into the future is the appropriate response to the final value of humanity itself. Mit dem Entwurf eines merkantilistischen, autarken und sozialen Ständestaates liefert Fichte eine der geschlossensten Konkretisierungen seiner rechtspolitischen Ideen, nämlich das erste Modell einer sozialistischen Planwirtschaft. Zugleich berührt das Werk ein Kernproblem von Fichtes praktischer Philosophie: Wie läßt sich die freie Selbsttätigkeit der Einzelnen mit der alle auf ein Ideal verpflichtenden Hoheit des Vernunftsstaates vereinigen?

This article explores the underestimated teaching of the 'five tears' as mystical expression in the text Il dialogo by the Dominican nun and philosopher-theologian, Catherine of Siena. The objective of the article is to indicate the significance of the teaching of the 'five tears', against the backdrop of the wider symbolic function of tears and 'holy grief' in Late Medieval mysticism. After presenting a biographical introduction, the contemplative, communicative and secretive import of the meaning of tears in the Middle Ages (...) are reappraised and applied to The dialogues. By synthesising the scarce references in the relevant secondary literature, the teaching of the five tears are henceforth discussed: the tears of damnation, which are the tears of 'evil and sinful people'; the tears of fear, which are the tears of fallen humankind in the presence of God's judgement; the tears of gratitude, cried by a 'saved humanity' who now 'see and taste God's goodness' ; the perfect tears, cried by people in their selfless disposition toward and love for the human Other; and the sweet tears of tenderness, cried by those who love God and humankind, in a radicalisation of Jesus of Nazareth's summary of the Law, 'more than thyself'. Catherine's teaching of the 'five tears' certainly presents unique features and its own considerations, but should, nevertheless, be interpreted as an extension of the contemplative and secretive functions of 'holy grief' as already presented in Scripture and reconsidered by the Eastern and Western church fathers in the second to the fifth centuries. Catherine's contribution to Medieval mysticism is established therein that she expanded those initial contents by presenting the teaching of the five tears as a ritualised prerequisite for development in the Medieval pilgrim's spiritual itinerary to God.CONTRIBUTION: This article contributes to scholarship in Medieval philosophy by contextualising Catherine of Siena's teaching of the 'five tears' within the wider symbolic realm of tears and 'holy grief' in late Medieval mysticism, stressing the contemplative, communicative and secretive import of tears throughout the Middle Ages. With the publication of volume 10, the editors have now completed the edition of Fichte's works. Volume 10 contains publications of the last five years of Fichte's life. The famous Addresses to the German Nation that Fichte delivered publicly in Berlin in 1807/8 succeed the Grundzuge des gegenwartigen Zeitalters and the Anweisung zum seeligen Leben and thus form the last part of the trilogy which marks Fichte's change of direction towards a Philosophy of History. Following Pestalozzi, Fichte appeals for a new education of the German people in order to achieve an intellectual reformation. At the same time, this work is shaped by Fichte's intention to participate - within the bounds of his possibilities - in the course of political events. Fichte connected Germany's loss of political autonomy due to Napoleon's dominance with an imminent intellectual decline in Germany, and was therefore urged to take action. He realised his right and duty to speak out. Additionally, this volume contains Fichte's adaptations of Petrarca and Camoenes, his elaborated final lecture of 1810 Wissenschaftslehre in ihrem allgemeinen Umrisse, the speech Ueber die einzig mogliche Storung der akademischen Freiheit, as well as his two summer term lectures of 1812 Uber die Bestimmung des Gelehrten. This article investigates the palimpsest reception of Pseudo-Dionysius (ca. 500) in the metaphysics of Nicholas of Cusa (1401–1464). The article covers Cusa’s political theory and metaphysics, which are intertwined. Reading Cusa against the backdrop of an analysis of Pseudo-Dionysius’ metaphysics in a preceding article, the author, in a synthetic conclusion, isolates seven Dionysic ‘trails’ (S1 to S7) in Cusa’s metaphysics: the interpretation of transcendence as bound to immanence; the affirmation of God’s transcendence in the world (or a metaphysics of ‘creation (...) as teophany’); the radical transcendence and simultaneous radical immanence of God (that is, God as ‘Beingness’); fundamental restrictions of language and the analogical ‘Naming’ of God; creation as a system of dialectical symbols about God; the analogical participation of the subject in creation; and unification (reditus, the ‘flowing of things back to God’). The Dionysic trails in Cusa’s metaphysics are described as a noteworthy, if not important, palimpsest in the corpus of late Medieval philosophy and is indicative of what the author puts forward as ‘discursive memory’, which is presented as a modern-critical concept. Transgender people have among the highest rates of suicide attempts of any group in society, driven strongly by the perception that they do not belong in the sex of their physical body. Gender reassignment surgery is a procedure that can change the transgender person’s physical body to accord with their gender identity. The procedure raises important ethical and distributive justice concerns, given the controversy of whether it is a cosmetic or medical procedure and the economic costs associated with performing the (...) procedure. This paper argues that there is a strong case for funding GRS as a matter of clinical necessity and justice. This paper will be divided in four key sections: First, the state of transgender health will be outlined, including the role of GRS and common objections to it. Second, a number of common objections to GRS will be analysed at the outset and shown to be unconvincing. Third, a constructive argument will be advanced, arguing that publicly funded GRS is clinically necessary, cost-effective, and demanded by principles of justice. Fourth, the paper will briefly discuss moralistic biases and why we demand a higher burden of justification for funding GRS compared with other analogous procedures. (shrink)

Even though not all the books of the LXX have been completed by the Septuaginta-Unternehmen in Göttingen, by far the largest number of books have been assigned and are being prepared. Thus, text-critical work has largely been completed, or is in the process of being prepared. The next phase, hermeneutical research, is at hand. This phase naturally requires correct methodology. This applies to an acceptable textual theory (...) as well as to the reconstruction of the textual history of the LXX. This article takes the Septuagint of Proverbs as its point of comparison and discusses the following issues: novel research (monographs) and new research projects in conjunction with existing projects (exegetical commentaries, a theology of the Septuagint). Die erst im Juli 1980 gefundene, bis dahin gänzlich unbekannte Kolleghandschrift von Krause aus dem Wintersemester 1798/99 erweitert den Wissensstand um die Entwicklung der Philosophie Fichtes zwischen den Jahren 1795 und 1800 in einem erheblichen Maße und markiert eine Zäsur: Fichte scheidet die Philosophie nicht mehr in Theorie und Praxis, sondern faßt sie als eine, als Philosophie überhaupt.

Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution. Whatever ethical stance one takes in the debate regarding the ethics of human enhancement, one or more reference points are required to assess its morality. Some have suggested looking at the bioethical notions of safety, justice, and/or autonomy to find such reference points. Others, arguing that those notions are limited with respect to assessing the morality of human enhancement, have turned to human nature, human authenticity, or human dignity as reference points, thereby introducing some perfectionist assumptions into the debate. In (...) this article, we ask which perfectionist assumptions should be used in this debate. After a critique of views that are problematic, we take a positive approach, suggesting some perfectionist elements that can lend guidance to the practice of human enhancement, based on the work of Martha Nussbaum's Capability Approach. We suggest that the central capabilities can be used to define the human aspect of human enhancement and thereby allow a moral evaluation of enhancement interventions. These central capabilities can be maximized harmoniously to postulate what an ideal human would look like. Ultimately, the aim of this article is twofold. First, it seeks to make explicit the perfectionist assumptions found in the debate and eliminate those that are problematic. Second, the paper clarifies an element that is often neglected in the debate about human enhancement, the view of the ideal human towards which human enhancement should strive. Here, we suggest that some central capabilities that are essential for an ideal human being can be maximized harmoniously and can therefore serve as possible reference points to guide human enhancement.
