Fichte's System of Ethics, originally published in 1798, is at once the most accessible presentation of its author's comprehensive philosophical project, The Science of Knowledge or Wissenschaftslehre, and the most important work in moral philosophy written between Kant and Hegel. This study integrates the discussion of our moral duties into the systematic framework of a transcendental theory of the human subject. Postmetaphysics in this book is interpreted as thinking through metaphysics at the closure of metaphysics by thinking the impossible possibility of metaphysics. In this site of the closure of metaphysics and the turn to language, the grammar of faith is discovered as the grammar of language or writing. The logic or grammatology of writing and thus of reality is revealed, not contra to philosophy or metaphysics, but when thinking through metaphysics to its end or closure, and there in that site (...) the grammar of faith is revealed as the grammar of texts and contexts and in such a site "God" is a good name to save and hence the possibility of postmetaphysical God-talk. The book concludes with three oblique offerings with regard to such postmetaphysical God-talk, namely a construction of an image, theopoetics and finally holy folly in response to the limitations and possibilities of postmetaphysical God-talk in the light of the conversation between Heidegger, Levinas and Derrida. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

The recognition of capitalism as a core component of modernity has often led to conflation of the two categories; this happens to critics as well as defenders of capitalism, and it reflects their shared but only partly acknowledged premises. A tendency to interpret capitalism as a self-contained system has strongly affected the debate on its historical significance; this reductionistic approach could be adapted to different ideological stances as well as to changing views of capitalism's long-term trajectory. The notion of a (...) `spirit of capitalism', in the sense of cultural sources essential to the constitution (and arguably also to the continuity) of the capitalist order, has been one of the most important correctives to economic determinism and reductionism, but it has proved difficult to link this dimension to other aspects of the problematic. The article surveys the contributions of Weber, Sombart, Castoriadis and - most recently - Luc Boltanski and Eve Chiapello to this debate. The last section then discusses the work of Fernand Braudel and suggests that it could serve to reformulate the problematic of capitalism in more multidimensional terms. (shrink)

In the history of philosophy, Fichte's thought marks a crucial transitional stage between Kant and post-Kantian philosophy. Fichte radicalized Kant's thought by arguing that human freedom, not external reality, must be the starting point of all systematic philosophy, and in Foundations of Natural Right, thought by many to be his most important work of political philosophy, he applies his ideas to fundamental issues in political and legal philosophy, covering such topics as civic freedom, rights, private property, contracts, family relations, and (...) the foundations of modern political organization. This volume offers the first complete translation of the work into English, by Michael Baur, together with an introduction by Frederick Neuhouser that sets it in its philosophical and historical context. Johann Gottfried von Herder (1744-1803) is one of the most important German philosophers of the eighteenth century, who had enormous influence on later thinkers such as Hegel, Schleiermacher and Nietzsche. His wide-ranging ideas were formative in the development of linguistics, hermeneutics, anthropology and bible scholarship, and even today they retain their vitality and relevance to an extraordinary degree. This volume presents a new translation of Herder's most important and characteristic philosophical writings (some of which have never before been translated) (...) in his areas of central interest, including philosophy of language, philosophy of mind, philosophy of history and political philosophy, as well as his general philosophical program. An introduction sets the writings in their historical context and examines their philosophical achievement. (shrink)

Two key themes in contemporary social theory are particularly relevant to the interpretation and critique of figurational sociology. On the one hand, some recent critiques of the sociological tradition — Touraine's attempt to deconstruct the received image of society is the most important example — have called into question a dominant paradigm that underlies both Marxist and structural-functional theories. Norbert Elias has not only anticipated some of the most important criticisms but also suggested correctives to some of the currently fashionable (...) alternatives. More specifically, his relationship to the sociological traditions and to its contemporary offshoots can be described in terms of six antitheses: his approach is anti-economistic, anti-normativistic, anti-reductionistic, anti-functionalist, anti-structuralist and anti-individualistic. On the other hand, the impact of all these critical strategies is somewhat blunted by the one-sided emphasis on power. A more balanced version of figurational sociology would need a concept of culture to match and counter-balance Elias's insights into the problematic of power. Further exploration of this issue could draw both on the classics and on post-Parsonian debates about cultural power and their interconnections. Cultural interpretations of power are the most important link between those two dimensions of social life; although Elias has never explicitly thematized them, his recent writings touch upon some aspects of their specifically modern variants. Si l’on connaît aujourd’hui le dialogue fructueux que Paul Ricœur a noué avec les penseurs structuralistes, on ignore largement son positionnement face à la mouvance poststructuraliste. Faut-il opposer la philosophie de Ricœur au poststructuralisme à la française ou au contraire doit-on montrer qu’elle en est une variante singulière? C’est la seconde option qui est ici défendue. Certes, le poststructuralisme ne doit pas être considéré comme une école de pensée mais comme une reconstruction qui relève de l’histoire de la philosophie. Dans (...) la mesure où les horizons de dépassement du structuralisme ont été posés de manière chaque fois particulière, il est préférable de parler de poststructuralismes au pluriel. C’est la raison pour laquelle J. Michel propose des confrontations dyadiques entre Ricœur et certains de ses contemporains que l’on regroupe habituellement dans cette mouvance. (shrink)

Fichtes theoretischer Ansatz bietet den bis heute einzigen methodisch konsistenten Versuch einer Letztbegründung des Sollens als Beweis der sittlichen Freiheit des Einzelnen.

The time and opportunity have finally arrived for the next phase of Septuagint research. Even though not all the books of the LXX have been completed by the Septuaginta-Unternehmen in Göttingen, by far the largest number of books have been assigned and are being prepared. Thus, text-critical work has largely been completed, or is in the process of being prepared. The next phase, hermeneutical research, is at hand. This phase naturally requires correct methodology. This applies to an acceptable textual theory (...) as well as to the reconstruction of the textual history of the LXX. This article takes the Septuagint of Proverbs as its point of comparison and discusses the following issues: novel research (monographs) and new research projects in conjunction with existing projects (exegetical commentaries, a theology of the Septuagint). Foucault’s sodomite’: Damian’s Liber gomorrhianus (1049) reopened. Taking Michel Foucault’s famous statement about the difference between the ‘Medieval sodomite’ and the heteronormative ‘19th century homosexual’ as its cue, this article surveys the discursive source of that statement in the work of Peter Damian (1007–1072) with regard to his obscure, yet consequential text, Liber gomorrhianus (presented in 1049 to Pope Leo IX, preceding the Council of Reims). Drawing on the recent research by Ranft and because Damian is such an understated figure (...) in the corpus of Medieval philosophy, an overview of Damian’s life and work is presented, especially in terms of Damian’s 11th century reforming labour ethics. Only then the article proceeds to reopen Damian’s text, indicating that the ‘Medieval sodomite’ is far removed from an elementary precursor to the modern scientia sexualis homosexual, but is indeed presented by Damian as a complex and gender-inclusive licentious person, within the context of the disintegration of sexual morality (especially within the domains of celibacy and confession) in the middle to late 11th century church and monasteries. Cross-referencing the own translation of the Latin text with the translation of Payer, the article disseminates and critiques the key concepts in Damian’s argument for the summarily deposition of lapsi [fallen priests] and the expulsion of promiscuous monks (and nuns) from the orders, especially with regard to Damian’s concepts of contra-natural and irrational fornication. Pope Leo’s deeply pastoral and insightful answer to Damian ( Ad splendidum nitentis ) is presented in the last part of the article, including his sanctioning of Damian’s complex concept of sodomy, which on that ground, became the conceptual source for the council of Reims (1049), and subsequent Medieval councils dealing with the ‘problem of sodomy’ in the church and monasteries. The canons of those councils were indeed the source of Foucault’s analysis of Medieval sexuality – yet the more fundamental source was Damian’s obscure text. (shrink)

This paper sketches a theory of the reason‐giving force of well‐being that allows us to reconcile our intuitions about two of the most recalcitrant problem cases in population ethics: Jan Narveson's Procreation Asymmetry and Derek Parfit's Non‐Identity Problem. I show that what has prevented philosophers from developing a theory that gives a satisfactory account of both these problems is their tacit commitment to a teleological conception of well‐being, as something to be ‘promoted’. Replacing this picture with one according to which (...) our reasons to confer well‐being on people are conditional on their existence allows me to do better. It also enables us to understand some of the deep structural parallels between seemingly disparate normative phenomena such as procreating and promising. The resulting theory charts a middle way between the familiar dichotomy of narrow person‐affecting theories and totalist or wide‐person affecting theories in population ethics. (shrink)

This article provides an original reappraisal of the notion of Minnemystik in the work of the 13th-century Flemish beguine Hadewijch of Antwerp, with specific reference to its Trinitarian and Christological orientations. After an introduction to the nature and origins of Hadewijch’s work, relating to the discovery of four extant manuscripts in Belgium in 1838, followed by an elucidation of the experience-driven epistemology of the Victorians Richard of St Victor and Hugo of St Victor as her key early scholastic influences, Hadewijch’s (...) Minnemystik is distinguished from Wesenmystik, as encountered in the mystical work of her French contemporary and beguine counterpart, Marguerite Porete. From this discursive basis, Hadewijch’s Minnemystik is reassessed and represented as pertinently Trinitarian and Christological in orientation, and therefore as a theological presentation from the 13th century. The world is undeniably full of injustice. Many feel that much political philosophy is practically impotent and engaged instead in overly abstract theorising insufficiently sensitive to the realities of the world. One response to this concern is David Miller’s influential model of evidence-based political philosophy, which claims to be sensitive to empirical evidence from the social sciences, takes seriously people’s opinions, and defends the role of facts in grounding normative principles. Using various examples from the field of global justice, one (...) of Miller’s key areas of work, I show that Miller’s method is unconvincing on two levels. His theoretical argument for fact-dependence is flawed, and his practical argument for an opinion-sensitive political theory is either guilty of status quo bias or, in an attempt to escape it, becomes self-defeating. While the paper is primarily critical, I endeavour also to draw out the implications of my critiques for the role of the ‘real world’ in theorising. (shrink)

Transgender people have among the highest rates of suicide attempts of any group in society, driven strongly by the perception that they do not belong in the sex of their physical body. Gender reassignment surgery is a procedure that can change the transgender person’s physical body to accord with their gender identity. The procedure raises important ethical and distributive justice concerns, given the controversy of whether it is a cosmetic or medical procedure and the economic costs associated with performing the (...) procedure. This paper argues that there is a strong case for funding GRS as a matter of clinical necessity and justice. This paper will be divided in four key sections: First, the state of transgender health will be outlined, including the role of GRS and common objections to it. Second, a number of common objections to GRS will be analysed at the outset and shown to be unconvincing. Third, a constructive argument will be advanced, arguing that publicly funded GRS is clinically necessary, cost-effective, and demanded by principles of justice. Fourth, the paper will briefly discuss moralistic biases and why we demand a higher burden of justification for funding GRS compared with other analogous procedures. (shrink)

The foundational conviction of contemporary liberal thought is that all persons possess equal moral worth and are entitled to equal concern and respect by others. At the same time, nation states, as the primary organs of our collective self-governance, frequently pursue policies that are strikingly partial towards the interests of compatriots over those of foreigners. A common strategy for justifying this national partiality is to view it as grounded in associative obligations that we incur by standing in special relationships with (...) our fellow citizens. For instance, according to familiar arguments from ‘fair play’, voluntarily partaking in and benefiting from cooperative relationships with our fellow citizens gives us reciprocal obligations to maintain these social institutions and care for needy compatriots. By contrast, we do not have corresponding associative obligations towards foreigners. I maintain that such arguments from associative obligations face an important stumbling block. I argue for the following “Boundary Principle”, according to which we cannot appeal to special relationships amongst members of a group to justify an attitude of partiality towards them unless the boundaries of this group, and the fact that they exclude other persons from membership, can also be justified. If this is right, arguments from associative obligations, by themselves, are necessarily incomplete. Most modern states severely limit the scope of economic migration, and thereby prevent many would-be contributors to the collective enterprises of affluent societies from entering into those special relationships with us that would give rise to associative obligations on our part. Not only are would-be immigrants excluded from the benefits that participation in the cooperative schemes of affluent nation-states would itself confer; in addition, the fact that they do not stand in such cooperative relationships with us is then appealed to in order to justify the fact that we assign significantly less weight to their interests in the formulation of state policy. The upshot of my discussion is not that a defense of national partiality in terms of associative obligations cannot succeed. It is rather that a successful defense of national partiality in these terms is more closely tied to the question whether principled restrictions can be placed on immigration than most political philosophers have hitherto assumed. Thomas Hobbes argued for absolute sovereignty, and claimed that in Christian countries the sovereign was fully empowered to govern the church as well as the state. There are grounds for seeing Hobbes as a staunch opponent of religious toleration, and a number of scholars support some variation of this position. This chapter examines the case for and against the idea of the tolerant Hobbes, beginning with his views on the clergy, and the historical context of those views, especially in the (...) debates on church–state relations that preoccupied his English contemporaries. Hobbes noted that clerics were commonly funded by tithes, which were a tenth of the incomes of the laity to whom they catered. Many English Protestant supporters of toleration drew the line at tolerating Roman Catholicism. Hobbes contended that “there is Publique, and Private Worship”. The precept that states should establish the uniform, public worship of God stemmed, in his opinion, from reason and nature. (shrink)

In this brief response to Herbert De Vriese’s The Charm of Disenchantment, his attempt to link secularism and modernity is questioned. Criticism is leveled at De Vriese’s use of the correspondence between Voltaire and Frederick the Great without reference to the historical context, notably the confessional states that existed between roughly 1650 and 1800 in Europe. De Vriese’s apology for disenchantment and modernity is also questioned in the light of both modern religious and secular responses to modernity as exemplified by (...) the Dalai Lama and Bernard Stiegler. This article discusses successive positions of the Frankfurt School, contrasts them to the unfolding ideas of Castoriadis and argues for a critical theory centred on a concept of autonomy, but aware of the obstacles and complications inherent in social–historical reality and its modern configuration. To clarify this perspective, we need a concept of society that distances itself from the Parsonian paradigm, more so than recent theorists of the Frankfurt School have done. The critique of over-integrated images of society, developed by (...) various sociologists in the 1970s and 1980s but not properly assimilated by the mainstream of the discipline and never taken on board by Frankfurt theorists, is an important source of reference, and it can be taken further in the light of Castoriadis’s reflections on the social–historical. The result is a definition of autonomy as a capacity of explicit and unlimited interrogation, confronted with its own hubristic temptations in the context of a multidimensional social world. (shrink)
