We investigate two under-explored factors in mitigating the risk of corporate fraud and regulatory enforcement against fraud, namely institutional investors and political connections. The role of institutional investors in the effective monitoring of a firm’s management is well established in the literature. We further observe that firms that have a large proportion of their shares held by institutional investors have a lower incidence of enforcement actions against corporate fraud. The importance of political connections for enterprises, whether in a developed market (...) such as the United States or an emerging market such as China, has been established by previous studies. However, we find evidence of another positive effect of political connections: they may reduce the incidence of enforcement action against corporate fraud. We also find that political connections play a more significant role in reducing regulatory enforcement incidents against non-state-owned enterprises and firms in weaker legal environments, whereas institutional ownership plays a more important role in reducing regulatory enforcement incidents against state-owned enterprises. There are relatively few empirical studies on the impacts of corporate social responsibility policies and programs. This article addresses the research gap by analyzing the incidence of, and the conditions that affect, decoupling among CSR policies, implementation of CSR programs, and CSR impacts for various environmental and social issues. Complete decoupling is a condition of full divergence among policies, programs, and impacts amounting to purely ceremonial CSR. Using ratings from a sustainability rating agency on a sample of about 1,000 large (...) companies in 24 countries, the authors find empirical evidence not supporting a conclusion of complete decoupling. The empirical evidence suggests four levels of nondivergence in the sample. First, for most CSR issues examined, CSR policies of high quality do have relatively strong effects on CSR implementation. Second, CSR programs of high quality do have relatively strong effects on CSR impacts. Third, for most CSR issues, even low-quality CSR policies enforce the incidence and quality of programs in comparison with having no policy at all. Fourth, weak programs have more impact on the realization of CSR goals than having no program at all. The authors also find that the quality of CSR reporting and locating the responsibility for CSR at the board level reduce decoupling by strengthening the quality of CSR programs. (shrink)

Current dynamic-epistemic logics model different types of information change in multi-agent scenarios. We generalize these logics to a probabilistic setting, obtaining a calculus for multi-agent update with three natural slots: prior probability on states, occurrence probabilities in the relevant process taking place, and observation probabilities of events. To match this update mechanism, we present a complete dynamic logic of information change with a probabilistic character. The completeness proof follows a compositional methodology that applies to a much larger class of dynamic-probabilistic (...) logics as well. How questions are understudied in philosophy and linguistics. They can be answered in very different ways, some of which are poorly understood. Jaworski identifies several types: ‘manner’, ‘method, means or mechanism’, ‘cognitive resolution’, and develops a logic designed to enable us to distinguish among them. Some key questions remain open, however, in particular, whether these distinctions derive from an ambiguity in how, from differences in the logical structure of the question or from contextual underspecification. Arguing from two classes of responses, (...) adverbs and by gerunds, I give the answer that the logical structure of the question is indeed relevant: loosely, manners are adjuncts but methods are arguments. This paper draws on the emerging field of innovation ethics to complement the more established field of responsible innovation by focusing on key ethical issues raised by technological innovations. One key limitation of influential frameworks of RI is that they tend to neglect some key ethical issues raised by innovation, as well as major normative dimensions of the notion of responsibility. We explain how IE could enrich RI by stressing the more important role that ethical analysis should play in RI. (...) We focus on two transversal issues of IE: the issue of redrawing conceptual boundaries, especially the topic of the artificialization of the world, and the issue of responsibility, especially the notion of total responsibility. We address these two issues from the thematic perspective of IE, thereby generating lessons learnt for RI. The artistic design stance is an important part of art appreciation, but it remains unclear how it can be applied to artworks for which art historical context is no longer available, such as Ice Age art. We propose that some of the designer's intentions can be gathered noninferentially through direct experience with prehistoric artworks.

The shift in the prevailing view of alcoholism from a moral paradigm towards a biomedical paradigm is often characterized as a form of biomedicalization. We will examine and critique three reasons offered for the claim that viewing alcoholism as a disease is morally problematic. The first is that the new conceptualization of alcoholism as a chronic brain disease will lead to individualization, e.g., a too narrow focus on the individual person, excluding cultural and social dimensions of alcoholism. The second claim (...) is that biomedicalization will lead to stigmatization and discrimination for both alcoholics and people who are at risk of becoming alcoholics. The third claim is that as a result of the biomedical point of view, the autonomy and responsibility of alcoholics and possibly even persons at risk may be unjustly restricted. Our conclusion is that the claims against the biomedical conceptualization of alcoholism as a chronic brain disease are neither specific nor convincing. Not only do some of these concerns also apply to the traditional moral model; above that they are not strong enough to justify the rejection of the new biomedical model altogether. The focus in the scientific and public debate should not be on some massive “biomedicalization objection” but on the various concerns underlying what is framed in terms of the biomedicalization of alcoholism. This introductory essay provides a historical and cross-cultural overview of evolutionary ethics, and how it can be situated within naturalized ethics. We also situate the contributions to this volume.

Introductory paper: Ethicists and political scientists are increasingly convinced that the moral legitimacy of political decisions is rooted in the quality of the social dialogue that precedes those decisions. A broad-based social consideration and discussion creates the form to examine and to refine options and visions and assures a general respect for commonly arrived decisions. In order to enable such consideration and discussion, it would seem essential that as many people and interest groups as possible be provided adequate information so (...) that they can proceed in a nuanced fashion in their discussions.Information on environment issues is often a complex of issues: genetic manipulation, atmospheric warming, and rising sea levels, for instance, often appear in highly technical and occasionally contradictory scientific reports. One cannot presume that the average citizen can make scientifically responsible judgements about these questions. It is not, however, just the complexity of issues that keeps the public debate about environmental questions in the shadow. There is a basic lack of interest among the general public about becoming technically informed about environmental issues. The popular media which as carefully as possible finesses its presentation about the issue, makes more room in its reporting for politicians fighting among themselves, crimes, scandals, and spectacular events.Issues based on well thought out argumentation are rarely reported. That does not mean that more people are growing concerned about the environment. In the insecurity that characterizes our post-modern existence, anxiety about the worsening environment is an important factor; but the result of this concern is not that there is more attentive reporting during news presentations but rather that startling conclusions are regularly announced or that spectacular protest actions are reported upon in every detail. What one often sees happening is that pressure groups, by arousing public emotion, try to influence the political agenda. Such emotional reactions are not the immediate result of a correct interpretation of the facts but are based rather on the fantastic images of one-liners or single events.What is the policy of Greenpeace in this regard, and especially in its campaigns about genetic manipulation? How do representatives of the agro-industry react to communications from Greenpeace? What do they propose as alternatives? How can one better communicate, in view of the breadth of public opinion, about environmental issues? How can a journalist, in the competitive world of the media, deliver objective information to the greatest number of people? How can the classic special interest groups, such as agricultural organizations, unions, cultural groups, and political parties truly contribute to quality dialogue about these questions? (shrink)

There is an increasing call for preventive state interventions in so-called families at risk—that is, interventions before any overt harm has been done by parents to their children or by the children to a third party, in families that are statistically known to be liable to harm children. One of the basic principles of liberal morality, however, is the citizen's right to be free from state intervention so long as no demonstrable harm has been done. On the other hand, Joel (...) Feinberg interprets the harm principle as a harm prevention principle, so that the risk of harm also might be a reason for interference. The question that needs to be asked, therefore, is whether enforced preventive intervention in the cases where families are judged to be at risk can be justified within the limits of liberalism. This article aims to reconstruct the normative distinction between sophistry and dialectics developed in Plato’s treatment of sophistry. We begin by describing Plato’s notion of sophistry as a knack of persuasion that succeeds by masquerading itself as truth-oriented and by providing gratification for its listeners. We then argue that the stringency of Plato’s arguments becomes clear by using his definition of sophistry as a guideline for the interpretation of the dialogues Protagoras and Gorgias. Together, these dialogues provide a well-structured argument (...) that questions the usefulness of sophistic practice, despite its effectiveness in attaining power within the Athenian democratic institutions. Plato’s fundamental critique of sophistry differs from certain misleading prejudices against sophistry, also found in Plato’s writings and challenged by historical research. The critique is therefore of lasting relevance not only to the understanding of Plato’s philosophical agenda but also to the interpretation of »the sophists«. We end by suggesting that Plato’s normative distinction between sophistry and dialectics is also of relevance for our contemporary conception of democratic discursive culture and its legitimacy. This article gives brief results of a Norwegian empirical project where the main purpose has been to study the burial rite versus bereavement and the role of religiousness in relation to the disposing of the dead. The theoretical perspective is that loss of a significant close, as well as religiousness are primary life experiences which flow together in the bereaved person's grieving conduct during the burial rite. 70 bereaved persons who had lost a close relative during a certain time period (...) have filled in questionnaires with information about the death, the funeral, religiousness and bereavement. The sample is treated statistically by means of indexes for grieving conduct during the burial week, religiousness, and grief. The sample is coherent and unambiguous, and shows that those who let the burial rite be a time to mourn experienced more benefit from the funeral service and had less anxiety, depression and intrusive experiences during the first year of bereavement. But sadness was independent of the grieving conduct during the burial rite, a result which makes sadness an aspect of mourning which qualitatively differs from the other aspects described. External conditions as urbanity and institutionalizing, as well as internal matters as the dramatical character of the loss, and personal religiousness affected the bereaved person's grieving conduct during the burial rite. Recently at least two papers1,2have appeared that look at cancer from an evolutionary perspective. That cancer has a negative effect on fitness needs no argument. However, cancer origination is not an isolated process, but the potential for it is linked in diverse ways to other genetically determined developmental events, complicating the way selection acts on it, and through it on the evolution of development. The two papers take a totally different line. Kavanagh argues that anti‐cancer selection has led to developmental (...) constraints. Leroi et al. argue that cancer is a side‐effect of recent evolutionary changes that usually will disappear over time through anti‐cancer selection. Here we place the papers in a wider perspective, and in so doing discuss various alternative developmental links cancer may have together with their evolutionary implications. Kurt Gödel’s version of the Ontological Proof derives rather than assumes the crucial Possibility Claim: the claim that it is possible that something God-like exists. Gödel’s derivation starts off with a proof of the Possible Instantiation of the Positive: the principle that, if a property is positive, it is possible that there exists something that has that property. I argue that Gödel’s proof of this principle relies on some implausible axiological assumptions but it can be patched so that it only (...) relies on plausible principles. But Gödel’s derivation of the Possibility Claim also needs a substantial axiological assumption, which is still open to doubt. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:The Microscope of Experience: Christian Garve’s Translation of Cicero’s De Officiis (1783)Johan van der ZandeDuring the negotiations leading to the Treaty of Teschen of 1779, ending the phony War of Bavarian Succession, Frederick II and his court stayed in Breslau, the capital of Silesia. There, in conversation with Christian Garve, the city’s most famous son, the king strongly recommended a new German translation of Cicero’s On Moral Duties (...) (De Officiis), one of the classical texts of humanist philosophy and his favorite book. Frederick’s faithful subject dutifully obliged his sovereign. Four years later, in the subservient language of a dedication to a royal patron, Garve offered in due obedience to Frederick a result that, “perhaps flawed,” was “vindicated by the efforts directed toward the execution of the command.” 1Yet Garve’s interest in Cicero differed markedly from that of Frederick. After all, as Garve wrote in the preface to the philosophical commentary on his translation, Cicero’s book was written for “persons of the higher classes who participated in the affairs of state” and for whom “moral prescription often transformed into political instruction.” Clearly that was not the world in which Garve lived. The son of an artisan, Garve, after a brief stint as a professor of philosophy in Leipzig in the early 1770s, was forced by his illness to spend the rest of his life as a reclusive private scholar in his hometown. He admitted that Cicero sometimes “condescended to deal with those classes who occupy themselves as educators and scholars.” The producing classes, however, “this vast, indispensable, and valuable part of humankind,” could only find prescriptions [End Page 75] for the virtuous life in Cicero’s work insofar as they were human beings, not in relation to their station in life. In general terms Garve thought that Cicero had neglected to deal sufficiently with domestic duties, a reproach which he also leveled against another intellectual pedigree, Adam Ferguson. This did not mean, however, that Garve reduced the citizen’s actions to the private sphere, where they could be productive economically and concerned only with their own Bildung. On the contrary, for Garve useful citizens were those who committed themselves to sociability and to political engagement. Moral actions were not only to be judged according to their motivation (as Kant asserted) but also on their effects on society at large.This different emphasis, I suggest, was typical of the German popular philosophers, who in the time span between Christian Wolff and Immanuel Kant formulated a philosophy of life and among whom Garve emerged as the foremost representative. As a group they constituted a philosophical movement in their own right and were not merely, as they are usually described, the popularizers of Wolff’s philosophy. Rather, popular philosophy was a characteristic compound of Wolffian rationalism and British empiricism. Some popular philosophers, mostly the older generation, were more inclined to the rationalist and others, among them Garve, to the empirical end of this spectrum. Little concerned with epistemological problems or with the irrational cult of life as were the life philosophies of the nineteenth century, the popular philosophers were primarily interested in the virtuous life, in a philosophical theory of moral and aesthetic action. Theirs was a “science of man,” that is, a combination of practical philosophy and literary skills with the goal of morally educating a literate but non-specialized public to be useful citizens of the absolute state. They wanted to speak with propriety on all themes of human existence rather than pursue those philosophical questions not directly related to human life. 2 I entirely agree with a recent commentator who describes Garve’s concerns as non-bourgeois, or better, pre-bourgeois and deeply rooted in humanist values. 3This approach shows in Garve’s Cicero translation and commentary. In Leipzig he had attended the lectures of the classical philologist Friedrich Wilhelm Reiz, who trained his students in precise, critical scholarship. When Garve became a professor himself, he and Reiz anonymously published a Latin edition of Aristotle’s Rhetoric. A compelling requirement on normative theories is that they should be satisfiable, that is, in every possible choice situation with a finite number of alternatives, there should be at least one performable act such that, if one were to perform that act, one would comply with the theory. In this paper, I argue that, given some standard assumptions about free will and counterfactuals, Objective Act Consequentialism violates this requirement.

Immigration is often associated with a situation in which would-be migrants and their countries of origin are put at the mercy of others’ decisions. The main objective of this article is to theorize this ‘being at the mercy’ in light of a republican definition of what freedom is about: the absence of domination. Immigration policy represents instances of domination on a wide spectrum of individuals and political communities. This article focuses on the procedural discretion claimed by states of destination in (...) their relations with would-be migrants. On the basis of a definition of the concept of ‘jurisdiction’, the article distinguishes 4 paradigmatic situations of immigration, which all display situations of domination. In each situation, the state of destination arbitrarily interferes with important interests of individuals and political communities. In light of this argument, existing mechanisms in national, transnational and international settings can be identified and justified as anti-domination measures. The argument offers a blueprint on how to further develop them in preventing domination in immigration. (shrink)

Due to the financial crisis of the Belgian central administration and the financial difficulties of local government, municipal taxes are gradually taking a higher place in the rank of municipal income sources. One could expect a differentiation between the presence of some political parties in the board ofmayor and aldermen on the one hand and the burden of taxation on the other hand. Concerning this amount of increase, the data showed no evidence to prove that differentiation in the Flemish municipalities. (...) Still we noticed a small variation in the burden of taxation according as to theweight of the socialist group within the local majority. Nevertheless factors as population and the level of mean income in the municipalities were more important to explain the burden of taxation. The results of the municipal-council elections of 1988 are not affected by the increase of the local burden of taxation. (shrink)

One of the principles on how to act under moral uncertainty, My Favourite Theory, says roughly that a morally conscientious agent chooses an option that is permitted by the most credible moral theory. In defence of this principle, we argue that it prescribes consistent choices over time, without relying on intertheoretic comparisons of value, while its main rivals are either plagued by moral analogues of money pumps or in need of a method for making non-arbitrary intertheoretic comparisons. We rebut the (...) arguments that have been levelled against My Favourite Theory and offer some arguments against intertheoretic comparisons of value. (shrink)

Jeremy Bentham is often interpreted as defending a satisficing, rather than maximizing, version of utilitarianism, where an act is right as long as it produces more pleasure than pain. This lack of maximization is surprising given Bentham’s maximizing slogan ‘the greatest happiness of the greatest number’. Against the satisficing interpretation, I argue that Bentham consistently defends a maximizing version of utilitarianism, where an act’s consequences are compared to those of not performing the act. I show that following this version of (...) utilitarianism requires that one realizes the greatest happiness for all affected individuals. (shrink)

One might think that money pumps directed at agents with cyclic preferences can be avoided by foresight. This view was challenged two decades ago by the discovery of a money pump with foresight, which works against agents who use backward induction. But backward induction implausibly assumes that the agent would act rationally and retain her trust in her future rationality even at choice nodes that could only be reached if she were to act irrationally. This worry does not apply to (...) BI-terminating decision problems, where at each choice node backward induction prescribes a move that terminates further action. For BI-terminating decision problems, it is enough to assume that rationality and trust in rationality are retained at choice nodes reachable by rational moves. The old money pump with foresight was not BI-terminating. In this paper, we present a new money pump with foresight, one that is both BI-terminating and considerably simpler. (shrink)

Bayesian models are often criticized for postulating computations that are computationally intractable (e.g., NP-hard) and therefore implausibly performed by our resource-bounded minds/brains. Our letter is motivated by the observation that Bayesian modelers have been claiming that they can counter this charge of “intractability” by proposing that Bayesian computations can be tractably approximated. We would like to make the cognitive science community aware of the problematic nature of such claims. We cite mathematical proofs from the computer science literature that show intractable (...) Bayesian computations, such as postulated in existing Bayesian models, cannot be tractably approximated. This does not mean that human brains do not (or cannot) implement the type of algorithms that Bayesian modelers are advancing, but it does mean that proposing that they do by itself does nothing to parry the charge of intractability, because the postulated algorithms are as intractable (i.e., require exponential time) as the computations they try to approximate. Besides our negative message for the community, our letter also makes a positive contribution by referring to a methodology that Bayesian modelers can use to try and parry the charge of intractability in a mathematically sound way. Human decision making shows systematic simplifications and deviations from the tenets of rationality (‘heuristics’) that may lead to suboptimal decisional outcomes (‘cognitive biases’). There are currently three prevailing theoretical perspectives on the origin of heuristics and cognitive biases: a cognitive-psychological, an ecological and an evolutionary perspective. However, these perspectives are mainly descriptive and none of them provides an overall explanatory framework for the underlying mechanisms of cognitive biases. To enhance our understanding of cognitive heuristics and biases we propose a neural (...) network framework for cognitive biases, which explains why our brain systematically tends to default to heuristic (‘Type 1’) decision making. We argue that many cognitive biases arise from intrinsic brain mechanisms that are fundamental for the working of biological neural networks. In order to substantiate our viewpoint, we discern and explain four basic neural network principles: (1) Association, (2) Compatibility (3) Retainment, and (4) Focus. These principles are inherent to (all) neural networks which were originally optimized to perform concrete biological, perceptual, and motor functions. They form the basis for our inclinations to associate and combine (unrelated) information, to prioritize information that is compatible with our present state (such as knowledge, opinions and expectations), to retain given information that sometimes could better be ignored, and to focus on dominant information while ignoring relevant information that is not directly activated. The supposed mechanisms are complementary and not mutually exclusive. For different cognitive biases they may all contribute in varying degrees to distortion of information. The present viewpoint not only complements the earlier three viewpoints, but also provides a unifying and binding framework for many cognitive bias phenomena. (shrink)

This article develops a new measure of freedom of choice based on the proposal that a set offers more freedom of choice than another if, and only if, the expected degree of dissimilarity between a random alternative from the set of possible alternatives and the most similar offered alternative in the set is smaller. Furthermore, a version of this measure is developed, which is able to take into account the values of the possible options.

Enacting an AI system typically requires three iterative phases where AI engineers are in command: selection and preparation of the data, selection and configuration of algorithmic tools, and fine-tuning of the different parameters on the basis of intermediate results. Our main hypothesis is that these phases involve practices with ethical questions. This paper maps these ethical questions and proposes a way to address them in light of a neo-republican understanding of freedom, defined as absence of domination. We thereby identify different (...) types of responsibility held by AI engineers and link them to concrete suggestions on how to improve professional practices. This paper contributes to the literature on AI and ethics by focusing on the work necessary to configure AI systems, thereby offering an input to better practices and an input for societal debates. The money-pump argument is the standard argument for the acyclicity of rational preferences. The argument purports to show that agents with cyclic preferences are in some possible situations forced to act against their preference. In the usual, diachronic version of the money-pump argument, such agents accept a series of trades that leaves them worse off than before. Two stock objections are (i) that one may get the drift and refuse the trades and (ii) that one may adopt a plan to (...) only accept some of the trades. This article argues that these objections are irrelevant. If the diachronic money-pump argument is cogent, so is a more direct synchronic argument. The upshot is that the standard objections to the diachronic money-pump argument do not affect this simpler synchronic argument. Hence the standard objections to the money-pump argument for acyclicity are irrelevant. (shrink)

Joshua Gert and Wlodek Rabinowicz have developed frameworks for value relations that are rich enough to allow for non-standard value relations such as parity. Yet their frameworks do not allow for any non-standard preference relations. In this paper, I shall defend a symmetry between values and preferences, namely, that for every value relation, there is a corresponding preference relation, and vice versa. I claim that if the arguments that there are non-standard value relations are cogent, these arguments, mutatis mutandis, also (...) show that there are non-standard preference relations. Hence frameworks of Gert and Rabinowicz's type are either inadequate since there are cogent arguments for both non-standard value and preference relations and these frameworks deny this, or they lack support since the arguments for non-standard value relations are unconvincing. Instead, I propose a simpler framework that allows for both non-standard value and preference relations. (shrink)

It has often been argued that, notwithstanding his commitment to the authoritarian state, Thomas Hobbes is a champion of the "minimal" version of liberty of conscience: namely, the freedom of citizens to think whatever they like as long as they obey the law. Such an interpretation renders Hobbes's philosophy more palatable to contemporary society. Yet the claim is incorrect. Alongside his notion of "private" conscience, namely, Hobbes develops a conception of conscience as a public phenomenon. In the following, it is (...) argued that this inconsistency serves the purpose of deception: it holds out the possibility of dissent while making it impossible to utilise. Arguably, moreover, this is the proper hermeneutical approach to take to Hobbes's inconsistencies in general. Indeed, said inconsistencies ought to alert contemporary normative theorists to the instability of the "minimal" version of liberty of conscience attributed to Hobbes: Hobbes himself, namely, shows that it is insufficient.
