Feinberg is one of the leading philosophers of law of the last forty years. This volume collects recent articles, both published and unpublished, on what he terms "basic questions" about the law, particularly in regard to the relationship to morality. Accessibly and elegantly written, this volume's audience will reflect the diverse nature of Feinberg's own interests: scholars in philosophy of law, legal theory, and ethical and moral theory.

Moderate rationalists maintain that our rational intuitions provide us with prima facie justification for believing various necessary propositions. Such a claim is often criticized on the grounds that our having reliable rational intuitions about domains in which the truths are necessary is inexplicable in some epistemically objectionable sense. In this paper, I defend moderate rationalism against such criticism. I argue that if the reliability of our rational intuitions is taken to be contingent, then there is no reason to think that (...) our reliability is inexplicable. I also suggest that our reliability is, in fact, necessary, and that such necessary reliability neither admits of, nor requires, any explanation of the envisaged sort. (shrink)

We analyze the expressivity, succinctness, and complexity of a family of languages based on weighted propositional formulas for the representation of utility functions. The central idea underlying this form of preference modeling is to associate numerical weights with goals specified in terms of propositional formulas, and to compute the utility value of an alternative as the sum of the weights of the goals it satisfies. We define a large number of representation languages based on this idea, each characterized by a (...) set of restrictions on the syntax of formulas and the range of weights. Our aims are threefold. First, for each language we try to identify the class of utility functions it can express. Second, when different languages can express the same class of utility functions, one may allow for a more succinct representation than another. Therefore, we analyze the relative succinctness of languages. Third, for each language we study the computational complexity of the problem of finding the most preferred alternative given a utility function expressed in that language. (shrink)

Kant's introduction of a distinctive form of philosophical investigation and proof, known as transcendental, inaugurated a new philosophical tradition. Transcendental Philosophy and Naturalism assesses the present state and contemporary relevance of this tradition. The contributors aim to understand the theoretical structures involved in transcendental explanation, and to assess the contemporary relevance of the transcendental orientation, in particular with respect to contemporary philosophical naturalism. These issues are approached from both naturalistic and transcendental perspectives.

In the face of escalating Medicaid costs and anticipated reductions in federal Medicaid spending, states are increasingly converting from fee-for-service to managed health care systems. The interrelated issues of enrollment and auto-assignment are fundamental to the overall success or failure of Medicaid managed care programs. The purpose of this article is to suggest how policy makers, consumer advocates, and providers should address these issues. My major premise is that implementation of managed care will proceed more smoothly if states adopt enrollment (...) strategies that promote voluntary selection of health plans by Medicaid consumers, minimize the likelihood of auto-assignment, and mitigate the negative consequences of mandatory assignment of consumers to managed care organizations.States seeking to implement Medicaid managed care must apply for a waiver from the secretary of the Department of Health and Human Services. A phylogeny that allows for lateral gene transfer (LGT) can be thought of as a strictly branching tree (all of whose branches are vertical) to which lateral branches have been added. Given that the goal of phylogenetics is to depict evolutionary history, we should look for the best supported phylogenetic network and not restrict ourselves to considering trees. However, the obvious extensions of popular tree-based methods such as maximum parsimony and maximum likelihood face a serious problem—if we judge networks by (...) fit to data alone, networks that have lateral branches will always fit the data at least as well as any network that restricts itself to vertical branches. This is analogous to the well-studied problem of overfitting data in the curve-fitting problem. Analogous problems often have analogous solutions and we propose to treat network inference as a case of model selection and use the Akaike Information Criterion (AIC). Strictly tree-like networks are more parsimonious than those that postulate lateral as well as vertical branches. This leads to the conclusion that we should not always infer LGT events whenever it would improve our fit-to-data, but should do so only when the improved fit is larger than the penalty for adding extra lateral branches. Alvin Plantinga theorizes about an epistemic property he calls "warrant," defined as that which makes the difference "between knowledge and mere true belief." I show that, given this account, Plantinga can have no justification for claiming that a false belief is warranted nor for claiming that warrant comes in degrees.

In the years shortly before and after the publication of his classic _Truth and Method_, the eminent German philosopher Hans-Georg Gadamer returned often to questions surrounding religion and ethics. In this selection of writings from _Gesammelte Werke_ that are here translated into English for the first time, Gadamer probes deeply into the hermeneutic significance of these subjects. Gadamer raises issues of importance to ethicists and theologians as well as students of language and literature. In this wide-ranging historical introduction to philosophical hermeneutics, Jean Grondin discusses the major figures from Philo to Habermas, analyzes conflicts between various interpretive schools, and provides a persuasive critique of Gadamer's view of hermeneutic history, though in other ways Gadamer's _Truth and Method_ serves as a model for Grondin's approach. Grondin begins with brief overviews of the pre-nineteenth-century thinkers Philo, Origen, Augustine, Luther, Flacius, Dannhauer, Chladenius, Meier, Rambach, Ast, and Schlegel. Next he provides more extensive treatments of such major nineteenth-century (...) figures as Schleiermacher, Böckh, Droysen, and Dilthey. There are full chapters devoted to Heidegger and Gadamer as well as shorter discussions of Betti, Habermas, and Derrida. Because he is the first to pay close attention to pre-Romantic figures, Grondin is able to show that the history of hermeneutics cannot be viewed as a gradual, steady progression in the direction of complete universalization. His book makes it clear that even in the early period, hermeneutic thinkers acknowledged a universal aspect in interpretation—that long before Schleiermacher, hermeneutics was philosophical and not merely practical. In revising and correcting the standard account, Grondin's book is not merely introductory but revisionary, suitable for beginners as well as advanced students in the field. (shrink)

In the preface to the Yale edition of Samuel Johnson’s poems, the editors remark that “for a modern reader who can recreate the situation in which [“London”] was written, it may still be exciting enough. But to one with less imaginative capacity or historical knowledge, its appeal lies in Johnson’s skillful handling of the couplet.”2 To assist us in re-creating the milieu of 1738, the editors supply the usual notes identifying various historical personages and events which are no longer in (...) the domain of common knowledge. In this respect they follow Johnson’s lead. “London” is manifestly an occasional poem; and its occasion—in part, Walpole’s timidity abroad and corruption at home—like all occasions, passed.3 Indeed it passed so quickly that Johnson himself felt called upon in the fifth edition to annotate, for instance, his mention of “the Gazetteer”: “the paper which at that time contained apologies for the Court.” By 1750 Walpole was long out of court, the Gazetteer extinct, and “London” as outdated as yesterday’s newspaper.For poems like “London” whose contents are neither au courant nor immortal but rather historical or simply dead, the Yale editors suggest two avenues of resuscitation: the reader may either restore the background by means of historical imagination or, failing that, admire Johnson’s couplet art, which perhaps has a better chance at perennial appeal. Either content or form, either history or art—both options require a sacrifice on our part, and that sacrifice is our occasion, our need. Even assuming that the poem’s context could be exhumed and that we could participate once again in all the rage of the “patriot” opposition to Walpole, Why would we want to? The problem is that not only “London” but the Walpole regime itself is now defunct. Yet the same question must be asked of the poem’s art, even and especially if it is eternal. Why are we interested in the aesthetic knowledge of couplets that have been drained of all substance? Is understanding “London” in either case an end in itself? The pure content of the poem is too concrete, its pure form too abstract, to answer our occasions. Thus to understand the poem as either history or art demands a leisure that has no exigencies and is therefore free for the bygone and ethereal.42. E.L. In this paper I look at a specific Hebrew religious term, Tikkun Olam, to examine the manner in which it signifies differently in two specific cases. While we understand that meaning is carried in both denotation and connotation, and while a genealogy of meaning is often useful to understand the manner in which meaning has changed across time, this paper recounts the manner in which a single word may signify differently synchronically, at a single point in history.

Biologist Richard Dawkins coined the term “meme” by which he meant a unit of culture. Dan Dennett continued by defining a meme as a bunch of bits of information. This paper explores the “meme” and how it is semiotic, both in its technical sense and in its popular sense and explores how memes signify both in terms of classical semiotics and also in terms of post-structuralist thought.
