According to weak utilitarianism, at least when other things are equal, you should maximize the sum of well-being. This view has considerable explanatory power, but it also has two implications that seem to me implausible. First, it implies that, other things equal, it is wrong to harm yourself, or even to deny yourself benefits. Second, it implies that, other things equal, given the opportunity to create new happy people, it is wrong not to. These implications can be avoided by accepting (...) a complaints-based alternative to weak utilitarianism. However, complaints-based views face two decisive problems, originally noticed by Jacob Ross. I here develop a view that avoids these problems while retaining the advantages of complaints-based views. (shrink)

Microbes in the gastrointestinal tract are under selective pressure to manipulate host eating behavior to increase their fitness, sometimes at the expense of host fitness. Microbes may do this through two potential strategies: (i) generating cravings for foods that they specialize on or foods that suppress their competitors, or (ii) inducing dysphoria until we eat foods that enhance their fitness. We review several potential mechanisms for microbial control over eating behavior including microbial influence on reward and satiety pathways, production of (...) toxins that alter mood, changes to receptors including taste receptors, and hijacking of the vagus nerve, the neural axis between the gut and the brain. We also review the evidence for alternative explanations for cravings and unhealthy eating behavior. Because microbiota are easily manipulatable by prebiotics, probiotics, antibiotics, fecal transplants, and dietary changes, altering our microbiota offers a tractable approach to otherwise intractable problems of obesity and unhealthy eating. There are many cases in which, by making some great sacrifice, you could bring about either a good outcome or a very good outcome. In some of these cases, it seems wrong for you to bring about the good outcome, since you could bring about the very good outcome with no additional sacrifice. It also seems permissible for you not to make the sacrifice, and bring about neither outcome. But together, these claims seem to imply that you ought to bring (...) about neither outcome rather than the good outcome. And that seems very counterintuitive. In this paper, I develop this problem, propose a solution, and then draw out some implications both for how we should understand supererogation and for how we should approach charitable giving. Many of us believe that exploitation is wrong, and that it is wrong even when, because the exploited would otherwise suffer, they consent to the exploitation. Does it follow that we should leave people to suffer rather than exploit them? This conclusion might seem difficult to accept, but avoiding it seems to require accepting a counterintuitively demanding view about our obligations to vulnerable people. In this paper, I offer a new solution to this problem.

This paper argues that white Christian churches participated in, benefited from, and promoted housing apartheid in the United States for at least thirty years, and that these actions have been significant causes of racial inequality through to the present day. Housing apartheid is defined primarily as housing policies that promoted opportunities in whites only communities and which denied and extracted opportunities from nonwhite, predominantly black communities. Blessing oppression is defined as the means by which white churches sustained and entrenched housing (...) apartheid through the basic practices of church life whereby the minds and hearts of white Christians were put at ease as they participated in massive oppression. Since the days of the Ancient Greeks, history has been perceived as the academic study of the past. Unfortunately, it has generally been taught as a litany of rigid, boring facts intended to be accepted rather than questioned. This has been reinforced for decades by weighty textbooks that overwhelm the reader with mind-numbing details presented in a chronological sequence. The end result is that students see little relevance of what they learn in history class to the real world, and many (...) simply struggle to stay awake. Compared to other subjects taught at the secondary level, history is frequently judged to be the most boring. This article focuses on Grotius’s treatment of obligations arising from wrongdoing in his Inleidinge. The work has clear parallels with the natural law formulation of the same topic in De Jure Belli ac Pacis, and this article explores the extent of the similarities. It focuses on points of divergence, suggesting that the theoretical coherence of the natural law approach to obligations arising from wrongdoing was challenged primarily by extant legislative enactments. These provided either for region-specific doctrines, or rules that proved (...) difficult to reconcile with the underlying principles of natural law, especially the primacy of fault. While much of the Inleidinge’s treatment of liability arising from wrongdoing is consonant with Grotius’ approach to the topic in De Jure Belli ac Pacis, these discrete points of dissimilarity serve as a reminder of the limits of theoretical accounts of private law. O objeto deste artigo é a leitura que Claude Geffré faz de Paul Tillich em De Babel a Pentecostes: ensaios de teologia inter-religiosa. O autor recorre à teologia de Tillich para desenvolver uma “hermenêutica do diálogo inter-religioso”, a fim de responder ao desafio do pluralismo religioso para a teologia cristã. O argumento que Geffré encontra é que apenas a partir do paradoxo cristológico, à luz do conceito de “revelação final” e “preocupação última”, a teologia cristã pode responder ao pluralismo religioso (...) sem perder-se de si mesmo. O artigo tem dois momentos: primeiro, uma percepção da obra de Geffré, especialmente a primeira parte, intitulada Não há outro nome, onde está nosso foco; segundo, a análise dos três conceitos de Tillich desenvolvidos por Geffré, procurando identificar e caracterizar acentos da leitura e analisar o resultado dessa leitura à luz das referências na obra de Tillich. Nossa conclusão sublinha a pertinência da teologia de Tillich para a reflexão acerca do problema proposto, tal como Geffré demonstra, e destaca uma crítica a partir do conceito de preocupação última, cuja implicação questiona a positividade desse conceito para uma teologia inter-religiosa, uma vez que seu caráter paradoxal seja relativizado. Externalism with regard to mental content says that in order to have certain types of intentional mental states (e.g. beliefs), it is necessary to be related to the environment in the right way.

Hendricks (2018) has defended an argument that abortion is (usually) immoral, which he calls the impairment argument. This argument purports to apply regardless of the moral status of the fetus. It has recently been bolstered by several amendments from Blackshaw and Hendricks (2021a; 2021b). In this paper, three problems are presented for their Strengthened Impairment Argument (SIA). In the first, it is observed that even with the new modifications the argument, contrary to their insistence, does seem to depend on Marquis’ (...) argument. In order for it not to do so, they would need to provide some other plausible reason why impairing a fetus is wrong that persists in cases of abortion. Because of the restrictions regarding what reasons can be used, they are not entitled to stipulate that some plausible reason can be found. In the second section, the use of an over-ridingness caveat – the most recent modification – is scrutinised. This is shown to either beg the question about the permissibility of abortion by assuming that opposing reasons are insufficient in most cases, or require an entirely separate argument to establish that such reasons are insufficient. Thirdly, I observe that the principle utilised in the latest version of the argument fails to account for undercutting reason, which suggest that the principle, in its current form, is false. Let me begin with the standard apology and expression of regret for not being able to comment on all of the intriguing and illuminating themes in Professor Churchland’s paper. I should at least note, though, my enthusiasm for his suggestive discussion of the complexity of all concepts, for his detailed portrayal of the resources of neural network models, and for his attempt to deflate our Cartesian pretensions by focusing on the commonality between human and infrahuman cognition. I restrict my developed (...) remarks to two different topics: First, I have some thoughts about Churchland’s central thesis with respect to the nature of epistemology. Second, I want to say something about the pursuit of epistemology if we follow Churchland’s lead. (shrink)

The use of recent research on variations in medical practice to promote competitive market oriented cost containment strategies is critically examined. Research demonstrating widespread variations in physician practices for similar patient populations undermines the medical profession's claims about the scientific objectivity of medical practice and indicates the existence of widespread waste and inappropriate utilization of health care resources. Cost containment programs which rely on market-based care avoidance incentives, such as Medicare prospective payment or cost sharing plans, attempt to impact medical (...) practice variations by creating economic barriers between doctor and patient. An alternative interpretation of research on practice variations is presented, emphasizing containing costs while improving quality of care and achieving greater equity through planning and regulation of medical supply factors. The physicists’ contention that visible matter and invisible dark matter and empty space have somehow managed to coexist at the same time after the supposedly finite big bang explosive commencement of the universe billions of light years ago is utterly invalid. There is no empty space between the stars and the planets. There is (...) merely a contrast in visible physical appearance. As there are an infinite number of visible stars, there is no way they could be assembled in only finite types. There is no way that any two stars could be separated by billions of finite miles of empty space. Socrates declared that the unexamined life is not worth living, but if someone opens themselves up to Socratic cross-examination, they are likely to fail, and on a matter of no small importance—how best to live. They will want to be able to pass their exams. Fortunately, philosophers’ avowed aim is to teach and facilitate ethical reflection. Someone who aims to lead an examined life, then, will want these instructors to teach and to help them to pass elenctic exams on how (...) best to live. The purpose of this paper is to describe and defend a mode of philosophy instruction with this as its sole aim, by responding to various objections leveled against other approaches within the Socratic teaching tradition. De l'Europe de Locarno dans les-années vingt, a la crise des euromissiles dans l'Europe dos années quatre-vingt, l'idée européenne, celle de l'unité politique de l'Europe, a été l'objet de la pensée de Raymond Aron, en ses diverses qualités de philosophe, éditorialiste et sociologue. Parti de l'idéal d'une République européenne des Lettres, Raymond Aron a consacré sa vie à défendre la liberté politique. Pendant la guerre, dans La France Libre, il a combattu la propagande hitlérienne qui usurpait le mythe politique de (...) l'Europe. Il a ensuite lui-même utilisé ce mythe pour renforcer la cohésion de I'Occident pendant la guerre froide. Selon lui, l'idée européenne est raisonnable, mais, écrit-il, c'est "une idée d'intellectuels". Il rappelait que l'Europe n'a jamais existé qu'en tant que nations : "On ne crée pas les patries sur commande." La vision aronienne de l'Europe n'était ni celle de Jean Monnet, ni celle du général de Gaulle. Ainsi Raymond Aron a-t-il pu se présenter comme un "grognard" du mouvement européen, ce qu'il fut dans les deux sens du mot : comme vétéran incontestable de l'entreprise, et critique opiniâtre de celle-ci. Citoyen français et intellectuel européen, Raymond Aron s'est efforcé d'être un éducateur de la cité, à l'échelle de la nation comme du continent. In order to be properly applied, criminal law must determine what conduct warrants punitive action. Figuring out exactly how one must act to be criminally liable is a difficulty that faces any legal system. In many jurisdictions criminal recklessness is regarded as an important notion for liability. However, recklessness is difficult to define, and attempts at this exercise have been a problem in legal philosophy since the mid-twentieth century, and persist today. This thesis discusses accounts of recklessness with the aim (...) of defining it in a way that overcomes several problems which have arisen in recent legal history. It is widely accepted, as well as prima facie intuitive, that people can be culpable for acts committed recklessly. Despite this, whether or not a state of mind is reckless is difficult to define, let alone define in a way that is not only conceptually sound, but also pragmatically apt. Recklessness occurs when an agent engages in some risky activity, but factors like the agent’s attitude and whether the risk is foreseen have been cited as relevant when ascertaining their recklessness. I discuss some difficulties in legally framing recklessness, before criticising some definitional manoeuvres made by judges and scholars in the past. With some problems in previous accounts noted, I consider the foundations of culpability in general. I suggest that two accounts of culpability – the agency theory and the choice theory – are both plausible, and each correlates to a prominent contemporary position on recklessness. After serious consideration of both positions, I conclude that the position advocated by Antony Duff, which I see as in keeping with the agency theory of culpability, is both more generally useful for criminal law and much more coherent with our everyday practices of blaming and punishing. Content note: This paper discusses rape throughout.Abstract. In this paper, I consider arguments in favor of jury trials. While I find these generally persuasive, I argue that there can be cases where juries are not fit for purpose. In those cases, I argue that they should be replaced by judge-only trials. In doing so, I propose a framework for determining whether a type of case is unsuitable for jury trials. Partly in response to low conviction rates, there have been recent (...) suggestions that rape trials should be conducted without juries. I suggest that there is strong evidence that these offences qualify under the criteria I have described. As a result, I argue that judge-only trials should be adopted for trying rape cases. (shrink)

Whilst much has been said about the implications of predictive processing for our scientific understanding of cognition, there has been comparatively little discussion of how this new paradigm fits with our everyday understanding of the mind, i.e. folk psychology. This paper aims to assess the relationship between folk psychology and predictive processing, which will first require making a distinction between two ways of understanding folk psychology: as propositional attitude psychology and as a broader folk psychological discourse. It will be argued (...) that folk psychology in this broader sense is compatible with predictive processing, despite the fact that there is an apparent incompatibility between predictive processing and a literalist interpretation of propositional attitude psychology. The distinction between these two kinds of folk psychology allows us to accept that our scientific usage of folk concepts requires revision, whilst rejecting the suggestion that we should eliminate folk psychology entirely. Is there any number of people you should save from paralysis rather than saving one person from death? Is there any number of people you should save from a headache rather than saving one person from death? Many people answer ‘yes’ and ‘no’, respectively. They therefore accept a partially aggregative moral view. Patrick Tomlin has recently argued that the most promising partially aggregative views in the literature have implausible implications in certain cases in which there are additions or subtractions to (...) the groups of people that we can save. Several philosophers have begun responding to this argument by developing partially aggregative views that avoid the relevant implications. In this paper, I extend Tomlin’s argument to create a dilemma that no partially aggregative view can avoid. I conclude that we should accept a fully aggregative moral view. (shrink)

The distinction between explanation and understanding was foundational to Jaspers’ ‘phenomenological’ approach to psychiatry. It makes sense that those now calling for a phenomenological approach to psychiatry would look to Jaspers for inspiration, and that in doing so, they would take up this distinction. However, I argue that it is and was a mistake to use the distinction in work on psychiatry: adhering to the distinction now would undermine, rather than support, the goals of those advocating a phenomenological approach to (...) psychiatry; furthermore, if the distinction had been adhered to, then contemporary psychiatry and its patients would be worse off. This paper purports to provide a fresh cashing out of Debasing Scepticism: the type of Scepticism put on the map in a recent article by Jonathan Schaffer, with a view to demonstrating that the Debasing Sceptic’s argument is not so easily dismissed as many of Schaffer’s commentators have thought. After defending the very possibility of the Debasing Sceptic’s favoured sceptical scenario, I lay out a framework for thinking of the agent’s power to hold their beliefs in the light of reasons (...) which I argue has initial plausibility. I then attempt to show that with this framework in tow, the Debasing Sceptic has an argument for their sceptical conclusion available to them which Schaffer’s commentators have failed to undermine, and which is independently interesting. By juxtaposing the two texts, an interesting "conversation" is illuminated—one which students of philosophy and rhetoric will find key in their analytical pursuits. _ Source: _Volume 47, Issue 3, pp 351 - 365 In his _Nietzsche_ lectures, Heidegger states that there is a concealed _discordance_ between beauty, semblance, and truth in Platonism. This paper explores this claim in detail to show how such a discordance haunts not only Platonism, but the beginnings and ends of Western philosophy. This commences with Plato’s claim that beauty’s radiance is both the reminder of the non-sensible εἴδη and a semblance belonging to the sensible world. This discordance is (...) not overcome in the ensuing Western tradition, however, but made more _dreadful_. This is because in Nietzsche’s anti-platonic retrieval of sensible beauty over non-sensible truth, the platonic reminder of the εἴδη is transformed into the dangerous production of new forms of power. In both cases, however, Heidegger proposes that this metaphysical thinking of Being-as-form conceals the early Greek insight that beauty’s tragic radiance lets Being appear _as_ both truth and semblance. My hypothesis is that human personhood has ancient biological roots which make it possible for social reinforcers to contribute to the gradual construction of real persons who are always deeper than the stories about them. Multiple persons do sometimes emerge from one human organism. Rather than try to prove they are real, I explore the consequences of assuming them to be genuine emergentsthat become social environment to one another. I suggest that the multiple-persons phenomenon has profoundly influenced the development of (...) human ethics and the attainment of personhood through the pursuit of ideals. (shrink)
