In absence of effective pharmaceutical treatments, the individual's compliance with a series of behavioral recommendations provided by the public health authorities play a critical role in the control and prevention of SARS-CoV2 infection. However, we still do not know much about the rate and determinants of adoption of the recommended health behaviors. This paper examines the compliance with the main behavioral recommendations, and compares sociocultural, psychosocial, and social cognitive explanations for its variation in the French population. Based on the current (...) literature, these 3 categories of factors were identified as potential determinants of individual differences in the health preventive behaviors. The data used for these analyses are drawn from 2 cross-sectional studies conducted after the lockdown and before the peak of the COVID-19 epidemic in France. The participants were drawn from a larger internet consumer panel where recruitment was stratified to generate a socio-demographically representative sample of the French adult population. Overall, the results show a very high rate of compliance with the behavioral recommendations among the participants. A hierarchical regression analysis was then performed to assess the potential explanatory power of these approaches in complying with these recommendations by successively entering sociocultural factors, psychosocial factors, social cognitive factors in the model. Only the inclusion of the cognitive variables substantially increased the explained variance of the self-reported adoption of preventive behaviors, providing better support for the social cognitive than the sociocultural and psychosocial explanations. To date, ethics discussions about stem cell research overwhelmingly have centered on the morality and acceptability of using human embryonic stem cells. Governments in many jurisdictions have now answered these “first-level questions” and many have now begun to address ethical issues related to the donation of cells, gametes, or embryos for research. In this commentary, we move beyond these ethical concerns to discuss new themes that scientists on the forefront of NRM development anticipate, providing a preliminary framework for further discussion (...) between scientists and ethicists. Fostering strong partnerships between neuroscientists and ethicists that operate and collaborate within this evolving framework will maximize the translation of NRM discoveries on the brain into cures that are safe and address the needs of science and society. The question of whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying has recently come to the fore in debates about the legalisation of assisted dying. For example, it was central to critiques of the 2021 amendments made to Canada’s assisted dying law. The question of whether changes to a country’s assisted dying legislation lead to descents down slippery slopes has also come to the fore—as it does any time a jurisdiction (...) changes its laws. We explore these two questions through the lens of Canada’s experience both to inform Canada’s ongoing discussions and because other countries will confront the same questions if they contemplate changing their assisted dying law. Canada’s Medical Assistance in Dying law has evolved through a journey from the courts to Parliament, back to the courts, and then back to Parliament. Along this journey the eligibility criteria, the procedural safeguards, and the monitoring regime have changed. In this article, we focus on the eligibility criteria. First, we explain the evolution of the law and what the eligibility criteria were at the various stops along the way. We then explore the ethical justifications for Canada’s new criteria by looking at two elements of the often-corrosive debate. First, we ask whether problems with the social determinants of health that might impact decision-making justify denying eligibility for assisted dying of decisionally capable people with mental illnesses and people with disabilities as their sole underlying medical conditions. Second, we ask whether Canada’s journey supports slippery slope arguments against permitting assisted dying. All data relevant to the study are included in the article. (shrink)

Machine learning-based AI algorithms lack transparency. In this article, I offer an interpretation of AI’s explainability problem and highlight its ethical saliency. I try to make the case for the legal enforcement of a strong explainability requirement: human organizations which decide to automate decision-making should be legally obliged to demonstrate the capacity to explain and justify the algorithmic decisions that have an impact on the wellbeing, rights, and opportunities of those affected by the decisions. This legal duty can be derived (...) from the demands of Rawlsian public reason. In the second part of the paper, I try to show that the argument from the limitations of human cognition fails to get AI off the hook of public reason. Against a growing trend in AI ethics, my main argument is that the analogy between human minds and artificial neural networks fails because it suffers from an atomistic bias which makes it blind to the social and institutional dimension of human reasoning processes. I suggest that developing interpretive AI algorithms is not the only possible answer to the explainability problem; social and institutional answers are also available and in many cases more trustworthy than techno-scientific ones. Medical assistance in dying has received considerable attention from many in the field of bioethics. Philosophers, theologians, lawyers, and clinicians of all sorts have engaged with many challenging aspects of this issue. Public debate, public policy, and the law have been enhanced by the varied disciplinary analyses. With the legalization of MAiD in Canada, some attention is now being turned to issues that have historically been overshadowed by the debate about whether to permit MAiD. One such issue is voluntary stopping (...) eating and drinking as an alternative to MAiD. In this paper, I will apply a legal lens to the issue. An understanding of whether VSED is legal provides a foundation for ethical reflection on whether it ought to be permitted. Is it permitted for those who prefer VSED to MAiD? Is it permitted for those who do not qualify for MAiD under our current legislation – for those who do not have a grievous and irremediable medical condition, for mature minors, for individuals whose sole underlying medical condition is a mental disorder and who do not otherwise meet the eligibility criteria, and for individuals who have lost capacity but had completed an advance directive? Ce commentaire intégral des Conjectures de Nicolas de Cues manifeste toute la fécondité de l'oeuvre dans sa complexité. Il élucide l'art général des conjectures, en explore et approfondit les sources doctrinales (en particulier lulliennes) et scientifiques : optiques, mathématiques, biologiques et médicales... Il montre ainsi que la théorie cusaine de la connaissance constitue une hénologie des points de vue et met en évidence l'articulation du rapport entre la vérité, objet de toute recherche connaissante, et l'altérité, condition de tout être fini, (...) et notamment de l'homme. La vérité dans l'altérité se révèle alors comme condition de possibilité de tout ce qui est à partir de l'Un - ce qui constitue l'ordre de l'être - et comme condition de possibilité de toute pensée. Il s'agit, dès lors, de saisir la singularité de l'approche cusaine de la réflexion réciproque entre l'ordre de la pensée et l'ordre de l'être. Après avoir analysé le concept central de conjecture, entendu non comme une simple supposition, mais bien comme une connaissance inadéquate du vrai, la première partie déploie les principes de la nouvelle méthode, fondée sur l'analogie fondamentale entre mens humaine et mens divine. La découverte de ces principes nécessite l'exposition d'une théorie du nombre articulée à celle, d'inspiration proclusienne, des quatre unités (divine, intellectuelle, rationnelle et sensible). Cette première partie conduit à la mise en place de figures manuductrices, paradigmatiques pour notre connaissance. La seconde partie du commentaire explicite les exemples d'application de l'ars coniecturalis donnés par le Cusain en mathématiques, en philosophie naturelle et en anthropologie. Many researchers have identified a process they call ‘deskilling’, which they use to describe the daily experience of teachers who have been gradually losing control of their own labour within ‘low‐trust’ workplaces. Conversely, other scholars have found that under similar conditions, some teachers have their own ways of dealing with it which leads them towards a process of ‘reskilling’. This study is an attempt to explore the actual teachers’ perceptions towards their daily practice within the context of educational decentralization, a (...) neglected area of research which needs to be further discussed and explored. This paper uses data gathered from seven schools in Guangdong Province, China as a case study to show that educational decentralization in China not only results in teachers being deskilled because indirect control is still being maintained, but also provides a small number of teachers with a competitive working environment to reskill their pedagogical techniques and educational knowledge, and to pursue good practices in teaching under the pressure of competition. All in all, educational decentralization provides a context in which teachers can experience either deprofessionalization or reprofessionalization. (shrink)

Patients in Quebec can legally obtain medical assistance in dying (MAID) if they are able to give informed consent, have a serious and incurable illness, are at the end of their lives and are in a situation of unbearable suffering. Since the Supreme Court of Canada’s 2015 Carter decision, access to MAID, under certain conditions, has become a constitutional right. Quebec physicians are now likely to receive requests for MAID from their patients. The Quebec and Canadian laws recognize a physician’s (...) right to conscientious objection, but this right is contested both in the medical ethics literature and in the public sphere. This paper presents the results of a qualitative study conducted with twenty Quebec physicians who did not integrate MAID into their medical practice, either because they were opposed to or deeply ambivalent about MAID. The interviews aimed to explore the reasons – religious and secular – for opposition to or ambivalence towards MAID. The secular reasons given by participants were grouped into four main categories: 1) the ends of medicine and professional identity, 2) the philosophy of palliative medicine and resource allocation in palliative care, 3) benevolent paternalism, the “good death”, and the interests of future selves, 4) the risk of a slippery slope and the protection of vulnerable people. Jocelyn Maclure and Charles Taylor provide a clearly reasoned, articulate account of the two main principles of secularism—equal respect, and freedom of conscience—and argue that in our religiously diverse, politically interconnected world, secularism, properly understood, may offer the only path to religious and philosophical freedom.

Jocelyn Maclure | : Alan Patten’s Equal Recognition is a major contribution to the normative literature on minority rights. I nonetheless suggest that liberal culturalism as a normative theory, even in Patten’s sophisticated version, is ill suited to deal with the challenges related to the status of religion in the public sphere that are so prevalent in contemporary democracies. In addition, I submit that Patten did not supply a fully convincing answer to the argument that liberal egalitarianism, well understood, (...) is capacious enough to secure fair terms of social cooperation for members of cultural minorities, making the language of “cultural rights” and “cultural recognition” superfluous. | : Le livre Equal Recognition d’Alan Patten contribue de façon majeure aux travaux de philosophie politique sur les droits des minorités culturelles. RÉSUMÉJe défends dans ce texte une version particulière de la position que Sharon Street a appelée le «constructivisme humien». J'esquisserai pourquoi je considère que ce constructivisme est préférable à la fois au réalisme moral et au constructivisme kantien sur le plan de la compréhension du statut ontologique des valeurs. Après avoir accepté de reconnaître le rôle des pressions de l’évolution dans l’émergence de la moralité, le constructivisme humien doit toutefois préciser le rôle de l'intersubjectivité historique dans l’évolution subséquente de la (...) morale. J'expliquerai aussi pourquoi je considère que l'intégration d'un volet cohérentiste au constructivisme permet d'atténuer les craintes concernant le caractère potentiellement non-cognitiviste des théories contextualistes. Enfin, j'esquisserai pourquoi l'idée d'un «espace des raisons morales» indépendant, à certains égards, de l'esprit humain est compatible avec le constructivisme humien. (shrink)

Drawing on ethical principles of fairness and integrative social contracts theory, moral obligations of fair dealing exist between the firm and all shareholders. This study investigates empirically whether privileged investors of publicly traded firms engage in legal, but morally questionable, trading that at the expense of non-privileged institutional or atomistic investors. In this context, we define privilege as the access to material, nonpublic earnings surprise information. Our results show that the opportunity for procedural unfairness increases with the presence of privileged (...) investors. However, this procedural unfairness does not appear to lead to distributive unfairness even though the level of abnormal trading also increases with the presence of privileged investors. That is, our findings suggest that other shareholders are in fact better off from an outcome perspective given that the abnormal stock price returns upon the announcement of an earnings surprise are either more positive or less negative when the firm has a high proportion of privileged investors. We extract the important implications of our study for future research on the fairness of capital markets and information asymmetry amongst classes of investors, as well as for public policy. L’assistance médicale à mourir (AMM) a reçu beaucoup d’attention de la part de nombreux acteurs dans le domaine de la bioéthique. Des philosophes, des théologiens, des avocats et des cliniciens de toutes sortes ont abordé de nombreux aspects difficiles de cette question. Le débat public, la politique publique et la loi ont été renforcés par des analyses disciplinaires variées. Avec la légalisation du AMM au Canada, on s’intéresse maintenant à des questions qui ont toujours été éclipsées par le débat sur (...) l’autorisation de l’AMM. Un de ces problèmes est l’arrêt volontaire de manger et boire (AVMB) comme une alternative à l’AMM. Dans cet article, je vais appliquer une perspective légale à la question. Une compréhension des aspects légaux de l’AVMB permet d'établir les fondements d'une réflexion éthique au sujet de son autorisation. Est-il permis pour ceux qui préfèrent l’AVMB à l’AMM? Est-il permis pour ceux qui ne sont pas admissibles à l’AMM en vertu de notre législation actuelle – pour ceux qui n’ont pas de maladie grave et irrémédiable, pour les mineurs matures, pour les personnes dont la seule condition médicale sous-jacente est un trouble mental et qui ne rencontrent pas les critères d’admissibilité, et pour les personnes ayant perdu leur capacité, mais ayant rempli une directive préalable? This study uses a sample of 242 European professional purchasers to examine the six characteristics of the decision-making process developed by Jones. The illustration mobilizes six original scenarios reproducing typical purchasing situations. Two versions of each scenario were used, one representing low moral intensity and the other showing high moral intensity. Two populations were sampled: one of 120 purchasers responding to the first version of the questionnaire and a second of 122 different purchasers responding to version two. Each version contained (...) three low-moral-intensity scenarios and three high-moral-intensity scenarios. The research also investigates two concepts suggested by Hannah et al. :663–685, 2011): examining the complexity of ethical decision-making through scenarios and microsocial professional ethical contexts. The findings reveal that neither traditional individual characteristics nor standard company characteristics have a real impact on two stages of Rest’s model. They also show that internal locus of control and a high microsocial ethical environment have a positive impact on purchaser awareness and intention to act ethically for four of the six dimensions: magnitude of consequences, social consensus, temporal immediacy, and concentration of effect. Moral intensity factors also have a positive impact on these four dimensions. The two other dimensions are not related to the independent variables. (shrink)

Jocelyn Benoist, envers et contre un certain traitement philosophique de la perception - qui la confond avec la connaissance que nous pouvons en tirer ou le sens que nous pouvons lui donner -, nous invite à écouter en elle le bruissement du sensible. Selon lui, pour rendre celui-ci pleinement audible. il faut congédier ce que la philosophie aujourd'hui appelle le "problème de la perception" et, peut-être, renoncer au concept même de "perception" tel que nous l'héritons de la philosophie moderne, au profit d'une enquête sur la texture réelle et poétique du sensible. I also offer some personal observations and reflections on the role and impact of bioethics and bioethicists, on what it was like to be a participant in Canada's law reform process, and on lessons that readers in other jurisdictions might take (...) from Canada's experience. This paper critically examines the notion of a limit. It questions whether a putative opposition of philosophical “camps” emphasized in recent years is actually tenable. This opposition is taken to hold between classical approaches in a Kantian spirit, operating with the notion of necessary limits to human cognition and sense-making, and a recent “speculative” turn in philosophy championed by Quentin Meillassoux, looking to overcome such limits. The paper’s contention against this dichotomy is that the rhetoric of unlimitedness depends on ideas (...) about limits that are rooted in the very Kantian way of thinking it claims to oppose. What is more, these ideas are just as questionable for they, in turn, rely on a notion of “the Absolute” which they claim to undermine. The paper investigates these foundations of modern thought about limits and finitude in perception and thought, and the consequences these ideas have had. It closes by arguing that the notion of a limit as it has been formative for recent philosophy is inconsistent, and that our focus in philosophy should rather rest on the contextual conditions of thought: on this picture, thoughts articulate a contextually determined grip on reality, which presupposes that reality is used in a certain way. In a thought-provoking paper, Schuklenk and Smalling argue that no right to conscientious objection should be granted to medical professionals. First, they hold that it is impossible to assess either the truth of conscience-based claims or the sincerity of the objectors. Second, even a fettered right to conscientious refusal inevitably has adverse effects on the rights of patients. We argue that the main problem with their position is that it is not derived from a broader reflection on the meaning and (...) implications of freedom of conscience and reasonable accommodation. We point out that they collapse two related but distinct questions, that is, the subjective conception of freedom of conscience and the sincerity test. We note that they do not successfully show that the standard norm according to which exemption claims should not impose undue hardship on others is unworkable. We suggest that the main reason why arguments such as no one is forced to be a medical professional are flawed is that public norms should not constrain citizens to choose between two of their basic rights unless it is necessary. In fine, Schuklenk and Smalling, who see conscience claims as arbitrary dislikes, sell freedom of conscience short and forego any attempts at balancing the competing rights involved. We maintain the authors neglect that most of legal reasoning is contextual and that the blanket restriction of healthcare professionals' freedom of conscience is disproportionate. (shrink)

Esteemed philosopher Jocelyn Benoist argues for a renewed realism that takes seriously the context in which intention occurs. "What there is"-the traditional subject of metaphysics-can be determined only in context, Benoist contends, carving out a new path that rejects acontextual ontologies and approaches to the mind.

A number of phenomena have lent a new complexity to the long-standing challenge of constructing a legitimate and stable political order. I contend that both legitimacy and integration under contemporary conditions ultimately hinge upon a form of public practical reasoning that departs considerably from the ones proposed by John Rawls, Jürgen Habermas and several deliberative democrats. I argue that the generalizability test that constitutes the cornerstone of most contemporary neo-Kantian theories of public reason should be abandoned as a rule of (...) public argumentation and be replaced by a norm of civic responsiveness towards minority claims. I not only suggest that a wider variety of reasons, motives and genres of speech needs to be admitted within the purview of public reason, but more fundamentally that generalizability cannot cogently be seen as anything more (or less) than a civic virtue. The underlying point of this article is that neo-Kantian theories of public reason work with a problematic conception of practical reason. I conclude by providing reasons, against some radical and agonistic democrats, why the language of public reasoning needs to be retained and renovated. This paper reconciles an inconsistency between the benefits of mind wandering and a prominent conception of attention in philosophy and cognitive psychology, namely, the prioritization view. Since we prioritize the information in a task less if we are doing it while mind wandering compared to solely concentrating on it, why does our performance in the task sometimes improve when we are mind wandering? To explain this, we offer a conception of diffuse attention that generalizes from external to internal forms of (...) attention and captures deep commonalities between the two (Chun et al. 2011). We conceptualize mind wandering as an instance of internal diffuse attention that also induces diffuse attention in other concurrent tasks. Moreover, pace the prioritization view, certain tasks are in fact better performed with diffuse attention, which prioritizes information less than focused attention. Our account of mind wandering as an instance of the more general category of diffuse attention improves upon current leading philosophical views of mind wandering (such as Irving 2016) by better explaining the interaction between mind wandering and other tasks. This article was written jointly by a philosopher and a mathematician. It has two aims: to acquaint mathematicians with some of the philosophical questions at the foundations of their subject and to familiarize philosophers with some of the answers to these questions which have recently been obtained by mathematicians. In particular, we argue that, if these recent findings are borne in mind, four different basic philosophical positions, logicism, formalism, platonism and intuitionism, if stated with some moderation, are in fact reconcilable, (...) although with some reservations in the case of logicism, provided one adopts a nominalistic interpretation of Plato's ideal objects. This eclectic view has been asserted by Lambek and Scott (LS 1986) on fairly technical grounds, but the present argument is meant to be accessible to a wider audience and to provide some new insights. La question du synthétique a priori définie par Husserl, malgré la critique adressée par le Cercle de Vienne, est réouverte. Plutôt que de fonder le concept à partir de l'intuition, l'auteur propose de le fonder à partir du concept. Il s'appuie sur la pensée de Bolzano, pour en faire le principe d'une lecture de Kant, Husserl, Schlick et Wittgenstein.

A la lumière des recherches menées dans l'ouvrage complémentaire Représentations sans objet. Aux origines de la phénoménologie et de la philosophie analytique, il s'agit ici de livrer une analyse détaillée des Recherches logiques de Husserl, centrée sur le concept d'intentionalité, sur ses usages et sa structure. L'intentionalité telle que la construit alors Husserl est étudiée dans sa détermination fondamentalement sémantique, et on interroge systématiquement le rapport qu'il y a, dans les Recherches, entre la théorie de l'intentionalité et la théorie de (...) la référence linguistique. Cette étude débouche sur une comparaison de fond entre les doctrines de Husserl et de Frege et leurs implications respectives pour la philosophie du langage aujourd'hui - jusqu'à la remise en question, à la lumière de Frege, des insuffisances d'une pensée de l'intentionalité. La question peut alors se poser de la possibilité d'inventer une autre phénoménologie (qui ne passerait plus primairement par le concept d'intentionalité), à élaborer dans une nécessaire confrontation avec les philosophies du langage contemporaines. Animal production, especially pork production, is facing growing international criticism. The greatest concerns relate to the environment, the animals’ living conditions, and the occupational diseases. But human and animal conditions are rarely considered together. Yet the living conditions at work and the emotional bond that inevitably forms bring the farm workers and the animals to live very close, which leads to shared suffering. Suffering does spread from animals to human beings and can cause workers physical, mental, and also moral suffering, (...) which is all the more harmful due to the fact that it is concealed. The conceptual tools used to conceal suffering ( animal welfare, stress, pain) suggest that the industrial system can be improved, whereas for farmers it is by definition incompatible with animal husbandry. Les sciences sociales ont longtemps appréhendé le concept d'événement avec méfiance en évitant d'accorder sa juste place à leur capacité de rupture. Dès lors qu'il est question d'événements médiatiques, la perspective constructiviste fait des événements le produit d'une construction déformante de la réalité. Or, un événement est différent d'un fait ou d'une simple occurrence parce qu'il comporte une capacité de rupture qui déborde largement le travail des médias. Celui-ci s'articule en amont à l'activité d'une multitude d'acteurs et en aval au (...) regard d'un public. La question est alors de savoir de quelle façon les événements internationaux affectent un large public. Or, il semble que la médiatisation de ces événements imbrique des normes et des valeurs universelles à des contextes d'interprétation culturellement situés. Parce qu'ils se déploient sur des scènes publiques internationales et convoquent des acteurs transnationaux, parce qu'ils sont retransmis en direct par des chaînes de télévision transnationales, les événements internationaux ont pris la forme « d'événements globaux» et suscitent des émotions qui traduisent l'émergence d'une sensibilité mondiale.The social sciences have long grasped the concept of the event with suspicion by not granting its rightful place in their ability to rupture.
