Neurofeedback has been suggested as a potential complementary therapy to different psychiatric disorders. Of interest for this approach is the prediction of individual performance and outcomes. In this study, we applied functional connectivity-based modeling using electroencephalography (EEG) and functional near-infrared spectroscopy (fNIRS) modalities to (i) investigate whether resting-state connectivity predicts performance during an affective neurofeedback task and (ii) evaluate the extent to which predictive connectivity profiles are correlated across EEG and fNIRS techniques. The fNIRS oxyhemoglobin and deoxyhemoglobin concentrations and the (...) EEG beta and gamma bands modulated by the alpha frequency band (beta-m-alpha and gamma-m-alpha, respectively) recorded over the frontal cortex of healthy subjects were used to estimate functional connectivity from each neuroimaging modality. For each connectivity matrix, relevant edges were selected in a leave-one-subject-out procedure, summed into “connectivity summary scores” (CSS), and submitted as inputs to a support vector regressor (SVR). Then, the performance of the left-out-subject was predicted using the trained SVR model. Linear relationships between the CSS across both modalities were evaluated using Pearson’s correlation. The predictive model showed a mean absolute error smaller than 20%, and the fNIRS oxyhemoglobin CSS was significantly correlated with the EEG gamma-m-alpha CSS (r = −0.456, p = 0.030). These results support that pre-task electrophysiological and hemodynamic resting-state connectivity are potential predictors of neurofeedback performance and are meaningfully coupled. This investigation motivates the use of joint EEG-fNIRS connectivity as outcome predictors, as well as a tool for functional connectivity coupling investigation. (shrink)

The classifications of signs are among the most important topics of Peirce's theory of signs. The 10 classes of signs were developed from 1903 and represent an important refinement of the fundamental division of signs into icons, indexes, and symbols. In this paper we present two diagrammatic models for 10 classes, proposed by Peirce, and an interpretation of the reasoning behind their development, based on the analysis of preparatory versions of these models.

Uma seção da Gramática Especulativa de C.S.Peirce – Dez classes de signos – recebeu, a partir de 1903, um importante tratamento diagramático. Neste artigo, são apresentados e discutidos dois diagramas desenvolvidos por Peirce para as dez classes, incluindo esboços desses modelos.

A Teoria Crítica propõe, com Theodor Adorno, uma íntima relação entre filosofia e desenvolvimento de experiências formativas, constituindo um referencial teórico indispensável para o entendimento acerca do que é pensar filosoficamente em uma perspectiva denominada negativa. Nessa relação, a experiência e racionalidade estética demarcam uma nova forma de conceber a razão e seu momento na relação com a objetividade. Esse momento da razão não indica apropriação, mas remete para uma aproximação e, a partir dessa, a construção de sentido. A problemática (...) que orienta este texto indaga sobre como os conceitos de concreto, aproximação e construção se articulam no desenvolvimento das chamadas experiências formativas. Defendemos a hipótese de que a partir da articulação desses conceitos a riqueza constitutiva da realidade passa a ser manifestada e apreendida, possibilitando, mediante a ampliação das experiências, a manifestação do novo e a construção de sentido. Essa constelação conceitual indica o desafio de considerar a objetividade para além do imediatamente dado; indica, também, o sentido que deve assumir a tensão dialética geradora da aproximação e, por último, um caminho que nos auxilia na tarefa de compreensão do pensamento crítico de Theodor Adorno. The first model - the causalist - aims at explaining action in terms of causes and general laws. The second model - the intentionalist - explains human action in terms of intentions and practical syllogism. This haunting, unforgettable story centers on a young woman named Catarina, increasingly paralyzed and said to be mad, living out her time at Vita. The question about the condition of possibility of a renewal Council under this tradition shows relevant. The Vatican II is the result of a negotiation between renewal and preservation. Pope John XXIII personally coordinated the construction of the legitimacy of the new event, following steps which may be rescued during the preparatory stages (...) of the great assembly. The reading of this process from sociological parameters may elucidate its plausibility within the tradition and the Church's bureaucratic organization. Pope John started ably a church renewal process, opening a new phase in the long Catholic tradition. Na primeira, produziu um discurso anticomunista, mas de maneira um pouco tímida. Na segunda fase, com curta duração, o impresso passou a valorizar a ideologia comunista e, ao mesmo tempo, a defesa do presidente João Goulart. A última fase foi marcada por ataques violentos contra o comunismo, em defesa do golpe civil-militar e da ditadura implantada. (...) Introduction Intensive care units are contexts in which, due to the remarkable existence of particularly technological resources, interventions are promoted to extend the life of people who experience highly complex health situations. This ability can lead to a culture of death denial where the possibility of implementing futile care and treatment cannot be excluded. Objective To describe nurses’ perceptions of adult intensive care units regarding the therapeutic futility of interventions implemented to persons in critical health conditions. Method Review of the (...) literature following the Scoping Review protocol of the Joanna Briggs Institute. The Population, Concept, and Context mnemonic was used to elaborate the research question and the research was performed using the EBSCOHost search engine in the CINAHL Complete databases, MEDLINE Complete, Cochrane Central Register of Controlled Trials, and Cochrane Database of Systematic Reviews to identify studies published between 1990 and 2019. Seven studies were selected. Results Nurses consider that therapeutic futility, a current problem in adult intensive care units, may have a negative impact on persons in critical health conditions and that contributes directly to resource expenditure and moral conflicts and consequently leads to emotional exhaustion. Conclusion Due to the complexity of this concept, knowing and understanding people’s and families’ perceptions is crucial to the decision-making process, for which reason nurses can play a key role in managing these situations. A new argument has been made against moral enhancement by authors who are otherwise in favour of human enhancement. Additionally, they share the same evolutionary toolkit for analysing human traits as well as the belief that our current morality is unfit to deal with modern problems, such as climate change and nuclear proliferation. The argument is put forward by Buchanan and Powell and states that other paths to moral progress are enough to deal with these problems. Given the likely costs (...) and risks involved with developing moral enhancement, this argument implies moral enhancement is an unpromising enterprise. After mentioning proposed solutions to such modern problems, I will argue that moral enhancement would help implement any of them. I will then detail Buchanan and Powell’s new argument disfavouring moral enhancement and argue that it makes too bold assumptions about the efficacy of traditional moral progress. For instance, it overlooks how that progress was to achieve even in relatively successful cases such as the abolition of slavery. Traditional moral progress is likely to require assistance from non-traditional means in order to face new challenges. (shrink)

Our present moral traits are unable to provide the level of large-scale co-operation necessary to deal with risks such as nuclear proliferation, drastic climate change and pandemics. In order to survive in an environment with powerful and easily available technologies, some authors claim that we need to improve our moral traits with moral enhancement. But this is prone to produce paradoxical effects, be self-reinforcing and harm personal identity. The risks of moral enhancement require the use of a safety framework; such (...) a framework should guarantee practical robustness to moral uncertainty, empirical adequacy, correct balance between dispositions, preservation of identity, and be sensitive to practical considerations such as emergent social effects. A virtue theory can meet all these desiderata. Possible frameworks incorporate them to variable degrees. The social value orientations framework is one of the most promising candidates. (shrink)

The establishment of the Common European Asylum System by 2012 remains a key policy objective for the European Union. According to the Council of the European Union, the development of a Common Asylum Policy should be based on a full and inclusive application of the 1951 Geneva Convention Relating to the Status of Refugees and other relevant international treaties. In the European Pact on Immigration and Asylum attention is brought to the persistence of wide disparities amongst Member States in the (...) granting of protection and the form of protection granted. This is seen as one of the main problems to be addressed in building the CEAS. It is fairly obvious that existing divergences in policy have a substantial impact upon the aims of the CEAS. It can be assumed that the difference in governmental practices involving recognizing asylum seekers on refugee grounds or subsidiary protection grounds may be a substantial factor in the decision-making process on where to apply for international protection. The European Commission stressed the importance, during the second phase of the CEAS, of paying particular attention to subsidiary and other forms of protection. (shrink)

Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at international level (...) due to absence of a single authoritative body to provide guidance on interpretation and application of the 1951 Refugee Convention. Considering that the judgments of the EU Court are part of the EU law, the Member States should develop their national asylum law with due regard being taken to those judgments. By the beginning of 2012, the Court has issued eight judgments on the interpretation of various problematic issues of EU asylum law. This Article analyses the jurisprudence of the EU Court in asylum cases, related to the granting of refugee status and subsidiary protection. It also provides a critical evaluation of those judgments. The main objective of the Article is to familiarise the relevant Lithuanian institutions and lawyers with the first judgments of the EU Court in asylum cases and encourage discussions concerning the application of rules established by the Court in the Lithuanian context. Due to limited size, this Article presents the analysis of two EU Court judgments adopted on interpretation of the 2004 Qualification Directive: Elgafaji v. The Netherlands (2009) dealing with granting of subsidiary protection, and Abdulla and others v. Bundesrepublik Deutschland (2010), dealing with cessation of refugee status. The value of those judgments first of all lies in the guidance they provided to the Member States on such concepts as: protection in a situation of an armed conflict, agents of protection, effectiveness of protection; as well as determination of a relationship between refugee status and subsidiary protection, relationship of the Qualification Directive with the European Convention on Human Rights and Fundamental Freedoms (ECHR), also cessation of protection. Elgafaji decision, while quite liberal with regard to persons seeking international protection, is not so liberally applied in the Member States’ practice and does not in itself guarantee positive outcome of the application of a concrete individual fleeing from an armed conflict, or a liberal approach to granting subsidiary protection in the Member States. Based on Elgafaji judgment it is clear that: Art. 15(b) of the Qualification Directive correspond to Art. 3 ECHR, while Art. 15(c) provides additional protection and in that it expands the Member States’ obligations beyond the ECHR to provide protection to persons fleeing in situations of armed conflict. While not every person arriving from an armed conflict situation would automatically fall under the granting of subsidiary protection, in certain exceptional situations indiscriminate violence may amount to individual threat without invoking personal circumstances. The EU Court departed from the individualisation requirement applied by the European Court of Human Rights in Art. 3 cases and did not also rely on international humanitarian law, by introducing a “sliding scale” formula for establishing an individual threat in armed conflict situation instead. This formula addressed the alleged internal discrepancy between “individual threat” and “indiscriminate violence”. The Abdulla decision brought in the human rights and law enforcement perspectives to the interpretation of cessation clauses, however it represents a rather superficial approach in the context of the analysed concepts (e.g. towards effectiveness of protection provided by the multinational armed forces) and is likely to be incompatible with the latest legislative trends in the EU asylum instruments (e.g. determination of refugee status and subsidiary protection by means of a single procedure) and the recent jurisprudence under the ECHR (e.g. failure to ensure a minimum standard of living may violate the ECHR). In 2012 there are 76 countries of the world still criminalising same-sex sexual acts between consenting adults. In seven of those countries homosexual acts are punishable with death penalty (i. e., Mauritania, Sudan, the northern states of Nigeria, the southern parts of Somalia, Iran, Saudi Arabia and Yemen). Homophobic (transphobic) attitudes are also frequent in many societies. However, the LGBT asylum seekers are frequently left outside the refugee definition due to many refugee qualification and procedural problems in LGBT cases. Criminalisation, (...) state protection against non-state persecution, concealment of sexual or gender identity, internal protection were discussed in the previous article ‘The Refugee Qualification Problems in LGBT Asylum Cases’ by Laurynas Biekša2. In this article the authors aim to describe the main procedural problems in LGBT asylum cases (i. e., credibility assessment, late disclosure, country of origin information and reception) and propose their solutions. Guiding European and international standards are laid down in the Reception Directive3, Qualification Directive4, Procedures Directive5 and UNHCR Guidance Note6. Today these standards should serve as a starting point for identifying the problems LGBT asylum seekers may have during their asylum procedures and for finding possible solutions. (shrink)

Even though the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) does not explicitly address the rights of asylum seekers and refugees, the case law of the European Human Rights Court (ECtHR) confirms that their rights can be successfully defended under this mechanism. In parallel, in its evolving jurisprudence on asylum the Court of Justice of the European Union (CJEU) refers to the Strasbourg case law, where there is a certain interrelationship between these two jurisdictions, in particular (...) given the recent ECtHR pronouncement on “EU Dublin transfers”. The article aims at evaluating protection available for asylum seekers and refugees under the ECHR, while comparing it with protection of asylum relevant fundamental rights under the EU legal order and the most recent jurisprudence of the CJEU in asylum cases. The authors also analyze which of the two systems is more favourable and what are their limitations. Thus, the article offers to students and practitioners a detailed analysis of ECtHR and CJEU jurisprudence in asylum cases through a comparative perspective, as well as the key problematic aspects arising in both jurisdictions and their junction. The jurisprudence of the ECtHR reveals that despite the most developed protection from expulsion under Article 3 of the ECHR, it does not sufficiently secure status for the concerned persons. Effective remedy requirements under the ECHR allow for filling the gaps of national asylum procedures, while recognition of vulnerability and special status of asylum seekers by the ECtHR assist in addressing still commonly prevailing detention problems of asylum seekers in Europe. In the context of family protection, the recognition of positive obligations by states to reunite the refugee families is still rudimentary, thus, clearly Article 3 protection in expulsion cases takes over Article 8. At the same time, the jurisprudence of the CJEU in asylum cases is still inconsistent, as the court sometimes takes decisions without including human rights into its’ analysis (Kadzoev, Arslan, K.), while in other cases refers to the Charter (MA and others), verifies if its’ own decision is in line with the ECtHR jurisprudence (Elgafaji) or shapes secondary legislation in line with Strasbourg arguments and findings (N.S.). Quite likely, the ECtHR practice will have an important influence on the developments of subsidiary protection in the EU, at least in the context of Articles 2 and 3 of the ECHR, and serve as an important reference for interpretation of various concepts under the EU Qualification and Procedures Directives. The comparative analysis of pros and cons of the two mechanisms demonstrates that the main advantage of the ECtHR is individual justice possibility, which is not yet accessible under CJEU preliminary judgement procedure and its input in developing asylum law concepts, such as non-state agents of persecution, internal protection or even subsidiary protection regime under EU asylum law. Thanks to the ECtHR, the realistic possibility to question the application of certain EU norms has emerged (Dublin Regulation). While the ECtHR does not have such a specific competence over asylum issues as the CJEU and is clearly a slow and seriously overburdened mechanism, the pilot judgement procedure seems to be increasingly capable of providing guidelines to the states concerning systematic problems in their asylum procedures. Thus, both jurisdictions in their own ways contribute to strengthening asylum seekers’ protection while forming a common oasis for these individuals in Europe. (shrink)

Background Health advocacy is crucial for both patients and healthcare professionals. However, nurses who recognize the importance of health advocacy may experience heightened moral distress, particularly in complex donation and transplantation cases where patient autonomy, respect, and advocacy are paramount. Aim To identify the factors contributing to moral distress among nurses working in solid organ transplant units at a university hospital in São Paulo, with a focus on health advocacy. Research Design This descriptive, cross-sectional study employs both quantitative and qualitative (...) methods. For this, the quantitative phase of the study was conducted utilizing the Moral Distress Scale, while the qualitative phase was executed through focus group discussions. Participants and Research Context The quantitative phase involved 15 nurses using the Moral Distress Scale. The qualitative phase consisted of a focus group with 5 nurse managers/coordinators from the transplant units. Quantitative data were analyzed using R® software, while qualitative data were analyzed using Bardin’s Content Analysis. Ethical Considerations The study was approved by the Research Ethics Committee of the Ribeirão Preto College of Nursing, University of São Paulo. Participation was voluntary and confidentiality was ensured. Results A significant correlation was found between moral distress and the factors of “disregard for patient autonomy” ( p =.0100) and “therapeutic obstinacy” ( p =.0492). Conclusion The primary determinants associated with moral distress in the context of health advocacy were identified as “disregard for patient autonomy” and “therapeutic obstinacy.”. (shrink)

Ao estruturarem sua compreensão dos seres vivos enquanto máquinas autopoiéticas, Humberto Maturana e Francisco Varela reiteradamente tecem críticas à aplicação das noções de função e aptidão então estabelecidas em teorias científicas. Tais críticas apresentam-se em duas frentes principais: por um lado, os autores afirmam que atribuições funcionais são causalmente inertes, o que as reduz a meros artifícios explicativos não operacionalizáveis; por outro, defendem que todo organismo, enquanto não for destruído em suas interações com o meio, conserva sua aptidão, sendo esta (...) constitutiva dos seres vivos e, portanto, invariável. Contudo, como defende Gustavo Caponi, podemos compreender que atribuir funções significa nada mais do que destacar papeis causais desempenhados em determinados processos de referência, de modo que a comparação entre estruturas que desempenhem a mesma função possibilita a medição dos diferentes graus de eficiência em sua realização. No âmbito da biologia, esta estrutura conceitual traduz-se nas funções biológicas, operadas por diferentes subsistemas dos organismos e referentes à manutenção do ciclo vital, assim como na aptidão biológica, tomada como a eficiência na operação destas funções e determinante no processo evolutivo. Defendemos que a proposta de Caponi é imune a ambos os ataques dos autores chilenos, ao incorporar um conteúdo operacional e contextual para as atribuições funcionais e ao possibilitar a referência a aptidão biológica, cuja importância evolutiva pode ser aferida momento a momento. Tal abordagem mostra-se, ademais, como uma adição muito oportuna à chamada teoria da autopoiese, aparelhando-a com uma concepção bastante pertinente de atribuições funcionais. (shrink)

We verified moral distress related to organ shortage for transplantation in nursing students. This quantitative pilot study analyzed data from 104 nursing undergraduate students. Data were collected through a survey composed of four questions and two sociodemographic items. The chi-squared test was used to examine categorical variables, whereas continuous variable data were analyzed using ANOVA and the Pearson Product Moment correlational test for determining the existence of moral distress regarding the availability of one heart for four individuals susceptible to heart (...) transplantation. A high level of moral distress was identified with regard to the hypothetical decision-making process, which justifies the need for further studies on the subject. No contexto da publicação dos duzentos anos dessa obra filosófica, a explicitação dessa passagem é referencial para a compreensão da Ciência da Lógica e de todo o pensamento hegeliano. O artigo procura sustentar que o binômio necessidade/contingência, um dos pares categoriais da Lógica da essência, não é adequado para a articulação da filosofia (...) hegeliana. Como Hegel afirma reiteradas vezes, é preciso superar a dura necessidade para dar lugar à lógica da liberdade. Para a discussão da problemática, a confrontação entre algumas categorias da essência, tais como substancialidade, necessidade, contingência e causalidade, e algumas categorias do conceito, tais como universalidade, particularidade e singularidade é o foco da exposição. Dessa discussão brota a noção hegeliana de liberdade e a sua relação com o sistema. (shrink)

O texto é uma resenha da Doutrina do Conceito hegeliana recém editada e publicada em português. O terceiro livro da Ciência da Lógica é estruturado em subjetividade, objetividade e ideia, com cada uma destas partes também desenvolvida numa estrutura tripartite. Nesta exposição, merece destaque o movimento contraditório de autodeterminação do conceito, no qual a universalidade se autodiferencia imanentemente em particularidade e o conceito retorna a si mesmo na forma da universalidade concreta. O conceito passa pelas diferentes formas de mediação na (...) teoria do silogismo, especialmente com a mediação da universalidade, quando o conceito se transforma em objetividade. Esta começa com a relação externa do mecanismo, avança para a relação interna do quimismo e conclui na teleologia, onde a liberdade é mais elevada que a necessidade. A Ideia, última parte da Doutrina do Conceito, é a unidade sintética entre conceito e objetividade, com destaque no capítulo da Ideia absoluta na qual Hegel formula uma noção de método como estrutura e movimento do conteúdo e da racionalidade. Este artigo tem como objeto de investigação os principais níveis de fundamentação enquanto momentos estruturantes do sistema filosófico hegeliano. No contexto filosófico da comemoração dos duzentos anos de publicação da Enciclopédia das Ciências Filosóficas, o objeto do trabalho é a reconstrução dos momentos estruturantes da passagem da Ciência da Lógica para a Filosofia da Natureza, da Filosofia da Natureza para a Filosofia do Espírito e dessas para a esfera do Espírito Absoluto. O artigo não tem como meta a discussão de (...) tópicos intrínsecos à Ciência da Lógica ou à Filosofia do Espírito, mas visa à exposição de círculos da passagem dialética de uma esfera para a outra como um autodesenvolvimento sistemático qualitativo. Mesmo de caráter genérico, não aponta para a possível substantividade de uma parte do sistema, mas para as relações fundamentais entre os círculos. O texto é perpassado por uma chave interpretativa da filosofia hegeliana no sentido de que não é formado por partes fixas e estanques, mas é articulado na perspectiva de relações fundamentais caracterizadoras das interfaces entre as esferas. If we accept both that human enhancement could produce beings with higher moral status than our own (i.e. supra-persons), and that this scenario may be detrimental to unenhanced persons, then there are still several ways that the creation of supra-persons could be defended. I will argue that some of these defences fail. Their justification for the permissibility or unlikelihood of harms to the unenhanced is weakened once we consider that those who enhance may be undermining their own individual interests. Enhancements (...) that are substantial enough to increase moral status may also be substantial enough to affect psychological continuity. Certain individual interests are sensitive to loses of psychological continuity. I will consider three scenarios: the creation of supra-persons within one generation, the enhancement of persons into supra-persons, and the generational replacement of persons by supra-persons. The arguments for the first scenario fail on intuitive grounds. A thorough consideration of individual interests undermines the arguments for the other two scenarios. I conclude that although the creation of drastically morally better persons may be desirable and likely to help realise most of what we currently value, this realisation is undermined by the fact that the beings enjoying this future scenario might not be our psychological continuants. Pour cet essai nous partons de la définition que le philosophe brésilien Paulo Arantes donne au temps présent : un « âge d’émergence » pour penser le primat des émeutes, avec toutes ses ambiguïtés, dans les luttes sociales présentes. Pour cela nous nous appuyons principalement sur Arantes et Joshua Clover. Pour finir, nous tentons d’esquisser un concept ouvert d’improvisation à partir d’une intuition du collectif End Notes et une autre de Clover dans lorsqu’ils pensent les émeutes pour les retourner à (...) l’envers dans la tentative d’imaginer une possibilité de débloquer les limites des émeutes.
