People who judge that a wrongdoer’s behaviour is determined are disposed, in certain cases, to judge that the wrongdoer cannot be responsible for his behaviour. Some try to explain this phenomenon by arguing that people are intuitive incompatibilists about determinism and moral responsibility. However, Peter Strawson argues that we excuse determined wrongdoers because judging that someone is determined puts us into a psychological state – ‘the objective stance’ – which prevents us from holding them responsible, not because we think that (...) determined wrongdoers cannot be responsible. Two studies were completed to test the claim that the objective stance prevents us from judging wrongdoers responsible. Implicit association measures revealed that participants primed in the objective stance appraised a wrongdoer more positively, but as no less blameworthy, than those neutrally primed. These findings raise doubts about Strawson’s explanation of our tendency to excuse determined wrongdoers. (shrink)

Abstract:This paper investigates whether, in theoretical terms, corporations can be citizens. The argument is based on the observation that the debate on “corporate citizenship” (CC) has only paid limited attention to the actual notion of citizenship. Where it has been discussed, authors have either largely left the concept of CC unquestioned, or applied rather unidimensional and decontextualized notions of citizenship to the corporate sphere. The paper opens with a critical discussion of a major contribution to the CC literature, the work (...) of Logsdon and Wood (Wood and Logsdon 2001; Logsdon and Wood 2002). It continues with a consideration of the nature and role of metaphors for business and of the contestable nature of the political concept of citizenship. It evaluates corporations as citizens through a four-dimensional framework of democratic citizenship offered by Stokes (2002). The analysis suggests that corporations do not easily fit the “liberal minimalist” model of citizenship. It finds, however some possibilities for fit with the three more participatory models. The paper concludes by cautioning against basing corporate citizenship on legal and administrative status or identity, and mapping out specific criteria by which we might determine whether corporations could be considered as citizens by virtue of their participation in processes of governance. Jeremy Waldron argues that Michael Walzer's theory of justice mischaracterizes money's influence on social meanings. Waldron argues that the correct conception of money reveals that Walzer is mistaken in categorizing various social goods primarily in terms of their exchangeability or non‐exchangeability for money. Waldron offers an alternative explanation of why some monetary transactions are wrong. He argues that meanings of goods should be questioned and re‐examined.

Debates about the ethics and effects of placebos and whether ‘placebos’ in clinical trials of complex treatments such as acupuncture are adequate rage. Yet there is currently no widely accepted definition of the ‘placebo’. A definition of the placebo is likely to inform these controversies. Grünbaum’s characterization of placebos and placebo effects has been touted by some authors as the best attempt thus far, but has not won widespread acceptance largely because Grünbaum failed to specify what he means by a (...) therapeutic theory and because he does not stipulate a special role for expectation effects. Grünbaum claims that placebos are treatments whose ‘characteristic features’ do not have therapeutic effects on the target disorder. I show that with four modifications, Grünbaum’s definition provides a defensible account of placebos for the purpose of constructing placebo controls within clinical trials. The modifications I introduce are: adding a special role for expectations, insisting that placebo controls control for all and only the effects of the incidental treatment features, relativizing the definition of placebos to patients, and introducing harmful interventions and nocebos to the definitional scheme. I also provide guidance for classifying treatment features as characteristic or incidental. (shrink)

Bioethicists invoke a duty to rescue in a wide range of cases. Indeed, arguably, there exists an entire medical paradigm whereby vast numbers of medical encounters are treated as rescue cases. The intuitive power of the rescue paradigm is considerable, but much of this power stems from the problematic way that rescue cases are conceptualized—namely, as random, unanticipated, unavoidable, interpersonal events for which context is irrelevant and beneficence is the paramount value. In this article, I critique the basic assumptions of (...) the rescue paradigm, reframe the ethical landscape in which rescue obligations are understood, and defend the necessity and value of a wider social and institutional view. Along the way, I move back and forth between ethical theory and a concrete case where the duty to rescue has been problematically applied: the purported duty to regularly return incidental findings and individual research results in genomic and genetic research. The theories of cultural anthropologist Ernest Becker arise from an existential and psychological analysis of the death terror/anxiety deep in the unconscious of every human. Becker details how this anxiety governs the ideologies and behaviors of our species—something now confirmed by thousands of experiments performed by psychologists engaged in contemporary terror management theory (TMT). Humans manage their anxiety through what Becker terms “hero systems”—concepts, beliefs, and myths we create to give us a sense of significance and meaning during, and even (...) beyond our mortal lives. Today, many dominant economic, technological, and religious hero systems seek to confirm our significance by denying that we are—like all other species—animals who must exist in a decaying, mortal body. Becker shows how this attempt to deny our “creatureliness” (basic biological nature) causes humans to stand against the natural world we are embedded in, leading to an assault on the planet and nonhuman animals. As a result, Becker believed pacifism was the only hero system capable of keeping humankind from destroying itself and the earth. Pacifism is the precursor to the more encompassing ethical concept of “reverence for life,” advocated by Dr. Albert Schweitzer. By respecting the will-to-live in all sentient beings, reverence for life transcends concern for humans alone and extends moral and physical safeguards to life as such. Confronting the fact that humans are increasingly alienated from their commodified world and their own being, reverence for life stands as a vital solution to many of our modern problems. And following contemporary TMT research, reverencing life can also expand one’s self-esteem, which research shows lowers death anxiety, reduces aggression, and offers authentic meaning to life itself. There is a massive and so far quite mysterious difference between thinking of cosmopolitan norms as law and thinking in legal terms about the norms of an ordinary municipal system. Until one has something more to say about the former, the idea of a cosmopolitan order remains unanalyzed. This book's notion of “democratic iteration” contributes a substantial amount of what is needed here, to resolve this obscurity. However, this chapter pursues that idea in a slightly different way from the way (...) in which the book pursues it. The outset of the author's lectures indicates that she has a particular interest in norms defining “crimes against humanity” and by extension human rights norms and what she calls “cosmopolitan norms of justice.” What distinguishes these from the more familiar rules of international law is that cosmopolitan norms offer rights and protections to, and impose obligations on, human individuals as such, not just states. Having the emotion of pride requires taking oneself to stand in some special relation to the object of pride. According to agency accounts of this pride relation, the self and the object of pride are suitably related just in case one is morally responsible for the existence or excellence of the object of one's pride. I argue that agency accounts fail. This argument provides a strong prima facie defence of an alternate account of pride, according to which the self and (...) the object of pride are suitably related just in case one's relation to the object of pride indicates that one's life accords with some of one's personal ideals. I conclude that the pride relation, though distinct from the relation of moral responsibility, is nonetheless a relation of philosophical interest that merits further attention. (shrink)

In the following reply to Joe Frank Jones, Ill's "Analysis, Phenomenology and the Travails of Ontology," I argue that skepticism about method plays an important critical role in philosophical thinking. I further suggest that it may be time for philosophy to rehabilitate metaphysics rather than simply ceding it to the natural sciences.

La prise en charge de ces enjeux ne saurait s'opérer simplement par des mesures ponctuelles ou locales. Elle doit aujourd'hui être repensée la temporalité de l'action politique, confrontée à une urgence qui ne cessera de s'accroître dans les prochaines années.

A general method of interpreting weak higher-type theories of nonstandard arithmetic in their standard counterparts is presented. In particular, this provides natural nonstandard conservative extensions of primitive recursive arithmetic, elementary recursive arithmetic, and polynomial-time computable arithmetic. A means of formalizing basic real analysis in such theories is sketched.

The 1-consistency of arithmetic is shown to be equivalent to the existence of fixed points of a certain type of update procedure, which is implicit in the epsilon-substitution method.

The evidence of high cognitive abilities in cetaceans does not stand up to close scrutiny under the standards established by laboratory researchers. This is likely to lead to a sterile debate between laboratory and field researchers unless fresh ways of taking the debate forward are found. A few suggestions as to how to do this are proposed.

As the sciences of biotechnology, synthetic biology, and nanotechnology develop, questions about liability for harms caused by self-replicating inventions will arise increasingly often. Although negligence, nuisance, and other torts may be relevant in such circumstances, trespass may be the more appropriate cause of action. First, the author explores doctrinal hurdles facing plaintiffs alleging biotrespass. To overcome concerns about the metaphysicality of molecular biotrespass, the author draws analogies to “cybertrespass.” To confront the problem of suing patent licensors for the actions of (...) their licensees, the author makes reference to principles of landlord-tenant law. Well-established laws concerning wandering animals shed light on the policies underlying biotrespass. In the second part, the author examines such policies in further detail and considers the purpose of transporting property metaphors into bio/nanospace. This essay considers the special character of mathematical reasoning, and draws on observations from interactive theorem proving and the history of mathematics to clarify the nature of formal and informal mathematical language. It proposes that we view mathematics as a system of conventions and norms that is designed to help us make sense of the world and reason efficiently. Like any designed system, it can perform well or poorly, and the philosophy of mathematics has a role to play in helping (...) us understand the general principles by which it serves its purposes well. Although construct measurement is critical to explanatory research and intervention efforts, rigorous measure development remains a notable challenge. For example, though the primary theoretical model for understanding health disparities among sexual minority (e.g., lesbian, gay, bisexual) adolescents is minority stress theory, nearly all published studies of this population rely on minority stress measures with poor psychometric properties and development procedures. In response, we developed the Sexual Minority Adolescent Stress Inventory (SMASI) with N = 346 diverse adolescents ages 14–17, using a (...) comprehensive approach to de novo measure development designed to produce a measure with desirable psychometric properties. After exploratory factor analysis on 102 candidate items informed by a modified Delphi process, we applied item response theory techniques to the remaining 72 items. Discrimination and difficulty parameters and item characteristic curves were estimated overall, within each of 12 initially derived factors, and across demographic subgroups. Two items were removed for excessive discrimination and three were removed following reliability analysis. The measure demonstrated configural and scalar invariance for gender and age; a three-item factor was excluded for demonstrating substantial differences by sexual identity and race/ethnicity. The final 64-item measure comprised 11 subscales and demonstrated excellent overall (α = 0.98), subscale (α range 0.75–0.96), and test–retest (scale r > 0.99; subscale r range 0.89–0.99) reliabilities. Subscales represented a mix of proximal and distal stressors, including domains of internalized homonegativity, identity management, intersectionality, and negative expectancies (proximal) and social marginalization, family rejection, homonegative climate, homonegative communication, negative disclosure experiences, religion, and work domains (distal). Thus, the SMASI development process illustrates a method to incorporate information from multiple sources, including item response theory models, to guide item selection in building a psychometrically sound measure. We posit that similar methods can be used to improve construct measurement across all areas of psychological research, particularly in areas where a strong theoretical framework exists but existing measures are limited. The philosophy of mathematics has long been concerned with deter- mining the means that are appropriate for justifying claims of mathemat- ical knowledge, and the metaphysical considerations that render them so. But, as of late, many philosophers have called attention to the fact that a much broader range of normative judgments arise in ordinary math- ematical practice; for example, questions can be interesting, theorems important, proofs explanatory, concepts powerful, and so on. The as- sociated values are often loosely classied as (...) aspects of \mathematical understanding." Meanwhile, in a branch of computer science known as \formal ver- ication," the practice of interactive theorem proving has given rise to software tools and systems designed to support the development of com- plex formal axiomatic proofs. Such eorts require one to develop models of mathematical language and inference that are more robust than the the simple foundational models of the last century. This essay explores some of the insights that emerge from this work, and some of the ways that these insights can inform, and be informed by, philosophical theories of mathematical understanding. Since its introduction just over two decades ago, evidence-based medicine (EBM) has come to dominate medical practice, teaching, and policy. There are a growing number of textbooks, journals, and websites dedicated to EBM research, teaching, and evidence dissemination. EBM was most recently defined as a method that integrates best research evidence with clinical expertise and patient values and circumstances in the treatment of patients. There have been debates throughout the early 21st century about what counts as good research evidence between (...) EBM proponents and philosophical critics and even within the EBM community itself. Similar controversy arises about the relative worth of patient values and clinical expertise (and how these can be integrated). EBM has also evolved in ways that have come under scrutiny. Specifically, policymakers have used EBM research methodology to increase the relative importance of clinical guidelines that some clinicians have argued are tyrannical. Philosophers have addressed all of these controversies, and with very few exceptions have been critical of EBM. In addition most philosophical attention has been on the epistemic role of Randomization and evidence hierarchies, with relatively little attention being paid to the role of Diagnosis, expertise, patient values, and Systematic Reviews within EBM. Currently the dominant interpretation of Hobbes in the field of moral and political philosophy is as a social contract theorist: that he legitimates moral rules and sovereign power by arguing that we would agree we are better off obeying a sovereign than living in a state of nature, and that we are best off if that sovereign is an absolute monarch. There are interesting alternatives to this reading of Hobbes—Warrender’s divine-command interpretation and Boonin-Vail’s virtue theory interpretation, to name just two—but (...) it is not my purpose here to debate their relative merits. Rather, I want to comment on one of the main features of the social contract view, namely, the means of maintaining political stability. (shrink)

Four classes of naturally rare vascular plant species are described and classified, based on parameters of spatial distribution and longevity. Properties intrinsic to these time/space parameters are explored and an importance hierarchy of causes of rarity is proposed for each class. These hierarchies serve as the basis for a predictive classification. Human causes of rarity such as habitat destruction and taxonomic difficulties are not considered in detail here but are discussed as confounding factors in the elucidation of rarity in vascular (...) plants. Several examples are provided to illustrate this classification and provide testable hypotheses concerning the origins of natural rarity in plant species. (shrink)

Why is a college or university called an alma mater? This essay looks to Newman for an answer, first by pointing out his love for Trinity College, Oxford, his undergraduate alma mater. The author, sharing his experience of Louvain as his alma mater, emphasizes that an alma mater is not a theoretical concept, but a matter of real apprehension. This essay then examines two sources where Newman discussed the Catholic University of Ireland as an alma mater: his inaugural university sermon, (...) where he insisted that the university must be a mother to its students; and his first annual report to the Irish bishops, where he emphasized that the students’ resident life must provide a sense of community and a love for their alma mater. In sum, if a university is truly to be a “nourishing mother,” she must provide her students not only with an intellectual education, but also with moral discipline. (shrink)

Medical tourism is the practice of traveling across international borders with the intention of accessing medical care, paid for out-of-pocket. This practice has implications for preferential access to medical care for Canadians both through inbound and outbound medical tourism. In this paper, we identify four patterns of medical tourism with implications for preferential access to care by Canadians: Inbound medical tourism to Canada’s public hospitals; Inbound medical tourism to a First Nations reserve; Canadian patients opting to go abroad for medical (...) tourism; and Canadian patients traveling abroad with a Canadian surgeon. These patterns of medical tourism affect preferential access to health care by Canadians by circumventing domestic regulation of care, creating jurisdictional tensions over the provision of health care, and undermining solidarity with the Canadian health system. Focusing on the many reasons animal rights deserves a closer look, it investigates such issues as animal experimentation, human diet, and what should be the foundation of our moral reasoning when dealing with human and nonhuman animal relationships.

Since his death in 1986, Michel de Certeau's reputation as a thinker has steadily grown both in France and throughout the English-speaking world. His work is extraordinarily innovative and wide-ranging, cutting across issues in historiography, literary and cultural studies, anthropology, sociology, theology, philosophy and psychoanalysis. This book represents the first full-length study of Certeau's thought. It is organized around the central theme of interpretation and alterity, which Ahearne uses to illuminate Certeau's work as a whole. The author also examines Certeau's (...) theory and practice of historiography; his reflection on the relations between changing historical forms of writing, reading and orality; and his distinction between the "strategic" programmes of the politically powerful and the "tactics" of the relatively powerless. Ahearne places Certeau's work in its general intellectual context, relating it to the views of important contemporary thinkers, such as Pierre Bourdieu and Michel Foucault, and demonstrating the decisive importance to Certeau's thought of the writings of the early modern mystics and travellers. This book constitutes an excellent critical introduction to Certeau's work, while also providing a comprehensive and nuanced reading for those already familiar with his thought. (shrink)

We discuss the legacy of Alan Turing and his impact on computability and analysis.

Successful surgical treatment of patients with focal drug-resistant epilepsy remains challenging, especially in cases for which it is difficult to define the area of cortex from which seizures originate, the seizure onset zone. Various diagnostic methods are needed to select surgical candidates and determine the extent of resection. Interictal magnetoencephalography with source imaging has proven to be useful for presurgical evaluation, but the use of ictal MEG data remains limited. The purpose of the present study was to determine whether pre-ictal (...) variations of spectral properties of neural activity from ictal MEG recordings are predictive of SOZ location.We performed a 4 h overnight MEG recording in an 8-year-old child with drug-resistant focal epilepsy of suspected right fronto-temporal origin and captured one ~45-s seizure. The patient underwent a right temporal resection from the anterior temporal neocortex and amygdala to the mid-posterior temporal neocortex, sparing the hippocampus proper. She remains seizure-free 21 months postoperatively. The histopathological assessment confirmed frank focal cortical dysplasia type IIa in the MEG-defined SOZ, which was based on source imaging of averaged ictal spikes at seizure onset. We investigated temporal changes together with spatial differences in spectral parameters of background brain activity, namely the aperiodic broadband offset and slope, and assessed how they confounded the interpretation of apparent variations of signal power in typical electrophysiological bands. Our data show that the SOZ was associated with a higher aperiodic offset and exponent during the seizure compared to control regions. Both parameters increased in all regions from 2 min before the seizure onwards. Regions anatomically closer to the SOZ also expressed higher values compared to contralateral regions, potentially indicating ictal spread. We also show that narrow-band power changes were caused by these fluctuations in the aperiodic component of ongoing brain activity. Our results indicate that the broadband aperiodic component of ongoing brain activity cannot be reduced to background noise of no physiological interest, and rather may be indicative of the neuropathophysiology of the SOZ. We believe these findings will inspire future studies of ictal MEG cases and confirm their significance. (shrink)

Editor Sor-hoon Tan begins the Handbook with a historical journey starting from Hegel's insistence that "Chinese philosophy" is not really philosophy; through Hu Shih's and Fung Yulan's groundbreaking attempts in the early twentieth century to revise traditional Chinese thought using Western methods; and up to more current discussions on the question of whether there is such a thing as "Chinese philosophy."
