International human rights law and international humanitarian law (IHL) contain few obligations for rebel groups, yet those groups are nonetheless under pressure to comply with their foundational international norms. This case study of the Kosovo Liberation Army (KLA) analyzes the evolution of its discourse and behavior related to human rights and IHL. It then compares changes in the group’s discourse to evidence of changes in behavior. The study finds that the KLA does significantly change its language, gradually incorporating such language (...) over time, but it also demonstrates that this change is not accompanied by improvements in human rights and IHL adherence in its behavior. The study considers whether greater adoption of these norms is better explained by a constructivist or a rationalist approach and, in particular, looks at the role of legitimacy. Ethical codes have been hailed as an explicit vehicle for achieving more sustainable and defensible organizational practice. Nonetheless, when legal compliance and corporate governance codes are conflated, codes can be used to define organizational interests ostentatiously by stipulating norms for employee ethics. Such codes have a largely cosmetic and insurance function, acting subtly and strategically to control organizational risk management and protection. In this paper, we conduct a genealogical discourse analysis of a representative code of ethics from an international corporation (...) to understand how management frames expectations of compliance. Our contribution is to articulate the problems inherent in codes of ethics, and we make some recommendations to address these to benefit both an organization and its employees. In this way, we show how a code of ethics can provide a foundation for ethical sustainability, while addressing management intentions and employees’ ethical satisfaction. (shrink)

The purpose of this article is to understand how academic integrity educational tutorials are administered across Canadian higher education. Results are shared from a survey of publicly funded Canadian higher education institutions, including universities and colleges, across ten provinces where English is the primary language of instruction. The survey contained 29 items addressing institutional demographic details, as well as academic integrity education questions. Results showed that academic integrity tutorials are inconsistent across Canadian higher education, with further differences evident within the (...) university and college sectors. (shrink)

In this paper, I provide the framework for an account of group assertion. On my view, there are two kinds of group assertion, coordinated and authority-based, with authority-based group assertion being the core notion. I argue against a deflationary view, according to which a group’s asserting is understood in terms of individual assertions, by showing that a group can assert a proposition even when no individual does. Instead, I argue on behalf of an inflationary view, according to which it is (...) the group itself that asserts, a conclusion supported by the fact that paradigmatic features of assertion apply only at the level of the group. A central virtue of my account is that it appreciates the important relationship that exists between most groups and their spokespersons, as well as the consequences that follow from this relationship. My view, thus, provides the framework for distinguishing when responsibility for an assertion lies at the collective level, and when it should be shouldered by an individual simply speaking for herself. Numerous laws have passed to move away from criminalising youth who trade sex. Specialised courts have also been established to support youth. Despite proponents' contention that specialised, trauma-informed courts are less punitive than typical interventions, research is limited. This article explores one specialised dependency court's efforts to assist youth ‘at risk’. Drawing on interviews and ethnographic observations, I argue that laws and trauma-informed court interventions intensify the supervision of youth and families while inadvertently concealing the gendered-racialised effects of child welfare (...) system involvement. Ethnographic findings contribute to sociolegal and anti-carceral feminist research on carceral control beyond the criminal legal system. This work also explores the ethics of carceral-trauma entanglements that accompany decriminalisation’s afterlife. (shrink)

Metanormativists hold that moral uncertainty can affect how we ought, in some morally authoritative sense, to act. Many metanormativists aim to generalize expected utility theory for normative uncertainty. Such accounts face the “easy problem of intertheoretic comparisons”: the worry that distinct theories’ assessments of choiceworthiness are incomparable. The easy problem may well be resolvable, but another problem looms: while some moral theories assign cardinal degrees of choiceworthiness, other theories’ choiceworthiness assignments are merely ordinal. Expected choiceworthiness over such theories is undefined. (...) Call this the “hard problem of intertheoretic comparisons.” This paper argues that to solve the hard problem, we should model moral theories with imprecise choiceworthiness. Imprecise choiceworthiness assignments can model incomplete cardinal information about choiceworthiness, with precise cardinal choiceworthiness and merely ordinal choiceworthiness as limiting cases. Generalizing familiar decision theories for imprecise choiceworthiness to the case of moral uncertainty generates puzzles, however: natural generalizations seem to require reifying parts of the model that don’t correspond to anything in normative reality. I discuss three ways of addressing this problem: by demystifying the reified elements by using them as promiscuously as possible; by constructing alternative decision theories that don’t require the troublesome elements; and by employing an alternative model of metanormative decision problems, and of moral uncertainty generally. Around the world, many schools were closed as one of the measures to contain the spread of the COVID-19 pandemic. School closure brought about important challenges to the students' learning process. This context requires strong self-regulatory competences and agency for autonomous learning. Moreover, online remote learning was the main alternative response to classroom learning, which increased the inequalities between students with and without access to technological resources or for those with low digital literacy. All considered, to level the playing field (...) for students without digital resources, there is an urgent need to promote self-regulatory competences through offline intervention solutions. The current paper describes a project with this purpose, using radio broadcasting and letters to reach elementary students without digital resources. Moreover, potential reach and participants' perspectives of the project implementation are presented and discussed. The project draws on a prior evidence-based story-tool intervention grounded on a self-regulated learning framework. The original intervention was set previous to the COVID-19 pandemic and was implemented in the classroom context (N= 1,103 students). Once the schools had been closed down, the mode of intervention was adapted with the collaboration of the community. Alternative solutions were developed as follows: (i) story chapters were read on the radio and students received to their homes a printed script, prompting reflection, and suggesting related activities; (ii) students were provided with the story-tool to read autonomously and received letters from the main characters of the story which included, for example, suggestions for activities and reflection. These two alternative modes of intervention delivery potentially reached 394 elementary students, including students with digital resources. Interviews conducted with a group of students were provided information about the positive aspects of these two modes of intervention delivery, perceived learning (e.g., planning), constraints, and suggestions to improve the project. The current work is likely to merit attention from researchers and educational practitioners, given the need to use offline alternatives to provide support for students without digital resources to engage in autonomous learning during the pandemic period. This project may also be used as an alternative or a complementary solution to online modality. (shrink)

Emoji faces, which are ubiquitous in our everyday communication, are thought to resemble human faces and aid emotional communication. Yet, few studies examine whether emojis are perceived as a particular emotion and whether that perception changes based on rendering differences across electronic platforms. The current paper draws upon emotion theory to evaluate whether emoji faces depict anatomical differences that are proposed to differentiate human depictions of emotion. We modified the existing Facial Action Coding System to apply to emoji faces. An (...) equivalent “emoji FACS” rubric allowed us to evaluate two important questions: First, Anatomically, does the same emoji face “look” the same across platforms and versions? Second, Do emoji faces perceived as a particular emotion category resemble the proposed human facial expression for that emotion? To answer these questions, we compared the anatomically based codes for 31 emoji faces across three platforms and two version updates. We then compared those codes to the proposed human facial expression prototype for the emotion perceived within the emoji face. Overall, emoji faces across platforms and versions were not anatomically equivalent. Moreover, the majority of emoji faces did not conform to human facial expressions for an emotion, although the basic anatomical codes were shared among human and emoji faces. Some emotion categories were better predicted by the assortment of anatomical codes than others, with some individual differences among platforms. We discuss theories of emotion that help explain how emoji faces are perceived as an emotion, even when anatomical differences are not always consistent or specific to an emotion. (shrink)

Neoliberal cultural frames of individual choice inform mothers’ accounts of why they refuse state-mandated vaccines for their children. Using interviews with 25 mothers who reject recommended vaccines, this article examines the gendered discourse of vaccine refusal. First, I show how mothers, seeing themselves as experts on their children, weigh perceived risks of infection against those of vaccines and dismiss claims that vaccines are necessary. Second, I explicate how mothers see their own intensive mothering practices—particularly around feeding, nutrition, and natural living—as (...) an alternate and superior means of supporting their children’s immunity. Third, I show how they attempt to control risk through management of social exposure, as they envision disease risk to lie in “foreign” bodies outside their networks, and, therefore, individually manageable. Finally, I examine how these mothers focus solely on their own children by evaluating—and often rejecting—assertions that their choices undermine community health, while ignoring how their children benefit from the immunity of others. By analyzing the gendered discourse of vaccines, this article identifies how women’s insistence on individual maternal choice as evidence of commitment to their children draws on and replicates structural inequality in ways that remain invisible, but affect others. As Nelson Goodman put it, things are full of threats and promises. A fragile glass, for example, is prone to shatter when struck. Fragility is the glass's disposition, shattering is the manifestation of the disposition, and striking is the circumstances of manifestation. The properties of a fragile glass which are causally efficacious for shattering constitute the causal basis of the glass's fragility. The glass can remain fragile even if it never shatters. One can say of the fragile glass, with certain (...) qualifications, that if it were struck, it would shatter. This much is common ground among philosophers who discuss dispositions. In my dissertation, I defend three claims about dispositions that are more controversial. ;Some philosophers have claimed that dispositions are causally impotent. I disagree. In my first chapter, I defend the claim that dispositions can be causally efficacious with respect to their manifestations. Among the arguments I consider is the "no work" argument, according to which a disposition's causal basis causally explains its manifestation, leaving no causal work for the disposition to do. I respond to this argument by challenging the Principle of Explanatory Exclusion, according to which complete explanations exclude competitors. ;Furthermore, many philosophers hold that all dispositions must have independent causal bases. In my second chapter, I challenge this view, and defend the possibility of bare dispositions. I argue that the concept of a bare disposition is coherent, and show why arguments recently offered against bare dispositions, such as those based on the Truth Maker Principle, do not succeed in demonstrating that they are impossible. ;Another common assumption about dispositions is that they must be intrinsic properties of the objects that have them. In my third chapter, I challenge this assumption, and argue that some dispositions are extrinsic properties. Consider the property vulnerability. It seems dispositional in character; something which is vulnerable is susceptible to harm, but is not necessarily being harmed right now. However, it seems as if something could lose the property of being vulnerable without undergoing any intrinsic change. Build a fortress around the vulnerable object and it ceases to be vulnerable. This paper examines masculinity in relation to the modern tracking shot in Daren Aronofsky's The Wrestler and Derek Cianfrance's The Place Beyond the Pines. These films make prominent use of a particular tracking shot in which the camera floats behind a male character, his head neatly centred in the frame. The camera in these ‘follow-shots’ seems unmistakably but loosely tethered to the character's body. This paper attempts to ascertain the phenomenological nature and critical significance of that relationship, which in recent (...) films expresses the intimate distance and dissonance between mobile cameras, masculinity and the male body in the twenty-first century. Political corporate social responsibility (PCSR) calls for firms to implement and engage in deliberative democracy processes and structures, addressing governance gaps where governments are unwilling or unable to do so. However, an underlying assumption that the implementation of PCSR will enrich democratic processes in society has been exposed and challenged. In this conceptual article, we explore this challenge by developing a framework to reveal the dynamics of firms’ deliberative democratic processes and structures (meso level), and those at nation state (macro (...) level). Using existing cases as illustrative examples, we demonstrate that despite the public good premise of PCSR theory toward thickening the overall democracy in a society, corporate democratization at meso level can have the opposite effect and may actually erode macro-level democratic control of society and the economy. These findings imply a need for multilevel analysis in PCSR research and greater consideration of state-level public institutions and the responsibilities of business firms toward those institutions. Furthermore, we contribute to the PCSR literature by identifying the disruptive mechanisms associated with these dynamics and outline two alternative perspectives to allow firms to continue to take on political responsibilities. Commentators often claim that medical research subjects are coerced into participating in clinical studies. In recent years, such claims have appeared especially frequently in ethical discussions of research in developing countries. Medical research ethics is more important than ever as we move into the 21st century because worldwide the pharmaceutical industry has grown so much and shows no sign of slowing its growth. This means that more people are involved in medical research today than ever before, and in the future (...) even more will be involved. However, despite the pressing need for reflection on research ethics, it is important to carefully identify the concerns we have about research. Otherwise we run the risk that the moral language we use, and which we hear other people use, may do our moral thinking for us. We argue that many recent claims about the occurrence of coercion in medical research are misguided and misuse the word "coercion." We try to identify the real problems, and urge people to attend carefully to the implications of their descriptions of moral problems in research. (shrink)

Self-compassion is a mechanism of symptom improvement in post-traumatic stress disorder, however, the underlying neurobiological processes are not well understood. High levels of self-compassion are associated with reduced activation of the threat response system. Physiological threat responses to trauma reminders and increased arousal are key symptoms which are maintained by negative appraisals of the self and self-blame. Moreover, PTSD has been consistently associated with functional changes implicated in the brain’s saliency and the default mode networks. In this paper, we explore (...) how trauma exposed individuals respond to a validated self-compassion exercise. We distinguish three groups using the PTSD checklist; those with full PTSD, those without PTSD, and those with subsyndromal PTSD. Subsyndromal PTSD is a clinically relevant subgroup in which individuals meet the criteria for reexperiencing along with one of either avoidance or hyperarousal. We use electroencephalography alpha-asymmetry and EEG microstate analysis to characterize brain activity time series during the self-compassion exercise in the three groups. We contextualize our results with concurrently recorded autonomic measures of physiological arousal, parasympathetic activation and self-reported changes in state mood and self-perception. We find that in all three groups directing self-compassion toward oneself activates the negative self and elicits a threat response during the SC exercise and that individuals with subsyndromal PTSD who have high levels of hyperarousal have the highest threat response. We find impaired activation of the EEG microstate associated with the saliency, attention and self-referential processing brain networks, distinguishes the three PTSD groups. Our findings provide evidence for potential neural biomarkers for quantitatively differentiating PTSD subgroups. (shrink)

Previous research has shown that drawing improves short-term mood in children when used to distract from rather than express negative thoughts and feelings. The current study sought to examine how drawing might elevate mood in children ages 6–12 by examining the role played by absorption, enjoyment, and perceived competence as well as entering an imaginary world; and whether children spontaneously use drawing to distract from a sad mood. Across three studies, children were asked to think of a disappointing event. After (...) a sad mood induction, they drew for 5 min. Mood was measured before and after the mood induction and after drawing. Three main findings emerged. First, drawing to distract led to greater absorption and enjoyment than did drawing to express. Second, children’s mood improved equally when drawing imaginary and real scenes showing that the key ingredient is that the content of the drawings be distracting in nature. Third, drawing improved mood even when children were given no instructions on the content of their drawings and children were more likely to use drawing as a way to distract themselves from a sad mood. These studies help to define the characteristics of drawing activities that foster mood improvement in children and highlight the important role of the arts in emotion regulation. (shrink)

The doctrine of the image of God is often regarded as grounding human dignity in something permanent and unchanging that transcends our attitudes and behaviors. Yet we persistently encounter the argument that particular human individuals or groups have acted so as to forfeit their moral standing as fellow humans. They are bestialized, categorized as non-human animals, lifting ordinary restraints on punishment. I examine the logic of this argument in John Locke, Thomas Aquinas, and contemporary felony disenfranchisement, showing how it involves (...) slippage between the unobjectionable notion that specific rights may in particular circumstances be forfeited, and the deeply troubling claim that one’s moral standing as human can as such be forfeited. I argue that an apparently similar rhetoric of dehumanization employed by Frederick Douglass, in contrast, refrains from stripping the opponent of moral considerability. (shrink)

In this thesis, I examine recent proposals for the creation of African and Native American forms of Indigenous philosophy and show how the discussions and debates in these fields challenge the disciplinary boundaries of modern Academic Western philosophy. With regard to African philosophy, I critique the debates in the Anglophone literature, teasing out those aspects of the debates which pose substantial epistemological challenges to mainstream [Western] philosophy, focusing, in particular, on assumptions about the intersections between philosophy, culture, science, and universality (...) which manifest themselves in the Euro-traditional critiques the "Professional" school philosophers make of the Afri-traditional approach of the "Ethnophilosophy" school philosophers. Looking at the works of such "Ethnophilosophers" as Kagame, Mbiti, Wright, and Gyeke and the critiques made of them by "Professional" school philosophers such as Wiredu, Bodunrin, Oruka, and Appiah, I present and critique both sides of the universal European argument, the literacy argument, the objective individual male argument, and the logical-scientific vs. magical-religious arguments, highlighting the epistemological implications of each. With regard to Native American Philosophy, I discuss recent proposals being made by Native American academic philosophers, and also do a philosophical analysis of traditional Native American culture as expressed in a variety of Native-authored sources. I argue, based on the works of Native authors, that three main methodological problems condition the formulation of Native American philosophy, namely 'problems of conquest,' 'problems of translation,' and 'problems of identity' and that each of these problems manifest as epistemological problems. I then go on to make proposals for five possible beginning points for the formulation of Native American philosophy by identifying themes which recur in the works of philosophers Deloria, Cordova, and Hester; traditional sages such as Black Elk, and Lame Deer; critical theorists such as Warrior, Guerrero, Gunn-Allen, Durham, and Forbes; and novelists Silko and King. I argue that both African and American forms of Indigenous philosophy provoke a reevaluation of many of the epistemic frames heretofore assumed to be universal in modern academic philosophy. Different notions of objectivity support different notions of what is required for a moral value or obligation to be experienced as objective. If the objectivity of a property requires that it can exist even when we fail to notice its existence, then experiencing a property as objective will require that we imagine it appearing in some way that is not presently available to us. Explaining what that imagining involves is the central task of this paper. Defending the epistemic value of (...) such imagining is a secondary aim. (shrink)

As scholars integrate empirical approaches to ethical questions in healthcare, relational autonomy theory must inform research design and change practice. Qualitative approaches are well suited to issues where patient values play a central role, and they can be combined with relational autonomy theory to investigate the factors influencing autonomy-rich experiences. This paper draws upon my experience conducting bioethics research related to clinical trial decision-making to develop a systematic method for applying relational autonomy as a theoretical lens to qualitative health research. In this paper, we will examine the role that intuitions and responses to thought experiments play in confirming or disconfirming theories of reference, using insights from both debates as our starting point. Our view is that experimental evidence of the type elicited by MMNS does play a central role in the construction of theories of reference. This, however, is not because such theory construction is accurately characterized by "the method of cases." First, experimental philosophy does not directly collect data about (...) intuitions, but rather about peoples responses to thought experiments, which may reflect their intuitions but may well not. Second, unusually in the case of the theory of reference, experimental prompts involve elicitation of the phenomenon under investigation—that is, referring—and it is the reference facts rather than the intuitions that a theory of reference should capture. Finally, "best fit" models like the method of cases are inconsistent with the actual practice of semantic theorists, who appeal to general principles of theory construction as well as considerations native to the theory of reference, often in the service of rejecting intuitions. Indeed, Kripke himself viewed several claims of his theory as unintuitive, but felt no pressure to alter them on that account. These facts, we'll argue, suggest that the relevance of experimental methods in the theory of reference cannot be straightforwardly extended to other fields: an experimental prompt containing Newtons two rocks tied together in empty space may elicit referring, and may also elicit intuitions, but it doesn't also elicit the phenomenon under investigation. Furthermore, the considerations native to the theory of reference are not part of physics, which has its own distinct set of principles and considerations. This suggests that an evaluation of the centrality of intuitions/ responses to thought experiments in philosophical methodology must proceed in a piecemeal fashion. We conclude that the potential contributions of experimental philosophy will take different forms in different sub-fields of philosophical inquiry. (shrink)

This volume includes some 30 essays which variously criticize, comment on and develop Davidson's philosophy as represented in his collected papers "Essays on Actions and Events", in addition to three further essays by Davidson himself. The essays divide into three sections, each opening with an editorial introduction and corresponding to the three major sections of "Actions and Events". The first section discusses the nature of rational explanation, (...) the relationships between reasons and actions, intentions and actions, will and irrationality, and the concepts of agency, freedom and weakness of the will. This section also contains an essay in which Davidson presents his views on self-deception. The second section considers the nature of events, causal relationships, and the logical form of action and singular causal statements. She and I are in agreement that a mere handful of cases may be affected by our debate, since anecdotal evidence from clinical settings as well (...) as the studies Hawkins cites suggest that forced feeding will often be contraindicated. Book synopsis: The aim of this collection of papers is to present different philosophical perspectives on the mental, exploring questions about how to define, explain and understand the various kinds of mental acts and processes, and exhibiting, in particular, the contrast between naturalistic and non-naturalistic approaches. There is a long tradition in philosophy of clarifying concepts such as those of thinking, knowing and believing. The task of clarifying these concepts has become ever more important with the major developments that have (...) taken place over the last century in the human and cognitive sciences - most notably, psychology, sociology, linguistics, neurophysiology, AI, and cognitive science itself. In all these sciences, there is a need to delineate the domain of the mental and to elucidate the key concepts and underlying assumptions. This need is widely recognized, but approaches and answers vary significantly. Some stress the representational features involved in most of our mental processes, others the inferential dimension; some stress the necessity of using empirical data, others the need to refine ideas before pursuing and drawing on empirical research. The papers collected in this volume are grouped into four parts, on language and thought, on knowledge, belief and action, on intentionality, and on naturalism. Could an accreditation, certification, or rating mechanism help the pharmaceutical industry improve both its bioethical performance and its public reputation? Other industries have used such systems to assess, improve, distinguish, and demonstrate the quality of their services, processes, and products. These systems have also helped increase transparency, accountability, stakeholder confidence, and awareness of industry best practices. This article explains how market forces can be harnessed to recognize and promote better bioethical performance by pharmaceutical companies when there are good systems to (...) accredit, certify, or rate.
