This study analyzes cognitive responses to explore a dual processing perspective of ethical judgment formation. Specifically, the study investigates how two factors, judgment task difficulty and moral intensity, influence the extent of deontological and teleological processing and their effects on ethical judgments. A single experiment on 110 undergraduate research participants found that judgment task difficulty affected the extent of deontological and teleological processing. Although moral intensity affected ethical judgments, it did not produce effects on either deontological or teleological cognitive responses. (...) Results did not support the hypotheses that deontological and teleological cognitive responses would mediate the relationships between the experimental factors and ethical judgments. Overall, the results support continued research of factors that affect the nature of information processing in ethical decision situations and the use of cognitive response analysis as a tool for conducting this research. In this paper we highlight the racialized effects of agricultural labor laws on Southeast Asian family farmers in California’s Central Valley. We show how agricultural labor laws intended to protect farmworkers on industrial farms discriminate against and challenge small Southeast Asian refugee farmers. Hmong, Iu-Mien and Lao family farmers rely on cultural practices of labor reciprocity and unpaid help from extended family and clan networks to sustain the economic viability of their farms. This kind of labor sharing, a central tenet (...) of their customary farming practices, and a cornerstone of the American family farm ideal, is illegal in California agriculture. We examine the historical context that gave rise to agricultural labor regulations in California and the ways in which these regulations are both under-enforced and unevenly enforced, differentially impacting immigrant family farms, while failing to protect those for whom the laws were originally intended. In highlighting how employment and labor laws and their enforcement or lack thereof discriminate against Southeast Asia farms, this study illustrates how other “small family farms” reliant on volunteerism or labor-sharing arrangements, part of the emergent “sharing economy,” may be confronting similar legal conundrums to those faced by Southeast Asian farms. BackgroundThe COVID-19 pandemic has had a significant impact on the health system worldwide. The organ and tissue donation and transplantation (OTDT) system is no exception and has had to face ethical challenges related to the pandemic, such as risks of infection and resource allocation. In this setting, many Canadian transplant programs halted their activities during the first wave of the pandemic.MethodTo inform future ethical guidelines related to the COVID-19 pandemic or other public health emergencies of international concern, we conducted a (...) literature review to summarize the ethical issues.ResultsThis literature review identified three categories of ethical challenges. The first one describes the general ethical issues and challenges reported by OTDT organizations and transplantation programs, such as risks of COVID-19 transmission and infection to transplant recipients and healthcare professionals during the transplant process, risk of patient waitlist mortality or further resource strain where transplant procedures have been delayed or halted, and resource allocation. The second category describes ethical challenges related to informed consent in the context of uncertainty and virtual consent. Finally, the third category describes ethical issues related to organ allocation, such as social considerations in selecting transplant candidates.ConclusionThis literature review highlights the salient ethical issues related to OTDT during the current COVID-19 pandemic. As medical and scientific knowledge about COVID-19 increases, the uncertainties related to this disease will decrease and the associated ethical issues will continue to evolve. (shrink)

This book is a defense of political liberalism as a feminist liberalism. A novel and restrictive account of public reason is defended. Then it is argued that political liberalism's core commitments restrict reasonable conceptions of justice to those that secure genuine, substantive equality for women and other marginalized groups.

IntroductionThere is a significant disparity in the United States between the health care received by children with special health care needs versus physically healthy children.ObjectiveThe objective of the paper is to show that children with special needs receive less than adequate health care overall. This disparity affects the quality of life for these children and influences their ability to live their lives to their full potential.MethodsResearch was conducted by examining multiple studies with a focus on six major factors that play (...) a role in creating this disparity.ResultsThe findings show an alarming trend in the access and delivery of health care to children with special health care needs.ConclusionsSolutions to correcting the disparities are possible, but it will take a full understanding of the issues, perseverance, dedication, and hard work on the part of families, physicians, legislators, and others genuinely interested in creating an equal health care system for all children. An influential view in the ethics of self-defence is that causal responsibility for an unjust threat is a necessary requirement for liability to defensive harm. In this article, I argue against this view by providing intuitive counterexamples and by revealing weaknesses in the arguments offered in its favour. In response, adherents of the causal view have advanced the idea that although causally inefficacious agents are not liable to defensive harm, the fact that they may deserve harm can justify harming them (...) in the course of defending oneself. I argue that this strategy is ad hoc and leads to more problems than it solves. Once we allow normative facts outside our account of liability to affect a person's moral protection against harm, the lieability verdicts cannot tell us whether there is a relevant moral asymmetry between the victim and the target of defence. In conclusion, the causal view is wrong and causal responsibility for an unjust threat is not a necessary requirement for liability to defensive harm. (shrink)

Recent scholarship (Goodwin & Darley, 2008) on the meta-ethical debate between objectivism and relativism has found people to be mixed: they are objectivists about some issues, but relativists about others. The studies discussed here sought to explore this further. Study 1 explored whether giving people the ability to identify moral issues for themselves would reveal them to be more globally objectivist. Study 2 explored people's meta-ethical commitments more deeply, asking them to provide verbal explanations for their judgments. This revealed that (...) while people think they are relativists, this may not always be the case. The explanations people gave were sometimes rated by outside (blind) coders as being objective, even when given a relativist response. Nonetheless, people remained meta-ethical pluralists. Social cooperation based on reciprocity is the cornerstone of many theories of justice. However, what is central to social cooperation based on reciprocity? How does basing social cooperation on reciprocity structure and constrain theories of justice? In this paper, I consider what is central to reciprocity. I argue that the purpose of reciprocal exchange among persons is important for determining the appropriateness of reciprocal exchanges and that sustaining mutually advantageous relations is not always the point or the only point of (...) reciprocity. This has important implications for theorizing about justice. I show this by outlining two conceptions of justice as reciprocity. (shrink)

The feminization of agriculture narrative has been reproduced in development literature as an oversimplified metric of empowerment through changes in women’s labor and managerial roles with little attention to individuals’ heterogeneous livelihoods. Grounded in feminist political ecology, we sought to critically understand how labor and managerial feminization interact with changing agricultural practices. Working with a local NGO as part of an international, donor-funded research-for-development project, we conducted semi-structured interviews, focus group discussions, and participant observation with over 100 farmers in Mid-Western (...) Nepal in 2017. Household structure and headship are dynamic in the context of male out-migration, pushing women to take on new agricultural duties and increasing household labor responsibilities. In this context, decision-making processes related to agricultural management and new cultivation practices illustrate ongoing renegotiations of gender and cultivation practices within and beyond the household. We contend that the heterogeneity of household power dynamics muddies the empowering impacts of migration and emphasize the importance of community spaces as a locus of subjectivity formation and social value. We conclude that FPE can illuminate complexities of power, space, and individual responses to socio-ecological conditions that challenge the current feminization of agriculture framework. (shrink)

In the criminal legal system, confessions have long been considered the ‘gold standard’ in evidence. An immediate problem arises for this gold standard, however, when the prevalence of false confessions is taken into account. In this paper, I take a close look at false confessions in connection with the phenomenon of testimonial injustice. I show that false confessions provide a unique and compelling challenge to the current conceptual tools used to understand this epistemic wrong. In particular, I argue that we (...) cannot make sense of the unjust ways in which false confessions function in our criminal legal system by focusing exclusively on speakers getting less credibility than they deserve. I conclude that the way we conceive of testimonial injustice requires a significant expansion to include what I call agential testimonial injustice – where an unwarranted credibility excess is afforded to speakers when their epistemic agency has been denied or subverted in the obtaining of their testimony. There is a long history of the science of intelligent machines and its potential to provide scientific insights have been debated since the dawn of AI. In particular, there is renewed interest in the role of AI in research and research policy as an enabler of new methods, processes, management and evaluation which is still relatively under-explored. This empirical paper explores interviews with leading scholars on the potential impact of AI on research practice and culture through deductive, thematic analysis to (...) show the issues affecting academics and universities today. Our interviewees identify positive and negative consequences for research and researchers with respect to _collective_ and _individual use_. AI is perceived as helpful with respect to information gathering and other narrow tasks, and in support of impact and interdisciplinarity. However, using AI as a way of ‘speeding up—to keep up’ with bureaucratic and metricised processes, may proliferate negative aspects of academic culture in that the expansion of AI in research should assist and not replace human creativity. Research into the future role of AI in the research process needs to go further to address these challenges, and ask fundamental questions about how AI might assist in providing new tools able to question the values and principles driving institutions and research processes. We argue that to do this an explicit movement of meta-research on the role of AI in research should consider the effects for research and researcher creativity. Anticipatory approaches and engagement of diverse and critical voices at policy level and across disciplines should also be considered. (shrink)

Accuracy-first epistemology aims to show that the norms of epistemic rationality can be derived from the effective pursuit of accuracy. This paper explores the prospects within accuracy-first epistemology for vindicating “modesty”: the thesis that ideal rationality permits uncertainty about one’s own rationality. I argue that accuracy-first epistemology faces serious challenges in accommodating three forms of modesty: uncertainty about what priors are rational, uncertainty about whether one’s update policy is rational, and uncertainty about what one’s evidence is. I argue that the (...) problem stems from the representation of epistemic decision problems. The appropriate representation of decision problems, and corresponding decision rules, for (diachronic) update policies should be a generalization of decision problems and decision rules for (synchronic) coherence. I argue that extant accounts build in conflicting assumptions about which kinds of information about the believer should be used to structure epistemic decision problems. In particular, extant accounts of update build in a form of epistemic consequentialism. Related forms of epistemic consequentialism have been shown to generate problems for accuracy-first epistemology’s purported justifications of probabilism, conditionalization, and the principal principle. These results are vindicated only with nonconsequentialist epistemic decision theories. I close with suggestive examples of how, with a fully nonconsequentialist representation of epistemic decision problems, accuracy-first epistemology can allow for rational modesty. (shrink)

In this article, I highlight some core ideas that are important for understanding the parent-child relationship within the framework of political liberalism. I stress that, although some ideal or conception of the family is part of most, if not all, comprehensive doctrines, for political liberals, the state’s interest in the family is as a social-political institution in which certain needs of persons as free and equal citizens are met. I discuss the main needs and interests of children and parents in (...) the parent-child relationship. I consider that many children are cared for by multiple people, and I discuss how the state should address the recognition of multiple legal parents. I discuss some contexts in which conflicts arise between the interests of children and caregivers and address how such conflicts should be resolved in the politically liberal state. Although Rawls failed to offer an acceptable account of the family as part of the basic structure and did not adequately address the role of caring relationships in a just society, I hope that this article helps to show how political liberals can offer a plausible account. This book employs contemporary philosophy, scientific research, and clinical reports to argue that pain, though real, is not an appropriate object of scientific generalisations or an appropriate target for medical intervention. Each pain experience is instead complex and idiosyncratic in a way which undermines scientific utility. In addition to contributing novel arguments and developing a novel position on the nature of pain, the book provides an interdisciplinary overview of dominant models of pain. The author lays the needed groundwork for improved (...) models and targeted treatments at a time when pain science, pain medicine, and philosophy are explicitly searching for both and failing to find them. The Complex Reality of Pain will be of interest to a broad range of researchers and students, including those working in philosophy of mind, philosophy of science, cognitive science, neuroscience, medicine, health, cognitive and behavioural psychology, and pain science. Skepticism about the epistemic value of intuition in theoretical and philosophical inquiry fueled by the empirical discovery of irrational bias (e.g., the order effect) in people's judgments has recently been challenged by research suggesting that people can introspectively track intuitional instability. The two studies reported here build upon this, the first by demonstrating that people are able to introspectively track instability that was experimentally induced by introducing conflicting expert opinion about certain cases, and the second by demonstrating that it was (...) the presence of instability?not merely the presence of conflicting information?that resulted in changes in the relevant attitudinal states (i.e., confidence and belief strength). The paper closes with the suggestion that perhaps the best explanation for these (and other) findings may be that intuitional instability is not actually ?intuitional.? (shrink)

In this paper, I critically examine the two dominant views of the concept of luck in the current literature: lack of control accounts and modal accounts. In particular, I argue that the conditions proposed by such views—that is, a lack of control and the absence of counterfactual robustness—are neither necessary nor sufficient for an event's being lucky. Hence, I conclude that the two main accounts in the current literature both fail to capture what is distinctive of, and central to, the (...) concept of luck. (shrink)

College cheating is prevalent, with rates ranging widely from 9 to 95% (Whitley, 1998). Research has been exclusively conducted with enrolled college students. This study examined the prevalence of cheating in a sample of college alumni, who risk less in disclosing academic dishonesty than current students. A total of 273 alumni reported on their prevalence and perceived severity of 19 cheating behaviors. The vast majority of participants (81.7%) report having engaged in some form of cheating during their undergraduate career. The (...) most common forms of cheating were “copying from another student's assignment” and “allowing others to copy from your assignment.” More students reported cheating in classes for their major than other classes. Males and females cheated at the same rates in classes for their major, and males reported higher rates of cheating than females in nonmajor classes. Respondents reported that their top reasons for cheating were “lack of time” and “to help a friend.”. (shrink)

Using the threat of a severe AIDS epidemic in a collection of rural villages in South Africa, we illustrate how men and women reconsider gendered sexualities through conversations and interactions in everyday life. We draw from data collected by local ethnographers and focus on the processes through which men and women collectively respond to the threat posed by AIDS to relationships, families, and communities. Whereas previous research has shown that individuals often reaffirm hegemonic norms about gender and sexuality in response (...) to disruptions to heteronormative gender relations, we find that the threat of AIDS provokes reconsideration of gendered sexualities at the community level. That is, our data demonstrate how men and women—through the interactions and exchanges that make up their daily lives—debate, challenge, make sense of, and attempt to come to terms with social norms circumscribing gendered sexual practices in a context where the threat of a fatal disease transmitted through sex looms large. We argue that ethnographic data are particularly useful for capturing communal responses to events that threaten heteronormative gender relations and reflect on how our findings inform theories of gender relations and processes. The purpose of this article is to understand how academic integrity educational tutorials are administered across Canadian higher education. Results are shared from a survey of publicly funded Canadian higher education institutions, including universities and colleges, across ten provinces where English is the primary language of instruction. The survey contained 29 items addressing institutional demographic details, as well as academic integrity education questions. Results showed that academic integrity tutorials are inconsistent across Canadian higher education, with further differences evident within the (...) university and college sectors. (shrink)

Arguments about the supersession of historic injustice often use the dispossession of Indigenous lands as an example of the sort of injustice in the past that can be superseded in certain circumstances. This article aims not to directly challenge the content of such arguments but to place them into a different context, wherein they are seen playing a role in ongoing efforts to remove Indigenous understandings of law, justice, and morals from discussions about state-Indigenous histories and interactions. The normative narrowness (...) of these arguments is explored alongside developments within Canadian law that purport to respond to the historic denial of substantive Indigenous interests in lands by colonial and Canadian authorities. While the analysis predominantly takes a bird’s-eye view of the interaction of varied normative systems, the conclusion advances a normatively charged argument, as I speculate about why courts – and academics writing about the passage of time – seem intent on developing arguments that displace Indigenous understandings. Numerous laws have passed to move away from criminalising youth who trade sex. Specialised courts have also been established to support youth. Despite proponents' contention that specialised, trauma-informed courts are less punitive than typical interventions, research is limited. This article explores one specialised dependency court's efforts to assist youth ‘at risk’. Drawing on interviews and ethnographic observations, I argue that laws and trauma-informed court interventions intensify the supervision of youth and families while inadvertently concealing the gendered-racialised effects of child welfare (...) system involvement. Ethnographic findings contribute to sociolegal and anti-carceral feminist research on carceral control beyond the criminal legal system. This work also explores the ethics of carceral-trauma entanglements that accompany decriminalisation’s afterlife. (shrink)

Culture has been identified as a significant determinant of ethical attitudes of business managers. This research studies the impact of culture on the ethical attitudes of business managers in India, Korea and the United States using multivariate statistical analysis. Employing Geert Hofstede's cultural typology, this study examines the relationship between his five cultural dimensions (individualism, power distance, uncertainty avoidance, masculinity, and long-term orientation) and business managers' ethical attitudes. The study uses primary data collected from 345 business manager participants of Executive (...) MBA programs in selected business schools in India, Korea and the United States using Hofstede's Value Survey Module (94) and an instrument designed by the researchers to measure respondents' ethical attitudes (attitudes toward business ethics in general and toward twelve common questionable practices in particular). Results indicate that national culture has a strong influence on business managers' ethical attitudes. In addition to national culture, respondents' general attitudes toward business ethics are related to their personal integrity; their attitudes toward questionable business practices are related to the external environment and gender, as well as to their personal integrity. A strong relationship exists between cultural dimensions of individualism and power distance and respondents' ethical attitudes toward certain questionable practices. The analysis of the relationship between cultural dimensions of masculinity, uncertainty avoidance and long-term orientation and respondents' ethical attitudes toward questionable practices produced mixed results, likely due to the lack of notable differences in cultural dimension scores among the countries surveyed. According to a standard characterization of dispositions, when a disposition is activated by a stimulus, a manifestation of that disposition typically occurs. For example, when flammable gasoline encounters a spark in an oxygen-rich environment, the manifestation of flammability—combustion—occurs. In the dispositions/powers literature, it is common to assume that a manifestation is an effect of a disposition being activated. (I use “disposition” and “power” interchangeably). I address two questions in this chapter: Could all manifestations be effects that involve things acquiring only (...) dispositional properties? And, is thinking of manifestations as contributions to effects preferable to thinking of them as effects? I defend negative responses to both questions. If all properties are dispositional, as the pandispositionalists claim, then any time the activation of a disposition results is something acquiring a new property, it results in something acquiring another disposition. Some worry that a vicious regress ensues (Swinburne, 1980; Bird, 2007a, 2007b: 132-46). While I believe that regress arguments can be addressed, my worry is that, on the pandispositionalist view, manifestations become unobservable. Thinking of manifestations as effects is problematic in cases where what actually occurs is not the kind of effect that the power is a power for, but rather a complex interaction of various powers. Because of this, some prefer to think of manifestations as contributions to effects (Molnar, 2003: 194-8; Mumford, 2009). I argue against this proposal on the ground that it introduces mysterious new entities into our ontology. In the end, the most plausible view is that a single kind of power can have different kinds of effects, some of which involve the instantiation of non-dispositional properties. I proceed as follows. In the first section of this chapter, I show that the philosophical concept of a manifestation is the concept of an effect. In the second section, I argue against the claim that all manifestations involve instantiations of only dispositional properties. In the third section, I argue against the view that manifestations are contributions rather than effects. (shrink)

In this paper, we will examine the role that intuitions and responses to thought experiments play in confirming or disconfirming theories of reference, using insights from both debates as our starting point. Our view is that experimental evidence of the type elicited by MMNS does play a central role in the construction of theories of reference. This, however, is not because such theory construction is accurately characterized by "the method of cases." First, experimental philosophy does not directly collect data about (...) intuitions, but rather about peoples responses to thought experiments, which may reflect their intuitions but may well not. Second, unusually in the case of the theory of reference, experimental prompts involve elicitation of the phenomenon under investigation—that is, referring—and it is the reference facts rather than the intuitions that a theory of reference should capture. Finally, "best fit" models like the method of cases are inconsistent with the actual practice of semantic theorists, who appeal to general principles of theory construction as well as considerations native to the theory of reference, often in the service of rejecting intuitions. Indeed, Kripke himself viewed several claims of his theory as unintuitive, but felt no pressure to alter them on that account. These facts, we'll argue, suggest that the relevance of experimental methods in the theory of reference cannot be straightforwardly extended to other fields: an experimental prompt containing Newtons two rocks tied together in empty space may elicit referring, and may also elicit intuitions, but it doesn't also elicit the phenomenon under investigation. Furthermore, the considerations native to the theory of reference are not part of physics, which has its own distinct set of principles and considerations. This suggests that an evaluation of the centrality of intuitions/ responses to thought experiments in philosophical methodology must proceed in a piecemeal fashion. We conclude that the potential contributions of experimental philosophy will take different forms in different sub-fields of philosophical inquiry. (shrink)

Blended social impact investment transactions, in which multiple types of capital are combined to support attainment of social impact, are a pervasive, yet not closely examined, feature of the SII market. This paper seeks to describe and understand blended SII transactions through the lens of institutional theory. Specifically, we use the institutional logics theoretical frame to shed light on the implications of combining several institutional logics in SII transactions. Consistent with other SII research, we find that parties to blended SII (...) transactions combine financial/commercial and social welfare logics. However, in blended SII transactions, different combinations of these logics are enacted by different stakeholders in a multi-hybrid-logic structure. As such, we propose that blended SII transactions are hybrids-of-hybrids. We argue that it is this hybrids-of-hybrid characteristic that differentiates blended SII transactions from other forms of SII and increases the potential for significant logical misalignment and resultant conflict and contestation. From a business ethics perspective, blended SII transactions cast light on the critical and often unrecognized role that grants and concessionary capital frequently play in enabling SII in not-for-profit, charitable ventures. We speculate that this can distort understanding of SII with adverse implications at the transaction and field levels. (shrink)

Contingent transcranialists claim that the physical mechanisms of mind are not exclusively intracranial and that genuine cognitive systems can extend into cognizers' physical and socio-cultural environments. They further claim that extended cognitive systems must include the deep functional integration of external environmental resources with internal neural resources. They have found it difficult, however, to explicate the precise nature of such deep functional integration and provide compelling examples of it. Contingent intracranialists deny that extracranial resources can be components of genuine extended (...) cognitive systems. They claim that transcranialists fallaciously conflate coupling with constitution and construe cognition as extending always from brains into world rather than world into brains. By using insights from recent research in developmental psychology and by explicating the nature of one form that deep functional integration can take, I argue that (i) transcranialists do not fallaciously conflate coupling wth constitution, and (ii) human emotional ontogenesis is a world-to-brain transcranial achievement. A growing body of empirical research suggests that people's concrete‐case intuitions are unstable—i.e., vulnerable to biasing influences—with no way of anticipating the instability. This has led some to challenge the use of intuitions in philosophical practice. In this chapter, I consider responses to this challenge. One is that the empirical research cited has no bearing on the epistemic status of intuitions because it fails to actually test intuitions. While this is a worry worth taking seriously, there is another response available—namely, (...) that even if we grant that these studies successfully elicited intuitions, in the midst of the instability uncovered there was also a fair amount of stability. And an investigation into the features of unstable vs. stable judgments, and the contexts within which they are generated, suggests that the instability in question may not actually be intuitional.
