ABSTRACT:In this address I argue that different perspectives on the normative foundations of corporate responsibility reflect underlying disagreements about the ideal arrangement of tasks between market and state. I initially recommend that scholars look back to the “division of moral labor” inspired by John Rawls’ seminal work on distributive justice in order to rethink why, and to what extent, corporations take on responsibilities normally within the purview of government. I then examine how this notion is related to recent theoretical work (...) in the field of business ethics. I thereafter turn to provide a brief outline of an alternative view that sees corporations as having responsibilities in so far as markets are sites of delegated oversight over the production of social goods that might otherwise be administered by the state. McNeil (bio)René Girard's (1923–2015) mimetic theory and Georges Bataille's (1897–1962) theory of the sacred both describe an unwitting pull to violence fueled by an aspect of desire. This violence cannot be denied but may be channeled through ritual, resulting in social cohesion or utter catastrophe. Their theories also illustrate the contagious flow of affective violence between individuals, quickly infecting the whole. (...) Girard describes a violent contagion that threatens physical annihilation, while Bataille's more vital contagion illustrates the dissolution of self into other. Both come to the same result—collective cohesion. However, for all the similarities, the essential mechanisms "end up with profoundly different visions of the dynamics sustaining the social bond and, indeed, of society's whole affective economy."1 For Girard, the operative community requires distinct individuals specific in their identities. A lack of distinctions between individuals—a state he calls undifferentiation—leads to a struggle for identity, conflict, and violence. Unity comes from the catharsis of collectively thwarting violence before conflict can destroy the community. For Bataille, unity comes from collectively communicating through ritual. A [End Page 103] primal urge to slip out of the hierarchical mastery of discontinuous being and join with the other in a step closer to continuous being unites through mutual affect generated through shared experience. Girard asserts that cohesion occurs by maintaining separation, while Bataille describes cohesion generated in its destruction.Despite their similar concerns and many agreements, Girard and Bataille have rarely been compared. Among those few studies, Tiina Arppe argues that the divergence in both thinkers' theories can be found in their sources, namely, Emile Durkheim's theory of the sacred and Alexandre Kojève's reading of Hegel.2 Antony D. Traylor argues in answering the question of the purpose of sacrifice that Bataille's understanding may add to or replace Girard's scapegoat mechanism.3 Traylor dissects both theories focusing on Girard's critique of metaphysical desire and Bataille's notion of sovereignty. Nidesh Lawtoo mobilizes both thinkers and others to unmask the mimetic forces entwined in ego creation.4 First, similar to Arppe, I argue that apparent contradictions between Girard and Bataille arise from critical influences of each thinker and offer an analysis paving the way, like Traylor, toward compatibility. However, I focus on the influence (or denial) of Sigmund Freud and Marcel Mauss—whom I argue are the most crucial influences for untangling these theories. By examining Girard's interpretation of Freud's theory of cultural origin and Bataille's use of Mauss's notion of the gift and potlatch, I trace a short anthropological genealogy of the sacred that proves critical to both theories.5 In that regard, I eschew wrestling with metaphysical concerns and instead take an anthropological approach to the sacred that moves beyond compatibility. Second, we perform a synthetization, illuminating a shared mimetic force lurking within both theories and how Bataille offers an expansion to Girard's already acute observations—for which Lawtoo's notions of the mimetic unconscious and mimetic communication are essential.My primary source for Girard's theory is Violence and the Sacred, with secondary support from The Scapegoat and Things Hidden since the Foundation of the World. For Bataille, I consult Erotism: Death and Sensuality and two essays: "The Notion of Expenditure" (and its later development in The Accursed Share) and "Definition of Heterology." This article defends a new model of personal privacy. Privacy should be understood as demarcating culturally defined aspects of an individual's life in which he or she is granted immunity from the judgment of others. Such an analysis is preferable to either of the two favorite models of privacy in the current literature. The judgment of others model preserves all of the insights of the liberty and information models of privacy, But avoids the obvious problems and counterexamples. The double etymology of religio found in Antiquity has generated much discussion. Between the proposition of Cicero and that of Lactantius, we find the ambivalent position of Augustine. The modern analysis of these passages, which is influenced by criteria of linguistics, was centered around the true origin of the word and its true meaning. However, Augustine is neither here nor there. This article uses a rhetorical analysis of these etymologies and considers them as proof in the argumentation. This approach allows (...) identifying the reasons that urge Augustine to choose one or the other according to the addressee. When he addressed the non-Christians, Augustine chose the etymology of Cicero (relegere) and, when he dealt with the controversies with the Manicheans, he chose the etymology based on religare. This article describes the unauthorized uses of a coauthored work and a copyrighted U.S. dissertation by European scientists. The case involves alleged infringements of copyright and plagiarism in 6 works that were published up to 19 years after completion of the dissertation and up to 11 years after publication of the coauthored work. Relevant copyright laws, international copyright agreements, and professional psychology ethics and definitions of scientific misconduct are presented. Graduate students and professionals are advised to protect themselves from copyright (...) infringement and recognize that the responsibility for detecting and correcting misappropriated work usually lies with them, not journal editors. Although consumers are increasingly engaged with ethical factors when forming opinions about products and making purchase decisions, recent studies have highlighted significant differences between consumers' intentions to consume ethically, and their actual purchase behaviour. This article contributes to an understanding of this 'Ethical Purchasing Gap' through a review of existing literature, and the inductive analysis of focus group discussions. A model is suggested which includes exogenous variables such as moral maturity and age which have been well covered in the literature, (...) together with further impeding factors identified from the focus group discussions. For some consumers, inertia in purchasing behaviour was such that the decision-making process was devoid of ethical considerations. Several consumers manifested their ethical views through post-purchase dissonance and retrospective feelings of guilt. Others displayed a reluctance to consume ethically due to personal constraints, a perceived negative impact on image or quality, or an outright negation of responsibility. Those who expressed a desire to consume ethically often seemed deterred by cynicism, which caused them to question the impact they, as an individual, could achieve. These findings enhance the understanding of ethical consumption decisions and provide a platform for future research in this area. (shrink)

In the wake of recent corporate scandals, this paper examines the claim made by John Boatright that business ethics, as it is currently conceived, “rests on a mistake.” Ethics in business should not be achieved through managerial vision, discretion or responsibility; rather, ethics should shape the design of institutions that regulate business from the outside. What ethicists should advocate for, according to Boatright, are moral markets not moral managers. I explore the empirical and normative dimensions of his claim with special (...) attention paid to the extent to which Boatright’s development of the economic theory of the firm supports his position. I conclude by suggesting some reasons why moral markets and moral management are compatible frameworks for corporate reform. (shrink)

One common justification for the pursuit of profit by business firms within a market economy is that profit is not an end in itself but a means to more efficiently produce and allocate resources. Profit, in short, is a mechanism that serves the market’s purpose of producing Pareto superior outcomes for society. This discussion examines whether such a justification, if correct, requires business managers to remain attentive to how their firm’s operation impacts the market’s purpose. In particular, it is argued (...) that the value of efficiency, despite views to the contrary, cannot be fully separated from the planning and intentions of business managers as long as those managers direct their firms in an ethically responsible fashion. This position is inspired by, and serves as a supportive clarification of Joseph Heath’s so-called “market failures approach” to business ethics. (shrink)

People who defend “pragmatic encroachment” about knowledge generally advocate two ideas: you can rationally act according to what you know; knowledge is harder to achieve when more is at stake. In their chapter in this volume, Charity Anderson and John Hawthorne argue that these two ideas may not fit together so well. This chapter extends Anderson and Hawthorne’s argument. By applying some standard decision theory, we can calculate a precise quantity of “how much is at stake” that does fit together (...) with knowledge and action. Dungeons Dragons gamers exemplify Aristotle's claim that “no one would want to live without friends”. One might even see gaming as an attempt to find friends and build that political community of which Aristotle says friendship is the root. The really interesting thing about gamers is that, as they play Dungeons Dragons, they at one and the same time build bonds between their characters and between each other as players. The trajectory of these bonds often mirrors the trajectory of friendships (...) we find in epic fantasy literature where the characters, at first suspicious of each other, in the end have developed true friendships and established peaceful kingdoms where chaos had reigned before. Aristotle's philosophy of friendship can help us to understand this development. Dungeons Dragons players know a lot about friendship and the value of friendship in a person's life, despite the popular depiction of gamers. (shrink)

The Cambridge Companion to German Idealism. New York: Cambridge University Press, 2000. Pp. xiii + 306. Cloth, $54.95. Paper, $19.95. This recently published volume is a welcome and timely addition to the Cambridge Companion series. The past two decades have witnessed a renewed and now burgeoning interest in post-Kantian German philosophy, notably among (...) philosophers working in the continental and analytic traditions. Contributors to the volume reflect this diversity (actually, most work within the analytic tradition), and all are familiar and veteran scholars of Kant and German Idealism. The essays, as expected, are compact, but are tightly presented and clearly argued. The decision to devote a Cambridge Companion volume to a philosophical movement—a major exception, as most are aware, for the series—seems quite justified given the heretofore unacknowledged importance of the period and the global (at least among Anglo-American philosophers) misunderstanding from which it has suffered until recently. On both scores, this volume is a successful corrective. A short review precludes individual evaluation, however brief, of the essays in this fine collection, so I will limit my comments to a few general points.The essays are organized so as to provide the reader with a thorough introduction to the history of German Idealism construed broadly to include Kant, Hamann, Herder, Jacobi, Maimon, Reinhold, Fichte, Schelling, Hegel, the Romantics, and at least the trajectory of post-Hegelianism. The Romantics, particularly Novalis, Schiller, and Hölderlin, receive overdue and careful treatment—Charles Larmore's essay on Hölderlin and Novalis being, in this reviewer's judgment, one of the better contributions to the collection. Some authors retrace themes developed in their earlier scholarly work (especially Pinkard, Wood, Pippin, Beiser, and Bowie); however each essay almost without exception attempts to advance the scholarly discussion of the problems it explores. Paul Guyer's essay, for instance, fits this description: he offers a robust defense of Kantian dualism (e.g., intuition and concept, representation and thing in itself) against Hegelian objections which includes a fine analysis of the genesis of Kant's arguments. On the other hand, Guyer's essay, along with the contributions of Wood, Pippin, Pinkard, Larmore, and Bowie, might be more fruitful for readers more interested in philosophical problems engaged by the Idealists (e.g., moral and political autonomy, rational normativity). The collection begins with Frederick Beiser's skillfully condensed and informative essay on the unresolved tensions within Enlightenment philosophy (and the way in which those tensions, highlighted rather than resolved by the Pantheism controversy, helped set the agenda for what became the tasks of German Idealism) and ends with Karl Ameriks's fine essay on the complex legacy of Idealism in the works of Feuerbach, Marx, and Kierkegaard.One of the problems which occupied everyone in this period was rational authority, [End Page 596] namely, what would ground our normative theoretical and practical judgments and to what extent reason would provide either the foundation itself or access to this foundation. Most of the essays address this issue either directly or implicitly and accurately capture the diverse responses to this basic question and its implications for political philosophy—another central theme for the Idealist tradition. The problem of rational authority had been inherited from Rousseau, yet the Idealists explored the issue with an unparalleled thoroughness and urgency in the shadow of the French Revolution. Larmore does an exceptional job of articulating Hölderlin's and Novalis's critique of Fichtean self-consciousness, namely, that judgment itself must presuppose and draw upon a more basic unity (Absolute Being for Hölderlin and the Being of the I antecedent to self-awareness for Novalis) than the self-positing I, a unity which, as Larmore notes, underlies every cognitive attitude. Contributing to this general critique was the aesthetic holism of Hamann, Schiller, and Herder ably sketched by Daniel Dahlstromm. Central to the problem of rational authority is the contribution of Hegel, who took to heart Hölderlin's insistence on a more basic primordial unity... (shrink)

Robert Nozick has attempted to demonstrate that a state can emerge from anarchy which will be legitimate, in that it acquires power in morally permissible (i.e., non rights violating) ways. Its monopoly on force and apparent redistribution of holdings are, according to Nozick, justified by the steps required to prevent risky behavior by the dominant agency. These steps, I argue, contravene Nozick's own entitlement principles and so, his dominant agency is not warranted in taking them. This leaves Nozick "stranded" within (...) his own state of nature, the dominant agency unable to legitimately transform itself into a night watchman state. (shrink)

What is it like to live with the label “Disability?” NIB editorial staff and narrative symposium editors, Jeffery Bishop and Naomi Sunderland developed a call for stories, which was sent to several list serves, shared with the 1000 Voices Project community and posted on Narrative Inquiry in Bioethics ’ website. The request for personal stories from people who identify with the label “disabled” asked them to: consider how the label “disability” interacts with other aspects of their life in health (...) care settings; does the term “disability” reflect their actual embodied experiences of impairment or does it fail to do justice to their particular experience of impairment; describe the kind of experiences that are possible because of the impairment(s); discuss how the label has affected their “authentic voice”; and many other concepts about what effects the label has on their lives. These authors share deeply personal experiences that will help readers understand their world, challenges, and joys. Thirteen stories are found in the print version of the journal and an additional five supplemental stories are published online only through Project MUSE. The stories are complemented by four commentary articles by Elizabeth R. Schiltz; Lorna Hallahan; Nicole Matthews, Kathleen Ellem, and Lesley Chenoweth; and Jeffery Bishop, Rachelle Barina, and Devan Stahl. These scholars come from the disciplines of law, social work, media studies, medicine, and bioethics from Australia and the United States. Together, the symposium’s storytellers and commentators offer striking and informative insights into the everydayness of living with disabilities. (shrink)

In, Love and Politics Jeffery L. Nicholas argues that Eros is the final rejection of an alienated life, in which humans are prevented from developing their human powers; Eros, in contrast, is an overflowing of acting into new realities and new beauties, a world in which human beings extend their powers and senses. Nicholas uniquely interprets Alasdair MacIntyre's Revolutionary Aristotelianism as a response to alienation defined as the divorce of fact from value. However, this account cannot address alienation in (...) the form of the oppression of women or people of color. Importantly, it fails to acknowledge the domination of nature that blackens the heart of alienated life. Alienation must be seen as a separation of the human from nature. Nicholas turns to Aristotle, first, to uncover the way his philosophy embodies a divorce of human from nature, then to reconstruct the essential elements of Aristotle's metaphysics to defend a philosophical anthropology based on Eros. Love and Politics: Persistent Human Desires as a Foundation for Liberation presents a critical theory that synthesizes MacIntyre's Revolutionary Aristotelianism, Frankfurt School Critical Theory, and Social Reproduction Theory. L’utilisation de concepts modernes pour l’analyse des Diuinae institutiones constitue dès lors un frein à la compréhension des notions de religion, sacré et profane dans l’ouvrage de Lactance. | : The Diuinae institutiones of Lactantius are often referred to when analyzing the transition of the word religio from Latin to Christian thought. However, one should not read this fourth century A.D. text with the modern definition of religion in mind. Twentieth century sociologists put forth definitions of religion based on the sacred-profane opposition, but this dichotomy is not a valid category for the interpretation of religio in the book of Lactantius. Not only does he scarcely oppose these two terms, but also the very notion of sacer and profanus differ from the received definitions of the last century. Therefore, the use of modern concepts is a stumbling block for the understanding of the terms religion, sacred and profane in the Diuinae institutiones of Lactantius. (shrink)

The study investigates how the Beshara School has used Ibn 'Arabi's teachings in assisting a range of students from around the world towards personal, (...) spiritual development and how the Muhyiddin Ibn 'Arabi Society has evolved into an international organisation with increasing influence in both the West and the Muslim world. Originally published in 1950, this book is one of a series of studies regarding the structure of the British economy which were produced by the National Institute of Economic and Social Research after the Second World War. It was produced in collaboration with a group of leading businessmen, all of whom were concerned in one way or another with the distribution of consumer goods and dissatisfied with the existing state of knowledge about distribution. The study represented a substantial advance in (...) the knowledge of distribution and an important contribution to structural economics. This essay will pose and seek to answer the following question: If, as Swami Vivekananda claims, the four yogas are independent and equally effective paths to God-realization and liberation from the cycle of rebirth, then what must reality be like? What ontology is implied by the claim that the four yogas are all equally effective paths to the supreme goal of religious life? What metaphysical conditions would enable this pluralistic assertion to be true? Swami Vivekananda’s worldview is frequently identified with (...) Advaita Vedānta. We shall see that Vivekananda’s teaching is certainly Advaitic in what could be called a broad sense. As Anantanand Rambachan and others, however, have pointed out, it would be incorrect to identify Swami Vivekananda’s teachings in any rigid or dogmatic sense with the classical Advaita Vedānta of Śaṅkara; this is because Vivekananda’s teaching departs from that of Śaṅkara in some significant ways, not least in his assertion of the independent salvific efficacy of the four yogas. This essay will argue that Swami Vivekananda’s pluralism, based on the concept of the four yogas, is far more akin to the deep religious pluralism that is advocated by contemporary philosophers of religion in the Whiteheadian tradition of process thought like David Ray Griffin and John Cobb, the classical Jain doctrines of relativity (anekāntavāda, nayavāda, and syādvāda), and, most especially, the Vijñāna Vedānta of Vivekananda’s guru, Sri Ramakrishna, than any of these approaches is to the Advaita Vedānta of Śaṅkara. Advaita Vedānta, in Vivekananda’s pluralistic worldview, becomes one valid conceptual matrix among many that bear the ability to support an efficacious path to liberation. This essay is intended not as an historical reconstruction of Vivekananda’s thought, so much as a constructive philosophical contribution to the ongoing scholarly conversations about both religious (and, more broadly, worldview) pluralism and the religious and philosophical legacies of both Sri Ramakrishna and Swami Vivekananda. The former conversation has arrived at something of an impasse (as recounted by Kenneth Rose), while the latter conversation has recently been revived, thanks to the work of Swami Medhananda (formerly Ayon Maharaj) and Arpita Mitra.
