The traditional theory of the just war comprises two sets of principles, one governing the resort to war ( jus ad bellum) and the other governing the conduct of war ( jus in bello). The two sets of principles are regarded, in Michael Walzer’s words, as “logically independent. It is perfectly possible for a just war to be fought unjustly and for an unjust war to be fought in strict accordance with the rules.”1 Let us say that those who fight (...) in a just war are “just combatants,” while those who fight in a war that is unjust because it lacks a just cause are “unjust combatants.” (A just cause is an aim that can contribute to the justification for war and that may permissibly be pursued by means of war.)2 The most important implication of the idea that jus in bello is independent of jus ad bellum is that.. Most people are skeptical of the claim that the expectation that a person would have a life that would be well worth living provides a reason to cause that person to exist. In this essay I argue that to cause such a person to exist would be to confer a benefit of a noncomparative kind and that there is a moral reason to bestow benefits of this kind. But this conclusion raises many problems, among which is that it must be (...) determined how the benefits conferred on people by causing them to exist weigh against comparable benefits conferred on existing people. In particular, might the reason to cause people to exist ever outweigh the reason to save the lives of existing people? (shrink)

According to liberal egalitarian morality, all human beings are one another's moral equals. Nonhuman animals, by contrast, are not considered to be our moral equals. This essay considers two challenges to the liberal egalitarian view. One is the ``separation problem,'' which is the challenge to identify a morally significant intrinsic difference between all human beings and all nonhuman animals. The other is the “equality problem,” which is to explain how all human beings can be morally equal when there are some (...) human beings whose psychological capacities are no higher than those of certain nonhuman animals. The focus throughout is on the ethics of killing but the arguments are of broader relevance. The essay reaches a skeptical conclusion about our ability to meet these challenges. (shrink)

A just cause for war is a type of wrong that may make those responsible for it morally liable to military attack as a means of preventing or rectifying it. This claim has implications that conflict with assumptions of the current theory of just war.

This paper explores the central question of why soldiers in democratic societies might decide to fight in wars that they may have reason to believe are objectively or questionably unjust. First, I provide a framework for understanding the dilemma caused by an unjust war and a soldier's competing moral obligations; namely, the obligations to self and state. Next, I address a few traditional key thoughts concerning soldiers and jus ad bellum. This is followed by an exploration of the unique and (...) contradicting moral problems that confront modern soldiers and their officers. I argue that although traditional positions such as invincible ignorance provide a rather dangerous ‘head-in-the-sand’ mentality, soldiers serving a democratic government are nonetheless very limited in their legal and moral ability to interpret what is a justifiable war. However, a very few select senior officers are in positions to make such legal and moral decisions concerning jus ad bellum. (shrink)

This paper explores the relevance of the Non-Identity Problem to explaining the wrongness of causing climate change.

This chapter is concerned with the necessity constraint on defensive harming. It first considers whether a defensive option that would cause more harm than some other equally effective option is ruled out as causing unnecessary harm. The chapter argues that it is not. It defends the view, nonetheless, that there is a sense of “necessary” and a sense of “proportionate” such that defensive liability is itself limited to necessary and proportionate harm. The remainder of the chapter defends the view that (...) necessity, effectiveness, and proportionality are all “internal” to liability—that is, that one cannot be liable to suffer harm that is unnecessary ineffective or disproportionate. Discussions of the morality of the Gulf War have tended to embrace the traditional theory of the just war uncritically and to apply its tenets in a mechanical and unimaginative fashion. We believe, by contrast, that careful reflection of the Gulf War reveals that certain principles of the traditional theory are oversimplifications that require considerable refinement. Our aims, therefore, are both practical and theoretical. We hope to contribute to a better understanding of the ethics both of war in general and (...) of the Gulf War in particular. (shrink)

Proportionality in the resort to war determines a limit to the amount of harm it can be permissible to cause for the sake of achieving a just cause. It seems to follow that if a war has caused harm up to that limit but has not achieved the just cause, it should be terminated. I argue, however, that this is a mistake. Judgments of proportionality are entirely prospective and harms suffered or inflicted in the past should in general be ignored. (...) Moral agents sometimes have to act on the basis of beliefs that are reasonable in the context but are in fact false. In these circumstances, agents often act in ways that would be right if their beliefs were true but that they would recognize as wrong if they could see that their beliefs were false. Sometimes our tendency is to think that what these agents do is justified – for example, in the case discussed by Ferzan in which one person, (...) Defender, kills another, Threatener, who has loaded one bullet into a revolver, spun the chambers, pointed the gun at Defender’s head, and started to squeeze the trigger.1 We think that Defender was justified in killing even if we discover that the chamber was in fact empty. (Let us refer to this as the ‘‘Roulette case.’’) We accept, however, that if Apparent Defender had known with certainty that the chamber was empty and that Apparent Threatener would (or could) have pulled the trigger only once, it would have been pointless and therefore wrong to kill her. Lucretius wrote: “Look back at the eternity that passed before we were born, and mark how utterly it counts to us as nothing. This paper sets out an account of hermeneutics as essentially ‘topological’ in character at the same time as it also argues that hermeneutics has a key role to play in making clear the nature of the topological. At the centre of the argument is the idea that place and understanding are intimately connected, that this is what determines the interconnection between topology and hermeneutics, and that this also implies an intimate belonging-together of place and thinking, of place and experience, of (...) place and the very possibility of appearance, of presence, of being. The aim of this essay is to show that there are no easy options for those who are disturbed by the suggestion that infanticide may on occasion be morally permissible. The belief that infanticide is always wrong is doubtfully compatible with a range of widely shared moral beliefs that underlie various commonly accepted practices. Any set of beliefs about the morality of abortion, infanticide and the killing of animals that is internally consistent and even minimally credible will therefore unavoidably contain (...) some beliefs that are counterintuitive. Derek Parfit, who died in 2017, is widely believed to have been the best moral philosopher in well over a century. The twenty new essays in this book were written in his honour and have all been inspired by his work - in particular, his work in an area of moral philosophy known as 'population ethics', which is concerned with moral issues raised by causing people to exist. Until Parfit began writing about these issues in the 1970s, there was almost (...) no discussion of them in the entire history of philosophy. But his monumental book 'Reasons and Persons' (1984) revealed that population ethics abounds in deep and intractable problems and paradoxes that not only challenge all the major moral theories but also threaten to undermine many important common-sense moral beliefs. Some of the questions Professor Miller addresses are concerned with proportionality, a notion whose complexities are only beginning to be appreciated. My modest ambition in this comment is to try to sharpen these questions and provide some assistance in thinking about them.

Resolves the fundamental debate between cognitivists and social constructionists concerning the metaphysics of human psychology, and offers new insights into therapy, education, and creativity.

This chapter attempts to examine nostalgia as both a mood or disposition in general, and as a mood or disposition that is characteristic of philosophical reflection. Nostalgia is a combination of the Greek nostos, meaning home or the return home, with algos, meaning pain, so that its literal meaning is a pain associated with the return home. Part of this inquiry will involve a rethinking of the mood of nostalgia and what that mood encompasses. Rather than understand the nostalgic as (...) characterized solely by the desire to return to a halcyon past, it is explored through the connotations suggested by its Greek etymology as precisely a longing for the return home—a return that cannot be achieved—a form of homesickness, and so as unsettling rather than comfortable, as bringing with it a sense of the essential questionability of our own being in the world. Most of us agree that terrorism is always, or almost always, wrong, which is hardly surprising, since the word is generally used to express disapproval. If an act of which we approve has features characteristic of terrorism, we will be careful to deny that it is in fact an act of terrorism. For example, those who believe that the bombings of Hiroshima and Nagasaki were morally justified tend to deny that they were instances of terrorism. So while we agree that (...) terrorism is almost always wrong, we sometimes disagree about what it is we are condemning. To avoid misunderstanding, I will say at the outset what I understand terrorism to be. Acts of terrorism are intentional efforts to kill or seriously harm innocent people as a means of affecting other members of a group with which the immediate victims are identified.1 Usually the aim is to terrorize and intimidate the other members as a means of achieving some political or broadly ideological goal, though the aim might be different: it might, for example, be to punish or achieve vengeance against the group as a whole. Although the group against which terrorism is directed is usually political in nature, it need not be. It might, for example, be the group of doctors who perform abortions. Because the term `terrorism' is normatively loaded and therefore tends to be used by people to describe their enemies whatever their enemies may do, there is no definition that can capture all the many ways in which the term is ordinarily used. The United Nations Charter prohibits states to use force against other states except in ‘individual or collective self-defence if an armed attack occurs’.1 In the past, it may have seemed reasonable to insist that permissible defence must await the actual occurrence of an armed attack. Because war is usually disastrous for all concerned and to be avoided if at all possible, and because successful defence has often been at least possible against a military attack, it may not be imprudent for (...) a state threatened with attack by another state to make every effort to avoid war by diplomatic means and thus to defer military action until its adversary actually strikes the first blow. It is also possible to deter the attack by threatening the potential aggressor both with military defeat and with the destruction, if war occurs, of assets that the aggressor values – for example, in the case of a tyrannical regime, military assets on which it depends for control of its own population. Although often taken to lie at the very heart of philosophical inquiry, metaphysics has, at least since the time of Hume and Kant, frequently been surrounded by uncertainty and doubt as to its nature, possibility, and significance. The dominance of idealist philosophy in the late nineteenth century, and the reaction against it in the early twentieth, was often seen in terms of the dominance and subsequent decline of metaphysical styles of thought. Indeed, during the first half of the twentieth century (...) “metaphysics” seemed to have become, in many quarters, an almost entirely pejorative term. Yet if the first half of the century was, within the English-speaking world, largely antimetaphysical, the second half of the century, and especially the last thirty years or so, has been much more favorable to metaphysical thinking. This has been partly a result of the increasing importance of cognitive science and the philosophy of mind within contemporary philosophical thinking; it has also been a consequence of new developments in logic, especially modal logic; and it has been given additional impetus by the resurgence of interest in past philosophers, and so also in the metaphysical systems that they developed—Descartes, Spinoza, Berkeley, Locke, and Reid have all seen something of a renaissance over recent years and so has their metaphysics. Within contemporary English-speaking, “analytical” philosophy, then, metaphysics would seem to be alive and well. (shrink)
