In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. Medical decision making on behalf of unrepresented patients is one of the most challenging ethical issues faced in clinical practice. The legal environment surrounding these patients is equally complex. This article describes the efforts of a small coalition of interested healthcare professionals to address the issue in Colorado. A brief history of the effort is presented, along with discussion of the legal, ethical, practical, and political dimensions that arose in Colorado’s effort to address decision making for unrepresented patients through an (...) extension of the existing Colorado Medical Treatment Decision Act (CRS 15-18). It may be possible, one day, to use gene therapy to treat diseases whose genetic defects have been discerned. Because many genes responsible for inherited eye disorders within the retina have been identified, diseases of the eye are prime candidates for this form of therapy. The eye also has the advantage of being highly accessible with altered immunological properties, important considerations for easy delivery of virus and avoidance of systemic immune responses. Currently, adenovirus, adeno‐associated virus and lentivirus have been used (...) to successfully transfer genetic material to retinal pigment epithelium and photoreceptor cells. By harnessing therapeutic genes to these viruses, researchers have been able to demonstrate rescue in rodent models of retinitis pigmentosa, providing evidence that this form of therapy can be effective in delaying photoreceptor cell death. Future challenges include confirming therapeutic effects in animal models with eyes more anatomically similar to those of humans and demonstrating long‐term rescue with minimal toxicity. The views of Kierkegaard, Nietzsche, Jaspers, Heidegger, Ortega y Gasset, Sartre, Marcel, and Merleau-Ponty are briefly reviewed. In the course of discussion, the relation of the phenomenological existentialists to the others is also considered. In other words, it is about what happens when texts behave like images. In what follows I examine a series of philosophical contexts where this question appears to be (...) at issue. I claim that one way of understanding what’s going on in these contexts is that here the image-form of a text becomes a kind of icon. I begin by reflecting on a prejudice that belongs, according to Heidegger, to the “history of metaphysics”: the notion that it would be better, clearer, and less ambiguous to replace all reliance on images with self-effacing, transparent words. My goal here is to demonstrate the existence of an alternative historical trend that defends an opposite view. I compare a defense of iconography by Byzantine patriarch Nikephoros of Constantinople, as well as the Neoplatonist Porphyry’s commentary on Aristotle’s Categories, with works by two latter-day Heideggerians, Jacques Derrida and Jean-Luc Marion, who respond to the inherited problematic of non-referential, iconic texts. These responses suggest that non-semantic image-creation, as much as non-semantic verbal play, is the pre-conceptual condition of conceptuality. This essay presents a new way of understanding the philosophical issues that connect ancient and medieval discussions about icons and images with twentieth-century concerns about language.In her study of medieval European manuscript illumination, Animating the Letter (1999), Laura Kendrick emphasizes the non-semantic character of illuminated texts. Kendrick argues that the basic distinction between text and image is fundamentally at stake in illumination, and that the distinction is inherited from the Christian church fathers who opposed text and image, privileging the former and denigrating the latter. According to this traditional view, texts are better suited than images to a consideration of the divine on account of writing’s ethereal quality, its “transparency,” which leads the reader beyond the material sign to the immaterial concept. The problem with images, on the other hand, is their materiality, which may lead viewers down a dark path toward an ultimately heretical veneration for the mere image instead of for its referent. It seems to me that we find in Kendrick’s argument an exact homology with the discourse on the icon in the Byzantine Christian church. Emperor Constantine V, for instance, at the time of the “first iconoclast crisis” (the mid-eighth century CE), expresses wariness about the potentially heterodox metaphysics underpinning iconophilia. He objects to icons on the basis that their veneration would be acceptable only if the icon were to share the essence of that of which it is an icon (God), but that this is impossible; infinite divine nature cannot be encompassed within the finite line of human composition. The Byzantine iconophile’s response to this objection is not to deny the infinite, uncircumscribable nature of God, but to affirm that the icon, bound though it is to the register of images, nevertheless does not function in the same manner as an ordinary image. That is, the icon does not refer to its model by means of resemblance alone. In the language of Nikephoros of Constantinople (758–828 CE), the character of the icon consists in consubstantiality (homoousia) prior to resemblance (homoiōsis).1 [End Page 27]The problem of the limits of reference unites the discourse on the icon and the flourishing of the illuminated text. ABSTRACT: How can we think about a universal ethics that could be adopted by any intelligent being, including the rising population of cyborgs, intelligent machines, intelligent algorithms or even potential extraterrestrial life? We generally give value to complex structures, to objects resulting from a long work, to systems with many elements and with many links finely adjusted. These include living beings, books, works of art or scientific theories. Intuitively, we want to keep, multiply, and share such structures, as well as (...) prevent their destruction. Such objects have value not because more information would simply mean more value. Instead, they have value because they require a long computational history, numerous interactions for their construction that we can assimilate to a computation, and they display what we call organized complexity. To propose the foundations of a universal ethics based on the intrinsic value of organized complexity, we first discuss conceptions of complexity, and argue that Charles Bennett’s logical depth is certainly a first approximation of what we are looking for. We then put forward three fundamental imperatives: to preserve, augment and recursively promote organized complexity. We show a broad range of applications with human, non-human and non-living examples. Finally, we discuss some specific issues of our framework such as the distribution of complexity, of managing copies and erasures, and how our universal ethics tackles classical ethical issues. In sum, we propose a clear, homogenous and consistent ethical foundation that can integrate many universal ethics desiderata. (shrink)

In 2013, Bennett proposed a mereological theory in which the parthood relation is defined on the basis of two primitive relations: a is a part of b iff a fills a slot owned by b. However, this theory has issues counting how many parts an entity has. We explore the various counting problems and propose a new theory to solve them. Keeping the core idea of Bennett’s slots, this theory introduces mereological relations between slots. This theory enables us (...) to solve all known counting problems and to go beyond the limits of Bennett’s theory by theorising expected features of mereological theories: supplementation principles and mereological sum and fusion. Official texts and articles from the mainstream and professional media all highlight this rejection of the heavy-handed approach and extol the new pedagogy. If we put aside these printed sources and explore archives such as inspection reports, activity reports, records of both employees and the young people, we can see the discrepancy between actual practices and the new standards promoted by the authorities. The author (...) carried out the study at the Chanteloup correctional boarding school, the young offenders’ centre most likely to reject “educational violence”. Expert-informed public policy often depends on a degree of public trust in the relevant expert authorities. But if lay citizens are not themselves authorities on the relevant area of expertise, how can they make good judgements about the trustworthiness of those who claim such authority? I argue that the answer to this question depends on the kind of trust under consideration. Specifically, I maintain that a distinction between epistemic trust and recommendation trust has consequences for novices judging the trustworthiness of (...) experts. I argue for this by identifying the unique difficulties that emerge when a novice is asked not just to believe expert testimony, but to follow expert recommendations. I outline criteria for novice judgements of expert trustworthiness that have been proposed by Elizabeth Anderson and show that novel problems emerge for her criteria when we shift focus from epistemic trust to recommendation trust. More is needed when we are asked not just to believe the experts but to act as they recommend, because novices looking for trustworthy expert recommendations need to establish whether the recommended course of action supports what is important to them and accords with their values. In pursuit of a theory of expressive reasons, I focus on the practical rationality of actions such as welcoming, thanking, congratulating, saluting – I label them ‘expressive actions.’ How should we understand the kinds of practical reasons that count in favour of expressive actions? This question is related to the question of how to understand non-instrumental fittingness-type reasons for emotion. Expressive actions often are and should be expressions of emotion. It seems to be an important feature of such actions that (...) the reasons that count in favour of the action are entangled with reasons of fittingness that count in favour of the relevantly connected emotion. But how should we understand this entanglement? I argue that the relevant category of reasons cannot be captured on approaches standard in normative theory. I develop a theory of sui generis expressive reasons. I argue that we have reason to perform actions that mark certain situations that contain some significant value or disvalue, independently of any reason to alter those situations. This is the role of expressive actions. Sui generis reasons for expressive actions are entangled with reasons for relevantly connected emotions because (some) emotions have the same role of marking extraordinary situations. (shrink)

In this essay, I draw out some implications of a position called “Wittgensteinian Quasi-Fideism” for the theory and practice of interreligious communication. After setting out the main tenets of that position, I articulate what its theoretical and practical implications in this area would be if it were true. I thereby sketch a new, Wittgensteinian model of interreligious communication, concluding with a number of suggestions as to some points of focus for further work in this area.

Problem: While the elaboration and framing of constructivist epistemologies in keeping with the “currents of contemporary scientific epistemology” can be attributed to Jean Piaget, their development under the banner of radical constructivist epistemology is a result of the epistemological work of Ernst von Glasersfeld. The development of this epistemological paradigm, pursued over the last 40 years with the objective of “linking knowledge to action and situating the subject and the object on the same, multiple levels,” warrants further exploration and (...) contextualization within the framework of current scientific activity. Results: In what amounts to a historical coincidence, von Glasersfeld discovered the work of Piaget in 1973, the same year that the author of this article first began to read Piaget’s Epistemological Studies; this coincidence provides a starting point for describing the epistemological itinerary that led the author from a reading of Piaget in 1973 to a somewhat tardy reading of von Glasersfeld in 1988 (the same year of the translation of his “Introduction to Radical Constructivism” into French). He then explicates the subsequent developments of this paradigmatic conjunction over the last 30 years, interpreting them in the contexts of contemporary developments of scientific and operational interdisciplinarity as well as in terms of historical roots extending from Leonardo da Vinci to Paul Valéry. Implications: The paradigm of constructivist epistemologies (working from a phenomenologically-based gnoseological hypothesis) can be presented and supported with arguments that are at least as solid and legitimate as those invoked in favor of alternative paradigms of realist and post-positivist epistemologies (working from an ontologically-based gnoseological hypothesis). Recent writing on the expression of emotion has explored the idea that there is a symbolic dimension to many “expressive actions.” This paper aims to situate and better understand the “symbolic expression” account by exploring its position in a framework of views from the history of philosophy regarding emotion, action out of emotion, and their place in the good human life. The paper discusses a number of competing views that can be found in this tradition, ranging from irrationalism, through irenicism, (...) self‐externalization, and cognitivism to the symbolist tradition itself. In looking specifically at the roots of symbolism, the paper departs from the common view that Aristotelianism is the central tradition, for us, of thinking about philosophy of the emotions. It suggests that we can get a better grip on the source of these ideas by looking rather at how thinkers in the post‐Kantian and Romantic tradition wrestled with the question of the freedom and rationality of behaviour out of emotion. Critically engaging with thinkers including Slavoj Zizek, Alain Badiou, Catherine Malabou, Jean-Claude Milner, Martin Hagglund, William Connolly and Jane Bennett, Johnston formulates a materialist and naturalist account of subjectivity that does full justice to human beings as irreducible to natural matter alone.

Kalevi Kull’s target article importantly rejects the argument from biological aesthetics, that beauty is a product of natural selection. Instead, beauty is a reflection of the ongoing diversity of free semiotic choosing and fitting. From this view, biosemiotic aesthetics could become the semiotic branch par excellence, in its theorization of the origins of what has always been the central interest of general semiotics. The narrow argument about sexual selection is couched inside the broader ambition to establish a biological but nonreductive (...) definition and scope for aesthetics itself. One of the most important services biosemiotics can provide to the larger community is to bestow upon it some really unifying general principles applicable to all branches of semiotics, and the theory of biosemiotic aesthetics promises to do just this. General semiotics may later adopt some of Kull’s present theorization and apply it to the textual concerns which Kull prefers to consign to other specialists. (shrink)

Nevil Maskelyne, the Cambridge-trained mathematician and later Astronomer Royal, was appointed by the Royal Society to observe the 1761 transit of Venus from the Atlantic island of St Helena, assisted by the mathematical practitioner Robert Waddington. Both had experience of measurement and computation within astronomy and they decided to put their outward and return voyages to a further use by trying out the method of finding longitude at sea by lunar distances. The manuscript and printed records they generated in this (...) activity are complemented by the traditional logs and journals kept by the ships’ officers. Together these records show how the mathematicians came to engage with the navigational practices that were already part of shipboard routine and how their experience affected the development of the methods that Maskelyne and Waddington would separately promote on their return. The expedition to St Helena, in particular the part played by Maskelyne, has long been regarded as pivotal to the introduction of the lunar method to British seamen and to the establishment of theNautical Almanac. This study enriches our understanding of the episode by pointing to the significant role played by the established navigational competence among officers of the East India Company. (shrink)

This article investigates the place that habit occupies in different ‘architectures of the person’, focusing particularly on constructions of the relations between habit and other components of personhood that are marked by time. Three such positions are examined: first, the relations between thought, will, memory, habit and instinct proposed by post-Darwinian accounts of ‘organic memory’; second, Henri Bergson’s account of the relations between habit, memory and becoming; and, third, the temporal aspects of Pierre Bourdieu’s concept of habitus understood as a (...) set of hereditable dispositions. These different ‘architectures of the person’ are considered with regard to the role they accord habit in trans-generational mechanisms of inheritance; the historicised forms of embodied personhood that they propose; and the manner in which they account for the emergence of a capacity for freedom that can (partially) offset the weight of the inherited past. It is argued that the imputation of such a capacity to some forms of personhood, but not others, is both shaped by and provides the conditions for the operation of liberal forms of government. The manner in which the conduct of those who exhibit such a capacity for freedom is brought under the direction of varied ‘authorities of freedom’ is given particular consideration. (shrink)

Datafication of social life affects what society regards as knowledge. Jasanoff’s regimes of sight framework provides three ideal-type models of authorised knowing in environmental data practice. This paper applies Jasanoff's framework for analysing intelligence practice through an exploratory empirical study of crime and intelligence practitioners in a selection of police services in Australia, New Zealand, Canada and the United States. The paper argues that the ‘view from somewhere’ captures the essence of existing police intelligence practices in the four countries but (...) the ‘view from nowhere’ is emerging as a possible future for police intelligence – an approach promoted by technology companies and supported mainly by police leaders and managers. The paper investigates the challenges and limits of a shift by police from VFS to VFN in the production of intelligence; the challenges are primarily political, which threaten the dominance of police contextual knowledge over ‘scientific’ knowledge. These political challenges also have symbolic and material implications. The paper concludes that, because of these challenges, a complete shift from VFS to VFN is not likely to happen. At best the two models might co-exist with the latter subordinate to the imperatives of the former, resulting in further tension between sworn officers and civilians, organisational inertia, as well as technologies that may be under-utilised or abandoned. Parues pour la premiere fois en 1938, les Etudes kierkegaardiennes de Jean Wahl constitutent a tous egards une somme incontournable pour comprendre le sens de la philosophie de Kierkegaard et la place si originale qu'elle occupe dans l'histoire de la philosophie. L'auteur s'efforce d'y faire apparaitre le lien existant entre les evenements qui marquerent la vie de Kierkegaard et la formation de ses concepts fondamentaux. L'auteur montre enfin que la theorie des trois stades de la croyance et de l'existence qui lui sont liees sont inseparables d'une lutte entreprise contre les pensees qui contribuerent a la genese de la pensee de Kierkegaard et qu'il s'agit a present pour lui de depasser: il n'y a pas de chemin qui conduit de la pensee, du cogito, a l'etre, au sum, car l'existence est l'etre hors de toute pensee. In 1982-83, I was preparing my volume on the Belgian cartoonist Hergé. During the Second World War, Hergé’s comic strips appeared daily in the newspaper Le Soir. Since I wanted to analyze the influence of the rightist thought on Hergé and Tintin, I borrowed most of the copies of Le Soir available in this country through interlibrary loan. Examining the newspaper, I came across Paul de Man’s articles, which were sometimes on the same page as the comic strips. I showed (...) these articles to some colleagues related to or teaching at Harvard University. I specifically recall an afternoon with a colleague from Boston University whose specialty is the hunting of presumed French fascist intellectuals; we discussed together the possible bridges between de Man’s contemporary thought and his former intellectual engagement during the Second World War.That is to say that, as far as I know, several people at Harvard and in the Boston area were aware of de Man’s former affiliation with rightist circles. One can ask why it took five more years for the “scandal” to appear: why this “sudden” revelation after several years of silence and dissimulation? Compared to the fact that Hergé had constantly been confronted with his political past, one can wonder how strongly Paul de Man’s “secret” was kept. Cloth, $69.95.The status of a "great" philosopher is to stand out for centuries, asking questions in such a way that the answers can never be definitive. Not so many of them are able to stand such a severe (...) proof. Aristotle phrased some questions we are still groping to answer. It was a very good idea to ask thirteen scholars to deliver a lecture series at the Catholic University of America during the Fall 1999 about the reception of Aristotle's theory of intellectual virtues (Nich. Ethics VI). The speakers did not stick to this issue, and enlarged their purpose to a general approach of Aristotle's receptions in various moments of Western modern philosophy.Edward Mahoney complements Charles Schmitt's basic introduction to Aristotle and the Renaissance, with some very valuable pages about Cardinal Bessarion's contribution to the Byzantine debate aroused in 1439 by Plethon's comparison between Plato and Aristotle (in favor of the former). Along with Charles Schmitt, Antonino Poppi is the best specialist of the Paduan tradition, and wrote a very qualified paper about Zabarella (1533-89), who shaped Aristotelianism into the rigorous science of the schoolbooks: for centuries, Aristotle is read through Zabarella's glasses. Apart from a bird's view on recent Galilean studies (where Alistair Crombie is not mentioned), William A. Wallace makes his point about Aristotle's influence on Galilean logics, linking Galileo's 1640 letter to Liceti (where he states that, in matters of logic, he has been an Aristotelian all his life) to the scientist's deep knowledge as revealed by the logical questions in one of the juvenile treatises (ms 27 in Florence, more thoroughly studied in Wallace's book, Galileo's Logic of Discovery and Proof [Dordrecht, 1992]). John Doyle, a specialist of Late Scholastic Philosophy, figures out a [End Page 209] strange character, the French Jesuit André Semery (1630-1717), who taught for thirty years at the Collegium romanum. In a very anti-Aristotelian way, he holds a definite belief in metaphysical beings of reason. The boundary between what we can think and say is quietly stepped over, when Semery and other Jesuits begin to think about thinking, opening a very modern path which leads to Brentano and Quine. Christia Mercer states that Leibniz's combination of a Platonist epistemology with an Aristotelian conception of nature brings a very innovative view in ethics. A very forceful paper by Richard L. Velkley compares Rousseau's politics to Aristotle's view of man (the paper became a chapter of his 2002 impressive book Being after Rousseau), while Riccardo Pozzo gives a short presentation of Aristotle's reception in modern Germany, and an elaborate analysis of Kant's debt to Aristotle for the intellectual virtues. Hegel's appropriation of Aristotelian intellect is presented by Alfredo Ferrarin, while Michael Davis reconstructs Nietzsche's path from Aristotle to the tragedy and back, in a very convincing way. Husserl (Richard Cobb-Stevens), Heidegger (Stanley Rosen), Wittgenstein (Daniel Dahlstrom) and Gadamer (Enrico Berti) conclude brilliantly the series, showing how the thought of the Stagirite fertilized contemporary philosophers, in a permanent dialogue of disagreement or borrowing, never at rest, and never leaving anyone indifferent.
