The legal consensus that has evolved through adjudication and legislation since the Karen Quinlan case in 1976 is founded on the premise that there is a bright line between passive euthanasia and active euthanasia. Indeed, the term passive euthanasia is often eschewed in favor of less emotionally-laden terminology such as "forgoing life-sustaining treatment" or "terminating life support" so as to further sever any possible connection with active euthanasia. Legal approval has been bestowed upon passive euthanasia under certain circumstances while active (...) euthanasia is routinely condemned. This consensus was put to a test in 1990 when the United States Supreme Court ruled on the Cruzan case. However, the Court's narrow decision did not upset the consensus, and in the most significant appellate decisions handed down by state courts since Cruzan, there has been a reaffirmation-and possibly even an extension-of the consensus. Two other threats to the legal consensus about forgoing life-sustaining treatment have begun to manifest themselves: the increasing pressure for mercy killing and "futility" cases. Both of these challenge the fundamental premises on which the consensus is grounded. (shrink)

Mrs. F, seventy‐five, was diagnosed with Alzheimer's. She and her spouse often discussed how to handle the progression of the disease. She was adamant about not coming to the point where she would be unable to recognize herself, her husband, or their son and daughter. The manner she chose was voluntarily stopping eating and drinking (VSED), and she chose a specific date on which to carry out her plan. She asked her husband to promise, should she ever waver and request (...) nutrition or hydration, to remind her of the reasons she had chosen for pursuing this path.Mrs. F's ability to function was beginning to wax and wane. Sometimes she was her old self, and sometimes she had no recollection of her past identity. After she voluntarily stopped eating and drinking, the couple's promise created a dilemma for her professional caregivers. She asked for food and drink. Her husband and family reminded her of the reasons she had chosen VSED: “Remember, you didn't want to live in a nursing home, and you didn't want us to be responsible for caring for you at home. You believe that stopping eating and drinking will allow you to die with dignity.” Although they also asked Mrs. F, “What do you want to do?” the family asked the professional caregivers to respect her original choice to stop eating and drinking. Mrs. F still evidenced decision‐making capacity but often did not recall having chosen VSED. She again requested food and drink, from family and the professional caregivers.Can VSED be carried out for a patient whose advanced dementia makes disciplined voluntary action difficult? (shrink)

This paper describes the first three-year experience of the Consortium Ethics Program (CEP-1) of the University of Pittsburgh Center for Medical Ethics, and also outlines plans for the second three-year phase (CEP-2) of this experiment in continuing ethics education. In existence since 1990, the CEP has the primary goal of creating a cost-effective, permanent ethics resource network, by utilizing the educational resources of a university bioethics center and the practical expertise of a regional hospital council. The CEP's conception and specific (...) components stem from recognition of the need to make each hospital a major focus of educational efforts, and to provide academic support for the in-house activities of the representatives from each institution. : In 2000, the Romanian journal Paideia published a series of essays to commemorate the fiftieth anniversary of the death of John Dewey. Three articles--by Peter Hlebowitsh, then the editor of Education and Culture; Daniel Tanner, then the president of the John Dewey Society; and William Schubert, past president of the JDS-- were prepared and translated into Romanian for publication. Paideia editor Nicolae Sacalis has contributed an article describing Dewey's influence in Romania. In "The Writings of John Dewey in Romania: (...) Policy and Pedagogy," Sacalis describes the interest in pragmatism of the Romanian intellectuals of the 1920s and 1930s and how Dewey's writings became important to the government's education leaders and school practitioners. Dewey's popularity was so great that a comprehensive overview of his work was published to honor and acknowledge his eightieth birthday. The writings of Dewey were silenced thereafter but not forgotten. His works reappeared in the 1970s for a new generation of Romanian educators, and since the 1989 revolution, his writings have received even greater popularity, leading to the commemoration of his death by Paideia. Beauchamp (bio)It would be hard to overestimate the importance of two decisions on physician-assisted suicide delivered recently by the Ninth and Second Circuit Courts (Compassion in Dying v. State of Washington, 79 F.3d 790 (9th Cir. 1996) (en banc), aff’g 850 F.Supp. 1454 (W.D. Wash. 1994), rev’g 49 F.3d 586 (9th Cir. 1995); Quill v. Vacco, 80 F.3d 716 (2nd Cir. (...) 1996). They are the highest courts yet to render an opinion on this subject, and their decisions have set the stage for the U.S. Supreme Court to take one of two paths: It will either say that (1) all citizens have a liberty interest in physician-assisted suicide, or that (2) each state may set its own policy on such matters. Whichever path is elected, a right to request physician-assisted suicide is a virtual certainty, at least in some states.These opinions are later segments of an evolving legal history in which courts have held that no criminal liability exists for withholding or withdrawing a life-sustaining treatment when physicians are directed to do so by a patient or an authorized surrogate (see Alan Meisel 1992). The decriminalization of suicide and the right to refuse a life-sustaining treatment now appear to be evolving into a rule that a patient has a legal right to control his or her death, or at least to obtain a lethal prescription. We are at a delicate point in this evolving history. Neither in law nor in bioethics is the justification of physician assistance in suicide the received opinion at the present time, but support for physician assistance in dying could soon become the received opinion in both disciplines.The leading edge of the wedge producing these changes has been widespread acceptance of an extensive right to refuse treatment. This right is today axiomatic in even conservative quarters of bioethics, but 20 years ago it was far from axiomatic that all patients have a right to refuse treatment. Few at that time judged that it would be both immoral and illegal for a physician not to forgo treatment in the face of a competent, authoritative refusal of any form of medical service or treatment.The justification for assistance in bringing about death in medicine is an extension of the justification for letting patients die. Letting a patient die by accepting a valid refusal to continue in life is directly analogous to helping a patient die by accepting a valid request for help. The high value we place on [End Page 371] rights of autonomy thereby spills over from the right to refuse to the underexplored right to request active assistance. 1 As the autonomy interest in this choice increases, denial of help to the patient becomes more burdensome.Those who defend the view that euthanasia and physician-assisted suicide are morally prohibited typically assume that assistance involves an act of killing, that acts of killing are impermissible, and that a defensible distinction exists between killing and letting die. However, this distinction has proved difficult to explicate, and the category of killing often seems distant from the problem at hand. For example, it is an eccentric view that a physician who prescribes a lethal medication to a patient thereby kills the patient (or, for that matter, lets the patient die) when the patient voluntarily ingests the medication and dies. So poor are the conceptual understandings of “killing” and “letting die” that conceptual confusion abounds as to which term to use in almost all morally difficult and controversial cases.A common view is that “letting die” is a matter of “ceasing useless treatments” after which patients die (Gaylin, Kass, Pellegrino, and Siegler 1988). This account is attractive, but too narrow. “Letting die” occurs in medicine under at least two circumstances: cessation of treatment because it is useless and cessation of treatment because it has been refused (which can occur even with useful treatments). Neither conceptually nor morally is “ceasing useless treatment” the proper way to state the condition under which many “letting-die” cases occur. As regards logical questions, the central thesis of Wittgenstein's later philosophy is well known, both from the earlier posthumous volume and from the writings of his many disciples. In the Investigations the thesis is applied to the "logic of our expressions" in everyday contexts; here he discusses in the same spirit the more specialized language (...) used in talking about the foundations of mathematics. The Meno problem is explained and related to the swamping problem as discussed by Jonathan Kvanvig. The stance of virtue epistemologists is outlined. When communal sharing relationships suddenly intensify, people experience an emotion that English speakers may label, depending on context, “moved,” “touched,” “heart-warming,” “nostalgia,” “patriotism,” or “rapture”. We call the emotion kama muta. Kama muta evokes adaptive motives to devote and commit to the CSRs that are fundamental to social life. It occurs in diverse contexts and appears to be pervasive across cultures and throughout history, while people experience it with reference to its cultural and contextual meanings. Cultures have evolved diverse practices, (...) institutions, roles, narratives, arts, and artifacts whose core function is to evoke kama muta. Kama muta mediates much of human sociality. (shrink)

Hans Reichenbach was a formidable figure in early-twentieth-century philosophy of science. Educated in Germany, he was influential in establishing the so-called Berlin Circle, a companion group to the Vienna Circle founded by his colleague Rudolph Carnap. The movement they founded—usually known as "logical positivism," although it is more precisely known as "scientific philosophy" or "logical empiricism"—was a form of epistemology that privileged scientific over metaphysical truths. Reichenbach, like other young philosophers of the exact sciences of his generation, was deeply impressed (...) by the far-reaching changes in physics brought about by Einstein's special and general theories of relativity. Reichenbach responded to scientific advances by doing fundamental work in space-time theories, in quantum mechanics, in statistical mechanics, and in the development of probability theory—making him the most important philosopher of physics in the first generation of logical empiricism. Forced from his academic position by the Nazi race laws in 1933, Reichenbach wrote _Experience and Prediction_ at the University of Istanbul, where had had fled, expressly to introduce logical positivism to English speakers. In the two decades following World War II, during the explosion of scientific advances in North America, logical positivism was the reigning theory of the philosophy of science and Reichenbach was at the peak of his career. But, inevitably, support for logical positivism began to wane as it became obvious that the justification of scientific theories could not be entirely resolved by relying on strictly formal, technical processes. The growth of the discipline of the history of philosophy of science, which has created an audience of scholars eager for seminal classics in scientific philosophy, and the evidence supporting a historicist paradigm within logical positivism are two important reasons to make _Experience and Prediction_ available once again. Although best known for the hugely influential Anarchy, State and Utopia, Robert Nozick eschewed the label 'political philosopher' because the vast majority of his writings and attention have focused on other areas. Indeed the breadth of Nozick's work is perhaps greater than that of any other contemporary philosopher. Bertrand Russell has played a central role in the development of modern western philosophy, especially analytic philosophy. An appreciation of the main themes and arguments of the thinkers who contributed to this modern movement in philosophy must include references to and analyses of Russell’s important contributions. It would seem that many do recognize the significance of his thought and have shown this in a somewhat dramatic manner. Russell’s Google number, for instance, is about 2.35 million. If the number of entries (...) listed in this search engine is any indication of the level of interest online in Russell, we can surely conclude that the thought and life of this aristocratic English philosopher, logician and humanist still captures the imagination of tens of thousands, if not millions around the globe – even some thirty-seven years after his death. This serves as an introduction to a debate between Hans Kelsen and Otto Bauer concerning the nature and relative autonomy of the state, and the theories that informed the political practices of the Austro-Marxists and of the SDAP (Austrian Social Democratic Workers’ Party) immediately after the fall of the monarchy and during the early years of the First Republic. Both pieces (translated below) were published in Der Kampf ( The Campaign), the SDAP’s theoretical journal, in which many key texts of (...) Austro-Marxist thought appeared. The debate is of theoretical interest, particularly with respect to Marxist state theory, but is potentially also of renewed relevance to an age of post-GFC (Global Financial Crisis) austerity.
