We provide a new wrinkle to the Argument from Unfair Advantage, a rather popular one in the ethics of doping in sports discussions. But we add a new argument that we believe places the moral burden on those who favor doping in sports. We also defend our position against some important concerns that might be raised against it. In the end, we argue that for the time being, doping in sports ought to be banned until it can be demonstrated that (...) our concerns can be satisfied. (shrink)

This article examines the nonhistoricist higher-order compatibilist theory of moral responsibility devised and defended by Harry G. Frankfurt. Intuitions about certain kinds of cases of moral responsibility cast significant doubt on the wide irrelevancy clause of the nonhistoricist feature of Frankfurt’s theory. It will be argued that, while the questions of the nature and ascription of moral responsibility must be separated in doing moral responsibility theory, the questions of whether or not and the extent to which an agent is morally (...) responsible for performing certain kinds of actions cannot be settled without also answering the question of the history of that agent’s attitudes, preferences, etc. which may have contributed to the agent’s performing such actions. Thus Frankfurt’s repeated claim that the history of an agent’s action is “irrelevant” to the question of that agent’s moral responsibility for it is rendered dubious, thereby rendering problematic the strongly nonhistoricist component of his theory. The methodological difference between my challenge to Frankfurt’s nonhistoricism and those of others is that, while others have challenged Frankfurt’s nonhistoriciams by way of thought experiments involving hyper-manipulation, mine presents a set of counter-examples to his nonhistoricism which emanate from morality and the law. Indeed, if my counter-example is plausible, then Frankfurt’s nonhistoricism cannot make good sense of some standard instances of racism. Furthermore, while many believe that racist hate crimes ought to be punished more heavily than crimes committed absent hate, the argument herein provides reasons for mitigating, rather than increasing, the responsibility and punishments of many such crimes. What matters in such cases is the extent to which the hatred accompanying said crimes has a history in the agent’s life, one which makes it significantly difficult for her to do other than what she did in committing the racist crime. Professor Keith Lehrer has recently argued for what this author shall refer to as his “preference compatibilism,” according to which, among other things, knowledge of S’s preferences is what a counterfactual intervener uses to decide when S will depart from the counterfactual intervener’s plan. Lehrer assumes, among other things, Harry G. Frankfurt’s notion of “effective wants,” which are what Lehrer calls “preferences that reveal themselves in choice given the opportunity to act”. While the author here generally concurs with Lehrer’s preference (...) compatibilism, he shall make some suggestions with the intention of increasing its plausibility even further, especially with regard to its conception of free will when it is considered in light of certain matters of philosophy of law in particular and the ethics of responsibility more generally. If affirmative action and other ethnicity-based social programs are justified, then J. Angelo Corlett believes it is important to come to an adequate understanding of the nature of ethnicity in general and ethnic group membership in particular. In Race, Racism, and Reparations, Corlett reconceptualizes traditional ideas of race in terms of ethnicity. As he makes clear, the answers to the questions "What is a Native American?" or "What is a Latino?" have important implications for public policy, especially (...) for those programs designed to address historic injustices and economic and social imbalances among different groups in our society. Having supplanted "race" with a well-defined concept of ethnicity, the author then analyzes the nature and function of racism. Corlett argues for a notion of racism that must encompass not only racist beliefs but also racist actions, omissions, and attempted actions. His aim is to craft a definition of racism that will prove useful in legal and public policy contexts. Corlett places special emphasis on the broad questions of whether reparations for ethnic groups are desirable and what forms those reparations should take: land, money, social programs? He addresses the need for differential affirmative action programs and reparations policies—the experiences of different ethnic groups vary greatly. Arguments for reparations to Native and African Americans are considered in light of a variety of objections that are or might be raised against them. Corlett articulates and critically analyzes a number of possible proposals for reparations. (shrink)

This paper explicates and challenges John Rawl's argument concerning a rule-utilitarian theory of punishment. In so doing, it argues in favour of a retributivist theory of punishment, one that seeks to justify, not only particular forms of punishment, but the institution of punishment itself. Some crucial objections to retributivism are then considered: one regarding the adverse effects of punishment on the innocent, another concerning proportional punishment, a third pertaining to vengeance and retribution, a Marxian concern with retributive punishment, and a (...) concern with the concept of desert. Each objection is deflected in order to ward-off what seem to be the most serious criticisms of a retributivist view of punishment and to clarify the depth of the retributivist position. (shrink)

This essay provides a critical philosophical assessment of “offensiphobia,” which is the belief that higher educational academic freedom ought to be to some important extent censured because of the mere offensiveness of certain kinds of expressions, whether those expressions are perceived as being racist, sexist, etc., effectively holding that the offensiveness of such expressions is a sufficient condition to justify its prohibition. This paper concisely sets forth the general legal parameters of the United States constitutional First Amendment right to freedom (...) of expression. Subsequently, it follows Joel Feinberg in distinguishing between harms and offenses and explains why the law should only protect against harms and not mere offenses. Following this, logical and moral considerations are brought to bear in order to further assess the implicitly supporting view of offensiphobia that faculty and students in higher educational contexts have a claim right to not be offended correlated with a duty of others to not offend them. For example, the use-mention distinction is discussed in order to explain why linguistic intent is crucial for the determination of what genuinely counts as being racist, sexist or otherwise offensive discourse. In the end, there are a variety of reasons for thinking that there is no moral right to not be offended correlated with a moral duty of others to not offend in higher educational contexts and that the law and public policy ought to track this fact. Without a right to not be offended, those who seek to curtail higher educational academic freedom rights by way of censorship stand on unreasonable ethical grounds to do so, though the law seems to permit private institutions to delimit offensive expressions. Offensiphobia ought to be rejected as it is unsupported by the balance of reason. (shrink)

Given the hundreds of articles and books that have been written in epistemology over the span of just the past few decades, relatively little has been written specifically on epistemic responsibility. What has been written rarely considers the nature of epistemic responsibility and its possible role in epistemic justification or knowledge. Instead, such work concerns philosophical analyses and arguments about related concepts such as epistemic virtues or duties, rather than epistemic praiseworthiness and blameworthiness.2 It is epistemic responsibility in the blameworthiness (...) and praiseworthiness senses that is the primary concern of this paper, though the duty sense of epistemic responsibility is explored in terms of its pertinence to epistemic virtue. Shannon Shipp argues for the Modified Vendetta Sanction as a method of corporate-collective punishment. He claims that this sanction evades the difficulties of Peter French's Hester Prynne Sanction. In this paper I argue that, though the Modified Vendetta Sanction evades the problems that Shipp poses for it, it fails to evade some of the difficulties that I pose for French's method. Moreover, there are some difficulties that plague the Modified Vendetta Sanction which do not count against the Hester Prynne Sanction. (...) Therefore, if my analysis holds, then Shipp's method neither improves significantly on the Hester Prynne Sanction nor is unproblematic in its own right. The significance of this paper is that it foils yet another attempt by some corporate punishment theorists to establish the plausibility of a method of corporate-collective punishment. (shrink)

In 377b-378e some of the poetry of Homer, Hesiod and Pindar is deemed harmful and censored within the educational structure of the polis in virtue of its potentially deleterious effect on society.

J. Angelo Corlett’s new book, Interpreting Plato Socratically continues the critical discussion of the Platonic Question where Corlett’s book, Interpreting Plato’s Dialogues concluded. New arguments in favor of the Mouthpiece Interpretation of Plato’s works are considered and shown to be fallacious, as are new objections to some competing approaches to Plato’s works. The Platonic Question is the problem of how to approach and interpret Plato’s writings most of which are dialogues. How, if at all, can Plato’s beliefs, (...) doctrines, theories and such be extracted from dialogues where there is no direct indication from Plato that his own views are even to be found therein? Most philosophers of Plato attempt to decipher from Plato’s texts seemingly all manner of ideas expressed by Socrates which they then attribute to Plato. They seek to ascribe to Plato particular views about justice, art, love, virtue, knowledge, and the like because, they believe, Socrates is Plato’s mouthpiece through the dialogues. But is such an approach justified? What are the arguments in favor of such an approach? Is there a viable alternative approach to Plato’s dialogues? In this rigorous account of the dominant approach to Plato’s dialogues, there is no room left for reasonable doubt about the problematic reasons given for the notion that Plato’s dialogues reveal either Plato’s or Socrates’ beliefs, doctrines or theories about substantive philosophical matters. Corlett’s approach to Plato’s dialogues is applied to a variety of passages throughout Plato’s works on a wide range of topics concerning justice. In-depth discussions of themes such as legal obligation, punishment and compensatory justice are clarified and with some surprising results. Plato’s works serve as a rich source of philosophical thinking about such matters. A central question in today’s Platonic studies is whether Socrates, or any other protagonist in the dialogues, presents views that the author wanted to assert or defend. Professor Corlett offers a detailed defense of his view that the role of Socrates is to raise questions rather than to provide the author’s answers to them. This essay argues that Alvin I. Goldman's truth-linked theory of group knowledge (veritism) omits individual components of social cognition, that all group based theories of knowledge lead to scepticism, and that if any sense is to be made of social knowledge, it must be done on individualist lines. I argue that Goldman's veritism can be reconstructed by adopting a reliabilist theory,social reliabilism. And I argue that Goldman's objections to a particular sort of consensualism are not telling. This paper amounts to a reply to Professor Donald G. Brown’s thoughtful comment on my “Ethical Issues in Journal Peer-Review”, which appeared in this journal.

This article presents philosophical-ethical arguments concerning the extent to which NCAA inter-collegiate football is a public good and some implausible implications of the claim that it constitutes a public good and ought to be publicly subsidized as part of a component of U.S. higher education generally as is currently the case. Underlying this main argument is one concerning who or what should have the responsibility for subsidizing the necessary costs of the sport, including its associated healthcare and medical costs.

In some recent articles, Dr. Leigh Turner [Doffing the Mask: Why Manuscript Reviewers Ought to Be Identifiable,” Journal of Academic Ethics, 1 (2003), pp. 41–48; “Promoting F.A.I.T.H. in Peer Review: Five Core Attributes in Effective Peer Review,” Journal of Academic Ethics, 1 (2003), pp. 181–188.] makes some rather critical observations regarding the processes of peer-review in academic journals. I shall note them in turn, note wherein I concur and wherein I disagree, and discuss some of Turner's suggestions to resolve such (...) difficulties. It is hoped that my comments on Turner's much-appreciated points will engage readers of this august and well-edited journal to take more seriously Turner's arguments for the sake of the betterment of academic research. This paper describes and assesses the arguments offered both \nagainst closed borders and in favor of a more open borders approach to U.S. \nimmigration reform as those arguments are set forth in R. Pevnick’s book, \nImmigration and the Constraints of Justice. We find numerous problems \nwith Pevnick’s reasoning on both counts.

Recently, there have been discussions about whether or not inter-collegiate football should be eliminated in the US. This article philosophically assesses the arguments for its elimination as well as the arguments proffered against its elimination. While a variety of arguments are discussed, a new one is brought into the foray of philosophical investigation, one that combines the unfairness and economic arguments: the health care and medical costs to others argument. This paper examines some of the essential features of Samuel Scheffler's hybrid theory of ethics. Scheffler posits and defends a moral theory which is intended to be neither act-consequentialist nor fully agent-centered. Instead, it provides an agent-centered analysis of moral thinking: one that, unlike consequentialist theories, respects the personal integrity of the moral agent. In this paper I shall do the following: (1) Sketch some of the general points of Scheffler's proposal; (2) Apply Scheffler's ethical theory to the matter of (...) corporate social responsibility; and (3) Raise some objections to this Schefflerian corporate social responsibility theory, along with some modifications of this hybrid theory of corporate social responsibility which are intended to evade such criticisms.The significance of this paper is that it shows that Scheffler's quite innovative ethical theory is problematic as a foundation for a theory of corporate social responsibility. This article is a critical philosophical assessment of John Searle’s theory of human rights as it is articulated both in his earlier book, The Construction of Social Reality and especially in his more recent book, Making the Social World.

It is often either assumed or argued that political liberalism respects rights, while Marxism does not. In fact, many believe that the omission of rights in communism counts decisively against the viability of Karl Marx's social philosophy. Is there room for rights in Marx's social philosophy?This paper examines Allen E. Buchanan's interpretation of Marx's critique of rights. Contrary to Buchanan's view, I shall argue that Marx's critique of rights is limited rather than comprehensive in scope.
