Reports of children participating in hunger strikes while detained in offshore detention centres raise interrelated ethical issues and recognizable challenges for the medical decision-makers at these sites. A composite case study, informed by reports in the public domain, is employed to explore the unique challenges of consent and decision-making in these circumstances and the perennial issues inherent in adolescents’ developing capacity and autonomy. We present an amalgamated case of a fourteen-year-old adolescent who refused to consent to medical reversal of her (...) hunger strike protest. The medical team became the final arbiter when her parents, who were also in detention, could not agree with each other even after mediation. The case explores the complexity of evaluating the adolescent’s capacity to provide informed consent while influenced by the opinions of co-detainees in this extreme setting. We argue that the parents and the child had compromised decisional capacity due to the effects of detention. The challenges to the medical team are recognized and discussed. The team members faced a difficult dilemma and considered the competing values of the multiple cultural and ethical factors. Each team member integrated his or her own roles, duties, and discipline-specific professional guidelines with the primary goal of mitigating potential harms. (shrink)

This paper examines the impact of integrated reporting on the integration of environmental, social, and governance issues into the business model and the related economic and ESG performance changes. To investigate these internal and external transformational effects of IR, important differences between IR and alternative ESG reporting strategies are worked out. Using three matched samples of companies from around the world for the sample period 2002–2011, IR companies are matched with companies applying no ESG reporting, stand-alone ESG reporting, or ESG (...) reporting in the annual report. The results suggest that IR is a superior mechanism only for the integration of ESG issues into the core business model when comparing IR with the ESG reporting strategies of no ESG reporting and ESG reporting in annual reports. In comparison with, stand-alone ESG reporting, the results indicate that IR is negatively associated with the ESG integration level and with the economic and ESG performance. Moreover, this negative impact is lower for companies that have already implemented ESG management tools prior to the initiation of IR and is stronger for companies residing in countries with legal requirements for the disclosure of ESG information. A separate change analysis reveals that companies do not benefit from a switch from stand-alone ESG reporting to IR. Thus, this paper provides empirical evidence that contradicts the general notion of IR as a superior reporting mechanism, as the benefits of IR are driven by several factors. (shrink)

We argue that two powerful error-theoretic concepts provide a general framework that satisfactorily accounts for key aspects of the explanation of physical patterns. This method gives an objective criterion to determine which mathematical models in a class of neighboring models are just as good as the exact one. The method also emphasizes that abstraction is essential for explanation and provides a precise conceptual framework that determines whether a given abstraction is explanatorily relevant and justified. Hence, it increases our epistemological understanding (...) of how one should go about reconstructing scientific practices by making clear that, at a fundamental level, a key aspect of mathematical modeling consists in exactly solving nearby problems. ABSTRACT This paper examines consequences of the computer revolution in mathematics. By comparing its repercussions with those of conceptual developments that unfolded in the nineteenth century, I argue that the key epistemological lesson to draw from the two transformative periods is that effective and successful mathematical practices in science result from integrating the computational and conceptual styles of mathematics, and not that one of the two styles of mathematical reasoning is superior. Ethically permissible clinical trials must not expose subjects to risks that are unreasonable in relation to anticipated benefits. In the research ethics literature, this moral requirement is typically understood in one of two different ways: as requiring the existence of a state of clinical equipoise, meaning a state of honest, professional disagreement among the community of experts about the preferred treatment; or as requiring an equilibrium between individual and collective ethics. It has been maintained that this second interpretation makes it (...) mandatory to minimize the number of patients receiving the treatment that will eventually be shown to be inferior by the trial. This requirement has led to the development of adaptive trials, i.e., trials in which treatment allocation is determined by data accumulated during interim analysis. Many statisticians argue that in some circumstances—typically with potentially high benefits, as in the much discussed ECMO trial—adaptive design is the only ethically permissible experimental design. Nevertheless, some proponents of clinical equipoise argue that adaptive trials are neither ethically required nor permissible. More specifically, they argue that clinical trials using adaptive designs fail to meet the moral requirement of clinical equipoise, since these trials presuppose an epistemic state that is incompatible with a physician’s duty of care to her subjects. This paper emphasizes that the debate is to a large extent resting on an epistemological confusion. Specifically, I argue that this response conflates two different conceptions of statistical evidence, and that recognizing this distinction elucidates an epistemological framework in which adaptive trials are both consistent with and recommended by the moral requirement of clinical equipoise. The relatively recent increase in prominence of computer simulations in scientific inquiry gives us more reasons than ever before for asserting that mathematics is a wonderful tool. In fact, a practical knowledge of scientific computation has become essential for scientists working in all disciplines involving mathematics. Despite their incontestable success, it must be emphasized that the numerical methods subtending simulations provide at best approximate solutions and that they can also return very misleading results. Accordingly, epistemological sobriety demands that we clarify (...) the circumstances under which simulations can be relied upon. With this in mind, this paper articulates a general perspective to better understand and compare the strengths and weaknesses of various error-analysis methods. (shrink)

One of the most unsettling problems in the history of philosophy examines how mathematics can be used to adequately represent the world. An influential thesis, stated by Eugene Wigner in his paper entitled "The Unreasonable Effectiveness of Mathematics in the Natural Sciences," claims that "the miracle of the appropriateness of the language of mathematics for the formulation of the laws of physics is a wonderful gift which we neither understand nor deserve." Contrary to this view, this thesis delineates and implements (...) a strategy to show that the applicability of mathematics is very reasonable indeed. I distinguish three forms of the problem of the applicability of mathematics, and focus on one I call the problem of uncanny accuracy: Given that the construction and manipulation of mathematical representations is pervaded by uncertainty, error, approximation, and idealization, how can their apparently uncanny accuracy be explained? I argue that this question has found no satisfactory answer because our rational reconstruction of scientific practice has not involved tools rich enough to capture the logic of mathematical modelling. Thus, I characterize a general schema of mathematical analysis of real systems, focusing on the selection of modelling assumptions, on the construction of model equations, and on the extraction of information, in order to address contextually determinate questions on some behaviour of interest. A concept of selective accuracy is developed to explain the way in which qualitative and quantitative solutions should be utilized to understand systems. The qualitative methods rely on asymptotic methods and on sensitivity analysis, whereas the quantitative methods are best understood using backward error analysis. The basic underpinning of this perspective is readily understandable across scientific fields, and it thereby provides a view of mathematical tractability readily interpretable in the broader context of mathematical modelling. In addition, this perspective is used to discuss the nature of theories, the role of scaling, and the epistemological and semantic aspects of experimentation. In conclusion, we argue for a method of local and global conceptual analysis that goes beyond the reach of the tools standardly used to capture the logic of science; on their basis, the applicability of mathematics finds itself demystified. The dominant theory of elite power, grounded in Weberian bureaucracy, has analyzed elites in terms of stable positions at the top of enduring institutions. Today, many conditions that spawned these stable ‘command posts’ no longer prevail, and elite power thus warrants rethinking. This article advances an argument about contemporary ‘influence elites’. The way they are organized and the modus operandi they employ to wield influence enable them to evade public accountability, a hallmark of a democratic society. Three cases are presented, (...) first to investigate changes in how elites operate and, second, to examine varying configurations in which the new elites are organized. The cases demonstrate that influence elites intermesh hierarchies and networks, serve as connectors, and coordinate influence from multiple, moving perches, inside and outside official structures. Their flexible and multi-positioned organizing modes call for reconsidering elite theory and grappling with the implications of these elites for democratic society. (shrink)

ACMES is a multidisciplinary conference series that focuses on epistemological and mathematical issues relating to computation in modern science. This volume includes a selection of papers presented at the 2015 and 2016 conferences held at Western University that provide an interdisciplinary outlook on modern applied mathematics that draws from theory and practice, and situates it in proper context. These papers come from leading mathematicians, computational scientists, and philosophers of science, and cover a broad collection of mathematical and philosophical topics, including (...) numerical analysis and its underlying philosophy, computer algebra, reliability and uncertainty quantification, computation and complexity theory, combinatorics, error analysis, perturbation theory, experimental mathematics, scientific epistemology, and foundations of mathematics. By bringing together contributions from researchers who approach the mathematical sciences from different perspectives, the volume will further readers' understanding of the multifaceted role of mathematics in modern science, informed by the state of the art in mathematics, scientific computing, and current modeling techniques. A work that underscores the need to examine history from a philosophical perspective.

When shared decision making breaks down and parents and medical providers have developed entrenched and conflicting views, ethical frameworks are needed to find a way forward. This article reviews the evolution of thought about the best interest standard and then discusses the advantages of the harm principle (HP) and the zone of parental discretion (ZPD). Applying these frameworks to parental refusals in situations of complexity and uncertainty presents challenges that necessitate concrete substeps to analyze the big picture and identify key (...) questions. I outline and defend a new decision-making tool that includes three parts: identifying the nature of the disagreement, checklists for key elements of the HP and ZPD, and a “think list” of specific questions designed to enhance use of the HP and ZPD in clinical decision making. These tools together will assist those embroiled in complex disagreements to disentangle the issues to find a path to resolution. (shrink)

Interest in the computational aspects of modeling has been steadily growing in philosophy of science. This paper aims to advance the discussion by articulating the way in which modeling and computational errors are related and by explaining the significance of error management strategies for the rational reconstruction of scientific practice. To this end, we first characterize the role and nature of modeling error in relation to a recipe for model construction known as Euler’s recipe. We then describe a general model (...) that allows us to assess the quality of numerical solutions in terms of measures of computational errors that are completely interpretable in terms of modeling error. Finally, we emphasize that this type of error analysis involves forms of perturbation analysis that go beyond the basic model-theoretical and statistical/probabilistic tools typically used to characterize the scientific method; this demands that we revise and complement our reconstructive toolbox in a way that can affect our normative image of science. I argue in this paper for the continued construction and maintenance of what I have called the ‘American Foucault’, whose principal preoccupation is with the question of how to be free within our contemporary political constraints and possibilities. (Such a Foucault can be found in the works of American writers such as W. E. Connolly, Todd May, and Thomas Dumm.) Appreciation of Foucault’s contribution to an understanding of freedom is too often (...) hampered, however, by the insistence on the part of many of the most influential of Foucault’s critics (and some of his defenders) that his particular mode of thinking is ultimately too irresponsible . It is thought that Foucault’s refusal to account for the grounds of his work vitiates his overall project. I argue that, if we distinguish between the ‘account-ability’ demanded by his critics and the ‘response-ability’ that his work permits, we will be in a better position to appreciate the timeliness of his conception of freedom. Despite being one of the most dependable methods used by applied mathematicians and engineers in handling complex systems, the finite element method commits variational crimes. This paper contextualizes the concept of variational crime within a broader account of mathematical practice by explaining the tradeoff between complexity and accuracy involved in the construction of numerical methods. We articulate two standards of accuracy used to determine whether inexact solutions are good enough and show that, despite violating the justificatory principles of one, the (...) finite element method nevertheless succeeds in obtaining its legitimacy from the other. This paper articulates an account of imperatives that sensibly supports the idea of a logic of imperative inferences. We rebuke common objections to the very possibility of such a logic, from a perspective based on recent linguistic work on the morphosyntax of imperatives. Specifically, we develop the notion that the content of an imperative sentence includes both a force operator alongside an imperational content to which the force applies. We further argue that this account of the content of imperatives constitutes (...) a plausible and flexible framework to develop a logic of imperative by examining a number of reconstructions of this idea using semantical analogs of widespread modal semantics. After studying the performance of those approaches, we conclude that progress in imperative logic has been hindered by the failure to adopt conflict-tolerant and resource-sensitive semantics, but suggest that such considerations can be incorporated in this flexible framework. Finally, we also propose a simple account of the difference between operators applying to the content of imperatives and imperative operators, in a way that sheds light on some of the issues underlying the usual antinomies. In the wake of the most recent financial crisis, corporations have been criticized as being self-interested and unmindful of their relationship to society. Indeed, the blame is sometimes placed on the corporate legal form, which can exacerbate the tension between duties to shareholders and interests of stakeholders. In comparison, the Benefit Corporation (BC) is a new legal business entity that is obligated to pursue public benefit in addition to the responsibility to return profits to shareholders. It is legally a for-profit, (...) socially obligated, corporate form of business, with all the traditional corporate characteristics combined with societal responsibilities. Considering the history and perception of shareholder primacy in United States law, it is argued that this new business structure is an ethical step toward empowering socially committed commercial entities. The contribution of this research is to provide a fundamental base of knowledge about the new legal form of business, the BC, upon which further study may rely. First, the legal history of the corporation is briefly reviewed in order to provide context to the relationship of the corporate form to society, including exploration of the premise that shareholder wealth maximization is its best and only purpose. Second, the BC is described in detail, and state statutes are compared. Third, the BC is placed within the context of corporate social responsibility. Modern mathematical sciences are hard to imagine without appeal to efficient computational algorithms. We address several conceptual problems arising from this interaction by outlining rival but complementary perspectives on mathematical tractability. More specifically, we articulate three alternative characterizations of the complexity hierarchy of mathematical problems that are themselves based on different understandings of computational constraints. These distinctions resolve the tension between epistemic contexts in which exact solutions can be found and the ones in which they cannot; however, contrary to a (...) persistent myth, we conclude that having an exact solution is not generally more epistemologically beneficial than lacking one. The subject of my dissertation is the notion, what could turn out, extracted from Naming and Necessity, in a context in which it is being used to show the contingency of gold's yellowness. ;In general, I seek to establish an actuality-oriented notion of what could turn out that makes a break with an epistemological picture of this notion as well as another making what could turn out for an object depend on what's metaphysically possible for it. ;In particular, I distinguish (...) various what-could-turn-out notions. I then develop an actuality-oriented notion of what could turn out on which what-could-turn-out truths are in subject-predicate form. Afterwards, I provide some of the necessary conditions for an object's possessing a what-could-turn-out predicate. That a what-could-turn-out predicate applies to an object depends on at least two conditions: that the object in question actually possess the simple property P contained within the complex modal one, could turn out P; and that, in principle, we could come to know of the object's actually possessing P. For example, in order for neutrinos to possibly turn out to have infinitesimal mass, it must at least be the case that they actually have infinitesimal mass, and that, in principle, we could come to know of their actually being as such. O artigo apresenta e analisa as representações acerca da espiritualidade presentes nos relatos de mulheres usuárias de substâncias que buscam acolhimento em comunidades terapêuticas (CTs) de perfil religioso. Os dados observados são provenientes de entrevistas semiestruturadas realizadas ao longo do segundo semestre de 2020 com mulheres acolhidas em duas CT’s, sendo uma delas de perfil católico carismático e outra vinculada a uma igreja que compõe o protestantismo histórico. As lideranças dessas instituições foram igualmente ouvidas com a intenção de alcançar informações (...) a respeito da maneira como religião e espiritualidade são acionadas e articuladas no método empregado por essas CTs. A principal conclusão desse trabalho indica que as estratégias institucionais aplicadas para afastar essas mulheres do uso de substâncias fundamentam-se em narrativas religiosas que, muitas vezes, são ressignificadas pelas acolhidas por meio de suas próprias experiências subjetivas ao longo da permanência na CT. Ainda, deve-se ressaltar que a espiritualidade vivenciada pelas entrevistadas parece, em algumas situações, confrontar as orientações institucionais. (shrink)

Professional providers of mental health services are motivated to help people, including, or especially, vulnerable people. We analyse the ethical implications of mental health providers accepting employment at detention centres that operate out of the normal regulatory structure of the modern state. Specifically, we examine tensions and moral harms experienced by providers at the Australian immigration detention centre on the island of Nauru. Australia has adopted indefinite offshore detention for asylum-seekers arriving by boat as part of a deterrence strategy that (...) relies on making detainment conditions harsh. This has known deleterious mental health effects. As a token to fiduciary care obligations, Australia employs mental health professionals to work on Nauru. These providers are often motivated to make a positive difference for detainees’ lives. We examine the overall impact of the providers’ work with detainees and the implications of their presence. The strongest evidence supports that the small mitigation of harms offered by these providers does not outweigh the harms of supporting a system designed to perpetuate human suffering. For mental health professionals considering working in offshore detention, we offer specific topics to scrutinise and weigh prior to employment. Because optimising detainee’s mental health is beyond the capacity of individual providers, we call for the organisations standardising and supporting mental health professionals to oppose employment of their associates in offshore detention. Lessons from this case study are generalisable to other jurisdictions to help inform organisations that licence and support mental health providers and individual providers considering work in similar settings. This paper examines whether and to what extent the overall business strategy influences the firm’s mismanagement of sustainability. Specifically, an empirical measure for the mismanagement of sustainability is developed by exploiting the newly available materiality guidelines for US firms to define industry-specific material sustainability issues. Using this measure, this paper shows that mismanagement of sustainability can represent unethical business behavior when firms intentionally perform better on immaterial issues than on material issues by diverting stakeholders’ attention from the firm’s low overall (...) sustainability performance. This paper assumes that the right business strategy can prevent such unethical actions. Based on Miles and Snow’s organizational theory, this paper distinguishes between Prospector and Defender business strategies. By employing multiple firm-level panel regressions, the findings suggest that Prospector-type firms are more likely to mismanage sustainability issues compared to Defender-type firms intentionally. The results give implications for researchers, regulators and standard setters, auditors, sustainability practitioners, and scholars. (shrink)

Like Kant, Foucault challenges us to rethink the way we relate freedom and truth by stressing the idea of "maturity" understood as a release from the "self-incurred tutelage" (the expression is from Kant) that otherwise characterizes so much of our lives. Though, rather than linking freedom and truth via the concept of autonomy (or lawfulness), as Kant does, Foucault outlines a possible experience of ethics as an individualizing ideal that contrasts with the model of establishing codes within a conception of (...) moral order. Foucault's project can be read as attempting to decouple ethics from the epistemological concern with the objectivity of a moral order in order to reconnect it to the formation of a political sensibility that sees truth(fulness) in a certain practice of freedom, as opposed to seeing our freedom confirmed or granted by a certain kind of (mode of relating to the) truth. I call this reading of Foucault's investigations into ethics the "methodological/prescriptive" approach (asking and responding to what we can do, ethically-speaking) and contrast it with the sketch of an alternative reading which I call "ontological/historical" (asking and responding to what we are, ethically-speaking). This reading, instead of pushing beyond Kant in the direction of a Nietzschean sensibility, rather challenges Kant's moral law from the space of a Hegelian insistence on the (historical) realization or actualization of freedom in and through the normative constraints structuring existing power-relations. It is argued in this article that Foucault’s most distinctive contribution to philosophical practice is to be found in his distinctive mode of taking up historiography, exploring critically the conditions and limits of knowledge through archival work. The focus on knowledge would seem to place him in the critical lineage of Kant; however, his appeal to history and archival explorations reconfigure the relation between sensibility and the understanding in a way that suggests a different concern with the conditions of “a (...) possible knowledge.” After discussing how Foucault’s archival work engages a distinct sensibility, I suggest that his concern with knowledge can best be understood not within a transcendental project, however historicized, but within the logical space of Hegel’s Doctrine of the Concept, specifically the discussion of the Idea of cognition where it is a question of the twin processes of unifying subjectivity and objectivity as expressive of cognition’s “urge to truth.” Understood within this conceptual context, Foucault’s distinctive archival approach to what he calls “subjectivation” and “objectivation” allows us to appreciate the distinction between knowledge and truth in a way that leaves open the possibility of transformation. Since these problems first appeared, suspicion has fallen on a new type of insecticide, which is used to treat seeds. The legislation prescribes environmental risk assessments of any insecticide substance before it reaches the market, and beekeepers therefore decided to consult the files concerning the suspect molecules. As a result, they became involved in critically reviewing and developing assessment rules, and thus came to rub shoulders with experts in bee toxicology. (shrink)

Class Clowns: Talking out of Turn with an Orientation Toward Humor The classroom is a primary site for children to learn accommodation to cultural practices and norms, but also for them to develop strategies for disruption and humor while avoiding sanctions. Although the teacher has the power in the elementary classroom, there are twenty or so prospective disruptors and all sorts of possible disruptions with humorous potential at various different points in the interaction. In our paper, we investigate disruptive humor (...) in the first six years of school from the perspective of the pupil adjusting to the restrictions and possibilities of the system, rather than from the usual perspective of the teacher, who wants to control classroom behavior. We explore recorded classroom interaction to determine the types of humorous disruptions and their interactional effects, showing how pupils adjust to the conventions of classroom behavior, but also how they test the system for humorous purposes. We argue that humorous disruptions often function to assert individual identity or to create a particular class personality in the otherwise faceless group orientation of the elementary classroom.
