Background: There is a significant discourse in the literature that opines that people who use illicit opiates are unable to provide informed consent due to withdrawal symptoms and cognitive impairment as a result of opiate use. Aims: This paper discusses the issues related to informed consent for this population. Ethical considerations: Ethical approval was obtained from both the local REB and the university. Written informed consent was obtained from all participants. Method: This was a qualitative interpretive descriptive study. 22 participants (...) were interviewed, including 18 nurses, 2 social workers and 2 clinic support workers. The findings were analyzed using thematic analysis, which is a way of systematically reducing the complexity of the information to arrive at generalized explanations. Results: The staff at the clinic were overwhelming clear in their judgment that people who use opiates can and should be able to participate in research and that their drug use is not a barrier to informed consent. Conclusions: It is important to involve people who use opiates in research. Protectionist concerns about this population may be overstated. Such concerns do not promote the interests of research participants. People who use heroin need to be able to tell their story. (shrink)

The aim of the paper is to prove the consistency of libertarianism. We examine the example of Jane, who deliberates at length over whether to vacation in Colorado (C) or Hawaii (H), weighing the costs and benefits, consulting travel brochures, etc. Underlying phenomenological deliberation is an indeterministic neural process in which nonactual motor neural states n(C) and n(H) corresponding to alternatives C and H remain physically possible up until the moment of decision. The neurophysiological probabilities pr(n(C)) and pr(n(H)) evolve (...) continuously according to the different weights Jane's judgement attaches to C and H at different times during the deliberation. The overall process is indeterministic, since Jane's exact judgemental weighting would vary slightly were the process to be repeated from the same initial conditions. The weighting is however rational, and entirely under Jane's control. This controlled, rational, indeterministic process shows that libertarianism is a consistent philosophical thesis. (shrink)

In his paper ‘‘Bad luck once again’’ Neil Levy attacks our proof of the consistency of libertarianism by reiterating a time-worn compatibilist complaint.1 This is, that what is not determined must be due to chance. If A has a choice of X or Y, neither X nor Y being causally determined, then if A chooses X it can only be by chance, never for a reason. The only ‘‘reason’’ that could explain the choice of X over Y would have to (...) be a causally sufficient reason, which would rule out A’s having a genuine choice in the first place. Either X is causally necessitated or X is realized by sheer luck. But that these are the only alternatives is untrue. The exercise of deliberative reason opens the way between the Scylla of causal necessitation and the Charybdis of chance, as we shall try to make clear. The central core of Levy’s argument is that any attempt to give a reasons-based explanation of a contrastive fact must fail. A contrastive fact is a fact of the kind ‘‘Jane decides to vacation in Hawaii rather than Colorado,’’ or ‘‘Jane assigns a greater weight to surfing that to white-water rafting.’’ In the last three paragraphs of his paper Levy argues that Jane’s assigning more weight to surfing than to rafting cannot be a reasons-based assignment, because, as he puts it, ‘‘the reasons that would explain the weighting are the weighted reasons themselves.’’ Similarly, prior to making her Hawaii⁄ Colorado decision, Jane has.. Call the norms of inquiry zetetic norms. How are zetetic norms related to epistemic norms? At first glance, they seem quite closely connected. Aren't epistemic norms norms that bind inquirers qua inquirers? And isn't epistemology the place to look for a normative theory of inquiry? While much of this thought seems right, this paper argues that the relationship between the epistemic and the zetetic is not as harmonious as one might have thought and liked. In this paper I explore the contours of a picture of normative epistemology that speaks centrally to the question of how to inquire rather than just the question of what to believe. What if normative epistemology were expanded to encompass inquiry in full? I argue that while a 'zetetic epistemology' builds on traditional normative epistemology in many appealing ways, it also faces some challenges.

Biobanks are proliferating rapidly worldwide because they are powerful tools and organisational structures for undertaking medical research. By linking samples to data on the health of individuals, it is anticipated that biobanks will be used to explore the relationship between genes, environment and lifestyle for many diseases, as well as the potential of individually-tailored drug treatments based on genetic predisposition. However, they also raise considerable challenges for existing legal frameworks and research governance structures. This book critically examines the current governance (...) structures in place for biobanks in England and Wales. It shows that the technologies, techniques and practices involved in biobanking do not always conform neatly to existing legal principles and frameworks that apply to other areas of medical research. Using a socio-legal approach, including interview data gathered from the scientific community, this book provides unique insights and makes recommendations about appropriate governance mechanisms for biobanking in the future. It also explores the issues around the secondary use of information, such as consent and how to protect privacy, when biobanks are accessed by a number of different third parties. Financial and nonfinancial conflicts of interest in medicine and surgery are troubling because they have the capacity to skew decision making in ways that might be detrimental to patient care and well-being. The recent case of the Articular Surface Replacement (ASR) hip provides a vivid illustration of the harmful effects of conflicts of interest in surgery.

Drawing on recent advances in analytic epistemology, feminist scholarship, and philosophy of science, Jane Duran's Toward a Feminist Epistemology is the first book that spells out in the detail required by a supportable epistemology what a feminist theory of knowledge would entail.

R. S. Peters and a small group of contemporaries set the foundations for analytic philosophy of education in the 1960s, a field which continues to this day. This article asks about the value of analytic philosophy of education today, and proposes alterations to its initial aims and methods to make its value clearer. I outline some critiques of analytic philosophy of education, and respond by clarifying its aims. The key insight is that if analytic philosophy of education is explicitly aligned (...) with recent trends in social philosophy to focus on ameliorative analysis, then its value and relevance as a method in educational studies becomes clearer. Ameliorative analysis starts with the social role that a concept plays, and analyses it with this purpose in mind. I illustrate how R. S. Peters analysis of education would be approached differently with ameliorative analysis in mind, and conclude by pointing to some interesting points of discussion that arise from this approach. First person authority, argues Moran, is not to be understood as a matter of having some especially good observational access to certain facts about oneself. We can imagine a person who can report accurately on her own psychological states, for example because she can perform, without conscious thought, extremely reliable psychoanalytic-style diagnoses of herself. But the ‘authority’ with which she produces her judgements resembles that which she could have about another person in that it can exist even when she does (...) not endorse or identify with the states she reports on. In imagining such a person we see that her speech about herself is very different from our more usual sort of psychological self-attributions and that something central to their authority, something we want to explain, has gone missing. Also the observational view does not illuminate why it is only psychological states to which one can have such privileged access, and only one’s own; nor does it explain why loss of such access is a serious matter. “Gut issues” refers to any condition that affects our digestive systems and that causes pain or discomfort. The term points to the experience of our gut being an issue for us – interfering with our plans, undermining our bodily self-control, threatening our well-being. This paper aims to do three things: (1) to introduce and justify a disability theory approach to gut issues; (2) to use this lens to argue that the experience of gut issues has a social and relational dimension (...) that could be otherwise; and (3) to argue for a shared responsibility to ameliorate this dimension. The Porosity of the Self delivers an original interpretation of the philosophy of Edmund Husserl, the founder of phenomenology and one of the most important philosophers of the nineteenth and twentieth centuries. Laura Jane Nanni provides a unique exploration of the philosophical problem of the self, challenging prevailing accounts of self and personhood that are predominantly one-dimensional and fail to capture the intricate double-sidedness of how we experience ourselves, others, and the world around us in everyday life. Nanni demonstrates (...) how Husserl's philosophy offers an important alternative account of the self as porous - a notion that emerges through a thematic reconstruction of Husserl's conceptions of embodiment, habituality, temporality, relationality, personhood, intersubjectivity, and sociality. Here, the case is made that the self should be understood as multidimensional, dynamic, and complex by highlighting its fundamentally permeable nature. The main argument of the book is that no one element of the self is experienceable in isolation, and that Husserl's understanding can equally accommodate the uniqueness of subjective experience as well as social, cultural, and historical inflections, without yielding constitutive priority to one dimension over the other. The book is original as it encourages broad engagement with Husserl by simplifying some of his more complex texts using clear and accessible language, and adopting a thematic rather than chronological approach to his life's work. It shows how Husserlian phenomenology can provide a rich supplementary perspective for fields such as critical phenomenology and feminist philosophy, and offers a renewed way of engaging with Husserl's philosophy. Indexical predication is possible as well as the more familiar indexical reference. ‘My curtains are coloured thus’ describes my curtains. The indexical predicate expression it contains stands to possible non‐indexical replacements as a referring indexical does to possible non‐indexical replacements , in that it calls upon the context of utterance to fix its semantic contribution to the whole. Indexical predication is the natural resource to call upon in talk about skilful human performances, where we exhibit considerable know‐how but little explicit (...) know‐that. Speech is among such performances. Both direct and indirect speech reports may be illuminated by seeing them in the light of this thought. A corollary of the approach is that the prospects of providing a formal semantic treatment of indirect speech do not look good. (shrink)

Summary This paper notes and explores the attraction of Dugald Stewart's moral philosophy for women readers and a few women writers. Student lecture notes reveal the chronological development of his ideas, as he drew upon the works of Thomas Reid, Adam Smith, and Adam Ferguson, and responded to political events. Particular attention is paid to Stewart's comments relating to women and gender, through discussions of education, the institution of marriage, and population questions. After 1800, he shifted away from a speculative (...) conjectural history towards a philosophy of moral progress rooted in common sense philosophy and a belief in perfectibility. He taught a system of practical morality relevant to the education of children and strongly emphasised the importance of the association of ideas in childhood. For women readers, the message was contradictory in that he united an apparently conservative reinforcement of the relations of the sexes with a belief in the improvement of the condition of women through education in a modern, progressive, and commercial society. All professional ethics are dependent on the epistemology of the profession. The possibility of following a code of ethics, whether the official one or an alternative code, is dependent on being able to obtain knowledge and understand the world. Professional knowledge has to be based on inferences from limited information. Statistics provides the optimal methods for making such inferences, and thus ethical professional conduct requires individual or collective understanding of some statistical thcory and practice. This is demonstrated using the medical (...) profession as an example. Statistical methods are essential in all areas of medicine, in routine medical practice, in screening for disease and in research. Evidence from medical journals, textbooks and research bodies shows that the statistical basis for ethical conduct is lacking. However, there are attempts to improve the situation. (shrink)

This paper will examine the way in which premenstrual symptomatology has been represented and regulated by psychology and psychiatry. It questions the “truths” about women's premenstrual experiences that circulate in scientific discourse, namely the fictions framed as facts that serve to regulate femininity, reproduction, and what it is to be “woman.” Hegemonic truths that define Premenstrual Dysphoric Disorder (PMDD) and its nosological predecessor Premenstrual Syndrome (PMS) are examined to illustrate how regimes of objectified knowledge and practices of “assemblage” come to (...) regulate individual women through a process of subjectification. Five interconnected “truths” are presented as objects of scrutiny: PMDD is a thing that can be objectively defined and measured; PMDD is a pathology to be eradicated; PMDD is caused and can be treated by one factor; PMDD is a bodily phenomenon; PMDD causes women's problems or symptoms. I examine the way in which these hegemonic truths function in framing the reproductive body as a cause of disorder or distress that leads women to interpret premenstrual experiences within a pathological framework deserving medical or psychological treatment. Finally, I offer an alternative framework drawing on Eastern models of selfhood that provides a more empowering model of women's premenstrual experiences. (shrink)

In this essay, I examine the tactics that Maria Edgeworth, Eliza Farrar, and Frances Willard used to appropriate and respond to a tradition of rhetoric that by fiat excluded women from rhetorical education, public speaking, and persuasive writing. In order to analyze their poaching on men's territory, I borrow from Michel de Certeau's theory of everyday practices of consumption.In The Practice of Everyday Life (1984), de Certeau suggests that we should study the ways that culture is constituted not only by dominant ideology, but also by "the dominated element in society (a status that does not mean that they are either passive or docile)" (xi-xii). Culture, for de Certeau, is not simply consumed; rather, in everyday life, it is invented "by poaching in countless ways on the property of others" (xii). One must study not just consumers, but also how they consume, what they do and make with the cultural artifacts and constructs offered to them, how they manipulate ideology. For the weak, those lacking political power, de Certeau, like recent feminists, 3 claims sophistic rhetoric, since the Sophists privileged the art of making "the weak position seem the stronger" (xx). How do "users reappropriate the space organized by techniques of sociocultural production?" asks de Certeau (xvii). For the weak, as for the Sophist, "[a] tactic insinuates itself into the other's place, fragmentarily, without taking it over in its entirety, without being able to keep it at a distance" (xix). With these issues in play, de Certeau studies everyday practices--shopping, cooking, moving about, and, most important for our purposes, reading. [End Page 243]Although seemingly passive, reading, de Certeau points out, is an "activity" of "silent production" (xxi). The reader does not absorb what he or she reads, but, instead, reinvents it--misunderstands it, adapts it to his or her own interests and concerns, remembers pieces of it, but pieces mutated. "This mutation makes the text habitable" (xxi), argues de Certeau. Thus, the dominant in culture may offer a set of rules, but it is only a basis for improvisation for the multitude of others in society. The statue of Augustus from Prima Porta and the garden paintings from the underground complex have long been the most famous exemplars of their types. Recently new studies (...) have treated these works of art in relation to their setting. 1 But there is one source of information in particular which has not received the scrutiny in this regard that it might and that is the remarkable omen which gave the villa its name in antiquity, ad Gallinas. Although this omen is sometimes mentioned to explain the odd name, scholars have not examined in any detail the relationship of the omen to the art and architecture of the villa. In fact, the omen of the gallina alba is the foundation augurium of the villa-garden itself. 2In this essay I intend to examine the ancient literary sources concerning the villa; the only information given by the sources about the villa comes in fact by way of the omen. First the individual components of the omen and the surrounding body of augury and myth will be examined and illustrated where possible in the monuments. Secondly I hope to illuminate the symbolic interrelationships between this augural imagery and the iconography of three features of the art and architecture of the villa-garden: the statue of Augustus, the underground complex, and the laurel grove. This article examines the contribution that poetry written over the last fifty years might make to the established and burgeoning field of Medical Humanities. It takes poems by women about cancer and depression as a case study of how they can offer insight into the impact of these conditions on the sufferer. Collectively, the poems document and effect shifts in knowledge about, and the associated stigmas concerning, illnesses that carry secrecy and shame, specifically cancer and depression. Additionally, drawing on Virginia (...) Woolf’s remarkable essay “On Being Ill”, we see how the non-verbal features of poems, particularly metaphors and symbols, mark the space of what a patient cannot fully articulate. Accordingly, the poems discussed illuminate how literature can express human interiority but at the same time remind the reader – or health professional – that interiority can never be fully presented. Thus, poetry both contributes to and also checks the ways in which literature is appropriated by the biomedical sciences. The poets included are Eavan Boland, Julia Darling, U.A. Fanthorpe, Jackie Kay, Gwyneth Lewis, Carol Satyamurti and Jo Shapcott. Some poems specify a female subjectivity, some express agency as autonomous individuals, while others presume to speak of common human experience. (shrink)

The standard view of Kant’s retributivism, as well as its more recent reworking in the ‘limited’ or ‘partial’ retributivist reading are, it is argued here, inadequate accounts of Kant on punishment. In the case of the former, the view is too limited and superficial, and in the latter it is simply inaccurate as an interpretation of Kant. Instead, this paper argues that a more sophisticated and accurate rendering of Kant on punishment can be obtained by looking to his construction of (...) the concept of justice. In so doing, not only is a superior account of Kant furnished, but also one up to the task of resolving the vexed issue of justifying legal punishment. (shrink)

In this paper, Tarskis notion of Logical Consequence is viewed as a special case of the more general notion of being a theorem of an axiomatic theory. As was recognized by Tarski, the material adequacy of his definition depends on having the distinction between logical and non logical constants right, but we find Tarskis analysis persuasive even if we dont agree on what constants are logical. This accords with the view put forward in this paper that Tarski indeed captures the (...) more inclusive notion of theoremhood in an axiomatic theory. The approach to logical consequence via axiomatic theories leads us to grant centrality to inference schemas rather than to full-fledged arguments and to view the logically valid schemas as a subclass of generally valid schemas. A patient's informed consent is required by the Nuremberg code, and its successors, before she can be entered into a clinical trial. However, concern has been expressed by both patients and professionals about the beneficial or detrimental effect on the patient of asking for her consent. We examine advantages and drawbacks of popular variations on consent, which might reduce the stress on patients at the point of illness. Both informed and uninformed responses to particular trials, and trials in general, are (...) discussed. The selection by doctors of patients, to whom entry to trials will be offered, is explored. Many mammals use scent marks to advertise territory ownership, but only recently have we started to understand the complexity of these scent signals and the types of information that they convey. Whilst attention has generally focused on volatile odorants as the main information molecules in scents, studies of the house mouse have now defined a role for a family of proteins termed major urinary proteins (MUPs) which are, of course, involatile. MUPs bind male signalling volatiles and control their release from (...) scent marks. These proteins are also highly polymorphic and the pattern of polymorphic variants provides a stable ownership signal that communicates genome‐derived information on the individual identity of the scent owner. Here we review the interaction between the chemical basis of mouse scents and the dynamics of their competitive scent marking behaviour, demonstrating how it is possible to provide reliable signals of the competitive ability and identity of individual males. Second-order languages, canonically understood, allow quantification over all sets of objects in the range of the first-order variables. In this chapter two arguments are given against the suitability of using second-order consequence as the consequence relation of axiomatic theories. According to the first argument, second-order languages are inadequate for axiomatizing set theory because of the strong set-theoretic content coded by second-order consequence. The second more general argument is directed against the determinacy of second-order consequence, that is, against the assumption that (...) this is a definite relation.
