Evaluating clinical ethics support services has been hailed as important research task. At the same time, there is considerable debate about how to evaluate CESS appropriately. The criticism, which has been aired, refers to normative as well as empirical aspects of evaluating CESS. In this paper, we argue that a first necessary step for progress is to better understand the intervention in CESS. Tools of complex intervention research methodology may provide relevant means in this respect. In a first step, we (...) introduce principles of “complex intervention research” and show how CESS fulfil the criteria of “complex interventions”. In a second step, we develop a generic “conceptual framework” for “ethics consultation on request” as standard for many forms of ethics consultation in clinical ethics practice. We apply this conceptual framework to the model of “bioethics mediation” to make explicit the specific structural and procedural elements of this form of ethics consultation on request. In a final step we conduct a comparative analysis of two different types of CESS, which have been subject to evaluation research: “proactive ethics consultation” and “moral case deliberation” and discuss implications for evaluating both types of CESS. To make explicit different premises of implemented CESS interventions by means of conceptual frameworks can inform the search for sound empirical evaluation of CESS. In addition, such work provides a starting point for further reflection about what it means to offer “good” CESS. (shrink)

This paper explores the fact that linear opinion pooling can be represented as a Bayesian update on the opinions of others. It uses this fact to propose a new interpretation of the pooling weights. Relative to certain modelling assumptions the weights can be equated with the so-called truth-conduciveness known from the context of Condorcet's jury theorem. This suggests a novel way to elicit the weights.

Digitization of a health record changes its accessibility. An electronic health record (EHR) can be accessed by multiple authorized users. Health information from EHRs contributes to learning healthcare systems’ development. The objective of this systematic review is to answer a question: What are ethical issues concerning research using EHRs in the literature? We searched Medline Ovid, Embase and Scopus for publications concerning ethical issues of research use of EHRs. We employed the constant comparative method to retrieve common ethical themes. We (...) descriptively summarized empirical studies. The study reveals the breadth, depth, and complexity of ethical problems associated with research use of EHRs. The central ethical question that emerges from the review is how to manage access to EHRs. Managing accessibility consists of interconnected and overlapping issues: streamlining research access to EHRs, minimizing risk, engaging and educating patients, as well as ensuring trustworthy governance of EHR data. Most of the ethical problems concerning EHR-based research arise from rapid cultural change. The framing of concepts of privacy, as well as individual and public dimensions of beneficence, are changing. We are currently living in the middle of this transition period. Human emotions and mental habits, as well as laws, are lagging behind technological developments. In the medical tradition, individual patient’s health has always been in the center. Transformation of healthcare care, its digitalization, seems to have some impacts on our perspective of health care ethics, research ethics and public health ethics. (shrink)

Hilbert's axiomatization program of physical theories met an interesting challenge when it confronted the rise of quantum mechanics in the mid-twenties. The novelty of the mathematical apparatus of the then newly born theory was to be matched only by its substantial lack of any definite physical interpretation. The early attempts at axiomatization, which are described here, reflect all the difficulty of the task faced by Jordan, Hilbert, von Neumann and others. The role of von Neumann is examined in considerable detail (...) as he can be viewed here as the most outstanding of Hilbert's heirs. Von Neumann, especially in his work devoted to the proof of the impossibility of hidden variables, not only continued Hilbert's program but pushed it to its very limits, blending axiomatic rigor and interpretative commitment. This paper discusses ἐπιβολαὶ τῆς διανοίας, which later Epicureans are supposed to have elevated to a fourth criterion of truth to complement perceptions, preconceptions and feelings. By examining Epicurus’ extant writings, the paper distinguishes three different senses of the term: ‘thought in general’, ‘act of attention’ and ‘mental perception’. It is argued that only the sense ‘mental perception’ yields a plausible reading of ἐπιβολαί as a criterion of truth. The paper then turns to the textual evidence on ἐπιβολαί in later (...) authors. While the term ἐπιβολή is not used by Cicero, Lucretius and Philodemus in the sense of mental perception, it is argued that this still is the most plausible way of understanding ἐπιβολή as a criterion of truth. This article analyses domestic and foreign reactions to a 2008 report in the British Medical Journal on the complementary and, as argued, synergistic relationship between palliative care and euthanasia in Belgium. The earliest initiators of palliative care in Belgium in the late 1970s held the view that access to proper palliative care was a precondition for euthanasia to be acceptable and that euthanasia and palliative care could, and should, develop together. Advocates of euthanasia including author Jan Bernheim, independent from but (...) together with British expatriates, were among the founders of what was probably the first palliative care service in Europe outside of the United Kingdom. In what has become known as the Belgian model of integral end-of-life care, euthanasia is an available option, also at the end of a palliative care pathway. This approach became the majority view among the wider Belgian public, palliative care workers, other health professionals, and legislators. The legal regulation of euthanasia in 2002 was preceded and followed by a considerable expansion of palliative care services. It is argued that this synergistic development was made possible by public confidence in the health care system and widespread progressive social attitudes that gave rise to a high level of community support for both palliative care and euthanasia. The Belgian model of so-called integral end-of-life care is continuing to evolve, with constant scrutiny of practice and improvements to procedures. It still exhibits several imperfections, for which some solutions are being developed. This article analyses this model by way of answers to a series of questions posed by Journal of Bioethical Inquiry consulting editor Michael Ashby to the Belgian authors. (shrink)

The Covid-19 pandemic creates an unprecedented threatening situation worldwide with an urgent need for critical reflection and new knowledge production, but also a need for imminent action despite prevailing knowledge gaps and multilevel uncertainty. With regard to the role of research ethics in these pandemic times some argue in favor of exceptionalism, others, including the authors of this paper, emphasize the urgent need to remain committed to core ethical principles and fundamental human rights obligations all reflected in research regulations and (...) guidelines carefully crafted over time. In this paper we disentangle some of the arguments put forward in the ongoing debate about Covid-19 human challenge studies (CHIs) and the concomitant role of health-related research ethics in pandemic times. We suggest it might be helpful to think through a lens differentiating between risk, strict uncertainty and ignorance. We provide some examples of lessons learned by harm done in the name of research in the past and discuss the relevance of this legacy in the current situation. (shrink)

In the literature, regress arguments often take one of two different forms: either they conclude that a given solution fails to solve any problem of a certain kind (the strong conclusion), or they conclude that a given solution fails to solve all problems of a certain kind (the weaker conclusion). This gives rise to a logical problem: do regresses entail the strong or the weaker conclusion, or none? In this paper I demonstrate that regress arguments can in fact take both (...) forms, and clearly set out the logical difference between them. Throughout the paper, I confine myself to metaphysical examples from the early Russell. Only now that we know they are valid can we start to discuss whether they are sound. (shrink)

Non-invasive brain stimulation promises innovative experimental possibilities for psychology and neurosci- ence as well as new therapeutic and palliative measures in medicine. Because of its good risk–benefit ratio, non-invasiveness and reversibility as well as its low effort and cost it has good chances of becoming a wide- spread tool in science, medicine and even in lay use. While most issues in medical and research ethics such as informed consent, safety, and potential for misuse can be handled with manageable effort, the (...) real promise of brain stimulation does raise one prominent moral worry: it may lay the foundation of reliable, precise and stable manipulations of the mind. This article addresses this worry and concludes that it is not the possibility of manipulation, but the shift in our understanding of our mind which stands in need of careful consideration. (shrink)

Lovecraft’s teetotalism is well known among Lovecraftians, but the lengths to which he went to incorporate his views and how he sought to influence the people around him via his various writing remain relatively unexplored. This essay focuses on Lovecraft’s teetotalism and opens with a brief sketch of the historical background from which his dry outlook emerged. It continues by providing evidence for Love- craft’s advocacy of abstinence and Prohibition from a variety of sources, including biographical material, philosophical essays, letters, (...) poetry, and fiction, with a view to showing how he communicated his dry philosophy and how it softened as he advanced into middle age. The essay ends by arguing that although there can be no doubt that Lovecraft was a teetotaler par excellence, his later softened position is more balanced and rooted partly in the realization of his own idiosyncrasy and anachronism. The article investigates how two different conceptions of the edifying potential of education attempt to take into account the normative dimension of scientific knowledge. In the first conception it is the demand for truth that is edifying, whereas in the second concept it is a distinctively ethical demand. It is argued that the first concept in the end implies the subjection of education to the ‘brutality of facticity’, under which it risks losing its critical point. The second conception, drawing on (...) Levinas and Arendt, tries to safeguard this critical point. It conceives education as a process through which scientific knowledge is made subject to reflection, and is thus confronted with the ethical challenges and demands of society. (shrink)

An inquiry into the bioethical or ethical component of post-humanism can be through the question of sex. Following from Manoj’s idea of a cyborg as having a “sexless” possibility, this paper presents other arguments that advance the possibility of asexuality in the posthuman. First, I begin with a discussion of Žižek’s point concerning the cessation or voiding of sexual difference. Second, I will continue such an argument through the selfreplicating possibilities of cloning and full cyberspace immersion, the later as prototyped (...) by Pokémon. And finally, there seems to be an inevitable thread that begs to link the concept of the posthuman to Nietzsche; so I will explore some of the arguments that include or exclude Nietzschean ethics in this prospect. This paper investigates the distinction between determining and modifying expressions that played an important role in the Brentano School. The focus lies on how the distinction is applied to adjectives by Anton Marty and Kazimierz Twardowski. In ‘heavy gun’, ‘heavy’ plays a determining role: heavy guns are guns; in ‘fake gun’, ‘fake’ plays a modifying role: fake guns are no guns at all. According to Marty and Twardowski, when a modifying adjective is combined with a noun, it shifts the meaning (...) of the noun. This paper rejects this proposal and proposes a better account which was developed by Bernard Bolzano: the difference between determining and modifying adjectives must be understood in terms of how their meanings figure in meaning analyses of adjective-noun combinations. Logik und Semantik sind im Mittelalter so eng miteinander verknupft, dass die Trennung beider Gebiete das Verstandnis der Probleme beeintrachtigen wurde. Die spezifische Leistung der mittelalterlichen Logik besteht in der Analyse der semantischen Voraussetzungen der aristotelischen Logik und dem damit verbundenen Versuch, die semantischen Voraussetzungen der naturlichen Sprachen zu untersuchen. Damit haben die mittelalterlichen Logiker eine Arbeit geleistet, die von Aristoteles und lange Zeit auch von der modernen Logik vernachlassigt wurde.

In this article I am dealing mainly with the following notions: “perception apparatus” (Weltbildapparat), “view of the world” (Weltbild, picture of the world) and “representation”. The first and the second ones belong to the basic notions in the vocabulary of K. Lorenz’s evolutionary epistemology, the third in cognitive sciences. I seek to demonstrate the relationships between them. This analysis is put in a broader context, indicating the relationships between expensively developing cognitive sciences and evolutionary epistemology (much less popular today). It (...) is quite easy to determine what the perception apparatus is, however, it is harder to state what the view of the world, especially in its ontological aspect, is. Nevertheless, the view of the representation in the context of evolutionary epistemology points to the fact that this notion is still unclear and many representational features can be assigned to objects which, as it seems, are not representations according to cognitive sciences. Rationality requires us to have certain propositional attitudes (beliefs, intentions, etc.) given certain other attitudes that we have. Carroll’s Tortoise repeatedly shows up in this discussion. Following up on Brunero (Ethical Theory Moral Pract 8:557–569, 2005), I ask what Carroll-style considerations actually prove. This paper rejects two existing suggestions, and defends a third.
