ZusammenfassungDie rechtliche Regelung der Fortpflanzungsmedizin ist dringend reformbedürftig. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

BackgroundClinical ethics case consultations (CECCs) provide a structured approach in situations of ethical uncertainty or conflicts. There have been increasing calls in recent years to assess the quality of CECCs by means of empirical research. This study provides detailed data of a descriptive quantitative and qualitative evaluation of a CECC service in a department of cardiology and intensive care at a German university hospital.MethodsSemi-structured document analysis of CECCs was conducted in the period of November 1, 2018, to May 31, 2020. All documents were analysed by two researchers independently.ResultsTwenty-four CECCs were requested within the study period, of which most (n = 22; 92%) had been initiated by physicians of the department. The patients were an average of 79 years old (R: 43–96), and 14 (58%) patients were female. The median length of stay prior to request was 12.5 days (R: 1–65 days). The most frequent diagnoses (several diagnoses possible) were cardiology-related (n = 29), followed by sepsis (n = 11) and cancer (n = 6). Twenty patients lacked decisional capacity. The main reason for a CECC request was uncertainty about the balancing of potential benefit and harm related to the medically indicated treatment (n = 18). Further reasons included differing views regarding the best individual treatment option between health professionals and patients (n = 3) or between different team members (n = 3). Consensus between participants could be reached in 18 (75%) consultations. The implementation of a disease specific treatment intervention was recommended in five cases. Palliative care and limitation of further disease specific interventions was recommended in 12 cases.ConclusionsTo the best of our knowledge, this is the first in-depth evaluation of a CECC service set up for an academic department of cardiology and intensive medical care. Patient characteristics and the issues deliberated during CECC provide a starting point for the development and testing of more tailored clinical ethics support services and research on CECC outcomes. The term “synthetic biology” is a popular label of an emerging biotechnological field with strong claims to robustness, modularity, and controlled construction, finally enabling the creation of new organisms. Although the research community is heterogeneous, it advocates a common denominator that seems to define this field: the principles of rational engineering. However, it still remains unclear to what extent rational engineering—rather than “tinkering” or the usage of random based or non-rational processes—actually constitutes the basis for the techniques of synthetic biology. (...) In this article, we present the results of a quantitative bibliometric analysis of the realized extent of rational engineering in synthetic biology. In our analysis, we examine three issues: (1) We evaluate whether work at three levels of synthetic biology (parts, devices, and systems) is consistent with the principles of rational engineering. (2) We estimate the extent of rational engineering in synthetic biology laboratory practice by an evaluation of publications in synthetic biology. (3) We examine the methodological specialization in rational engineering of authors in synthetic biology. Our analysis demonstrates that rational engineering is prevalent in about half of the articles related to synthetic biology. Interestingly, in recent years the relative number of respective publications has decreased. Despite its prominent role among the claims of synthetic biology, rational engineering has not yet entirely replaced biotechnological methods based on “tinkering” and non-rational principles. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Im folgenden Text wird es mir um zwei Begriffe des Selbstseins ge­ hen, von denen der eine in Heideggers Sein und Zeit bei der Abgren­ zung der authentischen Existenz des Menschen eine entscheidende Rolle spielt, während der andere in den Modus der Uneigentlich­ keit abgeschoben wird. Ich werde den zentralen Begriff des frühen Heidegger – das Selbstsein – nehmen, um zu zeigen, dass sich hinter seiner Individualitätstheorie eine Entscheidung für einen bestimm­ ten Identitätsbegriff verbirgt. Weiterhin möchte ich eine Alternative bieten, (...) die potentiellen Einwänden von der Heideggerschen Posi­ tion aus standhalten kann, und in der Abschlussüberlegung zeigen, dass es für die Bestimmung der menschlichen Existenz notwendig ist, zwei verschiedene Begriffe des Selbstseins ins Spiel zu bringen. English summary: Questions about the origins and reality of good and evil and about their mutual relationship play a central part in the history of philosophy and religion from their very beginning. Giving answers to these questions had a decisive influence on how the world and its civilization(s) as well as human beings and their ethics were perceived in their relations to higher beings (god or gods). The contributions within this conference volume illustrate which concepts regarding these questions were developed (...) in ancient civilizations around the Mediterranean, from the early literatures of Egypt and Mesopotamia, Iran and Greece to biblical, Qumranic and ancient Christian texts as well as the writings of the Manichaeans and the Quran. Thus this volume gives a representative overview of the responses of the ancient world to one of the fundamental questions of mankind. German description: Die Frage nach Herkunft und Wirklichkeit des Guten und des Bosen sowie nach ihrem Verhaltnis zueinander hat in der Philosophie- und Religionsgeschichte von Anfang an eine zentrale Rolle gespielt. Ihre Beantwortung hatte entscheidenden Einfluss darauf, wie man Welt und Kultur, Mensch und Ethik in der Beziehung zu Gott bzw. den Gottern wahrnahm. The Indian philosopher Acharya Nagarjuna was the founder of the Madhyamaka school of Mahayana Buddhism and arguably the most influential Buddhist thinker after Buddha himself. Indeed, in the Tibetan and East Asian traditions, Nagarjuna is often referred to as the 'second Buddha.' His primary contribution to Buddhist thought lies is in the further development of the concept of sunyata or 'emptiness.' For Nagarjuna, all phenomena are without any svabhaba, literally 'own-nature' or 'self-nature', and thus without any underlying essence. In this (...) book, Jan Westerhoff offers a systematic account of Nagarjuna's philosophical position. He reads Nagarjuna in his own philosophical context, but he does not hesitate to show that the issues of Indian and Tibetan Buddhist philosophy have at least family resemblances to issues in European philosophy. Bastiat's great contribution to economics, in his own view, was his identification of service as the source of economic value. What is anything worth to anybody? In the cases where we are not dealing with what our fellow men do for us, the answer is to be found in its utility - how much the thing contributes to our satisfaction. In the case where we deal with our fellows, we are interested specifically in what they can do for us, that (...) is, how much service they can render us - how much they can or could, by their actions, contribute to the purchaser's satisfactions. If the providers are free beings, then the recipient will obtain those satisfactions only by agreement with that provider. It is to be assumed that the purchaser will get the best outcome he can: he will pay the lowest price feasible, for the option that is better than any known alternative. (shrink)

This paper explores the fact that linear opinion pooling can be represented as a Bayesian update on the opinions of others. It uses this fact to propose a new interpretation of the pooling weights. Relative to certain modelling assumptions the weights can be equated with the so-called truth-conduciveness known from the context of Condorcet's jury theorem. This suggests a novel way to elicit the weights.

Hilbert's axiomatization program of physical theories met an interesting challenge when it confronted the rise of quantum mechanics in the mid-twenties. The novelty of the mathematical apparatus of the then newly born theory was to be matched only by its substantial lack of any definite physical interpretation. The early attempts at axiomatization, which are described here, reflect all the difficulty of the task faced by Jordan, Hilbert, von Neumann and others. The role of von Neumann is examined in considerable detail (...) as he can be viewed here as the most outstanding of Hilbert's heirs. Von Neumann, especially in his work devoted to the proof of the impossibility of hidden variables, not only continued Hilbert's program but pushed it to its very limits, blending axiomatic rigor and interpretative commitment. Following Foucault, ‘critique’ could be regarded as being the art not to be governed in this way or as a project of desubjectivation. In this paper it is shown how such a project could be described as an e‐ducative practice. It explores this idea through an example which Foucault himself gave of such a critical practice: the writing of ‘experience books’. Thus it appears that such an e‐ducative practice is a ‘dangerous’, public and uncomfortable practice that is not in need (...) of pastoral care but requires generosity, presence and attention. As such it demands a pedagogy of experience which is to be invented in order to ‘make’ oneself into a question, to transgress the limits of a governmental regime. (shrink)

Due to the intense selection pressure against inbreeding, humans are expected to possess psychological adaptations that regulate mate choice and avoid inbreeding. From a gene’s-eye perspective, there is little difference in the evolutionary costs between situations where an individual him/herself is participating in inbreeding and inbreeding among other close relatives. The difference is merely quantitative, as fitness can be compromised via both routes. The question is whether humans are sensitive to the direct as well as indirect costs of inbreeding. Using (...) responses from a large population-based sample (27,364 responses from 2,353 participants), we found that human motivations to avoid inbreeding closely track the theoretical costs of inbreeding as predicted by inclusive-fitness theory. Participants were asked to select in a forced choice paradigm, which of two acts of inbreeding with actual family members they would want to avoid most. We found that the estimated fitness costs explained 83.6% of participant choices. Importantly, fitness costs explained choices also when the self was not involved. We conclude that humans intuit the indirect fitness costs of mating decisions made by close family members and that psychological inbreeding avoidance mechanisms extend beyond self-regulation. This paper discusses ἐπιβολαὶ τῆς διανοίας, which later Epicureans are supposed to have elevated to a fourth criterion of truth to complement perceptions, preconceptions and feelings. By examining Epicurus’ extant writings, the paper distinguishes three different senses of the term: ‘thought in general’, ‘act of attention’ and ‘mental perception’. It is argued that only the sense ‘mental perception’ yields a plausible reading of ἐπιβολαί as a criterion of truth. The paper then turns to the textual evidence on ἐπιβολαί in later (...) authors. While the term ἐπιβολή is not used by Cicero, Lucretius and Philodemus in the sense of mental perception, it is argued that this still is the most plausible way of understanding ἐπιβολή as a criterion of truth.
