Background: Clinical genomic implementation studies pose challenges for informed consent. Consent forms often include complex language and concepts, which can be a barrier to diverse enrollment, and these studies often blur traditional research-clinical boundaries. There is a move toward self-directed, web-based research enrollment, but more evidence is needed about how these enrollment approaches work in practice. In this study, we developed and evaluated a literacy-focused, web-based consent approach to support enrollment of diverse participants in an ongoing clinical genomic implementation study. (...) Methods: As part of the Cancer Health Assessments Reaching Many (CHARM) study, we developed a web-based consent approach that featured plain language, multimedia, and separate descriptions of clinical care and research activities. CHARM offered clinical exome sequencing to individuals at high risk of hereditary cancer. We interviewed CHARM participants about their reactions to the consent approach. We audio recorded, transcribed, and coded interviews using a deductively and inductively derived codebook. We reviewed coded excerpts as a team to identify overarching themes. Results: We conducted 32 interviews, including 12 (38%) in Spanish. Most (69%) enrolled without assistance from study staff, usually on a mobile phone. Those who completed enrollment in one day spent an average of 12 minutes on the consent portion. Interviewees found the information simple to read but comprehensive, were neutral to positive about the multimedia support, and identified increased access to testing in the study as the key difference from clinical care. Conclusions: This study showed that interviewees found our literacy-focused, web-based consent approach acceptable; did not distinguish the consent materials from other online study processes; and valued getting access to testing in the study. Overall, conducting empirical bioethics research in an ongoing clinical trial was useful to demonstrate the acceptability of our novel consent approach but posed practical challenges. (shrink)

In this book, Newell makes the case for unified theories by setting forth a candidate.

The logics of the modal operators and of the quantifiers show striking analogies. The analogies are so extensive that, when a special class of entities (possible worlds) is postulated, natural and non-arbitrary translation procedures can be defined from the language with the modal operators into a purely quantificational one, under which the necessity and possibility operators translate into universal and existential quantifiers. In view of this I would be willing to classify the modal operators as ‘disguised’ quantifiers, and I think (...) that wholehearted acceptance of modal language should be considered to carry ontological commitment to something like possible worldsConsidered as two languages for describing the same subject matter, modal and purely quantificational languages show interesting differences. The operator variables of the purely quantificational languages give them more power than the modal languages, but at least some of the functions performed by the apparatus of operator variables are also performed, in a more primitive and less versatile way, by actuality operators in modal languages.A final note. Quine has written much on the inter-relations of quantifiers, identity, and the concept of existence. These, he holds, form a tightly knit conceptual system which has been evolved to a high point of perfection, but which might conceivably change yet further.29 He has also dropped hints about the possibility of a simpler, primitive or defective version of the system, in which the quantifiers are not backed up in their accustomed way by the concept of identity. He has dubbed the resulting concept a ‘pre-individuative’ concept of existence, or a concept of ‘entity without identity.’ What would a pre-individuative concept of existence be like? Quine has sometimes suggested that one might be embodied in the use of mass nouns, but the identity concept is used in connection with stuff as well as with things: “is that the same coffee that was in the cup last night?” I would submit that modality provides a better case. In view of the comparative weakness of modal languages, compared to the explicitly quantificational ones Quine takes as canonical, there is surely a sense in which the concept of existence embodied in that disguised existential quantifier, the possibility operator, is a defective one. And as we have seen, one of the differences between modal operators and explicit quantifiers is that modal operators cannot be joined with the identity predicate in the way quantifiers with operator variables can. Surely, then, there is a sense in which ordinary speech, as opposed to the metaphysical theorizing of a Leibniz or a David Lewis, conceives of possible worlds as entities without identity. (shrink)

The distinctive aim of applied ethics is to provide guidance as to how we ought to act, as individuals and as shapers of social policies. In this essay, I argue that applied ethics as currently practiced is inadequate and ought to be transformed to incorporate what I shall call social moral epistemology. This is a branch of social epistemology, the study of the social practices and institutions that promote the formation, preservation, and transmission of true beliefs. In this book, Allen Wood investigates Kant's conception of ethical theory, using it to develop a viable approach to the rights and moral duties of human beings. By remaining closer to Kant's own view of the aims of ethics, Wood's understanding of Kantian ethics differs from the received 'constructivist' interpretation, especially on such matters as the ground and function of ethical principles, the nature of ethical reasoning and autonomy as the ground of ethics. Wood does not hesitate to criticize (...) and modify Kant's conclusions when they seem inconsistent with his basic principles or fail to make the best use of the resources Kantian principles make available. George Washington: A Life in Books, and several on Edgar Allen Poe. Works like the 2020 monograph Shakespeare and the Making of America showcase his intersecting interests in biography, literature, and American political history. It is these interests that are very much on display in his 2022 monograph The Future of the Book: Images of Reading in the American Utopian Novel, and we should be thankful that Hayes has turned his attention to the subject of utopian fiction as he certainly has much to add to the discussion. The book is clearly a labor of love and Hayes writes with a great degree of detail and authority suggesting he has always held a deep interest in the utopian novel. In fact, from the preface, it is clear the research supporting this book has spanned many years.The preface sets it all up very neatly. Immediately, the reader is invited into the research story of the book. Hayes has an evocative and methodical style that carries that research throughout. The author is also careful in this preface to assert his expertise in the field. Having read “virtually every utopian novel in American literature published before 1910” on microfilm gives Hayes the opportunity to explore many of the obscure and lesser-known works of the period (ix), which he notes in his introduction is primarily between 1880 and 1915. Since many of these novels are yet to be digitized, his insight is notably rare.Aside from an introduction and conclusion, the book is divided into five chapters. The first is titled “The Residential Library” and is centrally about [End Page 601] books in home-spaces, from personal libraries to books on shelves in someone’s living room. Chapter 2, “The Public Library,” explores depictions of public libraries and ways that collected knowledge might be organized and made accessible in utopian visions. “The Idea of Authorship,” chapter 3, is about the professional/amateur status of authors in utopian societies. In this section, Hayes also explores ideas about literary quality and attempts to answer concerns that a utopian age would necessarily be incapable of producing great literature. Chapter 4, titled “The Newspaper,” details the struggles utopian authors have had with the newspaper format. Finally, “The Printed Page and the Written Word” examines ways in which utopian authors sought to refine the printed and written word and their innovative suggestions in this area. The demonstration that slow transport of clocks can be used to define simultaneity in inertial frames of reference leads to the question of whether clock transport can similarly be used in noninertial frames. It is shown that there are certain types of reference frames in which the clock-transport method cannot be used in a self-consistent manner. It is also shown that there are other types of noninertial frames in which the clock-transport method will succeed. Cognitive science has now produced a massive number of high-quality regularities with many microtheories that reveal important mechanisms. The need for integration is pressing and will continue to increase. Equally important, cognitive science now has the theoretical concepts and tools to support serious attempts at unified theories. The argument is made (...) entirely by presenting an exemplar unified theory of cognition both to show what a real unified theory would be like and to provide convincing evidence that such theories are feasible. The exemplar is SOAR, a cognitive architecture, which is realized as a software system. After a detailed discussion of the architecture and its properties, with its relation to the constraints on cognition in the real world and to existing ideas in cognitive science, SOAR is used as theory for a wide range of cognitive phenomena: immediate responses ; discrete motor skills ; memory and learning ; problem solving ; language ; and development. The treatments vary in depth and adequacy, but they clearly reveal a single, highly specific, operational theory that works over the entire range of human cognition, SOAR is presented as an exemplar unified theory, not as the sole candidate. The advent of sales over the Internet has led to interesting developments in sales tax policy as states attempt to monitor, control, and collect revenue from illusive Internet tobacco vendors. Tobacco sales have been successfully monitored and regulated, to some extent, in convenience stores, grocery stores, and smoke shops, and in most cases sales taxes are collected. The Internet, however, is extremely difficult to regulate. States could use their regulatory powers to ban the sale of products such as tobacco and (...) alcohol over the Internet, but enforcement would be nearly impossible.The issue of enforcement of Internet sales is extremely difficult. This article addresses the issue of why God would sanction, via the Old Testament Law, less than ideal practices such as slavery, polygamy, and excessively harsh punishments for certain crimes. I appeal to two concepts (the idea of a supererogatory good, and the idea of Molinism) to explain why God sanctioned these practices. I explain that God’s sanctioning these practices may have been necessary in order to create the world with the most possible good.

Genes controlling the choice of sexual strategy must be sensitive to critical environmental contingencies, including the presence of other strategically relevant genetic traits. To determine which strategy works best for each individual, one must assess both its environment and itself within that environment. Psychosexual development involves an assessment of sociosexual affordances, strategically calibrating optimal utilization of physical and psychosocial assets.

Smart homes create a beneficial environment for the lives of elderly people and enhance the quality of their home lives. This study aims to explore the design of age-friendly interfaces that can meet the emotional needs of self-care elderly people from the perspective of functional realization of the operating interface. Sixteen elderly users aged fifty-five and above were selected as subjects with healthy eyes and no excessive drooping eyelids to obscure them. Four representative age-friendly applications with different interface designs were (...) selected from the Android application market as the stimulus material for the experiment, and a total of fifteen pages were browsed independently. During the experiment, the ErgoLAB human-computer environment synchronization cloud platform was used to monitor and record the subjects' multidimensional physiological indicators of eye movements, skin electricity, and heart rate variability when using different styles of mobile application interfaces. Combined with the post-experimental PAD emotion scale data, the preferences of emotional interface design elements of the self-care elderly were analyzed to guide the subsequent design practice. The results show that: on the layout characteristics of the home page, a simple and intuitive multi-column layout or card layout combined with a bottom navigation bar type main navigation is used; on the choice of the main color, a single color with low saturation is used as the main color, with high saturation color accents to play a role in highlighting key information; on the information density of the home page, a moderate proportion of graphics and text is adopted, with low information density; on the arrangement of the page content, they try to give priority to information content with high user relevance. I appreciate very much the thoroughness with which Jocelyne St-Arnaud has analyzed the text of my paper. As she points out, the major source of difference between our approach to the authors under consideration derives from a preference for an ethical and political perspective on her side and a preference for a metaphysical perspective on mine. The impulse toward violence and cruelty is endemic to the human species. But so, likewise, is the impulse toward compassionate behavior. Victor Nell acknowledges this, but he does not explore the matter any further. I supplement his account by discussing how compassion, specifically in the moral education of children, can help remedy the problem of violence and cruelty in society.

Seth Vannatta identifies the common law as a central feature of the jurisprudence of former United States Supreme Court justice Oliver Wendell Holmes, Jr. Holmes treated the common law as if it were an epistemology or a reliable mode for knowledge transmission over successive generations. Against the grand notion that the common law reflected a priori principles consistent with the natural law, Holmes detected that the common law was historical, aggregated, and evolutionary, the sum of the concrete facts and operative (...) principles of innumerable cases with reasonable solutions to complex problems. This view of the common law is both conservative and pragmatic. Vannatta’s analysis of Holmes opens new directions for the study of conservatism and pragmatism—and pragmatic conservatism—demonstrating that common-law processes and practices have much in common with the form of communal inquiry championed by C.S. It describes the dialectical turn in libertarian political and economic theory and analyzes the diverse contributions to dialectics by the various authors in this volume.

E.M. Forster’s A Passage to India presents Brahman Hindu jurisprudence as an alternative to British rule of law, a utilitarian jurisprudence that hinges on mercantilism, central planning, and imperialism. Building on John Hasnas’s critiques of rule of law and Murray Rothbard’s critiques of Benthamite utilitarianism, this essay argues that Forster’s depictions of Brahman Hindu in the novel endorse polycentric legal systems. Mr. Turton is the local district collector whose job is to pander to both British and Indian interests; positioned as (...) such, Turton is a site for critique and comparison. Forster uses Turton to show that Brahman Hindu jurisprudence is fair and more effective than British bureaucratic administration. Forster’s depictions of Brahman Hindu are not verisimilar, and Brahman Hindu does not recommend a particular jurisprudence. But Forster appropriates Brahman Hindu for aesthetic and political purposes and in so doing advocates a jurisprudence that does not reduce all experience to mathematical calculation. Forster writes against the Benthamite utilitarianism adopted by most colonial administrators in India. A tough figure to pin down politically, Forster celebrates the individual and personal relations: things that British rule of law seeks to suppress. (shrink)

R. E. Allen's superb new translation of Plato's Symposium brings this classic text to life for modern readers. Allen supplements his translation with a commentary that not only enriches our understanding of Plato's philosophy and the world of Greek antiquity but also provides insights into present-day philosophical concerns. Allen reveals the unity of Plato's intentions in the Symposium, explores the dialogue's major themes, and links them with Plato's other dialogues. The Attempt at a Critique of All Revelation was the first published work of Johann Gottlieb Fichte, the founder of the German idealist movement in philosophy. It predated the system of philosophy which Fichte developed during his years in Jena, and for that reason - and possibly also because of its religious orientation - later commentators have tended to overlook the work in their treatments of Fichte's philosophy. It is, however, already representative of the most interesting aspects of Fichte's thought. (...) The image of the poem as an isolated aesthetic object has become untenable as the field has become dominated by concepts of intertextuality, performativity, social construction, and self-fashioning. The text in books like Tony Corbeill's Controlling Laughter (Princeton 1996) is less an object than an action. Thomas Habinek's The World of Roman Song represents an attempt to make good on the promise of these developments by rethinking the entirety of Roman literature as an embedded social process of "song," of marked speech, that stands at the origins of the Roman social order. Ritual hymns, funereal laudations, convivial play, and comedic performances become so many moments in the constitution of what it means to be Roman, even as conflicts between center and periphery, masculine and feminine, vir and cinaedus are both played out and resisted in the various genres that constitute the world of ritualized speech and its formal derivatives.Any such sweeping endeavor brings with it both a necessary boldness—asking us to rethink the history of Roman culture from a new perspective—and the danger of reductiveness. For the most part, these are dangers that Habinek manages skillfully to skirt through a combination of fine-grained philological analysis and a sophisticated, but never overbearing, theoretical apparatus. The World of Roman Song features close readings of the usage of words such as cano, carmen, dico, ludus, convivia, and sodalis, from their earliest attestations through their appearance in later imperial literature. It also deploys an intellectual armature that draws upon contemporary anthropology, Frankfurt-school Marxism, object-relations psychoanalysis, and the theories of Bourdieu, Bakhtin, and Bataille. Complex textual systems become reduced to exemplary moments of embeddedness. Here Habinek traces the relation between three primary sets of terms: dico, dictum, and implicitly dictator, meaning to make an authoritative statement; cano, canto, and carmen, meaning to perform a song (carmen) of one's own (cano), or to repeat that of another (canto), so as to establish a relation between the singer and the constituted social, and ultimately cosmic, whole, via ritualized speech; and ludo, ludus, and lusus, referring to scripted or formalized movements of the body. Thus a poetic ludus, such as that described in Catullus 50 between the poet and Licinius Calvus, would refer not so much to the acts of song (carmina) to which the game of composition gave rise as to the formalized interchange and embodied practice of writing capping verses in different meters in a convivial setting. The previous chapter, "Song and Speech," had established the difference between loquor and dico, with the former referring to unmarked speech and the latter to the making of statements that the speaker asserts as authoritative and hence true. It is thus possible for the terms cano and dico to overlap and those of ludo and cano as well. A survey of the recent literature suggests that physicians should engage religious patients on religious grounds when the patient cites religious considerations for a medical decision. We offer two arguments that physicians ought to avoid engaging patients in this manner. The first is the Public Reason Argument. We explain why physicians are relevantly akin to public officials. This suggests that it is not the physician’s proper role to engage in religious deliberation. This is because the public character of a physician’s (...) role binds him/her to public reason, which precludes the use of religious considerations. The second argument is the Fiduciary Argument. We show that the patient-physician relationship is a fiduciary relationship, which suggests that the patient has the clinical expectation that physicians limit themselves to medical considerations. Probability theory promises to deliver an exact and unified foundation for inquiry in epistemology and philosophy of science. But philosophy of religion is also fertile ground for the application of probabilistic thinking. This volume presents original contributions from twelve contemporary researchers, both established and emerging, to offer a representative sample of the work currently being carried out in this potentially rich field of inquiry. Grouped into five parts, the chapters span a broad range of traditional issues in religious epistemology. The (...) first three parts discuss the evidential impact of various considerations that have been brought to bear on the question of the existence of God. These include witness reports of the occurrence of miraculous events, the existence of complex biological adaptations, the apparent 'fine-tuning' for life of various physical constants and the existence of seemingly unnecessary evil. The fourth part addresses a number of issues raised by Pascal's famous pragmatic argument for theistic belief. Crispin Wright’s discussion of the notion of ‘transmission-failure’ promises to have important philosophical ramifications, both in epistemology and beyond. This paper offers a precise, formal characterisation of the concept within a Bayesian framework. The interpretation given avoids the serious shortcomings of a recent alternative proposal due to Samir Okasha.

Aulisio and Arora argue that the moral significance of value imposition explains the moral distinction between traditional conscientious objection and non-traditional conscientious objection. The former objects to directly performing actions, whereas the latter objects to indirectly assisting actions on the grounds that indirectly assisting makes the actor morally complicit. Examples of non-traditional conscientious objection include objections to the duty to refer. Typically, we expect physicians who object to a practice to refer, but the non-traditional conscientious objector physician refuses to refer. (...) Aulisio and Arora argue that physicians have a duty to refer because refusing to do so violates the patient’s values. While we agree with Aulisio and Arora’s conclusions, we argue value imposition cannot adequately explain the moral difference between traditional conscientious objection and non-traditional conscientious objection. Treating autonomy as the freedom to live in accordance with one’s values, as Aulisio and Arora do, is a departure from traditional liberal conceptions of autonomy and consequently fails to explain the moral difference between the two kinds of objection. We outline how a traditional liberal understanding of autonomy would help in this regard, and we make two additional arguments—one that maintains that non-traditional conscientious objection undermines society’s autonomy, and another that maintains that it undermines the physician-patient relationship—to establish why physicians have a duty to refer. The Procreation Asymmetry holds that we have strong moral reasons not to create miserable people for their own sakes, but no moral reasons to create happy people for their own sakes. To defend this conjunction against an argument that it leads to inconsistency, I show how recognizing ‘creation’ as a temporally extended process allows us to revise the conjuncts in a way that preserves their intuitive force. This defense of the Procreation Asymmetry is preferable to others because it does not (...) require us to take on controversial metaphysical or metaethical commitments – in other words, it has the theoretical virtue of portability. This essay presents deductive arguments to an introductory-level audience via a discussion of Aristotle's three types of rhetoric, the goals of and differences between deductive and non-deductive arguments, and the major features of deductive arguments (e.g., validity and soundness).
