Background Over the last decades, the neurosciences, behavioral sciences, and the social sciences have all seen a rapid development of innovative research methods. The field of bioethics, however, has trailed behind in methodological innovation. Despite the so-called “empirical turn” in bioethics, research methodology for project development, data collection and analysis, and dissemination has remained largely restricted to surveys, interviews, and research papers. We have previously argued for a “Design Bioethics” approach to empirical bioethics methodology, which develops purpose-built methods for investigation (...) of bioethical concerns. In this paper we compare a research tool created using a design bioethics approach to a “methods-as-usual” approach in empirical bioethics. Methods Our study compared dimensions of engagement with a digital game we created, called “Tracing Tomorrow,” to a standard vignette survey. The two tools investigated the same subject matter, digital phenotyping for mental health, in a sample of 301 UK adolescents. Results Participants who played the game reported a greater sense of presence, emotional engagement, cognitive absorption, and mental health ethics insight, compared to participants who completed the vignette survey. Perceived authenticity and curiosity/motivation to learn more was equivalent for both methods. Conclusion The results of this study highlights the importance of purpose-built methodology for empirical bioethics research. (shrink)

How can a state be morally justified in punishing some of its citizens? In tackling this I shall set aside three important matters: we do not morally approve of all the laws of the land, so that sometimes there is a legal but not a moral case against an offender; we can do more things about crime than just punish the criminals, for example remedying the familial and social conditions that encourage it; and, thirdly, many actual penal institutions do things (...) to convicts that are indefensible by any decent standard. My topic may be humanly less important than any of those three; but I want to discuss it and not them. Like many others, I hold that the punishment is justified only to the extent that it does good, that is, leads to a better over-all state of affairs than would have obtained otherwise. Some versions of this view, however, assign to doing-good a role in which it swamps other considerations which most of us think are also essential to a defensible penal system. My aim in this paper will be remedy this defect - to reconcile a doing-good justification with the rest of what we think about punishment. The fear that this cannot be done has led some to question whether our having penal systems and procedures does any good. Jacobs may be right in stressing how hard it is to discover what the consequences are of any given system of punishment (1999: 540), but it would be lamentable if that led us to omit doing-good from our view of what justifies punishment. I shall return to this topic at the end of Section 7, offering to relieve Jacobs of his fears. I usually think of the good that punishment can do in terms of the deterrence of potential offenders - the punished person or others who learn about his punishment. In all the uncertainty about what our penal procedures achieve, it seems certain that they have a deterrent effect without which our society would be lost. There are other possible goods: making the convict a better person; placating victims and their kin; increasing our sense of the majesty and importance of the law; and so on.. (shrink)

In his work, the philosopher John Haugeland (1945–2010) proposed a radical expansion of philosophy's conceptual toolkit, calling for a wider range of resources for understanding the mind, the world, and how they relate. Haugeland argued that “giving a damn” is essential for having a mind—suggesting that traditional approaches to cognitive science mistakenly overlook the relevance of caring to the understanding of mindedness. Haugeland's determination to expand philosophy's array of concepts led him to write on a wide variety of subjects that (...) may seem unrelated—from topics in cognitive science and philosophy of mind to examinations of such figures as Martin Heidegger and Thomas Kuhn. Haugeland's two books with the MIT Press, Artificial Intelligence and Mind Design, show the range of his interests. -/- This book offers a collection of essays in conversation with Haugeland's work. The essays, by prominent scholars, extend Haugeland's work on a range of contemporary topics in philosophy of mind—from questions about intentionality to issues concerning objectivity and truth to the work of Heidegger. Giving a Damn also includes a previously unpublished paper by Haugeland, “Two Dogmas of Rationalism,” as well as critical responses to it. Matthew Adler's Measuring Social Welfare is an introduction to the social welfare function (SWF) methodology. This essay questions some ideas at the core of the SWF methodology having to do with the relation between the SWF and the measure of well-being. The facts about individual well-being do not single out a particular scale on which well-being must be measured. As with physical quantities, there are multiple scales that can be used to represent the same information about well-being; no one scale (...) is special. Like physical laws, the SWF and its ranking of distributions cannot depend on exactly which of these scales we use. Adler and other theorists in the SWF tradition have used this idea to derive highly restrictive constraints on the shape of the SWF. These constraints rule out seemingly plausible views about distributive justice and population ethics. I argue, however, that these constraints stem from a simple but instructive mistake. The SWF should not be applied to vectors of numbers such as 1 and 2, but rather to vectors of dimensioned quantities such as 1 util and 2 utils. This seemingly pedantic suggestion turns out to have far-reaching consequences. Unlike the orthodox SWF approach, treating welfare levels as dimensioned quantities lets us distinguish between real changes in well-being and mere changes in the unit of measurement. It does this without making the SWF depend on the scale on which welfare is measured, and in a way that avoids the restrictive constraints on the shape of the SWF. (shrink)

This article summarizes some of the results of the BIOMED II project “Basic Ethical Principles in European Bioethics and Biolaw” connected to a research project of the Danish Research Councils “Bioethics and Law”. The BIOMED project was based on cooperation between 22 partners in most EU countries. The aim of the project was to identify the ethical principles of respect for autonomy, dignity, integrity and vulnerability as four important ideas or values for a European bioethics and biolaw. The research concluded (...) that the basic ethical principles cannot be understood as universal everlasting ideas or transcendental truths but they rather function reflective guidelines and important values in European culture. The method of the research was conceptual, philosophical analysis of the cultural background of the four values or normative ideas that people use and find important in their existence. Moreover, this was combined with analysis of empirical legal material and policy documents. Also, a number of qualitative interviews with relevant experts were carried out. Another important result of the BIOMED project was the partner's Policy Proposals to the European Commission, the Barcelona Declaration, unique as a philosophical and political agreement between experts in bioethics and biolaw from many different countries. Personal authenticity is out of fashion amongst analytic philosophers. Yet, Kierkegaard, Nietzsche, Heidegger, Sartre and Camus were clearly preoccupied by its theoretical and practical viability. In this study, Jacob Golomb illuminates the writings of these philosophers in an attempt to explain their particular ethical stance on the subject. This book will prove invaluable reading for students and teachers of philosophy, literature and education and indeed for anyone who has ever empathized with Camus's Meursault, Sartre's Matthieu or Nietzsche's Zarathustra.

Alva Noë’s version of the enactive conception in _Action in Perception_ is an important contribution to the study of visual perception. First, I argue, however, that it is unclear (at best) whether, as the enactivists claim, work on change blindness supports the denial of the existence of detailed visual representations. Second, I elaborate on what Noë calls the ‘puzzle of perceptual presence’. Thirdly, I question the enactivist account of perceptual constancy. Finally, I draw attention to the tensions between enactivism and (...) two trends in cognitive neuroscience: the two-visual systems model of human vision and the theory of internal forward models of action. It is often assumed that perceptual experience provides evidence about the external world. But much perception can occur unconsciously, as in cases of masked priming or blindsight. Does unconscious perception provide evidence as well? Many theorists maintain that it cannot, holding that perceptual experience provides evidence in virtue of its conscious character. Against such views, I challenge here both the necessity and, perhaps more controversially, the sufficiency of consciousness for perception to provide evidence about the external world. In addition to (...) motivating and defending the idea that unconscious perception can and does often provide evidence, I observe that whether or not perceptual phenomenology is relevant to the evidentiary status of perception depends on the nature of consciousness. And I argue that a well-supported theory of consciousness—higher-order thought theory—invites a striking conclusion: that perceptual phenomenology is not on its own sufficient to provide for evidence of the external world. A background assumption in much contemporary political philosophy is that justice is the first virtue of social institutions, taking priority over other values such as beneficence. This assumption is typically treated as a methodological starting point, rather than as following from any particular moral or political theory. In this paper, I challenge this assumption. To frame my discussion, I argue, first, that justice doesn’t in principle override beneficence, and second, that justice doesn’t typically outweigh beneficence, since, in institutional contexts, the (...) stakes of beneficence are often extremely high. While there are various ways one might resist this argument, none challenge the core methodological point that political philosophy should abandon its preoccupation with justice and begin to pay considerably more attention to social beneficence—that is, to beneficence understood as a virtue of social institutions. Along the way, I also highlight areas where focusing on social beneficence would lead political philosophers in new and fruitful directions, and where normative ethicists focused on personal beneficence might scale up their thinking to the institutional case. According to the Maximin principle of distributive justice, one outcome is more just than another if the worst off individual in the first outcome is better off than the worst off individual in the second. This is often interpreted as a highly egalitarian principle, and, more specifically, as a highly egalitarian way of balancing a concern with equality against a concern with efficiency. But this interpretation faces a challenge: why should a concern with efficiency and equality lead us to a (...) concern only for the very worst off? Egalitarian proponents of Maximin tend to meet this challenge by showing that it possible to formally derive Maximin from surprisingly weak conditions relating efficiency and equality to justice. But in this paper, I argue that this reply fails. The issue is not that the proofs are invalid, but instead that every existing proof of Maximin transforms into an impossibility result as soon as we realize that any reasonable conception of equality must satisfy a certain formal property. The upshot is that even if it is possible to defend Maximin on other grounds, there is no known way to defend it on the grounds that it balances a concern with equality against a concern for efficiency. Further, more general implications of this result for egalitarian theories of distributive justice are also explored. (shrink)

Drug regulation is fraught with inductive risk. Regulators must make a prediction about whether or not an experimental pharmaceutical will be effective and relatively safe when used by typical patients, and such predictions are based on a complex, indeterminate, and incomplete evidential basis. Such inductive risk has important practical consequences. If regulators reject an experimental drug when it in fact has a favourable benefit/harm profile, then a valuable intervention is denied to the public and a company’s material interests are needlessly (...) thwarted. Conversely, if regulators approve an experimental drug when it in fact has an unfavourable benefit/harm profile, then resources are wasted, people are needlessly harmed, and other potentially more effective treatments are underutilized. Given that such regulatory decisions have these practical consequences, non-epistemic values about the relative importance of these consequences impact the way such regulatory decisions are made (similar to the analysis of laboratory studies on the toxic effects of dioxins presented in Douglas [2000]). To balance the competing demands of the pertinent non-epistemic values, regulators must perform what I call an “inductive risk calculus.” At least in the American context this inductive risk calculus is not well-managed. Standard lore holds that magnetic forces are incapable of doing mechanical work. More precisely, the claim is that whenever it appears that a magnetic force is doing work, the work is actually being done by another force, with the magnetic force serving only as an indirect mediator. However, the most familiar instances of magnetic forces acting in everyday life, such as when bar magnets lift other bar magnets, appear to present manifest evidence of magnetic forces doing work. These sorts of (...) counterexamples are often dismissed as arising from quantum effects that lie outside the classical regime. In this paper, we show that quantum theory is not needed to account for these phenomena, and that classical electromagnetism admits a model of elementary magnetic dipoles on which magnetic forces can indeed do work. In order to develop this model, we revisit the foundational principles of the classical theory of electromagnetism, showcase the importance of constraints from relativity, examine the structure of the multipole expansion, and study the connection between the Lorentz force law and conservation of energy and momentum. David Rosenthal explains conscious mentality in terms of two independent, though complementary, theories—the higher-order thought (“HOT”) theory of consciousness and quality-space theory (“QST”) about mental qualities. It is natural to understand this combination of views as constituting a kind of representationalism about experience—that is, a version of the view that an experience’s conscious character is identical with certain of its representational properties. At times, however, Rosenthal seems to resist this characterization of his view. We explore here whether and to what (...) extent it makes sense to construe Rosenthal’s views as representationalist. Our goal is not merely terminological—discerning how best to use the expression ‘representationalism’. Rather, we argue that understanding Rosenthal’s account as a kind of representationalism permits us not only to make sense of broader debates within the philosophy of mind, but also to extend and clarify aspects of the view itself. In the last several years, there has been an uptick of scholarly interest in Aristotelian theories of efficient causation. Much of this interest has focused on the late scholastic figure Francisco Suárez (1548-1617). This paper clarifies an important but neglected aspect of Suárez's theory of efficient causation—namely, his account of active causal powers. Like other Aristotelians, Suárez understands active causal powers as features that enable their subjects to perform certain sorts of actions. For example, a fire is able to heat (...) in virtue of its power or capacity for heating. However, it is not immediately clear which items in an Aristotelian ontology perform the role of an active power. The paper explains and motivates Suárez's answer to this question, and shows how this answer influences his position in a scholastic controversy about the causal roles of substantial and accidental forms in substantial change. Using video recordings of draft meetings conducted as part of an intramural basketball program as data, this conversation analytic study examines the use of an incomplete utterance in a joint evaluative activity. In particular, we focus on how the participants, volunteer coaches, who meet to draft players for their respective teams, produce a syntactically incomplete utterance as a means to critically assess a player, a non-present third party to the interaction. Analysis reveals that the participants use an incomplete utterance as (...) part of dispreferred design; it allows them to withhold articulating overt criticism of others. By trailing off where the criticism is due, the participants display reluctance to verbalize what is to be said and treat its articulation as delicate. The syntactic structure of the utterance that includes a contrastive conjunction and accompanying embodied actions such as head shakes help them convey a critical stance. We examine the use of incomplete utterances in both agreement and disagreement sequences; the recipients display their unproblematic understanding of the critical assessment and respond by providing their own assessments that either affiliate or disaffiliate with the conveyed critical stance. In this paper, we review a general technique for converting the standard Lagrangian description of a classical system into a formulation that puts time on an equal footing with the system's degrees of freedom. We show how the resulting framework anticipates key features of special relativity, including the signature of the Minkowski metric tensor and the special role played by theories that are invariant under a generalized notion of Lorentz transformations. We then use this technique to revisit a classification of (...) classical particle-types that mirrors Wigner's classification of quantum particle-types in terms of irreducible representations of the Poincaré group, including the cases of massive particles, massless particles, and tachyons. Along the way, we see gauge invariance naturally emerge in the context of classical massless particles with nonzero spin, as well as study the massless limit of a massive particle and derive a classical-particle version of the Higgs mechanism. Since the 1950s, philosophers and AI researchers have held that disambiguating natural language sentences depended on common sense. In 2012, the Winograd Schema Challenge was established to evaluate the common-sense reasoning abilities of a machine by testing its ability to disambiguate sentences. The designers argued only a system capable of “thinking in the full-bodied sense” would be able to pass the test. However, by 2023, the original authors concede the test has been soundly defeated by large language models which still (...) seem to lack common sense of full-bodied thinking. In this paper, we argue that disambiguating sentences only seemed like a good test of common-sense based on a certain picture of the relationship between linguistic comprehension and semantic knowledge—one typically associated with the early computational theory of mind and Symbolic AI. If this picture is rejected, as it is by most LLM researchers, then disambiguation ceases to look like a comprehensive test of common-sense and instead appear only to test linguistic competence. The upshot is that any linguistic test, not just disambiguation, is unlikely to tell us much about common sense or genuine intelligence. (shrink)

Can we describe certain sonic experiences as “homely,” even when they take place outside of a traditional home-space? While phenomenological accounts of home abound, with writers detailing a rich spectrum of the felt characteristics of the homely including safety, familiarity, and affective “warmth,” there is a scarcity of research into sonic experience that engages with such literatures. With specific interest in the experience of embodied space, I account here for what might be termed feelings of “sonic homeliness” as they emerge (...) during headphone listening. After forming a conceptual model of homeliness that draws from phenomenological philosophy, I investigate its applicability to experiences of headphone listening. Through analysis of primary interview data, I consider how headphones may be said to territorialize space for listeners, analyzing how sonic “boundaries” are experienced in relation to the body, as well as how some listeners describe their experiences as interiorized, comforting, and “wombic.”. Since several landmark legal decisions in the 1970s and 1980s, substituted judgment has become widely accepted as an approach to decision‐making for incapacitated patients that incorporates their autonomy and interests. Two notable exceptions have been cases involving minors and those involving cognitively or psychiatrically impaired individuals who never previously possessed the ability to contemplate the medical decisions involved in their care. While a best interest standard may have universal merit in pediatric cases, this paper argues that substituted judgement has been (...) rejected too broadly for “never‐capacitated” patients. It then lays out a three‐condition test for using substituted judgment in these cases. For a subset of “never‐capacitated” patients who belong to distinctive religious or cultural communities with clear medical values and have an appropriate surrogate, these values may prove helpful in vindicating the interests of the never‐capacitated and should not be blanketly dismissed. A conception of probability that can be traced back to Johannes von Kries is introduced: the “Spielraum” or range conception. Its close connection to the so-called method of arbitrary functions is highlighted. Possible interpretations of it are discussed, and likewise its scope and its relation to certain current interpretations of probability. Taken together, these approaches form a class of interpretations of probability in its own right, but also with its own problems. We summarize a new realist, unextravagant interpretation of quantum theory that builds on the existing physical structure of the theory and allows experiments to have definite outcomes but leaves the theory's basic dynamical content essentially intact. Much as classical systems have specific states that evolve along definite trajectories through configuration spaces, the traditional formulation of quantum theory permits assuming that closed quantum systems have specific states that evolve unitarily along definite trajectories through Hilbert spaces, and our interpretation extends this intuitive (...) picture of states and Hilbert-space trajectories to the more realistic case of open quantum systems despite the generic development of entanglement. Our interpretation—which we claim is ultimately compatible with Lorentz invariance—reformulates wave-function collapse in terms of an underlying interpolating dynamics, makes it possible to derive the Born rule from deeper principles, and resolves several open questions regarding ontological stability and dynamics. According to proponents of the continuity hypothesis, metaphors represent one end of a spectrum of linguistic phenomena, which includes various forms of loosening/broadening, such as category extensions and approximations, as well as hyperbolic interpretations. The continuity hypothesis is used to establish that the inferences derived from the set of linguistic expressions mentioned above result from the same or nearly similar pragmatic processes. In this paper, we want to challenge that particular aspect of the continuity hypothesis. We do so based on (...) considerations and analysis of an understudied linguistic phenomenon that we call the metaphorical uses of proper names (MPNs). We first explain how MPNs represent a unique linguistic class distinguishable from, for example, nicknames. In addition, we offer some remarks on how MPNs can be understood against the background of current debates between referentialists and predicativists about names. Our discussion leads us to conclude that MPNs are categorically different from literal interpretations of proper names. We spell out the consequences that the results of our analysis have for the continuity hypothesis. (shrink)

They aim to point the way to practical advances but also to give an accessible guide for those new to the debate.

Descartes bequeathed to his successors what he and they thought to be a sharp, deep split between the mental and the material. He thought it was a split between things, with every thing belonging to one of the two kinds and no thing belonging to both. According to him, a human being is a pair, a duo, a mind and a body; or, more strictly, a human being is a mind that is tightly related to an animal body. The exact (...) nature of that relation was one of the problems that Descartes never solved to his own satisfaction, let alone to anyone else’s. Not all of those who took over the split thought that it was a split through things. It was possible to hold - as I am sometimes inclined to - that material properties are radically different from mental properties, neither being reducible to the other, and yet there are single things, not pairs or duos or small committees, that have properties of both kinds. In the language of the 17th century, that is the belief that matter can think, i.e. that an item that bumps and shoves its way through space can also be the subject of thoughts and experiences and perceptions. In that century an impressive amount of intellectual energy went into debating whether matter could think. I’m going to pick out of that debate certain strands that I hope are still of interest today. They certainly interest me. Such understanding as I have of the philosophy of mind - I mean of what is actually true about mentality, not merely of the history of men’s opinions about it - has come from tracking some of the 17th century writers as they beat their way through the undergrowth. I don’t mean that they eventually led me to true conclusions, which I gratefully swallowed. They got most things wrong, I believe; but there is a lot to be learned from working out where they were wrong and why. (shrink)
