  1. The ubiquity of background knowledge.Jaap Kamps - 2005 - Poznan Studies in the Philosophy of the Sciences and the Humanities 84 (1):317-337.
Scientific discourse leaves implicit a vast amount of knowledge, assumes that this background knowledge is taken into account – even taken for granted – and treated as undisputed. In particular, the terminology in the empirical sciences is treated as antecedently understood. The background knowledge surrounding a theory is usually assumed to be true or approximately true. This is in sharp contrast with logic, which explicitly ignores underlying presuppositions and assumes uninterpreted languages. We discuss the problems that background knowledge may cause (...)

This book is the second of two volumes devoted to the work of Theo Kuipers, a leading Dutch philosopher of science. Philosophers and scientists from all over the world, thirty seven in all, comment on Kuipers’ philosophy, and each of their commentaries is followed by a reply from Kuipers. The present volume is devoted to Kuipers’ neo-classical philosophy of science, as laid down in his Structures in Science . Kuipers defends a dialectical interaction between science and philosophy in that he (...)

Further beyond the Frege boundary.Edward L. Keenan - unknown
avant propos This paper is basically Keenan (1992) augmented by some new types of properly polyadic quantification in natural language drawn from Moltmann (1992), Nam (1991) and Srivastav (1990). In addition I would draw the reader's attention to recent mathematical studies of polyadic quantiicationz Ben-Shalom (1992), Spaan (1992) and Westerstahl (1992). The first and third of these extend and generalize (in some cases considerably) the techniques and results in Keenan (1992). Finally I would like to acknowledge the stimulating and constructive (...)

Euthanasia requests in dementia cases; what are experiences and needs of Dutch physicians? A qualitative interview study.Jaap Schuurmans, Romy Bouwmeester, Lamar Crombach, Tessa van Rijssel, Lizzy Wingens, Kristina Georgieva, Nadine O’Shea, Stephanie Vos, Bram Tilburgs & Yvonne Engels - 2019 - BMC Medical Ethics 20 (1):1-9.
In the Netherlands, in 2002, euthanasia became a legitimate medical act, only allowed when the due care criteria and procedural requirements are met. Legally, an Advanced Euthanasia Directive can replace direct communication if a patient can no longer express his own wishes. In the past decade, an exponential number of persons with dementia share a euthanasia request with their physician. The impact this on physicians, and the consequent support needs, remained unknown. Our objective was to gain more insight into the (...)

Classroom discussion is frequently proposes as an essential part of democratic citizenship education. Literature, however, pays little attention to what kind of discussion is most effective and how teachers can facilitate a discussion. This study aims to contribute to the development of a framework for analysing the characteristics of classroom discussions and the different roles teachers can adopt in guiding a discussion on controversial issues. In addition, we investigated how the way teachers guide the discussion is related to the structure (...)

Reasoning with Rules: An Essay on Legal Reasoning and its Underlying Logic.Jaap Hage - 1996 - Kluwer Academic Publishers.
Rule-applying legal arguments are traditionally treated as a kind of syllogism. Such a treatment overlooks the fact that legal principles and rules are not statements which describe the world, but rather means by which humans impose structure on the world. Legal rules create legal consequences, they do not describe them. This has consequences for the logic of rule- and principle-applying arguments, the most important of which may be that such arguments are defeasible. This book offers an extensive analysis of the (...)

Dialectical models in artificial intelligence and law.Jaap Hage - 2000 - Artificial Intelligence and Law 8 (2-3):137-172.
Dialogues and dialectics have come to playan important role in the field of ArtificialIntelligence and Law. This paper describes thelegal-theoretical and logical background of this role, and discusses the different services into whichdialogues are put. These services include:characterising logical operators, modelling thedefeasibility of legal reasoning, providing the basisfor legal justification and identifying legal issues, and establishing the law in concrete cases. Specialattention is given to the requirements oflaw-establishing dialogues.

Theoretical foundations for the responsibility of autonomous agents.Jaap Hage - 2017 - Artificial Intelligence and Law 25 (3):255-271.
This article argues that it is possible to hold autonomous agents themselves, and not only their makers, users or owners, responsible for the acts of these agents. In this connection autonomous systems are computer programs that interact with the outside world without human interference. They include such systems as ‘intelligent’ weapons and self-driving cars. The argument is based on an analogy between human beings and autonomous agents and its main element asserts that if humans can be held responsible, so can, (...)

Not Able to Lead a Healthy Life When You Need It the Most: Dual Role of Lifestyle Behaviors in the Association of Blurred Work-Life Boundaries With Well-Being.Helen Pluut & Jaap Wonders - 2020 - Frontiers in Psychology 11.
As there is a growing trend for people to work from home, precipitated by the COVID-19 pandemic, this research examines the impact of blurred work-life boundaries on lifestyle and subjective well-being. Our cross-sectional study in the Netherlands demonstrates that heightened levels of blurred work-life boundaries predict negative changes in happiness through enhanced emotional exhaustion. In addition, the findings point to a dual role of lifestyle in this process. On the one hand, we observed that healthy overall lifestyle patterns buffered employees (...)

This commentary discusses several problems with the target article by Ceci et al. First, the results admit of an alternative interpretation that undercuts the conclusion drawn. In addition, at a number of points, the research should be supplemented by examining situations in which there is no tenure-granting policy. Finally, 60% of the questions are concerned with whistle-blowing, but the issues involved in such cases make them much less relevant to the assessment of tenure than the authors suppose. The Athenian sophist Philostratus completed a romanticised biography of Apollonius of Tyana in the second or third decade of the third century A.D. One of the most striking aspects of the presentation of this firstcentury Pythagorean sage and miracleworker in the Vita Apollonii (VA) is his role as 'politically active philosopher'. Not only does the protagonist of the VA regularly intervene in situa-tions of conflict in Greek cities and instruct their citi-zens on how they ought to live together, but he (...)

In addition, we compared innovative learning environments that aim to enhance self-regulated learning with traditional learning environments. This paper proposes a method for computing the temporal aspects of the interpretations of a variety of Germa sentences. The method is strictly modular in the sense that it allows each meaning-bearing sentence constituent to make its own, separate, contribution to the semantic representation of any sentence containing it. The semantic representation of a sentence is reached in several stages. First, an ‘initial semantic representation’ is constructed, using a syntactic analysis of the sentence as input. This initial representation is then (...)

A Theory of Interpretation for Comparative and Chinese Philosophy.Jaap Brakel & Lin Ma - 2016 - Dao: A Journal of Comparative Philosophy 15 (4):575-589.
Why should interpretation of conceptual schemes and practices across traditions work at all? In this paper we present the following necessary conditions of possibility for interpretation in comparative and Chinese philosophy: the interpreter must presuppose that there are mutually recognizable human practices; the interpreter must presuppose that “the other” is, on the whole, sincere, consistent, and right; the interpreter must be committed to certain epistemic virtues. Some of these necessary conditions are consistent with the fact that interpretation is not thwarted (...)

This paper describes a model of legal reasoning and a logic for reasoning with rules, principles and goals that is especially suited to this model of legal reasoning. The paper consists of three parts. The first part describes a model of legal reasoning based on a two-layered view of the law. The first layer consists of principles and goals that express fundamental ideas of a legal system. The second layer contains legal rules which in a sense summarise the outcome of (...)

The paper consists of three parts. In the first part five kinds of defeasibility are distinguished that is ontological, conceptual, epistemic, justification and logical defeasibility. In the second part it is argued that from these, justification defeat is the phenomenon that plays a role in legal reasoning. In the third part, the view is defended that non-monotonic logics are not necessary to model justification defeat, but that they are so to speak the natural way to model this phenomenon.
