This essay is about the difficulties connected with grounding human rights philosophically in a multicultural context. These difficulties are argued to derive from the tension between our aspiration to universal validity and our shared belief in the constitutive role of life-forms, traditions, cultures, and vocabularies vis-à-vis our conceptions of justice. Rawls's and Habermas's approaches to the justification of human rights are then briefly reconstructed and assessed. A symmetrical distribution of strong and weak points is argued to obtain. In the light (...) of this reconstruction, the author explores the potential of his judgment view of justice for providing a justification of the universality of human rights not vulnerable to the difficulties of the other examined approaches. The purpose of this paper is to present the results of a natural experiment involving academic cheating by university students. We explore the relationship of moral judgment to actual behavior, as well as the relationship between the honesty of students self-reports and the extent of cheating. We were able to determine the extent to which students actually cheated on the take-home portion of an accounting exam. The take-home problem was not assigned with the intent of inducing cheating among students. (...) However, the high rate of observed cheating prompted the instructor to return to class and ask the students to provide information on their motivation. The students' responses are the data analyzed in this natural experiment. We found that in a simple regression the relationship between moral judgment scores and cheating behavior was insignificant. However, when we tested whether including Utilizer scores affected the relationship of cheating and moral judgment we found that Utilizer affected the relationship significantly. Finally, we found that moral judgment and honesty were not related, but higher levels of cheating behavior related to less honesty. (shrink)

The five English words—sentence, proposition, judgment, statement, and fact—are central to coherent discussion in logic. However, each is ambiguous in that logicians use each with multiple normal meanings. Several of their meanings are vague in the sense of admitting borderline cases. In the course of displaying and describing the phenomena discussed using these words, this paper juxtaposes, distinguishes, and analyzes several senses of these and related words, focusing on a constellation of recommended senses. One of the purposes of this (...) paper is to demonstrate that ordinary English properly used has the resources for intricate and philosophically sound investigation of rather deep issues in logic and philosophy of language. No mathematical, logical, or linguistic symbols are used. Meanings need to be identified and clarified before being expressed in symbols. We hope to establish that clarity is served by deferring the extensive use of formalized or logically perfect languages until a solid “informal” foundation has been established. Questions of “ontological status”—e.g., whether propositions or sentences, or for that matter characters, numbers, truth-values, or instants, are “real entities”, are “idealizations”, or are “theoretical constructs”—plays no role in this paper. As is suggested by the title, this paper is written to be read aloud. -/- I hope that reading this aloud in groups will unite people in the enjoyment of the humanistic spirit of analytic philosophy. The mere exposure effect is the increase in positive affect that results from the repeated exposure to previously novel stimuli. We sought to determine if judgments other than affective preference could reliably produce a mere exposure effect for two-dimensional random shapes. In two experiments, we found that brighter and darker judgments did not differentiate target from distracter shapes, liking judgments led to target selection greater than chance, and disliking judgments led to distracter selection greater than chance. These results for brighter, (...) darker, and liking judgments were obtained regardless of whether shape recognition was greater (Experiment 1) or not greater (Experiment 2) than chance. Effects of prior exposure to novel shapes were reliably observed only for affective judgment tasks. These results are inconsistent with general predictions made by the nonspecific activation hypothesis, but not the affective primacy or perceptual fluency hypotheses which were discussed in terms of cognitive neuroscience research. Norms are apt for reasoning because they have propositional structure and content; they are practical because they aim to guide action, rather than to describe aspects of the world. These two features hold equally of norms construed sociologically as the norms of specific social groups, and of norms conceived abstractly as principles of action. On either view, norms are indeterminate while acts are particular and determinate. Consequently norms cannot fully specify which particular act is to be done. Are they then (...) not genuinely action-guiding unless supplemented by practical judgment? Yet accounts of practical judgement are often thin, sometimes seeing it as blind, unreasoned `picking' of one rather than another enactment of a norm. However, on another view practical judgement carries the substantive task of seeking ways of acting that satisfy a plurality of norms, which can be both reasoned and practical. The essay argues that individual ethical judgment is a necessary ingredient in an organisation’s ethical performance. Attempts to systematise judgment, removing it from individual responsibility are not successful, and sometimes can even be counterproductive. Focus on systems of accountability can actually detract from the production of ethical behaviour. A number of examples are provided. Although it is much more difficult to produce, individual responsible decision-making and individual judgment should be the features that an organisation focuses on in (...) its interest to promote ethical performance. Accountability systems are important; but they have very limited application toward production of an ethically excellent environment. The essay argues that there has been too much attention paid to accountability systems within organisations, and much too little paid toward the development and cultivation of individual ethical decision making and responsible behaviour. It is suggested that wittgenstein's picture theory of meaning is, In part a synthesis and resolution of the early metaphysics of moore and the theory of judgment held by russell about 1910. Moore's theory of the objective existence of concepts and their propositional role is considered. Russell's unsuccessful attempt at the problem of the false proposition is discussed. The ptm offers a more successful solution, Through the concept of logical form, Akin to the russellian concept of order. The reism adopted by Brentano in the later stages of his philosophy led him to advocate a non-propositional theory of judgment. George Bealer, in his book Quality and Concept, charges that Brentano's theory, and indeed all non-propositional theories of judgment are not adequate to certain "intuitively valid" arguments in the realm of intensional logic. I show that Bealer is mistaken when he claims that Brentano's theory cannot offer an adequate rendering of the first two arguments, and I challenge (...) the intuitive validity of the third. I conclude, therefore, that Bealer's arguments against Brentano do not succeed. (shrink)

Philosopy of medicine focuses inter alia on metaphysics and epistemology that are instantiated in biomedicine as physicalism (or materialism) and empiricism. The Golubchuck case reveals how the clinicans failed to recognize the relation between medical science and medical ethics and made biomedical decsions devoid of medical ethics. That is, they failed to make medical judgments that by defintion include a normative ethical component.

This dissertation engages the following question: how, in the absence of an uncontroversial source of moral guidance, can liberals make political and moral claims across cultural divides? While committed to toleration, liberals cannot escape the compulsion to apply basic standards of equal individual human rights and liberties universally. Under postmetaphysical conditions, however, they no longer find credible arguments that assure them of the sources of these standards in "natural law," "human nature," or "practical reason." Aware that individual rights have their (...) provenance in modern "Western" history, liberals fear being intolerant when they apply these standards universally, and experience as a result a problem of cross-cultural judgement. ;In this project I engage in a sympathetic critique of Richard Rorty's, Jurgen Habermas's and John Rawls's attempts at addressing this problem and provide a fourth alternative that cannot be absorbed by any of their frameworks. Rorty offers liberals the comforts of ethnocentrism. He assures them that political and moral judgements are always made by someone from somewhere. For this comfort, however, he extracts the exorbitant ethical price of other-disregard. Habermas derives individual rights from the universal practice of argumentation. By relying on the overly exacting standard of "rational consensus," however, he limits the applicability of his answer to liberal secular contexts. In his free-standing answer, Rawls offers the promising standard of an "overlapping consensus." His overly static use of this concept, however, drains it of its promise. ;Drawing on each of these attempts as well as on Aristotle's Rhetoric, I offer the alternative of a political project of moral persuasion. Instead of seeking to address the problem of cross-cultural judgement by coup de plume, liberals' best hope is to obviate it in practice, by forging a global, minimally liberal, overlapping consensus. As moral persuaders liberals would intrude actively in nonliberal debates and would seek to convince nonliberals from within their various lights, of the worthiness of the commitment to the freedom and equality of persons. The notions of acting against one's better judgment and self-deception are notoriously problematic. Often, they have been deemed incoherent in a tradition which may be traced back to Socrates. My inquiry into these notions, unlike many others, explicitly draws upon considerations pertaining to the interpretation of speech and action and the role which rationality plays within it, the nature of psychological explanation and the framework in which it is embedded. This work is motivated by the view that, if carried (...) out properly, a study of the mind which focuses on deviant phenomena will also improve understanding of standard cases of action and belief-formation. ;The possibility of acting against one's better judgment seems, prima facie, to be at odds with our notion of action. I begin by critically examining several arguments purporting to show that akrasia is in fact incompatible with the notion of a free intentional action. I show that, overall, an agent appears more rational, and thus more intelligible, if instances of local irrationality of this kind are acknowledged as such rather than re-interpreted as non-akratic actions. The position I reject represents the agent as significantly more inconsistent than necessary, and in some sense, undermines the endeavor of a psychological explanation. ;I proceed to argue that reasons play a unique role in the context of explaining actions. At the same time, the framework of action explanation must be expanded so as to include additional familiar elements such as emotions and fantasies in order to improve understanding of the choices we make. I argue that the causal influence of these elements cannot be fully captured as merely a source of reasons for actions; thus, some of the mental causes responsible for our actions lie outside the realm of reasons. Finally, I show how expanding the explanatory framework of actions makes the phenomenon of akrasia less puzzling in some respects; indeed, this expansion should incline us to expect that persons would act akratically on occasion. ;My discussion of self-deception focuses on two major questions: whether every case of self-deception involves the presence of an intention to form a belief and to what extent this phenomenon warrants a view of the mind as divided. With respect to the first question, I suggest that a view which refrains from interpreting every case of self-deception as involving an intention to form a belief is psychologically more plausible and accounts for some key cases for which the intentionalist view fails to account. As for the second question, I contend that there are at least two ways in which the mind may be properly seen as divided, yet divisions which introduce homuncularism should be rejected. What emerges from my discussion of self-deception, as well as the preceding discussion of akrasia, is a view of the mind that essentially incorporates both rational and non-rational elements. The main sources here are Hume, Husserl, and De Finetti. The problem is how phenomenological investigation has to do with partial or probabilistic judgment. Behavioristic, frequentist and subjectivistic views are briefly surveyed. A variant of Hume's account of the probability of chances is developed with the help of De Finetti's concept of exchangeability. The question of transcendental elements in or behind partial judgment is considered in the light of understanding disagreement and error in partial judgment.

This study investigated inverse preference effects in L2 structural priming of English relative clauses and their potential influences on subsequent learning of target structures. One hundred fourteen Chinese learners of English at a low-to-intermediate proficiency level participated in a structural priming experiment with a pretest-posttest design. The experimental group underwent a priming task in which they orally produced syntactic structures immediately after viewing English object or passive relative clauses as primes, whereas the control group only read sentences unrelated to English (...) relative clauses. A grammaticality judgment task and a sentence completion task were used to measure the inverse preference effect and its subsequent effects on L2 learning. The results showed the presence of structural priming and inverse preference effects in immediate production, which extended to subsequent learning of L2. In subsequent grammaticality judgments and production, L2 learners performed better with English object relative clauses than with English passive relative clauses in comparison with the pretest. The results are discussed in terms of the structural frequency in both L1 and L2 as well as the implicit learning mechanisms of structural priming. (shrink)

The dissertation offers a study of Kant's aesthetic theory as it is developed in the "Critique of Aesthetic Judgment", the first half of his Critique of Judgment, which is widely acknowledged to be the founding text of modern philosophical aesthetics. I aim to show that this work elaborates an important and deeply interesting study of the nature and conditions of aesthetic judgment which---despite the recent resurgence of commentary and of secondary literature---has not yet been inherited. I give (...) an account focused on understanding Kant's idea that aesthetic judgment makes a claim to "subjective universality" and "exemplary necessity", the "twofold peculiarity" of aesthetic judgment that Kant himself presents as the main thematic guiding the course of the Critique. I argue for an interpretation of Kant's notion of aesthetic judgment which takes seriously his idea that its demand for the agreement of others takes the form of a presumption, in which the judge offers her judgment as exemplary of a "universal voice", apart from any independently or transcendentally assured authorization. Brentano’s work contains the seeds of an account of meaning of assertoric utterances according to which the correctness commitment of judgement enables these acts to mean states of affairs. In this point, Brentano’s work contrasts with Marty’s and Grice’s approaches to meaning in which communicative intentions are central. In my contribution, I will develop Brentano’s suggestion in order to make plausible that it is a viable alternative to Grice’s work.
