The legal framework governing claims of medical negligence is extensively documented within South African (SA) jurisprudence, with a predominant focus on the liability of medical practitioners. In contrast, the liability of pharmacists has received comparatively scant attention. This issue was recently highlighted by a case in which a woman from the Western Cape initiated legal action against Clicks, a leading health, beauty and wellness retailer and SA’s largest retail pharmacy chain, alleging that the provision of incorrect medication nearly cost her (...) life. At the time of writing, the case has yet to advance to trial. This article explores the legal and ethical dimensions of medical negligence attributed to pharmacists within the context of their professional duties. Additionally, it investigates how similar cases are adjudicated in foreign jurisdictions, with a specific focus on the US. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. B.K.Matilal, and earlier J.F.Staal, have suggested a reading of the `Nyaya five limb schema' (also sometimes referred to as the Indian Schema or Hindu Syllogism) from Gotama's Nyaya-Sutra in terms of a binary occurrence relation. In this paper we provide a rational justification of a version of this reading as Analogical Reasoning within the framework of Polyadic Pure Inductive Logic.

We discuss the concepts of Weyl and Riemann frames in the context of metric theories of gravity and state the fact that they are completely equivalent as far as geodesic motion is concerned. We apply this result to conformally flat spacetimes and show that a new picture arises when a Riemannian spacetime is taken by means of geometrical gauge transformations into a Minkowskian flat spacetime. We find out that in the Weyl frame gravity is described by a scalar field. We (...) give some examples of how conformally flat spacetime configurations look when viewed from the standpoint of a Weyl frame. We show that in the non-relativistic and weak field regime the Weyl scalar field may be identified with the Newtonian gravitational potential. We suggest an equation for the scalar field by varying the Einstein-Hilbert action restricted to the class of conformally-flat spacetimes. We revisit Einstein and Fokker’s interpretation of Nordström scalar gravity theory and draw an analogy between this approach and the Weyl gauge formalism. We briefly take a look at two-dimensional gravity as viewed in the Weyl frame and address the question of quantizing a conformally flat spacetime by going to the Weyl frame. (shrink)

This is the fourth volume of the Clarendon edition of Robert Burton's Anatomy of Melancholy and the first of three volumes of Commentary. It contains commentary on the text up to p. 327 of volume one - i.e. The Argument of the Frontispeice, Democritus to the Reader, and Partition 1 as far as the end of Section 2, Member 3, Subsection 15: 'Misery of Schollers'. In his study of morbid psychology as it was understood in his day, Burton cites many (...) other writers. No previous edition of the Anatomy has identified all of these or verified all his quotations. In addition to explanatory notes and translations of all the passages in Latin, this edition attempts to locate all Burton's sources in the actual books he himself owned or to which he probably had access. The last of the three volumes of commentary will contain a Biobibliography listing over 1,500 authorities referred to by Burton, many very obscure, and will give not only bibliographical details but information about the writers. We investigate the relative probabilistic support afforded by the combination of two analogies based on possibly different, structural similarity (as opposed to e.g. shared predicates) within the context of Pure Inductive Logic and under the assumption of Language Invariance. We show that whilst repeated analogies grounded on the same structural similarity only strengthen the probabilistic support this need not be the case when combining analogies based on different structural similarities. We characterize those identities and independencies which hold for all probability functions on a unary language satisfying the Principle of Atom Exchangeability. We then show that if this is strengthen to the requirement that Johnson's Sufficientness Principle holds, thus giving Carnap's Continuum of inductive methods for languages with at least two predicates, then new and somewhat inexplicable identities and independencies emerge, the latter even in the case of Carnap's Continuum for the language with just a single predicate.

We show that in Polyadic Pure Inductive Logic the Invariance Principle, based on consideration of symmetry with respect to automorphisms, has only a trivial solution, namely the polyadic equivalent of Carnap’s $$c_0$$ c 0. (This extends a result proved earlier in the unary case.) We then consider the Exchangeable Invariance Principle, a symmetry principle which is a weakening of the Invariance Principle and has been proven to be strictly stronger than the Permutation Invariance Principle. We show that the Exchangeable Invariance (...) Principle follows from Spectrum Exchangeability, a principle not obviously based on symmetry but based on irrelevance, that is treating certain features as irrelevant for the purpose of belief assignment, and that the converse does not hold. We conclude that Spectrum Exchangeability is the strongest currently known rational principle of belief assignment in Pure Inductive Logic that does not lead to the aforementioned trivial solution. The question of meaning entered sociology from the beginning. It is at issue with Marx’s theory of alienation and Weber’s method Verstehen. It was also at issue in the theoretical conflicts of naturalistic and positivistic with Marxist and verstehen-oriented methodologists. This would suggest that the perennial problem about what ‘sociology’ is or might be is at root about what ‘meaning’ is or might be.
