Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. With its emphasis on analytical dualism and its detailed account of the concepts and methods necessary for its application, Margaret Archer's morphogenetic approach seems to provide significant potential for empirical research. Over a decade after its publication, however, the potential of the approach remains largely unrealised. This paper seeks to begin to address this situation by reporting on and assessing the application of the morphogenetic approach to a longitudinal case study of information systems development and organisational change in British local (...) government. This assessment confirms Archer's claims for the approach's value as an instrument for the production of non-conflationary practical social theory. In addition, certain features of the methodology moved the analysis of IS and organisational change beyond that of more mainstream approaches used for this type of research. However, a range of issues are identified which demonstrate that the complexity and resulting resource intensity of the approach may well work against its more widespread adoption for empirical research. The main result proved in the paper is that on every recursive structure the intrinsically hyperarithmetical sets coincide with the relatively intrinsically hyperarithmetical sets. As a side effect of the proof an effective version of the Kueker's theorem on definability by means of infinitary formulas is obtained.

ABSTRACT In this article I confront and criticize the widespread tendency to ignore, marginalize, or dismiss without serious consideration Nietzsche's psychological hypothesis that a “will to power” is the major motivator of human behavior. I begin by separating Nietzsche's psychological hypothesis from both his occasional cosmological extension of it into an account of all processes in the world and from his power-based theory of value. And I argue that, since the psychological thesis does not depend on the cosmological extension, is (...) more fundamental to Nietzsche's overall project, and is much better supported by Nietzsche's argument, it deserves to be seriously considered on its own merits. Then, I critically consider Robert Solomon's attempts to deny any value at all to the will to power as a general motivational hypothesis and to reinterpret Nietzsche's theory of the will to power in a way that ignores what Nietzsche actually says about it and, moreover, radically undermines its significance. This article has four main objectives. First, it introduces the ideal types of domination of Weber. Contrary to the received wisdom, which knows only “three ideal types” (traditional, charismatic and legal rational) I present the “fourth” type of domination, Weber called “Wille der Beherrschten” as an important correction of his ideal type of legal-rational authority. Next I make a novel, critical distinction between patrimonial and prebendal types of traditional authority. Third, I discuss various ways that communist regimes tried to legitimate (...) themselves and how they entered eventually a legitimation crisis, leading to the collapse of communism. In the next section, I explore the different ways post-communist capitalisms seek legitimacy (with various combinations of legal rational authority and patrimonialism), and finally I conclude with a trend of re-convergence of some post-communist systems (especially Russia and Hungary, but with signs for similar trends elsewhere) into an illiberal, prebendal quasi-democratic system. Karl Polanyi’s scholarship is interpreted in radically different ways. The “hard” reading of Polanyi sees him as a radical socialist; the “soft” reading presents him as a theorist of mixed economy. This article sides with the soft interpretation. It uses Polanyi’s biography to explain his theoretical “elusiveness,” presents a novel interpretation of his three types of economic integration, claiming all economies are “mixed.” While it acknowledges Polanyi as one of the major sources of world system theory, it claims that Polanyi (...) saw not only the dangers, but also the necessity and positive consequences of globalization. Finally, it shows that, in spite of Polanyi’s life-long commitment to the political left, his scholarly work did not offer an apology of socialism. Instead this article uses Polanyi’s theory of economic integration to build a critical political economy of state socialism. (shrink)

We assessed students’ and employees’ perception of ethical climate at a university school of medicine compared to that of social sciences and humanities, as well as temporal changes in the employees’ perception of ethical climate. We also explored potential predictors of ethical climate, including moral foundations. This cross-sectional questionnaire study was conducted at the University of Split School of Medicine and the Faculty of Humanities and Social Sciences, in Croatia, from April to September 2019. We used 36-item Ethical Climate Questionnaire (...) and 22-item Moral Foundation Questionnaire to survey employees, senior and doctoral students. We collected responses using ballot boxes as well as online survey. We collected 449 complete responses. The dominant ethical climates at two schools were “Company rules and procedures” and “Laws and professional codes”. We compared our results with a study conducted in 2012 and found that the perception of ethical climate had not changed dramatically in last 8 years. Ethical climate, or shared social and work-related behaviours, does not seem to change in these institutions even when students and staff are included with faculty in surveys. We provide further discussion of why this seems to be the case. (shrink)

While agreeing with Bernard Reginster that Nietzsche's advocacy of the will to power as a psychological thesis is much more fundamental than his extension of it as a cosmological or metaphysical thesis, I criticize him for failing to support this interpretation, and I attempt to supply an analysis that does support it. Then, I take issue with the common tendency to sanitize Nietzsche's theory of the will to power, to make it more palatable—and with Reginster's treatment of this issue. En este artículo, se analiza la expansión en el número de novelas publicadas en Costa Rica entre 1990 y 2024. Tal proceso, favorecido por el crecimiento de la actividad editorial privada, dependió de la capacidad económica de los autores (hombres más que mujeres) para financiar sus obras. A partir del siglo XXI, la autopublicación fue reforzada por el surgimiento de plataformas donde es posible publicar de manera gratuita, como la de Amazon. Dado que esta novelística no respondió a una demanda (...) efectiva de diversas audiencias de lectores, tuvo un alcance limitado: por lo general, las personas solo publicaron una novela, y de la mayoría de los textos, se publicó solo una edición. El artículo presenta las críticas más importantes a la forma como la filosofía política liberal de John Rawls aborda el problema del carácter público de los argumentos filosóficos y religiosos en la sociedad pluralista contemporánea, en el entendido que tales críticas manifiestan los dilemas que tiene el planteamiento rawlsiano para ser implementado prácticamente. Se sugiere también que el autor le otorga a dichos argumentos un carácter semipúblico en el debate político, toda vez que mantiene cierta sospecha sobre su potencial para (...) desestabilizar una sociedad democrática. De este modo se pone en evidencia la seria dificultad de establecer una propuesta liberal de la justicia que eluda totalmente la cuestión del bien. (shrink)

A lo largo del presente artículo se pretende analizar la problematización foucaulteana de las ciencias humanas elaborada en el contexto de sus trabajos sobre biopolítica y gubernamentalidad. En ese sentido, la biopolítica y la gubernamentalidad en cuanto tales no constituyen el objeto de nuestra indagación, sino que más bien es a través del abordaje foucaulteano de dichas problemáticas que buscaremos revisar su lectura respecto de los saberes acerca de “lo humano”.

La exposición de los regímenes políticos del Tratado Político no es aleatoria; Spinoza expone en primer lugar el que menos conviene, esto es, el monárquico, después el que conviene más, la aristocracia, y finalmente la democracia, régimen al que concibe como el más perfecto. Este criterio de exposición no sirve de criterio para investigar cuál es el valor de la democracia para Spinoza, pero nos permite investigar cuál es el principal obstáculo o peligro que debe enfrentar la democracia para que (...) se pueda instituir realmente por parte de los ciudadanos, y para que no sea instrumentalizada por los intereses particulares de los gobernantes y políticos de turno. The article examines the essays dedicated to the philosophy of the late Fichte, specifically to the concept of the image and the absolute (Netrebiak, 2022 and 2024). It demonstrates the issues arising, on the one hand, from neglecting the context of Fichte’s philosophy in attempts to interpret his late philosophy and, on the other hand, from misinterpreting Fichte’s terminology and incorrect translations of his texts. Additionally, it refutes the claim regarding the theological context of Fichte’s philosophy, which consistently developed Kant’s (...) program of transcendental philosophy. This program aimed at reforming Christian epistemology and ethics by considering knowledge as the source of faith. The article also deals with Kant’s thesis on the setting aside (aufheben) of knowledge in order to make room for faith (KrV, B XXX) in the context of Luther’s translation of the biblical verb καταργεῖν (Rom. 3:31) as Kant’s claim for a reformation of Christianity. The path of Christianity (and the Christian philosopher) is the justification of knowledge (law, norms) through faith. Kant, however, radically rethinks this stance by justifying faith through knowledge. At bottom, Kant revises Christianity by rejecting transcendence, the supposed source of epistemic and practical world relations, leading to his critique of Christian ethics and its golden rule of morality whithin his doctrine of categorical imperatives. From this perspective, Fichte merely continues Kant’s program of transcendental philosophy, offering a path from knowledge to faith. Attempts to put forward a theological interpretation of Fichte’s Wissenschaftslehre fundamentally contradict both the early and later versions of the Wissenschaftslehre, as they disregard the epistemological context in which Fichte consistently developed Kant’s revolutionary equating of objective validity with objective reality, even though he employed his own original theoretical vocabulary. This article examines Schopenhauer’s influence on Nietzsche’s work. It considers how Nietzsche adopted some of his central ideas from Schopenhauer, how he exploited some of Schopenhauer’s positions to suit his own purposes, and how he developed some of his ideas as alternatives to Schopenhauerian positions. Nietzsche’s first published book, The Birth of Tragedy, is based on a Schopenhauerian metaphysical framework. Schopenhauer’s principle of individuation applicable to the world of representations is the key element in Nietzsche’s concept of the Apollonian and (...) Schopenhauer’s principle of the undifferentiated nature of ultimate reality of the will is the key element in Nietzsche’s concept of the Dionysian. (shrink)

In this paper we seek to take notice of the evolution and continuity of Jan Patočka’s phenomenology on the topic of the world and human existence’s relationship with it. We believe that this problem underlies and stimulates Patočka’s whole phenomenological research and we think that it is a key element to understand the ensemble of his thought.

An external characterization of the inductive sets on countable abstract structures is presented. The main result is an abstract version of the classical Suslin-Kleene characterization of the hyperarithmetical sets.

En este artículo examinamos a grandes rasgos la alternativa a la idea de lucha en el proceso de reconocimiento mutuo. Analizamos los conceptos que en nuestras sociedades modernas han dado lugar a estados de paz concretos, y que habiendo emergido de la tradición cristiana, tienen una sedimentación semántica que nos invita a desentrañarla. La philia, el eros y el ágape son aquí nuestros conceptos clave. The article traces possible channels of influence of a religious factor on the formation of a specific Russian version of socialism. Using the logics of the M. Weber?s work?The Protestant Ethic and the Spirit of Capitalism?, I. Zabaev reveals the categories that played a dominating role in the people?s consciousness in the pre-revolutionary Russia. According to his conclusion, these categories were?obedience? and?resignation?. It was obedience and resignation that assured the salvation of an Orthodox person. In everyday life such orientations were (...) easily transformed into the readiness to obey the?superior?. Once elaborated, they turned to be quite stable and, being separated from their religious roots, ensured a sort of asceticism on the secular path. (shrink)

Recent anti-governmental social movements in countries of former Yugoslavia have awakened the spirit of contention which had been dormant for almost two decades. The overwhelming economic deprivation, accompanied by the massive violation of basic human rights of the citizens, urged the challengers to take the streets.This paper is focused on comparison of two movements, the “Citizens for Macedonia” movement in the Republic of Macedonia and the “Bosnian Spring” in Bosnia and Herzegovina, highlighting the role and influence of movements on the (...) occurrence of policy outputs which articulated claims put forward by social movement organizations as well as other movement actors in the two respective countries. The analysis will be conducted taking into consideration specific social movement related variables like forms/types of claims-making and repertoires of action, as well as wider political process factors such as repression by state actors, and the attitude of allies and opponents of the movements.Regarding the methodological approach, we will apply a mixed comparative research design, with variation both on side of the independent and the dependent variables. Since the outcomes of the movements are already tangible, we will also apply elements of process tracing methodology, reconstructing the events as much as possible. My primary data collection tools encompass in-depth interviews with four specific categories of interviewees as well as thorough document analysis referring to the policy outputs. (shrink)

The main goal of the following article is to present and justify the philosophical concept of degrowth as a real alternative to the cult of (unlimited economic) growth, the driving force of which is the pursuit of profit, which devastates the individual and the entire society, and last but not least, nature and the climate. It is also critical of today’s generally recognized options for solving the climate crisis, such as the strategy of the so-called sustainable development or green growth, (...) which – as the author shows with several examples – may indeed help to solve it, but they do not consistently solve it. Such a permanent solution must involve a total and radical change in the way of life, which, would limit people, but would also be attractive enough for them. Although the focus is on a philosophical analysis of the whole issue, the author considers its historical, sociological and political aspects as well, to avoid excessive generalities and at the same time keep its philosophical breadth and depth. ---------------------------------------- Received: 19/06/2024.
