Sentences such as Olivia can take Logic or Algebra (‘♢∨-sentences’) are typically interpreted as entailing that Olivia can take Logic and can take Algebra. Given a standard semantics for modals and disjunction, those ‘Free choice’ (FC) readings are not predicted from the surface form of ♢∨-sentences. Yet the standard semantics is appropriate for the ‘double prohibition’ reading typically assigned to ¬♢∨-sentences like Olivia can’t take Logic or Algebra. Several extant approaches to FC can account for those two cases, but face (...) challenges when ♢∨, ¬♢∨ and related sentences appear embedded in certain environments. In this paper, we present a novel account of FC that builds on a ‘grammatical’ theory of scalar implicatures — proposed by Bassi et al. (2021) and Del Pinal (2021) — according to which covert exhaustification is a presupposition trigger such that the prejacent forms the assertive content while any excludable or includable alternatives are incorporated at the non-at issue, presuppositional level. Applied to ♢∨, ¬♢∨, and similar sentences, ‘presuppositional exhaustification’ predicts that their default interpretations have an assertive component (roughly, the classical interpretation of the prejacent) and a homogeneity presupposition which projects in standard ways. Those predictions, we then show, support a uniform account of the puzzling behavior of ♢∨, ¬♢∨, and related sentences when embedded under (negative) factives (Marty & Romoli 2020), disjunctions (Romoli & Santorio 2019), and in the scope of universal, existential (Bar-Lev & Fox 2020) and non-monotonic quantifiers (Gotzner et al. 2020). Grammatical theories of Scalar Implicatures make use of an exhaustivity operator exh, which asserts the conjunction of the prejacent with the negation of excludable alternatives. We present a new Grammatical theory of Scalar Implicatures according to which exh is replaced with pex, an operator that contributes its prejacent as asserted content, but the negation of scalar alternatives at a non-at-issue level of meaning. We show that by treating this non-at-issue level as a presupposition, this theory resolves a number of empirical (...) challenges faced by the old formulation of exh (as well as by standard neo-Gricean theories). The empirical challenges include projection of scalar implicatures from certain embedded environments (‘some under some’ sentences, some under negative factives), their restricted distribution under negation, and the existence of common ground-mismatching and oddness-inducing implicatures. We argue that these puzzles have a uniform solution given a pex-based Grammatical theory of implicatures and some independently motivated principles concerning presupposition projection, cancellation and accommodation. Abstract:One view of practical reasoning is that it involves the weighing of reasons. It is not clear, however, how the weights of reasons combine, especially given the logical and substantive relations among different reasons. Nor is it clear how the weighing of reasons relates to decision theoretic maximization of expected value. This paper constructs a formal model of reasons and their weight in order to shed light on these issues. Asymmetrical convergence is the increasing overlap between academic and industrial sectors, but with academia moving closer toward for-profit industrial norms than vice versa. Although this concept, developed by Kleinman and Vallas, is useful, processes of asymmetrical convergence in daily laboratory life are largely unexplored. Here, observations of three lab groups of chemical scientists in academic and industry contexts illustrate variation in interactions with ethics-related policies. Findings show more tension for academic science with business-based practices, such as the move toward greater (...) accountability, than for industrial science with academic practices. This asymmetry is evident in the process of purposive decoupling: for example, where academic scientists use humor to distance themselves from the performance of compliance in required reporting and top-down ethics training requirements. This distancing from meaningless requirements contrasts with mentoring around practices of professional behavior that are thought to matter. Convergence is evident in how safety policies seem more engaging than other kinds of policies. Yet, power structures shape engagement. Academic engagement often means rule following, and flows vertically from professor’s authority to student apprenticeship. Industry engagement includes collaborative problem solving and flows along a more horizontal peer structure where informal power is less visible. (shrink)

Intuition is frequently used in medicine. Along with the use of existing medical rules, there is a separate channel that physicians rely on when making decisions: their intuition. To cope with the epistemic problem of using intuition, I use some clues from Wittgenstein's philosophy to illuminate the decision-making process in medicine. First, I point to a connection between intuition as functioning in medicine and Wittgenstein's notions of "seeing as" or noticing "aspects". Secondly, I use Wittgenstein notion of empirical regularities hardened (...) into rules to suggest that there are two stages that should be addressed in the analysis of medical practice: the first concerns the accumulation of cases and the second pertains to the setting a rule based on these cases. I argue further that the medical context is exceptional in that the two stages are intertwined and, and explain the consequences of this fact for the physician's work. Finally, inspired by Wittgenstein's rule-following conundrum, I argue that medicine is particularly prone to difficulties in applying a general rule to a specific case represented by an individual patient. Recourse to intuition is reflects the physicians' efforts to bridge this gap. (shrink)

Objective: The purpose of this study was to demonstrate how educators involved in the teaching of bioethics to healthcare university students in Japan would cope with ethical disagreement in the classroom, and to identify factors influencing them.Methods: A cross sectional survey was conducted using self administered questionnaires mailed to a sample of university faculty in charge of bioethics curriculum for university healthcare students.Results: A total of 107 usable questionnaires were returned: a response rate of 61.5%. When facing ethical disagreement in (...) the classroom, coping behaviour differed depending on the topic of discussion, was influenced by educators’ individual clear ethical attitudes regarding the topic of discussion, and was independent of many respondents’ individual and social backgrounds. Among educators, it was commonly recognised that the purpose of bioethics education was to raise the level of awareness of ethical problems, to provide information about and knowledge of those issues, to raise students’ sensitivity to ethical problems, and to teach students methods of reasoning and logical argument. Yet, despite this, several respondents considered the purpose of bioethics education to be to influence students about normative ethical judgments. There was no clear relationship, however, between ways of coping with ethical disagreement and educators’ sense of the purpose of bioethics education.Conclusions: This descriptive study suggests that educators involved in bioethics education for healthcare university students in Japan coped in various ways with ethical disagreement. Further research concerning ethical disagreement in educational settings is needed to provide better bioethics education for healthcare students. (shrink)

This in particular applies to type-definable or hyper-definable objects in a classical first-order structure.

For a locally compact group G, we show that it is possible to present the class of continuous unitary representations of G as an elementary class of metric structures, in the sense of continuous logic. More precisely, we show how nondegenerate ∗-representations of a general ∗-algebra A (with some mild assumptions) can be viewed as an elementary class, in a many-sorted language, and use the correspondence between continuous unitary representations of G and nondegenerate ∗-representations of L1(G). We relate the notion (...) of ultraproduct of logical structures, under this presentation, with other notions of ultraproduct of representations appearing in the literature, and we characterize property (T) for G in terms of the definability of the sets of fixed points of L1 functions on G. Artificial intelligence (AI) technologies in medicine are gradually changing biomedical research and patient care. High expectations and promises from novel AI applications aiming to positively impact society raise new ethical considerations for patients and caregivers who use these technologies. Based on a qualitative content analysis of semi-structured interviews and focus groups with healthcare professionals (HCPs), patients, and family members of patients with Parkinson’s Disease (PD), the present study investigates participant views on the comparative benefits and problems of using human versus (...) AI predictive computer vision health monitoring, as well as participants’ ethical concerns regarding these technologies. Participants presumed that AI monitoring would enhance information sharing and treatment, but voiced concerns about data ownership, data protection, commercialization of patient data, and privacy at home. They highlighted that privacy issues at home and data security issues are often linked and should be investigated together. Findings may help technologists, HCPs, and policymakers determine how to incorporate stakeholders’ intersecting but divergent concerns into developing and implementing AI PD monitoring tools. Given a continuous and isometric action of a Polish group G on an adequate Polish topometric space $(X,\tau,\rho )$ and $x \in X$, we find a necessary and sufficient condition for $\overline {Gx}^{\rho }$ to be co-meagre; we also obtain a criterion that characterizes when such a point exists. This work completes a criterion established in earlier work of the authors.

The argument from inductive risk claims that judgments about the moral severity of errors are relevant to decisions about what should count as sufficient evidence for accepting claims. While this idea has been explored in connection with evidence required for the approval of pharmaceuticals, the role of inductive risk in the post-approval process has been largely neglected. In this article, we examine the ethics of inductive risk in connection with revisions to the product monograph for OxyContin in Canada, which understates (...) the risks of addiction and abuse associated with this drug. Using the concept of inductive risk, we consider what evidence should have been sufficient for Health Canada to revise the product monograph for OxyContin. Given the stakes involved, we argue that a less strict standard of evidence would have been appropriate, yet HC in fact took the opposite course, insisting upon a higher standard of evidence than it normally requires. In addition to providing a novel perspective on the opioid crisis in Canada, this article contributes to existing philosophical work by demonstrating that inductive risks in the post-approval stage are important and linked to pre-approval inductive risks. Jaegwon Kim (1998a, 2005) claims that his exclusion problem follows a priori for the non-reductive physicalist given her commitment to five apparently inconsistent theses: mental causation, non-identity, supervenience, causal closure and non-overdetermination. For Kim, the combination of these theses entails that mental properties are a priori excluded as causes, forcing the non-reductive physicalist to accept either epiphenomenalism, or some form of reduction. In this thesis, I argue that Kim’s exclusion problem depends on a particular conception of causation, namely sufficient production, (...) and that when causation is understood in interventionist terms, the non-reductive physicalist can avoid the exclusion problem. I argue that Woodward’s (2003, 2008a, 2011a) version of interventionism not only provides an account of mental causation that avoids the exclusion problem, but argue that it also upholds all of the minimal commitments of non-reductive physicalism, thereby providing a successful non-reductive physicalist solution to the exclusion problem. In Chapter 2, I argue that all five theses are minimal commitments of non-reductive physicalism that cannot be rejected in order to avoid the exclusion problem. Chapter 3 identifies the assumptions that I take to underlie the exclusion problem. Chapter 4 introduces and outlines the central features of Woodward’s (2003) interventionism and Chapter 5 argues that Woodward’s interventionist account of mental causation provides a solution to the exclusion problem. I examine two alternative interventionist accounts of mental causation[1] that fail to provide satisfactory solutions to the exclusion problem and conclude that Woodward’s account therefore provides the only satisfactory account of mental causation and solution to the exclusion problem. Chapter 6 addresses some challenges proposed by Michael Baumgartner (2009, 2010) and argues that the interventionist is able to defend her position against these objections and uphold the interventionist solution to the exclusion problem outlined in this thesis. Ethics in public administration has been a subject of growing interest for both researchers and practitioners interested in the future of governance. This study examined the relationship between ethics and performance in local governance. We tested the effects over time of an ethics program on employees' perceptions (awareness of the code of ethics, ethical leadership, inclusion of employees in ethical decision making [EDM], ethical climate [EC], organizational commitment, and quality of work life [QWL]) and behavior (organizational citizenship behavior) in one (...) Israeli regional council. We conducted a longitudinal study of 108 employees, using data from a two-phase survey (before implementation of the ethics program and a year after) and objective assessments of employees' behavior through managers' evaluations. The main findings show that the ethics program was very effective, resulting in greater awareness of the code of ethics, increased inclusion of employees in EDM, and an improved EC. Furthermore, ethical leadership was positively related to employees' awareness of the code of ethics, increased inclusion of employees in EDM, an improvement in the EC, greater organizational commitment, and higher QWL. We analyse a recent paper in which an alleged devastating criticism of the so called GRW proposal to account for the objectification of the properties of macroscopic systems has been presented and we show that the author has not taken into account the precise implications of the GRW theory. This fact makes his conclusions basically wrong. We also perform a survey of measurement theory aimed to focus better on the physical and the conceptual aspects of the so-called macro-objectification problem.

-/- Continuous first-order logic has found interest among model theorists who wish to extend the classical analysis of “algebraic” structures (such as fields, group, and graphs) to various natural classes of complete metric structures (such as probability algebras, Hilbert spaces, and Banach spaces). With research in continuous first-order logic preoccupied with studying the model theory of this framework, we find a natural question calls for attention. Is there an interesting set of axioms yielding a completeness result? -/- The primary purpose (...) of this article is to show that a certain, interesting set of axioms does indeed yield a completeness result for continuous first-order logic. In particular, we show that in continuous first-order logic a set of formulae is (completely) satisfiable if (and only if) it is consistent. From this result it follows that continuous first-order logic also satisfies an approximated form of strong completeness, whereby Σ⊧φ (if and) only if Σ⊢φ ∸2−n for all n < ω. This approximated form of strong completeness asserts that if Σ⊧φ, then proofs from Σ, being finite, can provide arbitrarily better approximations of the truth of φ. -/- Additionally, we consider a different kind of question traditionally arising in model theory—that of decidability. When is the set of all consequences of a theory (in a countable, recursive language) recursive? Say that a complete theory T is decidable if for every sentence φ, the value φ T is a recursive real, and moreover, uniformly computable from φ. If T is incomplete, we say it is decidable if for every sentence φ the real number φ T o is uniformly recursive from φ, where φ T o is the maximal value of φ consistent with T. As in classical first-order logic, it follows from the completeness theorem of continuous first-order logic that if a complete theory admits a recursive (or even recursively enumerable) axiomatization then it is decidable. Studies of public health decisions that have had harmful effects tend to disagree about what constitutes a public health error. Debates exist about whether public health errors must be culpable or not, as well as about what the criteria for judging public health errors should be.

We point out how the "Fundamental Theorem of Stability Theory", namely the equivalence between the "non order property" and definability of types, proved by Shelah in the 1970s, is in fact an immediate consequence of Grothendieck's "Criteres de compacite" from 1952. The familiar forms for the defining formulae then follow using Mazur's Lemma regarding weak convergence in Banach spaces.

Due to improvements in medicine, the figures of patients with disorders of consciousness (DoC) are increasing. Diagnostics of DoC and prognostication of rehabilitation outcome is challenging but necessary to evaluate recovery potential and to decide on treatment options. Such decisions should be made by doctors and patients’ surrogates based on medico-ethical principles. Meeting information needs and communicating effectively with caregivers as the patients´ most common surrogate-decision makers is crucial, and challenging when novel tech-nologies are introduced. This qualitative study aims to (...) explore information needs of informal DoC caregivers, how they manage the obtained information and their perceptions and experiences with caregiver-physician communication in facilities that implemented innovative neurodiagnostics studies. In 2021, we conducted semi-structured interviews with nine caregivers of clinically stable DoC patients in two rehabilitation centers in Italy and Germany. Participants were selected based on consecutive purposeful sampling. Caregivers were recruited at the facilities after written informed consent. All interviews were recorded, transcribed verbatim and translated. For analysis, we used reflexive thematic analysis according to Braun & Clarke (2006). Caregivers experienced the conversations emotionally, generally based on the value of the information provided. They reported to seek positive information, comfort and empathy with-in the communication of results of examinations. They needed detailed information to gain a deep understanding and a clear picture of their loved-one’s condition. The results suggest a mismatch between the perspectives of caregivers and the perspectives of medical profession-als, and stress the need for more elaborate approaches to the communication of results of neu-rodiagnostics studies. ObjectiveProcessing Speed, the ability to perceive and react fast to stimuli in the environment, has been shown to be impaired in children with attention deficit hyperactivity disorder. However, it is unclear whether PS can be improved following targeted treatments for ADHD. Here we examined potential changes in PS following application of transcranial electric stimulation combined with cognitive training in children with ADHD. Specifically, we examined changes in PS in the presence of different conditions of mental fatigue.MethodsWe used a randomized double-blind (...) active-controlled crossover study of 19 unmedicated children with ADHD. Participants received either anodal transcranial direct current stimulation over the left dorsolateral prefrontal cortex or transcranial random noise stimulation, while completing CT, and the administration order was counterbalanced. PS was assessed before and after treatment using the MOXO-CPT, which measures PS in the presence of various conditions of mental fatigue and cognitive load.ResultstRNS combined with CT yielded larger improvements in PS compared to tDCS combined with CT, mainly under condition of increased mental fatigue. Further improvements in PS were also seen in a 1-week follow up testing.ConclusionThis study provides initial support for the efficacy of tRNS combined with CT in improving PS in the presence of mental fatigue in pediatric ADHD. We develop several aspects of local and global stability in continuous first order logic. In particular, we study type-definable groups and genericity.

We give a general framework for the treatment of perturbations of types and structures in continuous logic, allowing to specify which parts of the logic may be perturbed. We prove that separable, elementarily equivalent structures which are approximately $aleph_0$-saturated up to arbitrarily small perturbations are isomorphic up to arbitrarily small perturbations. As a corollary, we obtain a Ryll-Nardzewski style characterisation of complete theories all of whose separable models are isomorphic up to arbitrarily small perturbations.

We present an adaptation of continuous first order logic to unbounded metric structures. This has the advantage of being closer in spirit to C. Ward Henson's logic for Banach space structures than the unit ball approach, as well as of applying in situations where the unit ball approach does not apply. We also introduce the process of single point emph{emboundment}, allowing to bring unbounded structures back into the setting of bounded continuous first order logic. Together with results from cite{BenYaacov:Perturbations} regarding (...) perturbations of bounded metric structures, we prove a Ryll-Nardzewski style characterisation of theories of Banach spaces which are separably categorical up to small perturbation of the norm. This last result is motivated by an unpublished result of Henson. (shrink)

Clinical ethics support, including ethics consultation, has become established in the field of medical practice throughout the world. This practice has been regarded as useful, most notably in the UK and the USA, in solving ethical problems encountered by both medical practitioners and those who receive medical treatment. In Japan, however, few services are available to respond to everyday clinical ethical issues, although a variety of difficult ethical problems arise daily in the medical field: termination of life support, euthanasia and (...) questions about patient autonomy. In light of these conditions, a group of 17 volunteer educators and researchers from the area of biomedical ethics, including the authors, have formed the Clinical Ethics Support and Education Project, and began providing Japan’s first small team clinical ethics consultation service in October, 2006. Members include scholars of biomedical ethics, scholars of philosophy and ethics, legal professionals and legal scholars, nurses and doctors, consisting of five women and 12 men. Consultation teams, made up of a small number of members, were organised each time a request for consultation was received. Over approximately 15 months (October 2006–December 2007), the programme received 22 consultation requests from medical practitioners and medical institutions, and three from the families of patients. In this paper, we will discuss the status of our consultation service and examples of consultation cases we have handled. In addition, we will examine the process of evaluating small team clinical ethics consultation services, as well as the strengths and weakness of such programmes. (shrink)

We prove that for every simple theory $T$ (or even simple thick compact abstract theory) there is a (unique) compact abstract theory $T^fP$ whose saturated models are the lovely pairs of $T$. Independence-theoretic results that were proved in [Ben Yaacov, Pillay, Vassiliev - Lovely pairs of models] when $T^fP$ is a first order theory are proved for the general case: in particular $T^fP$ is simple and we characterise independence.

We give a model-theoretic account for several results regarding sequences of random variables appearing in Berkes and Rosenthal [12]. In order to do this,•We study and compare three notions of convergence of types in a stable theory: logic convergence, i.e., formula by formula, metric convergence (both already well studied) and convergence of canonical bases. In particular, we characterise א0-categorical stable theories in which the last two agree.•We characterise sequences that admit almost indiscernible sub-sequences.•We apply these tools to the theory of (...) atomless random variables (ARV). We characterise types and notions of convergence of types as conditional distributions and weak/strong convergence thereof, and obtain, among other things, the Main Theorem of Berkes and Rosenthal. We prove that the definition of supersimplicity in metric structures from [Ben Yaacov, Uncountable dense categoricity in cats] is equivalent to an textit{a priori} stronger variant. This stronger variant is then used to prove that if $T$ is a supersimple Hausdorff cat then so is its theory of lovely pairs.

This paper explores ethical issues raised by quadratic voting. We compare quadratic voting to majority voting from two ethical perspectives: the perspective of utilitarianism and that of democratic theory. From a utilitarian standpoint, the comparison is ambiguous: if voter preferences are independent of wealth, then quadratic voting out- performs majority voting, but if voter preferences are polarized by wealth, then majority voting may be superior. From the standpoint of democratic theory, we argue that assess- ments in terms of efficiency are (...) too narrow. Voting institutions and political institutions more generally face a legitimacy requirement. We argue that in the presence of inequalities of wealth, any vote buying mechanism, including quadratic voting, will have a difficult time meeting this requirement. (shrink)

The paper examines the open problems that experts of space law shall increasingly address over the next few years, according to four different sets of legal issues. Such differentiation sheds light on what is old and what is new with today’s troubles of space law, e.g., the privatization of space, vis-à-vis the challenges that AI raises in this field. Some AI challenges depend on its unique features, e.g., autonomy and opacity, and how they affect pillars of the law, whether on (...) Earth or in space missions. The paper insists on a further class of legal issues that AI systems raise, however, only in outer space. We shall never overlook the constraints of a hazardous and hostile environment, such as on a mission between Mars and the Moon. The aim of this paper is to illustrate what is still mostly unexplored or in its infancy in this kind of research, namely, the fourfold ways in which the uniqueness of AI and that of outer space impact both ethical and legal standards. Such standards shall provide for thresholds of evaluation according to which courts and legislators evaluate the pros and cons of technology. Our claim is that a new generation of sui generis standards of space law, stricter or more flexible standards for AI systems in outer space, down to the “principle of equality” between human standards and robotic standards, will follow as a result of this twofold uniqueness of AI and of outer space. The paper deals with the governance of Unmanned Aircraft Systems in European law. Three different kinds of balance have been struck between multiple regulatory systems, in accordance with the sector of the governance of UAS which is taken into account. The first model regards the field of civil aviation law and its European Union ’s regulation: the model looks like a traditional mix of top-down regulation and soft law. The second model concerns the EU general data protection law, the GDPR, (...) which has set up a co-regulatory framework summed up with the principle of accountability also, but not only, in the field of drones. The third model of governance has been adopted by the EU through methods of legal experimentation and coordination mechanisms for UAS. The overall aim of the paper is to elucidate the ways in which such three models interact, insisting on differences and similarities with other technologies, and further legal systems. (shrink)

In this project, we assessed 242 codes of media ethics from 94 countries across the globe, focusing on their treatment of moonlighting. The analysis included whether the codes dealt with moonlighting, whether geopolitical and geoeconomic characteristics affected the treatment of the issue, and whether the type of media organization was significant. Only about half the codes addressed moonlighting; Eastern European countries paid the greatest attention to moonlighting, and newspapers and chains were more likely than other media organizations to deal with (...) the issue. Overall, it appears that codes of ethics do not provide clear, strict, or consistent guidelines. (shrink)

We show that K-generic projective planes have Morley rank either two or infinity. We also show give a direct argument that such planes are not Desarguesian.

We study the following conjecture. Conjecture. Let $T$ be an $\omega$-stable theory with continuum many countable models. Then either i) $T$ has continuum many complete extensions in $L_1$, or ii) some complete extension of $T$ in $L_1$ has continuum many $L_1$-types without parameters. By Shelah's proof of Vaught's conjecture for $\omega$-stable theories, we know that there are seven types of $\omega$-stable theory with continuum many countable models. We show that the conjecture is true for all but one of these seven (...) cases. In the last case we show the existence of continuum many $L_2$-types. (shrink)
