All contemporary frameworks of mental capacity stipulate that we must begin from the presumption that an adult has capacity. This presumption is crucial, as it manifests respect for autonomy and guards against prejudice and paternalism on the part of the evaluator. Given its ubiquity, we might presume that we all understand the presumption’s meaning and application in the same way. Evidence demonstrates that this is not the case and that this has led to harm in vulnerable persons. There is thus (...) strong reason to question our presumptions about the presumption of capacity. We distinguish between two main ways of understanding and applying the presumption of capacity, and advocate for the one that we argue mitigates risk of harm. Our proposed interpretation offers many advantages in that it is consonant with actual practice of capacity evaluations, precludes confused and abusive avoidance of needed evaluations, and preserves the respect for autonomy motivating the presumption in the first place. May Sinclair has been typically considered as a liminal author, positioned between two eras: the 19th and the 20th centuries, Victorian culture and modernism, traditional and avant-garde writing and thinking. As a result, traditional criticism has confined her to the margins of 20th-century literature and philosophy. Re-examining Sinclair's involvement in the literary and philosophical debates of her time, this collaborative volume seeks to challenge this liminal status and to reassert Sinclair's role as an author, critic and thinker firmly established within (...) her time. The aim of this study is to examine the link between working memory capacity and the ability to exert cognitive control. Here, participants with either high or low working memory capacity (WMC) performed a semantic negative priming (NP) task as a measure of cognitive control. They were required to ignore a single prime word followed by a pattern mask appearing immediately or after a delay. The prime could be semantically related or unrelated to an upcoming target word where a forced-choice (...) categorization was required. Each type of mask (immediate vs. delayed) appeared randomly from trial to trial. Results demonstrated that, when the ignored prime was immediately followed by the mask, neither of the groups (high or low WMC) showed reliable NP. In clear contrast, when the mask onset was delayed responses latencies were reliably slower for semantically related trials than for unrelated trials (semantic NP), but only for the high WMC group. The present results clearly demonstrate that semantic NP from single ignored primes depends on both the masking pattern that follows the prime (immediate vs. delayed mask), and on working memory capacity. To test if dreams contain remote or never-experienced motor skills, we collected during 6 weeks dream reports from 15 paraplegics and 15 healthy subjects. In 9/10 subjects with spinal cord injury and in 5/5 with congenital paraplegia, voluntary leg movements were reported during dream, including feelings of walking , running , dancing , standing up , bicycling , and practicing sports . Paraplegia patients experienced walking dreams just as often as controls . There was no correlation between the frequency of (...) walking dreams and the duration of paraplegia. In contrast, patients were rarely paraplegic in dreams. Subjects who had never walked or stopped walking 4–64 years prior to this study still experience walking in their dreams, suggesting that a cerebral walking program, either genetic or more probably developed via mirror neurons is reactivated during sleep. Understanding the clinical significance of variants associated with hereditary cancer risk requires access to a pooled data resource or network of resources—a “cancer gene variant commons”—incorporating representative, well-characterized genetic data, metadata, and, for some purposes, pathways to case-level data. Several initiatives have invested significant resources into collecting and sharing cancer gene variant data, but further progress hinges on identifying and addressing unresolved policy issues. This commentary provides insights from a modified policy Delphi process involving experts from a range of stakeholder (...) groups involved in the data-sharing ecosystem. In particular, we describe policy issues and options generated by Delphi participants in five domains critical to the development of an effective cancer gene variant commons: incentives, financial sustainability, privacy and security, equity, and data quality. Our intention is to stimulate wider discussion and lay a foundation for further work evaluating policy options more in-depth and mapping them to those who have the power to bring about change. Addressing issues in these five domains will contribute to a cancer gene variant commons that supports better care for at-risk and affected patients, empowers patient communities, and advances research on hereditary cancers. To test whether mental activities collected from non-REM sleep are influenced by REM sleep, we suppressed REM sleep using clomipramine 50 mg or placebo in the evening, in a double blind cross-over design, in 11 healthy young men. Subjects were awakened every hour and asked about their mental activity. The marked REM-sleep suppression induced by clomipramine did not substantially affect any aspects of dream recall . Since long, complex and bizarre dreams persist even after suppressing REM sleep either partially or (...) totally, it suggests that the generation of mental activity during sleep is independent of sleep stage. La gestation pour autrui ( gpa ) est une des méthodes de procréation médicalement assistée qui pose aujourd’hui le plus question. En effet, sa légitimité est discutée tant elle bouscule toutes les représentations classiques de la famille et la parentalité. Afin de mieux comprendre ce phénomène, l’étude reprise dans cet article s’est penchée sur la motivation des mères porteuses à offrir leurs services à un couple souhaitant avoir un enfant en recourant à la gpa. Quatre femmes ont été rencontrées à (...) qui il a été proposé de raconter la manière dont elles ont vécu cette « expérience ». La méthodologie est qualitative et comprend un entretien semi-structuré complété par deux génogrammes. Seront présentés dans cet article les principaux résultats concernant la motivation de la mère porteuse. Deux aspects ont particulièrement retenu l’attention : leur haut niveau d’empathie et la présence d’une dette au fondement de la motivation des mères porteuses. (shrink)

Moral or ethical questions are vital because they affect our daily lives: what is the best choice we can make, the best action to take in a given situation, and ultimately, the best way to live our lives? Health ethics has contributed to moving ethics toward a more experience-based and user-oriented theoretical and methodological stance but remains in our practice an incomplete lever for human development and flourishing. This context led us to envision and develop the stance of a “living (...) ethics”, described in this inaugural collective and programmatic paper as an effort to consolidate creative collaboration between a wide array of stakeholders. We engaged in a participatory discussion and collective writing process known as instrumentalist concept analysis. This process included initial local consultations, an exploratory literature review, the constitution of a working group of 21 co-authors, and 8 workshops supporting a collaborative thinking and writing process. First, a living ethics designates a stance attentive to human experience and the role played by morality in human existence. Second, a living ethics represents an ongoing effort to interrogate and scrutinize our moral experiences to facilitate adaptation of people and contexts. It promotes the active and inclusive engagement of both individuals and communities in envisioning and enacting scenarios which correspond to their flourishing as authentic ethical agents. Living ethics encourages meaningful participation of stakeholders because moral questions touch deeply upon who we are and who we want to be. We explain various aspects of a living ethics stance, including its theoretical, methodological, and practical implications as well as some barriers to its enactment based on the reflections resulting from the collaborative thinking and writing process. In Virgin Mary and the Neutrino, first published in French in 2006 and appearing here in English for the first time, Isabelle Stengers experiments with the possibility of addressing modern practices not as a block but through the way they diverge from each other. Drawing on thinkers ranging from Dewey to Deleuze, she develops what she calls an "ecology of practices" into a capacious and heterogeneous perspective that is inclusive of cultural and political forces but not reducible to them. (...) Stengers first advocates for an approach to sciences that would emphasize the way each should be situated by the kind of relationship demanded by what it attempts to address. This approach turns away from the disabling scientific/nonscientific binary-like the opposition between the neutrino and Virgin Mary. An ecology of practices stimulates instead an appetite for thinking reality not as an arbiter but as what we can relate with through the generation of diverging concerns and obligations. (shrink)

Cet article étudie l’influence du scepticisme de Montaigne dans l’« Égalité des hommes et des femmes » de Marie de Gournay. Plusieurs points communs entre ces deux auteurs sont analysés : le dépassement du dualisme des sexes dans le cadre d’une critique de l’idée de nature comme hiérarchie ; la condamnation de la présomption de la raison ; un relativisme des sexes, qui contribue à souligner l’iniquité de la domination masculine en Occident.

Background Citizen science is increasingly prevalent in the biomedical sciences, including the field of human genomics. Genomic citizen science initiatives present new opportunities to engage individuals in scientific discovery, but they also are provoking new questions regarding who owns the outputs of the research, including intangible ideas and discoveries and tangible writings, tools, technologies, and products. The legal and ethical claims of participants to research outputs become stronger—and also more likely to conflict with those of institution-based researchers and other stakeholders—as (...) participants become more involved, quantitatively and qualitatively, in the research process. It is not yet known, however, how genomic citizen science initiatives are managing the interests of their participants in accessing and controlling research outputs in practice. To help fill this gap, we conducted an in-depth review of relevant policies and practices of U.S.-based genomic citizen science initiatives. Methods We queried the peer-reviewed literature and grey literature to identify 22 genomic citizen science initiatives that satisfied six inclusion criteria. A data collection form was used to capture initiative features, policies, and practices relevant to participants’ access to and control over research outputs. Results This analysis revealed that the genomic citizen science landscape is diverse and includes many initiatives that do not have institutional affiliations. Two trends that are in apparent tension were identified: commercialization and operationalization of a philosophy of openness. While most initiatives supported participants’ access to research outputs, including datasets and published findings, none supported participants’ control over results via intellectual property, licensing, or commercialization rights. However, several initiatives disclaimed their own rights to profit from outputs. Conclusions There are opportunities for citizen science initiatives to incorporate more features that support participants’ access to and control over research outputs, consistent with their specific objectives, operations, and technical capabilities. Marie-Agnès Cathiard stands out for her important contributions to research on the imaginaire. Her commitment to interdisciplinarity has opened the door to rare partnerships with the scientific community. Projects such as “Mondes numériques et spectacle vivant (Digital Worlds and Performing Arts)” have led Marie-Agnès to work at the crossroads of scientific research and artistic creation, exploring the multi-sensory aspects of the work of the electro-video artist Lionel Palun and the director Isis Fahmy. His collaboration with Patrick Pajon, illustrated by a (...) project such as “Tech’sens”, brought together seemingly distant fields of research, with the aim of constructing a typology of new models of perception linked to digital tools. Their work addressed the upheavals underway in the fields of creation and imagination, calling for a reassessment of our relationship with the changing world and technology. (shrink)

This paper provides a picture of the constant interchange of ideas between English radicals and French Girondins, both in France and in Britain, information being selected for its relevance to the role of Mary Wollstonecraft in the circulation of radical ideas. It shows that Wollstonecraft knew, and approved of, works by Girondins before she went over to France and that events in France during the Brissotin ascendancy, as well as frequent socialising with Girondins reverberated through some of her works. Further, (...) some of her works were known in France before she arrived there. Finally, footnotes in the French translation of the Vindication of the Rights of Woman are shown to map out the common ground between the Girondins and Wollstonecraft. (shrink)

O presente artigo consiste no registro de memórias de um diretor e de uma diretora que atuaram em escolas públicas de M inas Gerais, e na análise de suas narrativas. O objetivo foi captar suas representações sobre as práticas administrativas e pedagógicas rememoradas dos anos de exercício profissional. Com a metodologia da história oral, nossa investigação buscou construir uma interpretação a respeito de atitudes, posturas e práticas enraizadas nos rituais da escola contemporânea. Pudemos observar que no período estudado havia uma (...) política extremamente centralizada, cujas diretrizes eram difundidas pelos órgãos centrais da administração burocrática. O trabalho de gestão das unidades escolares era pautado, principalmente, pelo controle do cumprimento das normas estabelecidas pela política pública de educação. (shrink)
